and said he smelled like a grill. he was worried about it. i said we like to know a guy can grill. spoeuf they -- >> they have cologne like that. let's tell you what's going on in washington. we've been telling you about the scandal at the v.a. i believe it was on wednesday night the house passed a bill so that they could hold those who do wrong at the v.a. accountable. a hospital administrator needs to can, they would be able to can them. the bill went from the house over to the u.s. senate and it looks like it going to sit on harry reid's desk through the vacation even though yesterday marco rubio, a florida senator, tried his best to get an emergency vote on it yesterday. he said the last thing we need to do is be on vacation and people walk up to them and say what are you going to do and he'd say we're going to have a hearing in 15 days.

he wanted to take action. harry said no. >> especially for memorial day. if you're back home at your district and we're honoring our veterans this weekend, when members of your constituency come up to you and say what have you done for your veterans? have you voted on the bill? we wanted to take time to read it. that is what bernie sanders said. "we have not held a hearing on this situation. some of us want to read the bill before we vote on it." meanwhile he's saying it is only three pages long. >> as compared with -- let's remind everybody, they were quite hasty to pass -- and we have to get a truck to find it -- >> this is the affordable care act. >> obamacare right here, 2,409 pages right here that certainly didn't cause pause or hesitation for

them to look at it. they didn't read it all. >> but three pages. >> we had to pass it before we could read it. there's the affordable care act bill. had to pass it before you could read it. ladies and gentlemen, this is the bill, the v.a. accountability bill. it is three pages, as clayton said. take a look. page 1. >> a bill. >> page 2. >> i just read it right here. >> page 3. >> there is not even a full page on the third page. >> it's 37 lines. yet what they say is we really have to take a look at it. one of the problems, the democrats say, is we want to make sure these government employees get their due process. we don't want to be tied up in a bunch of lawsuits and stuff like that. people don't care about lawsuits. >> more and more americans are actually becoming more and more furious with the fact that the v.a. isn't serving our veterans when they actually commit to saving anybody's life, being willing to put their

life on the line for you out there. you know it. and then they come back here and not getting the care they deserve. americans are finding out about it. it's going across the country. apparently the president found out about it on the news, so it is news to him according to their offices. what is so heartbreaking, this weekend on memorial day when we think about those that have paid the ultimate sacrifice, including those, 40 reportedly died in the phoenix v.a. system through the process there which didn't treat them in time, this is unlawful to let three pages sit there over the course of this weekend while they have a burger and hot dog in a backyard. >> that's a great point. that three pages is one of many bills actually sitting right now on the desks in the senate waiting, these v.a. reform bills. but they did, however, have time to write a letter requesting the washington redskins name change. you know how congress tends to waste their time honoring a bridge or high school basketball team and spend all afternoon doing that, but yet they can't

pass legislation dealing with our veterans right now. >> changing the redskins name. they actually let bills sit there, dead on arrival most of them come to the senate floor. >> let's get it over to heather nauert who is standing by with a look at the headlines. >> good morning, gang. happy friday morning to you. wild weather brings us to our first story. brand-new video coming in to "fox & friends," hail that is so big and powerful, it actually cracked the windshield of an airplane. there was a pilot at a u.s. airways flight forced to make an emergency landing in philadelphia because of all of this hail there. then take a look at this video coming out of hartly, delaware, a twister tearing homes apart leaving nothing behind but piles of wood. the death penalty making a lot of news after that botched lethal injection in missouri recently. now the electric chair returning to tennessee.

