for the it. the energy department sent a letter to house democrats saying that secretary rick perry will not be turning over ukraine documents theydemanding. we're following the trump's team effort to try to clean up the mess created by the acting white house chief of staff mick mulvaney. he struck at the heart of the defense when he told reporters the united states did tie ukraine military aid to the country's willingness to investiga investigate democrats. he later tried to walk that back and said there was no quid pro quo. we'll talk about the breaking ne news. our correspondentis and analyst are standing by. jim acosta is on the scene. the president and his team want to move on from mulvaney's remarks but democrats and even some republicans aren't letting them. >> reporter: that's right. president trump dodged the

confession. >> i have news for everybody, get over it. there's going to be political influence in foreign policy. i'm talking to mr. karl. that's going to happen. >> reporter: he later clarified in statement there was no quid pro quo and while some top republicans appear to be reading from the president's talking points. >> i think you saw mick mulvaney clarify a statement. >> reporter: a growing number of gop lawmakers are finding the comments troubling. >> well, yeah, whatever might have been gray and unclear before is certainly quite clear right now. the actions were related to g getting you careen to ukraine t things. >> he did a great job. he mentioned the same message over and over and now the media, we put statement out clarifying some of the things that the n d media got themselves in a tizy over. >> reporter: his remarks were called a confession. >> what's your reaction last

night? was that enough to satisfy your concerns? >> i didn't find it the least bit credible. >> reporter: the president is trying to spin his out of of trouble that george can he not told lawmakers he raised concerns in 2015 about joe biden's son in ukraine. >> he excoriated them saying they had tremendous problems with joe biden's son and the ukraine. >> reporter: biden campaign released a statement saying on joe biden's watch the u.s. made eradicating corruption a centerpiece of our policies toward ukraine including the removal of an inept prosecutor who shielded wrong doingers from accountability. the president insisted he was on top of the situation. mr. trump made the bizarre claim that the u.s. is in control of oil assets in the region. something that's just not true. >> we have isis under control.

we have taken control of the oil in nmiddle east. the oil that everybody was wo y worried about. the u.s. has control of that and there are no shots being fired and a lot of people are doing a lot of things. >> reporter: at his rally in dallas the president minimized the conflict as a schoolyard fight. >> sometimes you have to let them fight. like two kids in a lot, you got to let them fight and pull them apart. >> reporter: now as for the president's policy in syria, senate majority leader mitch mcconnell posted a scathing op-ed. he does not directly criticize the president by made but we can put this up on screen. it's strongly worded. he says quote withdrawing u.s. forces from syria is a grave strategic mistake. it will leave the american people and homeland less safe, embolden our enemies and weaken allianc alliances. the president announced his new

energy secretary to replace rick perry who is stepping down from that post after being swept up in the ukraine investigation. deputy secretary over at the energy department has been nominated by the president for that job. >> all right. thank you. let's go to capitol hill where house democrats have learned that rick perry is defying their subpoena. on what grounds did perry say he won't comply? >> reporter: we largely see the energy department here making the exact same argument that the white house has in resisting their own subpoena requests questioning and arguing about the validity of the impeachment inquiry given the house has not formally voted yet to start informal impeachment inquiry. in the letter sent in the last 30 minute, the energy department goes onto say quote, even if the inquiry was validly authorized, much of the information sought in the subpoena appears to

consist of confidential executive branch communications that are potentially protected by executive privilege. rick perry, himself, he was out defending himself today saying he didn't see a problem with president trump asking him to work with rudy giuliani on issues related to ukraine but he says that the biden's name did not come up in his conversation with trump, aides or the ukrainians but he does admit the issue of corruption writ large did. >> democrats have packed next week with more witnesses. tell us about that. >> reporter: despite the white house opposition, the daeemocra in the house have been successful in getting many key witnesses in. next week setting up to be a huge week. look at the schedule ahead. seven witnesses at the moment are on the schedule from the state department, omb, nsc and the defense department. the biggest moment could come early on on tuesday when bill

