streams liz peek, sitting there, talking about the case. by the way, no gag order has been issued on michael cohen, all right, and he's over there doing these tiktoks. >> i mean, look, the defense has already raised a stink about this and rightly so. the gag order on donald trump is unconsable in my view and probably unconstitutional. to your point, michael cohen has been perfectly free, night after night, day after a day, to come out and say whatever he wants about donald trump and yet donald trump is not allowed to respond. it's absurd. maria: unbelievable. >> we get to the point where michael cohen actually has to prove that the payments that donald trump made to him in return for the payments to stormy daniels actually constituted election fraud. in other words, that he gave michael cohen the money with the express intent of subverting the 2020 election. this is a ridiculous case.

it's an impossible thing to prove. and i don't think that michael cohen who is a known perjurier, is going to be able satisfy wht the jury needs to here. the juries is biased. they may not care about the details. they just want to get donald trump the way alvin bragg does. it's a ridiculous case which will without a doubt be overturned in appeal. maria: he takes the stand no credibility because he was already convicted partly for lying to congress. i spoke to matthew whitaker and greg jarett yesterday on sunday morning futures. they're warning the prosecution's star witness is simply not credible. >> michael cohen is going to come to the stand with more baggage than will fit up there with him. he'll have a hard time telling a story that's not completely

impeachable, asking the fundamental question are you lying now, were you lying them. >> he's incapable of telling the truth. that is precisely what alvin bragg is counting on, by putting on an add hitted liar on the stand, no credibility, the da is supporting perjury. knows cohen will lie. cross-examination is the engine of truth. maria: you know, mark, it's not going to matter to the prosecution because they just really want him up there to to continue to muddy up trump. what was the point of stormy daniels? did any of that and her fantasies, whatever, have anything to do with business records? no. had they just want to muddy up donald trump's name. >> it had nothing to do with what this case is actually about according to the prosecution. yes, so -- and look, to the point about the gag order, gag orders are there to protect a criminal defendant. that's their constitutional right. not to tie the defendant's hands behind his back while you let other people run their mouth.

when you look at the credibility of stormy daniels and michael cohen, it doesn't exist and if you felt dirty listening to stormy daniels, wait until you hear michael cohen, that's going to be filthy. but i also want to bring up evidentiary integrity, whether it's the jack smith case where he mishandled classified documents and lied about it or alvin bragg's office admitting on friday to deleting phone calls between michael cohen and a stormy daniels' attorney, they're tampering with evidence and that's a felony. and these cases are all shams but what's happening here is you've got a guy who likely didn't do anything wrong at least nothing more than a misdemeanor bookkeeping error. he's being secured. -- skewered. while you have people who are supposed to be above the law, who are supposed to be upholding

national intelligence, said my michaelco-angelo is working with the doj. you've had white house counsel meeting with fani willis, meeting with fish james. -- tish james. is this a conspiracy? is this coordinated? should that be investigated. >> it's an extremely good question and one i hope they will get to because i don't think america -- actually, i've got to say when you take a step back, if this is all they can bring against donald trump, you know, good for donald trump. because honestly, i don't think in any of these cases does he really look guilty of any kind of reasonable crime. and when i say reasonable crime, making payments to a porn star who by the way appears to have made up her story because bill maher of all people has come out with a clip that shows she wasn't raped, she wasn't assaulted. this was a consensual act that

maria: welcome back. it is time for the word on wall street, top investors watching your money. joining me is capital management ceo, shana sisel. also with me is mark tepper. great to see you. thank you for joining the conversation this morning. >> thank you for having me. maria: mark, want to kick things off with you with really what's been a rough second quarter so far. take a look at marketses this ms quarter, for the second quarter which started april 1. the dow industrials are down three quarters of a percent, nasdaq down a quarter of a percent, the s&p lower by two thirds of a percent. it was much worse so we've had a little bit of a rally here. for the career, stocks are in the green, s&p 500 holding strong, north america's largest companies on track to post the best quarterly earnings in two years despite lingering recession fears, the dow is up 5% this year, s&p up almost 10%

