7:00 pm
good start but then again warrants can be manipulated. you can put whatever you want on it. we'll have to see. i hate repeating myself, but i know you've got to go. liz: joe, get some rest. that's it for us on "the evening edit". we hope you have a good evening and join us again tomorrow night. kennedy: it's already being called the raid of the century but 24 hours of the if, bi tomorrow -- fbi stormed the home of former president trump, there's way more questions anti-seek storieses. who will come out on top: the white house or the donald? we have a live look at mar-a-lago in palm beach, florida. donald trump's palatial home at ritzy coastal golf coast and the maga faithful out in full force and the details from last night are thin. 30 agents executed a search warrant and took a lot of pictures, cracked trump's office
7:01 pm
safe and left with boxes of "evidence". of what we have no idea. the fbi isn't talking and neither is the doj and surprise surprise the white house is stone walling too. you know what happens in an information vacuum: rumors and innuendo fly. everywhere democrats are claiming this is the thing that will sink trump once and for all. i think we've heard that before a few times. republicans saying it's an unprecedented abuse of power. i think some libertarians are saying that too . the biden administration and their no-nothing press secretary are still denying everything. watch. >> if this administration -- is this administration weaponnizing the justice department and fbi against political opponents? >> peter, the president believes a rule of law, the president believes in the indense in the department of justice. >> that's a yes or no. >> it's a yes or no for you. i'm answering the question. you may not like it, but i'm
7:02 pm
answering the question, and i'm -- no, no. i'm answering the question and i'm telling you that we're not going to comment on a criminal investigation. the president has been very clear. i laid out what his thoughts were back on january 7 in 2021 about how he saw the department of justice. i'm just going to leave it there. kennedy: did you catch that? she call it had a criminal investigation. how does she know that? she also said reporters should direct all questions to the doj. i mean, apparently they're sharing information so if they r she can answer those questions. as i said earlier, they're not talking and the longer we go without answers and the worse the whole thing smells and tonight, we have every angle covered, legal, political, historical, and even emotional because i'm for you, america. i want some damn answers too. here with me now republican kentucky congressman thomas
7:03 pm
massey. this sin credibly serious -- is incredibly serious. welcome back, congressman. what do you make of the little we know so far? >> kennedy, the fbi can't seem to find a copy of the hunter biden search warrant. this is extremely troubling. it feels like a third world dictatorship or banana republic where once somebody goes out of power, the incoming regime persecutes and prosecutes the out going, you know, president. add to that, you know, we just found out today, my colleague scott perry, representative perry from pennsylvania was approached by three fbi agents that seized his cell phone. this is insane. can't we go through lawyers to do this? why does everything have to be a public raid or exposition? i'll tell you why i think it is,
7:04 pm
it's because they want to start trying this in the court of public opinion. opinion, which is what they've always done like when comey leaked his memo to the new york times to try and get something there. in this case attorney general garland, he should step back from this and there should be a special prosecutor if there should be a prosecutor at all, because it was the election of donald trump that kept him from becoming a supreme court nominee. i mean, he's got to hold a grudge there. kennedy: he's got a hold a grudge and the occupant of the white house right now, obviously is conflicted here because one of the reasons that former president trump was impeached was because he tried to get vladamir zelensky to help him launch an investigation into joe and hunter biden and people said that, you know, he was weapon
7:05 pm
weaponnizing his office for political gains and unless they have hooker heads in office boxes, i think this will be very, very problematic, and it could end up gavellizing a lot of -- galvanize a lot of the president's former supporters. >> hopefully it'll wake up some of the independent voters and the people who weren't infatuated with trump, but i think they can see in this situation the government has gotten too big. we don't need 87,000 more irs agents and they don't all need machine guns, they don't need to stockpile ammunition. if they can do this to the president or a representative in the u.s. congress, they can do it to anybody. kennedy: oh, yes. they are doing this in the light of day. you know, they are -- this is not cloak and cager stuff. this is -- dagger stuff. this is not secret surveillance. this is a former president being not only targeted by raided
7:06 pm
without warning, and we've never seen anything like that before. you know, you look at the current occupant, president biden, and you wonder, like, would you want this to happen to you and your family when you leave office? you know, if there was a republican president and congress -- republicans hold both house, and there is a republican department of justice, why wouldn't the pendulum swing the other way? i wouldn't want it to. we should have equal protection around the law. this feels very out of balance. >> yeah, i don't want it to swing the other way either. it's a race to the bottom when you go down this path and they've gone down this path. when we get the majority back and while biden is still president, there's 12 bills i know he's going to sign. i'm going to predict he'll sign the 12 bills. they're the 12 appropriations bills and may become one bill but every president from the beginning of this country has
7:07 pm
signed that bill, and that's where we need to put our legislation to reign in this out-of-control government and cut their budget and cut specific activities using the overof the purse. in we don't, sham on us. kennedy: yeah, we're going to talk about the expansion of the irs and the 87,000 new agents that are coming after your money. we're goon talk about that in -- going to talk about that in a little bit, but i don't know how you unring this bell. even if you rate the former president. even if he is just political garbage to you, this should worry you. this should concern you because it should not be happening in the united states, especially with someone who might run for president again. there has been no evidence that this is anything but a political hit job, and that is incredibly dangerous when you sick several law enforcement on potential political candidates. congressman massey, thank you so much. always good to have you stop by.