the president wants to withdraw u.s. troops from syria. how significant is this rebuke of the president by mitch mcconnell? >> this is one time when i agree with mitch mcconnell but as a majority leader he can and should do more than write open-open op-eds. we have a house passed bill that would rebuke the president and there's other bills that would impose sanctions on turkey. those are the kinds of measures that mitch mcconnell has within his power to bring to the floor of the senate. he has to do more. >> mcconnell says he wants stronger legislation than what was passed in the house of representatives. do you agree? >> great. bring all this legislation to the floor, mitch. thank you. i'd love to debate and get on with it because there's no question that the president enabled turkey to do what erdogan wanted to do and the cease-fire is a total

copitchlation to what erdogan wanted to get the kurds out of syria. we need to bring all of this to the fore because we have a president that's out of control. >> you were briefed by mark esper. did you get any clarity on the president's decision making process in all of this? >> no. >> what did you learn? >> the conclusion i and others have drown is that erdogan would not have risks northern syria if american troops were still there. he would not are risked killing american troops. the president removed that risk by withdrawing our troops and so you get what we have now which is chaos and for the president to describe this situation as a

sand locked fight just goes to show how infantile his thinking is. >> yesterday mick mulvaney acknowledged that military aid was held because of president trump's interest in seeing ukraine investigate the 2016 election and democrats at the same time. he then tried to walk that back. how concerning is this admission to you? >> it is an admission. great. this administration is very flagrant in its abuse of power and its corruption. i suppose mulvaney thought let's put it out there there was a quid pro quo. this didn't go over well and they are trying to walk it back. we all know what we heard. for the white house people to start blaming the press for get things wrong, please. what are we supposed to do not believe our lying eyes?

give me break. >> what can you do? you heard a while ago rick perry is not going to comply with house subpoenas, other white house officials are not comp complying. what are you going to do about that? what do you think can be done? >> the house will be able to -- they will continue to proceed with their impeachment inquiry which is a constitutional process. this is all part in parcel of what could be considered another aspect to the articles of impeachment. what's happening is you have two processes going on. you have all of the policy and political decisions that are creating chaos for our country and there's that going on with the muslim ban, the immigration, the trade wars, the latest going on with turkey and then you have on the other hand the constitutional inquiry, impee l impeachment inquiry.

tonight president trump and his allies trying to down play the stunning admission by mick mulvaney who told reporters the united states did, did tie ukraine military aid to investigation of democrats. let's bring in the former u.s. attorney for the southern district of new york. thanks for joining us. what's your reaction to hearing the acting chief of staff mulvaney admit that aid to ukraine was in part tied to the president's desire to see you crane investigate democrats on his behalf? >> on the one hand was reaction was tremendous surprise and on the other hand not so much

surprise. it's consistent with what the acting ambassador to ukraine thought. it's consistent with what we understand the call to have been about. it's consistent with the read out and what the whistle-blower was told by a lot of other people. they're trying to make this about language and about talking points when it's really just a recitation of what common sense understanding and literal understanding of the word spoken must mean. when i was a prosecutor, we accepted confessions very happily. there's a debate in world of lieu law enforcement few can admit a confession because it's the world of the cop. here you have it on video tape with a room full of reporters so it makes it that much powerful. >> was it potentially a crime? >> it can be. i'm going to say the same thing i've been saying like a man ttr for the last number of weeks. maybe it's a crime, maybe it's not. the issue is whether krong

congress will find toyota be it impeachab impeachable. we know a sitting president will not be convicted of a crime. whether or not it's something that rises to the level of impeachment. my view as been you can make a very powerful argument it rides to the level of impeachment even if there was no quid pro quo. the mere fact a president of the united states is asking a leader of a country to investigate and identify an identified poenied that is an abuse of power. the initial defense is it wasn't a quid pro quo. now we know not only was the initial request made but it's multiplied many times over by the fact that lots of people understand it to be a quid pro quo and the chief of staff to the president of the united states said it and said get over it. i don't think congress will get over it.