late last night tennessee's governor signing a bill to allow the state to electrocute death row inmates if the prisons there can't get lethal injection drugs. there is a european-led boycott of those drug sales. in wyoming and also utah, lawmakers are trying to bring this back. the firing squad. both states are set to introduce bills next year. the white house certainly hesitateed to send in help for the four americans who were killed in benghazi, but they didn't hesitate to e-mail youtube. according to a classified e-mail that was recently released, the white house reached out to youtube at 9:11 p.m. eastern time on the night of the attack while that attack was still unfolding. the reason was to warn the website about the alleged consequences of posting an anti-islam video on youtube. according to house oversight committee chairman darrell issa, the e-mail suggests the administration was

connecting the attack to the video from the very beginning, but that claim was later proven to be false. a brand-new update on paul mccartney. he is expected to make a full recovery. the 71-year-old was rushed to a hospital in japan because he had a virus. he had to cancel tour dates but is expected to be back on stage in texas on june 14. who needs paul mccartney when we've got sarah evans here today? and those are your headlines. warming up outside. >> she can sing. >> she can. she's awfully loud a little early but fun. gets you awake. >> a lot of people heard this loud and clear. mark cuban was at a conference in nashville. it was called the grow-co conference. and he said this that lighted up a firestorm on twitter. >> we're all prejudice in one way or the other. if i see a black kid in a hoodie and it's late at night, i'm walking to the other side of the street. and if on that side of the

street there's a guy that has at that tattoo all over his face, white guy, bald head, tattoos everywhere, i'm walking to the other side of the street. the list goes on of stereotypes of who we're fearful of. >> he said we're on a slippery slope, talking about there being a slippery slope with sroepgt sterling down. he went on to say we all have inherent prejudices, inherent stereotypes we walk around with on a daily basis. it is ignorant to say we don't. people flew off the handle. you saw people with headlines saying mark cuban said i'd cross to the other side of the street if i saw a black kid in a hoodie. >> he said via twitter, you better change this

headline. that's not what i meant. he defended what he said and is really being honest, and really to the surprise of many, steven a. schmitt got in the ring -- steven a. smith got in the ring to commend him. >> i want to emphasize that i have absolutely, positively no problem whatsoever with what mark cuban had to say. zero. there was nothing remotely offensive about what this man had to say. now, i understand that me being a black man, an african-american, that people are going to be rubbed the wrong way by those statements. they will need to get over it. >> they will need to get over it. well, what about the white guys who are bald with tattoos, shouldn't they be upset as well? no. he was making a point. stephen a. smith also said he believes every one of the owners of the nba club would say exactly the same thing that mark cuban did. he said donald sterling's

viagra home delivery. get started at viagra.com. the pot growing game weed firm has been yanked by apple off of i tunes but not before soaring to the number-one download on i tunes. similar apps are still available with crazy things. are these games becoming essentially the gateway to the gateway drug for our nation's youth? joining us is fox news contributor and former homicide detective rod whao*el in our d.c. -- rod wheeler in our d.c. bureau. good morning. what this app did is it showed people who download it and put it on their smart phone how to grow weed. what's your problem with that? >> it's not just showing people but it's also showing children and young teenagers because we all know these individuals are very influenceable at these ages. between the ages of 10 and

18 years old, that is the capture age. also that's the age more people download applications from websites such as the apple store. that's the problem that i have with this application. and not only does it show you how to cultivate and grow weed, it also, this application shows you how to sell weed. you know, does our kids really need to know or learn that type of behavior? >> sure, it's a good point. but it's a slippery slope too because this particular application got yanked by apple after it shot up to number one. there are still other weed games on-line that you can buy and stuff like that. but at the same time, you look at grand theft auto, games like that. you've got people not only stealing cars but killing people. you've got hookers, every imaginable bad thing. that's legal. where do you draw the line? >> here's the problem with that. these are learned behaviors. it's one thing to actually see this kind of stuff on television or even through the internet. but whenever there's an