7:08 pm
>> thanks for having me on, kennedy. kennedy: for four years democrats accused former president trump of abusing his power and weaponnizing the fbi and doj when things didn't go his way. now the shoe is on the other foot and we're getting the usual blah blah blah blah blah chardonnay blah blah from nancy pelosi, watch. >> no one is above the law, not even a presidential or former president of the united states. all of this will be made known to us over time, but i have no knowledge of it. i do know that there has been chatter or what's more than chatter about the presidential -- president's documents and how they must be preserved for history. kennedy: here's something different. didn't see this angle coming. disgraced andrew cuomo a democrat. he may be the voice of reason here and tweeted "doj must immediately explain the reason
7:09 pm
for its raid and it must be more than a search for inconsequential archives or it'll be viewed as a political tactic and undermine any future credible investigation of january 6 investigations". so what is that unfolding. we have media podcast host and spectator usa contributing editor steven l. miller. the host of richard fowler show and a fox news contributor, look at that handsome smile. it is richard fowler. she is an author and contributor at the hill, christine tate joining us once again. steven, i'll start with you. how does the current president wrangle out of targeting the former president and could it be anything but that? steven: well, first i think there's at least a 40% chance they might have found hooker heads in mar-a-lago. i just want to get that out there, in boxes.
7:10 pm
kennedy: glad you went on record with that. steven: i was thinking about it. for anyone who is, you know, looking at this in the optics of t i might be the only person on the entirety of cable news who's not pretending to be a lawyer and look through the lens of media and lens of every day voters and optics, and we're two to three months away from a midterm election where joe biden's party is most likely going to seek control of the house of representatives and lose committee controls, including the january 6 committee that will go poof on january 6. the unprecedented raid regardless if you agree with it, and you have a attorney general profess prevented from sitting on the supreme court by the former president that he okayed, most likely okayed a warrant on. if you don't like the optics, blame joe biden for making merrick garland attorney general
7:11 pm
and these are all problems with this and of all the roads like you you don't want to go down, this looks like the road of roads you want to go down and if i'm hunter biden, i'm probably lawyering up and hoping the doj in the year 2025 isn't asking who the big guy is. we'll throw in hillary clinton just for the hulls. that's kind of where this is headed. kennedy: is it where it should be headed, richard? is this how we should settle political grudges whether it's the clintons, bidens, our trumps? >> i'm not sure it's a political grudge and i agree with former governor cuomo needing more information about this, but there's a couple things we know. we know the national archive is asking for the former president of the united states to turn over documents he took. if donald trump wanted to keep the documents, he could have declassified them but chose not to and took them anyway from the white house and the office of the president. that's number one. number two the idea that there's a conspiracy that merrick
7:12 pm
garland is out to get the president as a federal judge when another federal judge signed off on the probable cause and agreed with him. not only do you have the head of the fbi appointed by donald trump, but you have an ag that's a former federal judge and a sitting federal judge who approved this probable cause warrant. this is how the justice department works. kennedy: this is how the justice system works against people it has political grudges with and the magistrate who signed off on this very problematic history with jeffrey epstein alone. your thoughts here, kristen -- >> donald trump has a problematic history with jeffrey epstein. kennedy: i don't disagree with you. there's a lot about donald trump to not like personally, but this is not how justice works in the country. they're doing it -- if they're doing it just for the optics, richard, that puts the country in a very, very bad place. kristen, your thoughts? >> yeah, democrats have seized
7:13 pm
full control of the brock bureaucracyand using that as a o take down their enemies. on a political level, i think liberals love this raid hack people talking about something other than inflation, the open southern border, or the out of control crime. i mean everything is worse in joe biden's america. everything. that's why the democrats ahead of the mid terms want to make the whole conversation about the threat donald trump poses to the ktht bectesesboy 6uaecuaseecuae the teshe,y the the are ared, d ee withititsssassiesi thislll ral p's base abase and and ma it more mor mor likely trumpp e te te gop nominee in 2024, and i think democrats would love that and would love to run against trump and once again it lets them whip up their base into hysterics over trump and they don't want to run against ron desantis because he could beat any democrat.