>> you're probably right on that point. let's tuk about rudy giuliani's role in all of this ukraine material. you and rudy giuliani served as the u.s. attorney for the southern district of new york which is now looking into rudy giuliani. what are the potential legal implications of all of this for rudy giuliani? >> that's hard to say. i would caution people not to read too much into the fact they are taking a look. there's cases we looked at and people we investigated. some became known and some didn't become known. they don't always end up being a criminal case. the office i used to lead is full of thorough, docked, dedicated professionals. if they see some smoke, they investigate it. they saw some smoke with respect to his associates who had been arrested and charged with campaign finance violations. maybe he had some connection there. they said that scheme was hidden from the candidate and from other people. it's possible depending on how you construe the law that rudy

giuliani in connection with being the president's kind of ombudsman in ukraine to try to figure out how to get through this quid pro quo we have been sdus sk discussing. we're told they are looking at a violation of the foreign agent registration act because he was lobbying on behalf of government. his excuse seems to be he was doing it at the behest of the united states. it's a little confusion. i would caution people not to read into it too much just yet. >> i was also making a lot of money from ukrainian interest at the same time. i'm sure they are looking into that as you point out. he's been pretty quiet this week. i assume his lawyers are telling him this is a good toime to remain silent. >> could be. >> thanks very much. coming up, we'll have more on the very messy attempt to clean up the ukraine quid pro quo by the acting white house

of backtrack this even though they are trying too. it's unclear whether or not this was the unveiling of sort of a strategy that they have around this saying so what. they did it. get over it as the t-shirt says. whether or not this is something will continue. we saw them back away in it. >> what are you hear about how the president is reacting to this? >> people around trump are really surprised by mulvaney coming out not only to announce where the g7 will be located but the way he answered those question, people were stunned that the chief of staff made that decision. came out because he was undercutting what the president has been denying for several weeks now in that form of trying to dismiss these questions. it's surprised a lot of people. it's not just democrats going after it, republicans too. francis was saying you can't walk this back. the white house said mulvaney clarified his comments. that's what the president said when he wassed asked. that wasn't a clarification.

he denied what he said on camera. >> what do you think? >> in the substance of what he said and the idea of get over it, mick mulvaney very deliberately or perhaps by -- inadvertently afaced a very bright line. the u.s. does in its foreign policy and its distribution of foreign aid sometimes try to condition that on the advance of national goals. our goals in the world, in foreign policy and security. it's a very different thing to condition foreign aid on contributing to the president's political, personal goals. that's a very clear bright line that he ignored in the substance of what he said. i do think however mistaken it was for him to do this, it's unabu understandable he felt this is what the administration does. one thing donald trump does is say out loud in the past things

we're back with our correspondents and analysts. we're following the breaking news. mitch mcconnell writes an op-ed. posted little while ago in the washington post. a sharp rebuke of president trump's syria policy. saying this, withdrawing u.s. forces from syria is a grave strategic mistake. it will leave the american people and homeland less safe, em bolden our enemies and weaken important alliances.

how significant is that? >> it is a sharp rebuke but it never really mentions president trump by name. hesita he's critical of obama. mentions him twice. he's critical of the candidates running for president. >> it's clear. >> it's clear who it is. what's clear is how far apart republicans are from this president. if you look at this op-ed what mitch mcconnell is asking for is the u.s. limit turkey oos incursii -- turk turkey's incursion, none of these are on the president's list. he said he managed to get a deal that people have wanted for 15 years. doesn't make any sense because that's not what's happening. turkey has gotten everything out of this deal and the u.s. hasn't gotten much of anything. wooem see where this goes. you heard republicans talk about sanctions but what would sanctions do at this point given

everything that's happened on the ground in terms of turkey and russia ascended in the region they hasn't been for years. >> you traveled with mike pence to work out the so called cease-fire as the u.s. calls it, the turks call it a pause. you came back where him. he called mitch mcconnell. clearly didn't have much of an impact. >> it's been an interesting position for mike pence. he's seen as the liaison between the white house and capitol hill. he heard an earful from people like this who disagree with the president's decision to withdraw those troops. after he negotiated with the turks for several hours on the flight home, we were told he was making calls to several lawmakers including democrats, republicans, the theirs of the relevant committees but i just learned he also call mitch mcconnell. obviously attempting to inform him of what happened but that conversation clearly didn't satisfy mcconnell since he published this op-ed condemning