application, steve, and i think this is where you draw the line. whenever there is an application that literally teaches people how to commit these crimes and teaches people how to become a hustler, such as this one weed game, i think that is where we have to draw the line. i think it is important to note that with the apple store as well as the google store, they have age restrictions that pop up, know, when you try to download certain apps. but the grim reality is there is nobody policing that, so if you have a 10-year-old or a 12-year-old and they want to download this app, that age restriction goes out the window. >> a lot of 10-year olds may have done it. it's ultimately the parent's responsibility because they've got the password to spend the money to buy the app. >> right. i think that's the bottom line. you hit the nail on the head when you said parents. parents must take responsibility at the end of the day. >> here's what the apps' firm said. the creators of this game do not encourage the cultivation or use of

cannibis. the plot of this game is solely a work of fiction and should be viewed only as such. but to your point, you know, you have a problem with the apps that teach you how to do stuff that's against the law. so the app on how to cook withpressure cooker bomb, that too? >> absolutely. because think about it. who really needs to know and who really needs to learn how to do those things? i know some of you are saying you can google it and go to different web pages. and you can. my issue with the app store is it puts these things in front of kids at an age when kids are very influenceable. they call it a game. the reality is it is not a game. right here in washington, d.c. and major cities we're seeing learned behavior of teenagers, kids and they're acting in ways where you have to say to yourself where did they learn that? think about about it.

23 minutes past the hour. quick headlines making news out of washington for you. thousands of americans mailing comments blasting new i.r.s. rules about targeting the tea party. now the agency says it will be backing off the proposed regulations. republicans warn that they would increase the targeting of conservative groups. the house overwhelmingly voting to restrict the n.s.a. from collecting and storing phone records. the agency is still allowed to get court permission to view land line and cell phone data. it's -- if part of a terrorism investigation. the measure now heads to the senate. >> on memorial day 2011, president obama stood in arlington national cemetery and told the story of two fallen heroes buried there side by side, an unlikely story. u.s. marine travis manion

and navy seal brendan looney were best friends who made the ultimate sacrifice for our country. now their stories being told in a book called "brothers forever." the book was written by travis's father tom, a retired marine corps colonel and he joins us now. thanks for being here this morning. i know having spoken to you about how difficult this was putting this on paper, how does it feel to finally be able to tell their story and put this out there in the world? >> it's great to be able to get it out there. as you said, we lost travis in 2007. as a father, your worst nightmare. but then to have lost brendan, his good friend and roommate at the naval academy in 2010, and then fast forward. we've got the navy seals that captured and killed osama bin laden and then the president talked about brendan and travis a couple weeks later, about their example of character, service and sacrifice.

to be able to write this story and get it out to the broader country was important for me. >> the book obviously focuses on their friendship. how did they come to find one another at the naval academy? how did they become so close? tell us about them. >> they were very similar in a lot of ways. they were cut from the same cloth, so to speak. both college athletes, division 1 athletes. travis wrestled. brendan played on the lacrosse team at navy. they went to the national championship game. and they both came from close knit families. and family was important to them, and they just sort of gravitated towards one another. they were also both very hard workers and overachievers, guys that sort of led from the front. they became very close at the academy and stayed close afterwards. >> you uncovered some things that i can only imagine losing your only son in this way, but then to go back and to pick through the details, to

have to learn about that fateful day in april 2007, tell us about what happened and how your son paid the ultimate sacrifice for this country. >> well, travis was part of a military transition team. he was embedded with the iraqis. they are on a patrol. they were sent to a home looking for a sniper and it turned out to be an ambush. and several of the marines were hit. they pulled them back to safety and then travis went out to lay it down fire and he was ultimately hit by a sniper. >> he went out to protect his fellow marines? >> he did. he moved out from around the cover to protect the guys. turns out he was the only one that didn't make it home that day. but he did what he needed to do, what he knew he had to do. >> brendan, of course, died in a helicopter crash in afghanistan. and then the families managed to bring them together to live eternally at arlington. how did that happen? >> you know, it's interesting because we never really got travis