7:14 pm
kennedy: if they're trying to politically woo the president, desantis is the only one saying i'm the only other one in double digits in every other straw poll. we've seen this time and again, if you're going to take a shot at the king, don't miss. all right, coming up, much more with the party panel and up next, more on the raid and the fallout and plus the white house claims 87,000 new irs agents, they're not going to be auditing the middle class. yeah, my middle ass and how the administration plans to shake down every last hard working american and i'm joined with more, next.
7:15 pm
7:16 pm
this is xfinity rewards.
7:17 pm
our way of showing our appreciation. with rewards of all shapes and sizes. [ cheers ] are we actually going? yes!! and once in a lifetime moments. two tickets to nascar! yes! find rewards like these and so many more in the xfinity app.
7:18 pm
kennedy: oh, the irs is coming for you. according to a house republican report, 60% of the new audits from the irs will target those making less than, less than $75,000 a year. despite president biden's promise, no one making more than $400 grand would be audited. let me help you out, mr. president, $75,000, it is less than $400,000. yes, the white house still insisting, no, that's not going to happen. full stop. watch.
7:19 pm
>> this is not about folks who make less than $400,000. >> no new audits on anybody making under $400,000 a year? >> no, very clear, no. kennedy: oh, yeah, she's definitely not going to regret those words very soon but no matter how the biden administration tries to spin it, americans are not buying it. >> oh, yeah, they have to -- they're going after more people. more taxpayers like me. >> we actually going after a lower income people or are we going after higher income people in >> i think after the small guy. i don't like them going -- i don't think they're going after big companies. kennedy: a lot more small guys and a lot more agents. if a former president can be bombarded at every turn by the fbi and irs. what hope is there for the rest of us. here to discuss, maxfunds.com cofounder and fox news contributor jonas. jonas, i do not buy kjp's response that no one who makes under $400,000 will be audited.
