tv   U.S. Senate Senators Consider First Impeachment Article Against DHS...  CSPAN  April 17, 2024 8:17pm-9:06pm EDT

article to the senate vote on the motion to adjourn the court of impeachment. finally there be up to four minutes for debate equally divided between the two leaders or their designees prior to each roll call votes all without intervening action or debate. >> is an objection? >> madam president for. >> reserving my right to object. to dismiss or table articles of impeachment againstst secretary mayorkas without a trial is an unprecedented move bite senator schumer. never before in the history of our republic has the senate dismissed or table articles of impeachment when the impeached individual was alive and had not resigned. senator schumer said in 2020 quote a fair trial has witnesses, a fair trial has well documented asof part of the recd affair trout seeks the truth. nothing more, nothing less i will not assist to senator senator schumerin setting our cn

ablaze and bulldozing 200 years of precedent. therefore i objected. >> madam president park objection is heard. >> madam president i raise the point ofde order that impeachmet article one does not allege conductt that rises to the level of a high crime or misdemeanor as required under article two section four of the united states constitution t. and is therefore unconstitutional. >> under the precedents and practices of the senate the chair has no power or authority to pass on such a point of order by the chair therefore under the precedence of the senate submits the question to the senate is the point of order will taken? the republican leader is recognized. the clerk will call the rule. >> 's quorum calls continues in the impeachment trial of alejandro mayorkas we are waiting for saturday to speak.
8:19 pm
you are hearing the roll call of the names of united states senators as they go through this quorum call. even though there is obviously a floor due to earlier production of the impeachment trial as we await a member of the senate to speak we are going to talk with the hilt newspaper watching this as well. alex joining us on the phone. good afternoon. explain week where we are and why this is a quorum call despite will be heard from senator schumer not too long ago? >> and basically to buy time on the senate floor so republican senators can figure out how to respond to schumer's move right here. schumer is raising a points of f order the first articles of impeachment is unconstitutional. because it does not allege a

high crime or misdemeanor that the standards set by the constitution. patty murray as you just showed says she does not have the power to decide that question she's going to ask for the t senate to vote whether schumer's point of order is invalid. the senate votes to sustain point of order it effectively dismisses she first articles of impeachment. then schumer will report as a point of order a similar point of order gives the second article of impeachment. if that sustained by separate votes, both s the chargers wille dismiss the senate trial will be effectively over. >> this could essentially become a speedier trial than what senator schumer was offering in the original statement he made? >> what schumer offered was to set aside debate time to give republicans an opportunity to to vote on trout resolution sponsored by michael lee and ted cruz to basically either hold a
8:21 pm
full senate trial or referred to a special committee. as you saw on the floor freshman senator schmidtch of missouri objected to that unanimous consent agreement. so because of that there is no structure for the trial and schumer is moving ahead with a point of order basically to declare the articles of impeachment unconstitutional. boarding is interesting schumer is raising a point of order to dismiss the charges are by doing so republicans do not have an opportunity to own their own points of order he is preempting them here so they really cannot do much in the way of protest or drag the proceedings out if in fact the point of order is sustained. >> our point of order is a simple majority vote in the senate. >> yes under senate impeachment rules all matters are decided by majority vote except for conviction or acquittal. as you know that requires two thirds to convict or remove a

federal officer from office for. >> coming back to eric schmitt objection was not expected do youas know? >> it been trying to work out a deal on debate and voting on trout resolutions since yesterday. it looks like almost everyone was on board except for schmidt. schmidt told reporters downstairs shortly before the boat he would notot agree. at the time he objected it was not a surprise but that was something revealed by schmidt only a short time before he objected. >> as you know the cameras controlled by the senate. we have a high shot of the dais here. did you get a sense of what the reaction was to schmidt's objectionbj and chuck schumer's response in offering this motion in response to that objection? >> from our colleague he was in the chamber sent met some color

and set after that happened senators administered to huddle and figure out next steps was a huddle on the flexion senate republican whip john thune, ted cruz, mike lee, jon kennedy macconnell chief of staff. john cornyn who is hoping to become the next majority republican leader was part of those conversations. there was certainly some frenzied huddling on the floor. so in the meantime jon tester jr who is a critical boat ran over and snapped a bag of peanut m&ms at a cory booker's desk but some of the floor activity. thee outcome is a foregone conclusion is not going to be a senate trial. i think senators are waiting for this to be over with. >> hill.com is read go to read alex bolton's reporting about of his colleagues but always great color in the hill. thanks for filling us in. >> thanks for having me on.

no briefing on that question in the position is directly contrary to the constitution, to the original understand the constitution of the time it was ratified. and to the explicit position of the biden department of justice has argued before the supreme court of the united states. the majority leader's position is asking members of this senate to vote on political expediency to avoid listening to arguments the only rational way to resolve this question is to actually debate it to consider the constitution and consider the law. >> the senator will recognize the senate is in a non- debatable position at the center has a right to offer his point of order. or his emotion but we are and eight non- debatable position because my motion is to change that. so that we can actually debate the law senators can't with the constitution and law says i therefore move the senate proceed to close session to g allow for deliberation on the question as required by

this is what our rules require of us as well. the sentence of the opportunity to perform this duty the senate will not hear the house and managers present the details of their case against secretary mayorkas. that key willingly neglected the duties of his office and he lied to congress about the extent of that failure. likewise we will not hear the secretary's representatives present the vigorous defense to which she is entitled. our colleagues know we are obligated to take these proceedings seriously. this is what our oath prescribes it is what the history and precedent require and i would urge each of our colleagues to consider this is what the framers actually envisioned. the power of impeachment is one of the most delicate balance is our constitutional strikes of

you'll recall senate majority's leaders point of order was article one of the impeachment articles against alejandro mayorkas was unconstitutional because no high crimes or misdemeanors were alleged. that is the vote democrats are trying to get too. this is the third motion by senate republicans to try to either delay that vote or go into a closed session or delay the trial to allow more debate. senators cannot debate as they are sitting at a court of impeachment. and so here we are watching these various emotions by the two so far been defeated on a party line vote we are awaiting results of this latest approach. again senate minority leader mitch mcconnell motion to table senator chuck schumer's point of order when it comes to the impeachment.