the decision today. he doesn't name president trump but he doesn't really have to. it's pretty explicit whose decision it is that he's disagreeing with it. >> how significant is it that the republicans are, without mentioning the president by name, but clearly rebuking, distancing themselves from his policy? >> i think both parts are equally significant. they are rebuking the policy but not criticizing him by name. one of the most interesting things about this entire episode is what it says about president trump's belief of his control over republicans. he is at a moment where he needs the republican party to lock arms to defend him against an impeachment inquiry that will lead to a vote to impeach him by the house. in the midst of that he per sur a foreign policy that he knew every republican -- he sent mick mulvaney out that he is awarding himself the g7 meeting at his

country club in miami. again, something that he has to know would be offensive to almost every one in congress. all of that says to me that he believes he has the republicans in congress so under his thumb they will stand by him no matter what else he does. we'll see in the next couple of weeks whether any of them call his bluff on that. >> what do you think jeffrey? >> well, the real question, it seems to me, will the republican opposition to the president remain the sort of jeff flake, bob cork herb, ben sasse sort of scar scar scaredey scat but continuing to vote with the president on everything. that's been the rule so far. the question is will it turn into actual opposition. will there be any republican votes for impeachment. we're starting to see that possibility. for the moment, when it comes to

where a brutal civil war is further fractioning is country as former allies turn on each over with american military hardware. our senior international correspondent joins us now from london with exclusive details. what are you finding out? >> well, wolf, we followed up on original reporting that showed the key u.s. allies, saudi arabia and the united arab emirates were illegally distributing u.s. equipment. what we found was equally disturbing. take a look at this. separatist militia and armed groups loyal to the government. just a few months ago the forces were on the same side backed by the saudi led coalition, supplied with u.s. weapons. now they have turned those very weapons against each other and terror groups are resulting in

chaos. in january we traveled through yemen documenting the proliferation of u.s. weaponary. >> it's like a graveyard of american military hardware. this is not under the control of coalition forces. this is in the command of malitias. >> reporter: this in violation of the law governing u.s. armed sales which says they can't be passed on. we identified american made armored vehicle which had been sold by the u.s. to the uae under a 2014 arm sale contract and had fallen into the hands of armed groups. six months on and we spot one of the supplied vehicles. the u.s. made max pro. being paraded by uae backed malitia known as the giants brigade. they have a new mission. here on their way to the strategic port city to fight against the very legitimate government to restore.

they are now fighting with the separatists. they did not respond to cnn's request for comment but the nie with u.s. made vehicles. it's part of yemeni forces that fight on the ground and under direct supervision. the vsupervision has failed. half a year on, it escalates. we set out to find out what happened to the american vehicles. in the aftermath of our original reporting we received death threats so we haven't been able to return to yemen but working with local journalists we have been able to verify that amongst the military vehicles used to weigh yemen's escalating conflict are those that we identified >> our team traveled to shebwa

been provided to uae and to saudi arabia have wound up in the hands of houthis that they have been traded and used on both sides of that conflict. >> we have not authorized saudi arabia or the emirates to re-transfer any of this equipment to other parties on the ground. >> publicly, the uae and saudi arabia have been struggling to explain how and why forces loyal to them have opened fire on each other. worse, as we've learned, that they're using proprietary u.s. technology to do it with. cnn has reached out to both the emirati and saudi arabian government for comment. there were no instances when u.s.-made equipment was not used except for four vehicles that were captured by the enemy. cnn found u.s.-made vehicles being used in attacks on key

locations and personnel, legitimate government of yemen, this, in spite of the fact that the uae told us no weaponry was being used without their direct oversight. we also contacted the pentagon who told us there is an ongoing investigation into our previous findings. for how much longer or what they'll do with it, hard to say, all the while, the war in yemen rages on, more lethal than ever. >> this issue of the continuing of arms sales to saudi arabia has been a major concern for lawmakers for some time and cnn has learned that they are calling negotiating to add conditional bans to the upcoming defense spending bill and we are already getting reaction to our reporting. senator elizabeth warren has told us that one report of u.s. military equipment ending up in the hands of our enemies is troubling. two reports is deeply disturbing. the defense and state