7:20 pm
all it takes is one black swan to disprove the universal all swans are white. >> yeah, first of all, it doesn't make any sense because you would go after where the tax fraud is and where people, you know, if you file a tax return that says you only make $100 but made up to expenses of $300,000, you're not going to get audited even by all the new auditors but if someone makes $1 million with a w2 and a bonus charitable donation. you're going to go after that american? makes no sense and go after the most bang for the buck and taxpayers get the most return and claiming there's a cutoff is absurd because that's not how auditing happens and it's difficult to shake down really rich people because first of all, they tend to do illegal deductions. peep don't want to hear this but they work with lots of expensive little tax lawyers that work around the tax code that
7:21 pm
congress stupidly created to get their taxes down to 10, 15, there's multiple presidents now like mitt romney, don trump legally paying a small percentage of taxpayers and a lot of lower income business owners lie or make mistakes and they get caught up because they're lies and not working around a system that's flawed to start with from its complexity so there's a lot of easy busts at the low end. they don't fight back with a team of attorneys anyway. that's where the audits will happen. kennedy: that's why the high tax environments never work out and they have to walk them back. just look at france much the point was not necessarily to turn the irs into even more of a baa high moth, it's supposed to reduce inflation and having 87,000 new irs agents do anything to reduce inflation, jonas? >> yeah, again, i'm not against
7:22 pm
fixing the money problems at the irs but has nothing to do with inflation and in fact, hiring anybody is already inflationary and we're in a 3.5% unemployment rate situation where rages are spawning out of control. this should have been done during the obama administration with high unemployment and looking for projects to create employment. don't wait for the lowest unemployment in decades and go on a fdr hiring spree. that part is stupid and if you're finding money abroad from the supposed rich people and that's not going to take years and the current spending is going on by consumers. if you want to hit that and inflation reduction plan would be a tax on those consumers. maybe a payroll tax increase to fix the bankrupt payroll system. it's not going on audits of people offshoring money. that's a good, noble cause to be done. again, i would do it when we had high unemployment but that's not an inty inflation program and this program as it sits is
7:23 pm
inflationary in the short run and argue any tax collections that would happen because of the new auditors would be disinflationary and sucking in money that's getting taxed and has nothing to do with the current situation with high inflation. kennedy: talk about unemployment being historically low. what if it gets lower and inflation goes higher? what happens then? >> then we are going to need higher interest rates to punish the economy to reduce the inflation. we're at a point now where if we can't get the inflation measurably lower on a trajectory of dropping, then the federal reserve, who's the only person now who's doing anything to stop the inflation because the government -- and this is also states, republican and democrat, don't want to punch the consumer in the stomach. they want to give them handouts to counter the inflation &that's going to make more inflation so it requires the federal reserve to keep raising rates, which raises the cost of financing a car, getting a mortgage or whatever. that has to keep going up till prices come down to reality
7:24 pm
again. so any spending program, and a lot of this plan, besides the irs part, is subdeciding purchases and if you -- subsidizing purchases and that's inflationary and not disinflationary. getting them to stop buying is disinflationary and if you put a sales tax on cars, that's disinflationary. if you give them money to buy a electric car, you need chips for cars and that's not slowing inflation. again, i'm not -- kennedy: it's like giving a diabetic kid cake instead of insulin. the fed, you know, it's like -- believe me, i have problems with central banking. but the fed is the only one with insulin right now. you know, the white house and congress are like, here, fat kid with diabetes, here's more cake. and it's not going to end well. i've seen this episode of many, atlo -- matlock and i used the box of kleenex because it was
7:25 pm
sad. jonas max ferris, thank you so much. more on the latest from the fbi raid at former president trump's home at mar-a-lago. could there be new legal issues for the trump team? and for djt if he tries to run again in 2024. shannon has all the knowledge. that's why she went to college. she is next.
7:26 pm
7:27 pm
7:28 pm
7:29 pm
kennedy: we're back with more on the raid of former president trump's mar-a-lago home after the news broke last night, palm beach turned into a bit of a circus. trump supporters gathered outside his club and fbi headquarters in protest. they were waving flags and shouting over megaphones and today fox digital spoke with some of the protesters to get their reaction, watch. >> i feel like this isn't russia or venezuela or china. this is the united states of
7:30 pm
america these things should not be happening in our country. >> it's all about november and trying to smear trump and trying to smear people that support america first. >> not fair and, you know, why do this now? what are they trying to prove? they don't want him to run, they're afraid of him. kennedy: they are afraid. the time of the raid, trump was reportedly in new york city and when he returns to palm beach, it's anybody's guess what's going on there. with the latest, jonathan is there live. what are you seeing tonight? >> reporter: yeah, hi, kennedy. we're seeing more protesters coming out here. it is the second evening we've seen trump supporters, most of them local, showing up here with signs, honking horns, driving by. on this causeway overlooking mar-a-lago, and this is also the second day that the former president has taken to his
7:31 pm
social media platform to blast the fbi search of his mar-a-lago property. let's take a look at some of his posts. in one he writes, it is all in my opinion a coordinated attack with radical left democrat state and local das and ags. another post reads, biden knew all about this just like he knew all about hunter's deal. with federal investigators releasing few details over the first 24 hours and much of the initial information about the fbi's search was coming from the former president himself, who described his home as being under siege. this rallied local supporters who showed up outside mar-a-lago in protest of the investigation. >> they're afraid of donald trump. they don't want him to run, and they're going to do everything they can to keep him from running. this is just part of it, i believe. >> reporter: a key trump ally believes that all this activity from the fbi may actually
7:32 pm
bolster his political prospects. it is certainly jimmed up support among his base, and reenergized them and at least his supporters are hoping this will perhaps offer the former president more encouragement as far as what they'd like to see him do and that's run for a second term in the white house in 2024. you can hear the people honking and even the dogs getting involved with this rally here on the causeway overlooking mar-a-lago. back to you, kennedy. kennedy: is that your dog, jonathan? >> reporter: that is not my dog. i don't know whose dog that is or what it's name it is. anyone know? no one knows. kennedy: the dog with the paws holding up a sign saying the safe was empty. great reporting. if nothing right now on the causeway, it looks very entertaining. glad you're there. thanks for bringing us pictures. >> reporter: my pleasure.