settled. my wife wanted him close to home. you're in shock when something like this happens, and we buried him near our home in pennsylvania. then it came to find out he told a lot of people if anything happened to him, he wanted to be in arlington. we never put a headstone up and deliberated whether we would move him to arlington. we thought about it. but my wife visited him every day. she didn't want to let him go. then when we lost brendan, brendan's wife amy said i want brendan to be with travis. and my wife finally was to a point where she said okay, this is right. let's do it. >> unbelievable. you'll be down there of course on memorial day at arlington. as you were describing to me, you can feel the spirits in the air. >> special place. >> we'll be thinking about you this memorial day. we'll be thinking about all the men and women we lost in this country paying the ultimate sacrifice. tom, great to see you this

the juice wants loose. o.j. simpson's lawyer filing a super sized appeal to the nevada supreme court over his conviction in 2007 on armed robbery charges. the appeal documents are 43% longer than the court normally accepts. the court is now deciding whether to accept his appeal or not. his lawyers claim the nfl great's trial was biased because of his notoriety. the 66-year-old is currently serving 33 years behind bars in a prison there. as you prepare for your holiday weekend cookouts, we have new information about that massive beef recall. the beef that was tainted with e. coli was shipped to stores in ten states, included on that list gordon food service marketplace, georgio's italian deli. it was sold from the end of march to may and has the establishment number 2574-b. so be on the lookout for that. george clooney's

today. take a look at this stage. the barbecue is free and also smelling delicious out here. this is great news, kicking it off. that is going to continue throughout the entire summer every friday on 48th and 6th. the weather conditions in the new york city area could be a little bit worse. we have a little bit of a chance for showers moving through but right now it is holding off and that's great news. mostly cloudy skies but areas farther south across the carolinas could be seeing the potential today for severe storms and across the state of new mexico and texas, you have the possibility for storms not only today but also as we head into this weekend. looking at largeunday we hail, damaging winds and even some isolated tornadoes from some of these storms. very heavy rain also expected, a flash flood threat is in place from texas up into parts of missouri, kansas and oklahoma. and temperature-wise, heating up across parts of the southeast. we're into the 90's across the state of florida. when you factor in the humidity, it feels hotter than that. in parts of georgia we're talking upper 80's for the

>> i personally miss, like, films that are about outer space, aliens, the most far-fetched things we can conceive but they have lost that sense of being in suburbia. all the exterior forces would come into our backyard and there was something human about it. i want like -- i want like marty mcfly back. >> she should be happy all this weekend at the theaters because x-men days of future past, is it worth the cash? my friends saw it last night. sold-out theater last night. >> this movie is predicted to do over $100 million, this is my favorite x-men film to date. there is a scene in this film that i would literally pay $20 just to watch on a loop for two hours. that's how insane the action is. this scene, all i will say the character's name is quicksilver. it is the most jaw-dropping

windows and also wind shields of these cars in pennsylvania. then look at this video coming out of hartley, delaware. there was a twister coming through tearing apart homes, leaving nothing behind but piles of wood. that crazy springtime weather. and then the death penalty making a lot of news lately after the botched lethal injection in missouri. but now the electric chair is returning to the state of tennessee. late last night, tennessee's governor signing a bill to allow the state to electrocute death row inmates if the prison there can't get lethal injection drugs they need. there is a boycott of those drug sales now, so it's increasingly difficult for prisons to get the drugs. then the state of utah and wyoming, lawmakers are trying to bring back the firing squad. both states are set to introduce bills related to that next year. and another example of the woosification of america. officials at an elementary school in michigan telling students, you will all be

that the inmates down there receive. they're getting cable television in the rooms. they get nice meals. they get nice libraries. >> they've got a ton of doctors. >> yeah. >> j.d. gordon, retired navy commander who served as pentagon spokesman a while ago, knows this, that they do have that great care 'cause he visited gitmo over 30 times and this is what he has to say. >> guantanamo bay there is 150 detainees there now and they've got a medical unit of about 100 doctors, nurses and health care support staff. 1.5 detainees to one is the ratio. if you look at the veterans in this country, there are 21 million veterans and of those 21 million veterans in the united states, 9 million are receiving v.a. care. but if you look at the v.a. employees, it's 267,000. that's a 35 to one ratio. i have think president obama has a flawed sense of priorities. he's taking better care of the