in 2024. and the nasdaq up almost 9% this year. i want to point out this morning that copper is at a two year high, another economic indicator. you've got a big week of first quarter earnings on deck, home depot will be out tomorrow. cisco systems out after the bell on wednesday. wal-mart and deere on thursday. these are some real good market movers, right, walmart, cisco, home depot, what are you expecting, mark? >> look, obviously home depot and walmart, you're you're going to have consumer, housing front and center and i think you'll see more of what you saw last quarter which is both of these companies are talking about how inflation is hurting the lower income consumer specifically, middle income consumers but also the tradedown effect they've been seeing happen where people are buying less expensive items, right. so i think you're going to see more of that. as it relates to copper, normally that is an economic indicator that would imply that maybe the economies is booming

right now. however, i think this specific instance, maria, this is really more about an increase in demand specifically related to evs and ouv andalternative energy an energy policy is causing things like that, like copper to go up. copper is up 22% this year. earnings season overall has been pretty good. earnings are up around 7% year over year. certainly there's some upside that we hope to see throughout the rest of this year. but investors seem to be pretty happy with it. i know the quarter hasn't really started off great but we are again now within striking distance of all-time highs in the stock market once again. maria: well, i'll be interested in hearing what home depot says and wal-mart. that will give us a good indicator into the consumer, right, mark? i mean, oil prices are edging higher, that's been a major issue for inflation. so we'll see if that comes

through with this quarterly number. i should point out that senate majority leader chuck schumer is urging the federal trade commission to, quote, pump the brakes on chevron's proposed $53 billion acquisition of hess, saying it would, quote, give big oil fuel to raise gasoline prices. of course we spoke the with chairman and ceo of chevron at the milken institute last week. here's what he said on the deal. >> this is a good deal for shareholders of both companies, a good deal for the industry, good deal for the country of guyana and we're confident the deal will close. we're working our way through the ftc process which we expect to be concluded by the end of the quarter, shareholder vote at the end of this month and then we've got a contract issue with one of the other partners that will be resolved through arbitration and that will take a little longer. maria: exxon is also trying to stop it because they want in on the deal for hess and the guyana project, mark, but now wee hear from chuck schumer who doesn't want this deal to go forward.

>> yeah. and he wants them to pulp the brakes on it, the ftc to get involved to pump the brakes on it and this is -- look, gas prices when president trump was in office before the 2020 election gas prices were $2.10. they're $3.62 right now according to triple a. so of course the democrats want to blame this on greedy oil companies, that's not what this is about. this is about bad energy policy coming out of this administration and honestly, chuck schumer, he should be focusing on things that are driving people out of new york and he should be trying to solve those problems to keep people living in new york. maybe start with inflation, crime, all of those things. but trying to blame high gas prices on greedy oil companies, americans are smarter than that. maria: maria: shana, how do you see all of this?

>> i agree with mark in a lot of ways. interesting fact here. whether it's oil or copper, when we start talking about commodities, there's been a noticeable shift in allocation al lowcommodities by wealth mans globally in a way we haven't seen before which is also driving the prices of commodities in general. can't be good for inflation, let's keep that in mind. we can have all the discussions we want about the inflation numbers being ex-energy but how it affects the consumer doesn't matter whether or not you take energy out or not, how consumer behavior is driven by commodity prices matters and i think that's something we need to be concerned about. maria: i mean, i'm just wondering if p copper is at a two-year high because people are holding more hard assets. you know. when you're afraid of a market that is vulnerable to what the fed is going to do, you want to go and hold hard assets.