7:33 pm
kennedy: thank you. meanwhile a former clinton campaign lawyer may have spilled the beans on what last night's raid was really all about, preventing trump from ever running for president again. he wrote on twitter that this is likely related to the presidential records act. anyone found guilty of violating, is disqualified from holding public office and from the video of trump power, folks very much divided. is this all a plot to keep former president trump from running and becoming future president trump again? joining me now, fox news chief legal correspondent and anchor of fox news at night, shannon bream. the guy who's been at the middle of the russia-gate scandal, the lawyer who is hired by hillary clinton's presidential campaign, he's now saying that if the president is in fact guilty of this sort of administer kai
7:34 pm
value malfeasance, he may be disqualified from running again. is he onto something or just trying to create a political fire storm with his friends in the doj and the white house? shannon: he's a very experienced lawyer, kennedy, as we all know. we've had this discussion in the context of his client and engaged by hillary clinton's campaign. back in 2:05 o'clock there were a lot of folks -- 2015, there were a lot of folks on the right saying that if you violate this particular statute, it would bar you from running for the presidency. back then, 2015, a lot of law professors and writers and scholars and study, people studied this stuff and came out and said it probably actually wouldn't keep hillary clinton from being able to run and in fact they made strong cases against it and said only the constitution can set the parameters of the qualification of the age and residency and all that stuff. back then their argument was no, this could never stop her from
7:35 pm
becoming president. you know how washington .s now the shoe is on the other foot and can stop president trump in his argument and that has been debunked in the past. kennedy: is it possible that president biden knew about that raid, and how does he give himself cover if he in fact had prior knowledge? shannon: you know, peter doocy pushed hard at the white house and it's tricky for the president and he shouldn't have his fingers on this at all. the doj needs this clean and clear from the president and there's investigations out there with hunter biden and they insulate the white house as much as possible but again, to say the president didn't know about what was going on, does it then look like he's out of the loop? really what keeps coming to mind to me is why don't we have special council in both cases and do it with hunter biden and former president trump and there's a statute saying whether there's a conflict or other extenuating circumstances, the
7:36 pm
doj can go ahead with a special council and would take away for a lot of people the view of any of this stuff is political and it's confusing they didn't go that route. this route is much more explosive and if they don't bear it out in court and deliver the goods on this, former president trump is going to use this to run and to hit advantage for '24. kennedy: yeah, walk me through that process. how do we get a glimpse of the search warrant? how do we know what they have and what they were worried about finding because, man, if this really -- they have to have the goods in order to have executed something like this about a political opponent. shannon: yeah, and people are saying that across the mitt spectrum. former new york governor andrew cuomo saying the doj needs to step up and show us what they have or else it's an egregious
7:37 pm
situation. people are saying one of two things, they have something we don't know at all or they overplayed their hands and it'll work to the former president's advantage. as far as a warrant, there's a warrant left at mar-a-lago when it's served and not having all the juicey underlying stuff with the affidavit and potential paperwork and the president's team has that and they could say to us at any time. i don't know if they will but the calls for briefing some kind of statement from the attorney general and doj, they're only going to grow and bipartisan in nature at this hour. kennedy: yeah, because the more silence they offer, the more conspiracy pop up and people who support the former president feel like they've seen this before. you know, he's a target, he's the victim here. he's not the criminal so, you know, we'll see how this all shakes out. it's just -- all of it is bad
7:38 pm
news for our political system that, you know, is in desperate need of a sassy makeover. shannon bream, we'll be watching you the only thing. thank you so much. shannon: see you later. thanks, kennedy. kennedy: we love memes here on the show and so do the biden fan boys. stark brandon taking the interpret by storm since trump's fbi raid and hillary clinton is so gross and capitalizing as well. good god. party panel breaks it down in moments.