to grow weed apps and you wanted to weigh in on this. what do you think about his comments? >> when mark cuban crosses the street because of the two examples that he gave, i'm going to probably be right behind him. and i'll tell you why, because what the guy is saying, first of all, he's being very honest and he's being very genuine. you know what? i'd rather as an african-american male myself, i'd rather talk to somebody such as mark cuban who is being very open and honest about his own personal prejudices and when he says we all have prejudices, he's absolutely right. so i'm trying to lessen exactly what the uproar is to what this guy said. i get the fact he used the analogy with the hoody and i understand that, but he apologized to the martin family and when he even used that analogy, i don't think he was necessarily thinking about trayvon. he was saying anybody in a hoody. you know what i mean? so i think we're kind of jumping at these things every opportunity we get. >> what do you think about the press reaction and some of the

headlines? they leave out the part where he's talking about the skin head and only focusing on his comment about the kid with the hoody? what did you make of that? >> that's unfortunate. the reason that's unfortunate is because that's happened to me before, too. look, some of these news network, not fox, believe it or not, fox played the entire clip. a lot of these news network also only pick and choose certain things that individuals say just to get the uproar going and they won't play the entire context of what was stated. that's one reason, guys, why i have so much respect for dr. ben carson. because dr. carson talks about this country. he talks about things without a racial perspective. that's why i have respect for him. but a lot of people see that from a different perspective. >> right. it's a culture where you can't even be honest about how you feel or where we're going. the conversation has to be dead. >> right. >> you're exactly right. with prejudices, these are learned behaviors. so we have to work our way through these prejudices and i think that's what mark cuban was saying. but what donald sterling said, on the other hand, was completely different. that was racism.

welcome back. the president acted mad as hell about the growing scandal at our v.a. but he still hasn't interrupted his fundraising trips to visit any of the veterans. >> soon the president hear them out? at the very least? we sent fox news contributor and ceo of concerned veterans for america, pete hegseth, to get their side of the story. good morning. >> good morning. yeah. it was great to get out on the street. we were in baltimore at the baltimore v.a. facility, just asking them questions about the care they're getting. we heard a lot of the headlines and talked about the wait times. what are the veterans saying and experiencing? this is what they told us about the care they're getting at the baltimore v.a. >> it's been bad. just getting appointments and scheduled and the waiting time here. he's not getting the care he needs. >> he has no teeth, so he's literally starving to death. >> there have been times i waited two days. >> sometimes it isn't a lack of prime minister, it's that the personnel don't have a sense of urgency? >> absolutely. either you're a number or you're a diagnosis. >> how long have you been

waiting? >> two years. >> do you feel like the president cares about this scandal at v.a.? >> negative. >> so the issue is not the care. the issue is the wait times and the barriers? >> yeah, exactly. >> i'm very disappointed. i'm very disappointed. starts at the top and i think he should be replaced. >> the buck stops at the president. it comes to the top. if the top doesn't put out the effort, nobody else is going to. >> i've got a nephew that left for boot camp four days ago. what's going to happen when he's 60 or 65 and he can't help himself? who is there for him? >> great questions. great answers. apparently the v.a. didn't want you to ask the questions because they tried to show you the door? n they tried to show us the door. they walked out. thankfully our cameramen moonlight there and said this is a public sidewalk. so we stayed and asked questions and these guys were candid, powerful stories. you can only play a little bit. we spent a couple hours there talking to people. time and time again, three months, four months, five months, six months. we're waiting. these are not guys that are victims. they don't see themselves as