gold is up. other commodities are up. so is that one of the reasons that you're seeing copper at two-year highs? i agree with mark. i don't believe that this is indicative of a stronger economy right here. i think it's the opposite. >> i completely agree with what you're saying. gold is a perfect example and while it's not technically a commodity we're seeing similarly things with bitcoin. so all of these things are notable. it's a shift away from equities and fixed income that i think we should be paying attention to. it's happening for a reason. i think there is some real desire to move away from the type of exposure as people are concerned about what the fed will do and what the economy is doing and we've seen economic numbers be a little bit concerning as of late and so we've got to think about what's going on with the economy and slowing economy, a weaker consumer, not great for recession outlook and i think maybe that victory lap about the soft landing was a little premature. maria: so shana, one of the

stocks you're looking at this week is nvidia, the company reports earnings next week. obviously this has been the face of a.i. and has lifted markets and many boats across the board. do you think this rally has legs after the earnings? >> i do. and anyone who knows me, i know mark knows me pretty well, knows that i've been an nvidia for a long time. i think we're very early innings of a.i. nvidia is obviously the biggest player in that space and as nvidia goes, as does tech in a lot of ways, as does the semis in a lot of and as does the market if you think about it. there's no reason to not expect nvidia earnings will continue to be great. the biggest concern with nvidia right now, they beat earnings but not to the same extent that they have been so the momentum of their earnings beat starts to

filing articles of impeachment against president biden on friday over potentially withholding weapons to israel. if prime minister benjamin netanyahu launches a major offensive in rafah, mills accusing the president of abuse of power but, quote, soliciting a quid pro quo with israel while leveraging vital military aid for policy changes. the new york times is reporting the president made the same threat on a february phone p cal wnetanyahu which was kept under wraps. joining me now is florida congressman cory mills. congressman, good to see you. thanks very much for being here. give us your sense of this story and tell us more about these articles. >> well, maria, to be honest with you, this is very clear. it's an obvious this for that, a quid pro quo or of what shoulde called a quid pro he joe. we've seen in michigan during the democrat primary, 13.2%

filed as uncommitted, 101,457 votes. sees the pro-hamas sympathizers who are protesting on university campus as well as blocking streets, sees the recent polls which shows president trump up in all the swing states, 1.2% on average increase in michigan, this is a clear understanding. he knew what the israeli supplemental aid package would include. he knew what once it was congressionally appropriated aid funding it was supposed to move forward and instead he pulled the wool over the eyes of the american people by sending the first shipment which was taken by hamas, utilized by their fighters and sold off to help with the counter offensive, while withholding weapons shipments to the idf and to israel in exchange for political gain in the elections so as far as i'm concerned i use 98% of representative jerry mad letter's own -- nadler's own

language that he used to impeach president trump. but this is something that has taken place by biden and the administration. maria: it's incredible the language we're hearing from the administration as relates to israel. antony blinken delivered one of the strongest rebukes ofs israel amid the war with hamas the new york post is reporting this this morning. during a pair of interviews, blinken said to this, the united states wants israeli forces, quote, to get out of gaza. unbelievable. that's what blinken says. and then the washington post reporting this outrageous story as well. that the administration is, quote, offering israel valuable assistance in an effort to persuade it to hold back on a full scale rafah i'm vacation r- rafah invasion, that includes sensitive intelligence to help the israeli military to find the

group's leaders and hidden tunnels. this suggests the administration has information about where the hamas terrorists are in these hidden tunnels and they haven't shared it yet. really? i spoke with utah senator mike leon of this yesterday on sunday morning futures. watch. the u.s. knows where the terrorists are, they're not going to share the information with israel unless israel doesn't go into rafah, this story is outrageous in the washington post. >> the story's outrageous. the facts underlying it are tragic. look, this is a extortion. we're saying we can help you locate your victims who have been kept under just horrible, horrific conditions, the worst anyone can imagine. we will share that information with you if and only if you choose not to defend yourselves. we are revictimizing the victim nation here, this is terrible. maria: i mean, can this get any worse, congressman? >> well, it can get worse because one of the things that