7:39 pm
7:40 pm
7:41 pm
7:42 pm
kennedy: aww, last night's mantra monday song much the winner was eric and that was for you dear sandy. rest in peace, olivia
7:43 pm
newton-john. democrats are trying their best to give president biden a senate makeover after spend america into oblivion bill. democratsand staffers began tweeting trying to re-brand president biden with laser patches and trying to reclaim the name brandon, their own. message being that sick and cleany joe is an act and he's done playing nice and now he's going ham presumably by sending the fbi to homes of political opponents. is dark brandon a viral sensation or misfire in the party panel is back, stephen .h miller, does this mean work? >> some of its funny. i mean, it's an center subculture kind of way and the illustrator of what they're using this meme off of was a chinese propaganda for the cccp and the white house com shop
7:44 pm
promoting literal propaganda and the problem with this meme is you can't act offended by the name brandon, which our media and the political app did for months and months and called it the -- nbc news called it a right wing slur and tried to get a southwest pilot fired over mishearing it. you can't act offended by it and then go, this isn't offensive anymore. the other problem is you can't portray joe biden as this all powerful superman edge lord villain when he has trouble getting off a helicopter and putting on his own jacket or shaking hands with ordinary people. the reality of joe biden doesn't come across. trump, these memes with trump worked because he's an insane lunatic and the base love he's an insane lunatic and they prop him up. but it doesn't work as joe biden
7:45 pm
when you return against the guy being the insane lunatic. kennedy: does the senile helpless man victim of elder abuse, is that an act, richard? what happened to your head? >> my head's back. lost you for a second. look, i think a couple of things. i think this white house should have been a lot less serious and i mean that in the nicest way. at the beginning of the biden presidency. hoe could have used humor in other ways to get across and show he's, you know, the joe that uncle joe that we know. i think they failed there. i think they're finally trying to catch up and i think it may be a day late and dollar short. who knows. midterms are 90 some odd days away and it could work in their favor. kennedy: i don't know, man. with inflation crushing consumers and new taxes that are going to crush new businesses and war in ukraine and death on the southern border, i don't know that there's a lot to laugh at. i actually wish that they were
7:46 pm
more serious and it's kind of sad, kristen and democrats want it to be true. they so want joe biden to be a tough guy like in ghost when they wanted patrick swayze to still be alive. it's sad. >> it's like sad and he's so senile and i feel kind of bad for the guy. he is clearly senile, and he should be living out his last day eating pudding in a nursing home and not being rolled around by his age and power hungry people around him who are running the show behind the scenes and for a meme like this to work and not going to catch on because the subject of the meme needs a huge base of people who love him. that's why the trump memes took off.
7:47 pm
but biden, no one really loves biden. you have democrats who hate trump, but biden himself, i don't think he has enough people who love him for the memes to catch on. kennedy: yeah, that's the other weird thing, stephen, propaganda comes from all sides and it's not just democrats. they come on my show and say i think joe bide season doing an amazing job. say that again. >> comes from china in this case. kennedy: it's actual chinese propaganda. good job, everybody. you proved everyone wrong. so are you going to get one of her butt her e-mail hats, richard? >> look. i might. kennedy: you should get one that says, i'm sure she's going to put out something that says jeffrey epstein killed himself. that would be a hoot. steven richard and kristen,
7:48 pm
thank you for being here. topical storm is next. thank you all.
7:49 pm

kennedy: a new study probably funded by your tax dollars claims you can keep your dog calm on long car rides by
7:52 pm