my great colleague senator mike lee left out is this intelligence that can be supplied to israel would also help with recovering american hostages. this is one of the first priorities that he is supposed to actually be doing is protecting the american people. look, maria, there is a plethora of impeachable offenses. we could have looked at the failure and the violation of the take care clause to enforce federal laws on the border, the separation of power abuse where he is trying to utilize money to buy votes for the college bailout, superseding what scotus ruling has done. mine is clear. he is playing politics and withholding information that could save people's lives. he's withholding defense articles that he had already approved so he could pander to the radical left, the rashida tlaib of the world, the ilhan omar of the world, the people who are taking over the democratic party. he is withholding these items. he's congressionally appropriated aid items in an effort to buy an election,

that's a clear quid pro quo. maria: i mean, why? why would he walk away from our number one ally in the middle east to get votes? i mean, i think based on the people i've spoken with about this story, this has been a red line for jewish voters. he's lost a lot of independents with this decision. >> well, the bottom line, maria, think about the 2020 elections, think about what he's done, weaponizing das and ags against president trump pfor election interference. think about where he has to pander to the radical left, trying to get to a pro-hamas sympathizer type of ideologies. he will do anything to win to stay in the white house. knows that when you look at the recent gallup poll, 41% of the people are concerned about inflation and economy. bidenomics is failing miserably. and pres president trump is knoo be able to handle, build job and increase the economy. knows he must do what it is to win that small percentage which is why he wants to try to continue to do replacement

theory, bring in illegals but again this is quid pro quo. i'm tired of hearings. i'm tired of the idea of one more piece of evidence, there's more than enough out there. the american people want results and accountability. i move forward, i filed my articles of impeachment and i ask my colleagues to join me in this. maria: you have what mike johnson leading the save act, senator lee also talked about the save act but you are co-sponsoring a bill that passed the house last week that would add a citizenship question to the census and block illegal migrants from impacting redistricting and electoral college appointment processes. congressman, tell us about this. because there's a lot of people who feel that's one of the reasons that this administration has the border wide open because you've got the census, this is counting more illegals and it's getting better congressional districting for the democrats. >> well, you said it right there, maria and i'm proud to have co-sponsored this piece of legislation which passed the house that would stop illegals

from actually being part of our census surveys, that would stop the redistricting lines, that would change how the demographics work with regards to congressional state and federal elected races, that would include national races and so even though they may or may not in certain states be allowed to actually participate in the elections, it still modifies district lines. that's why they're flying them out to rural areas, that's why every state is a border state with 9 plus million people coming across in the biden administration, that's why they don't want to secure the brother deer or impose executive -- border or impose the section that would allow him to secure it. they want him to modify elections. it goes back to my impeachment articles or all the others. joe biden will do anything, weaponizing the government, weaponizing lawfare, keeping borders open, he will do anything to stay in office and this is a gross abuse of power by the biden administration. maria: liz peek. >> good morning, congressman. i could not agree more, that

this idea of including illegals in the citizenship census is incredibly important and the supreme court kind of basically delayed the opportunity of the commerce department back during the 2020 census from including this question about citizenship. i hope your bill is something that the republicans will stay focused on because there is no accountability for democrat leaders of blue states like new york and california which are losing enormous numbers of citizens because they can just replace those numbers by inviting in illegals via becoming sanctuary states so i don't think voters actually understand the importance of this particularly but i hope in the next congress, if there is a republican led senate, that this will also track with that group and you will be able to push this forward. i think it's unbelievably

east. maria: the story is outrageous, the fact that the administration is leaking the story to the washington post that they would share sensitive information about the hidden p tunnels that believe hamas a terrorists are in only if they don't go into rafah. if you have that kind of sensitive information, the administration, about where the hamas hair wrists are in these tunnels and you haven't given it to israel yet. wow. trump discussed this at his rally on saturday night, slamming biden over the israel policies. watch this. >> this week he announced he will withhold shipping weapons to israel as they fight to eradicate hamas terrorists in gaza. that was shocking to hear it. even while there is still american hostages being held by hamas and they're saying oh, october 7th never happened. you know n they say that and biden's fallen for it.