victims. they're proud, they're grateful. they just want the v.a. to work. >> sure. they come from the generation of accountability. >> that's right. >> responsibility. so to not see it when it has to do with their health has to be ultimately frustrating. what can be done? >> what can be done is you can pass three-page bill, like you said. that's a great place to start. hold people accountable. the president can stand up and say people will be fired and held accountable. i think that's what these veterans are looking for. we asked about the scandal. they put it in context of i'm waiting. everyone is waiting. someone should pay for that. >> eventually the scandal will blow over and people are going to start to forget. but ultimately we were just talking a home ago, what should probably happen is give them the opportunity to go to a local doctor. >> we opened up that question. a number said if i had the opportunity to go to someplace else, i would do that. so it's a pretty common sense thing. v.a. facilities provide great care in some places. if they don't, let's let them go someplace and not wait six months for it.

>> because tourism translates into jobs and it translates into economic growth. when visitors come here, they don't just check out the hall. they rent cars, they stay in hotels. they eat at restaurants. >> reporter: that's all true. the president's argument is that all of this travel is essence, kind of a form of economic stimulus. however, it's easy for him to talk about travel. he gets to go on air force one. it doesn't cost him anything. the rest of us are stuck in car seats like this or having to pay our own air fare. air fare is up, hotel prices are up over last year. gas prices, more or less stable. normally we'd say that's a good thing. but gas prices have not been below $3 a gallon since the end of 2010. of course, all of that takes money out of all of our pockets. and that's money you would be spending on something else.

his hoody comment in just a minute. in the meantime, let's turn to heather nauert who has the update on the air. >> a lot of folks traveling this weekend for memorial day. two united airplanes packed with passengers within seconds of crashing into one another. it happened shortly after takeoff from houston's airport. air traffic control telling the pilot of the plane heading to vancouver, canada, to make a right turn instead of a left turn. that brought the jet within 400 feet of the other plane that was headed to mexico city. both planes had 150 people on board each. the faa just releasing this information now. incredible new video just coming in. hail that was so big and so powerful, it shattered windows and windshields of cars in parking lots in burks county, pennsylvania. the damage was so bad that these cars had to be towed away. crazy springtime weather there. the death penalty making news after that botched lethal

injection that took place recently in missouri. now the electric chair is returning to the state of tennessee. late last night, tennessee's governor signing a bill to allow the state to electrocute death row inmates if those prisons can't get the lethal injection drugs that they need. there has been a european-led boycott of the drug sales now, so it's been tough for prisons to get their hands on those things. then listen to this, in wyoming and utah, lawmakers are trying to bring this back, the firing squad. both states set to introduce bills related to that next year. a fun story for you. remember when president obama threw out the first pitch at the major league all-star game in 2009? remember these jeans? everybody called them mom jeans. we wanted to know what happened to them. the president was at the baseball hall of fame in cooperstown, new york, and answered that question. listen to this. >> at the hall's request, i contributed something on my own, which was the jacket i wore when i threw out the first pitch at the 2009 all-star game.

i want to say something about the president and his demeanor. he seems curiously disengaged. >> he's a bystander. >> it's almost as if he's taken the memorial day holiday off a couple of days ahead of time. i don't see any urgency in -- it kind of started with the ukraine and crimea and then from that point on, he just seems to be kind of mellow, taking -- >> he was at the baseball hall of fame. i get that, i like baseball. >> what if this was a republican president and this was happening on a republican president's watch right now and he was taking the memorial day off, would there be outrage in the main stream media? >> i don't know. it's very difficult to answer the question. i will say people tend to look at the memorial day weekend as a beginning of summer, as a barbecue. they forget what it's for. if i were president, i would seize this occasion. this is where you reenergize the nation's commitment to the people who serve in the armed

services. this is where you really -- where harry reid should seize the bill, where there should be bipartisan kind of let's go into this together. these are the -- we were on the platform with winnow a and the -- wynona and the acts, they were up for fleet week. this is when you embrace them and show them the due deference that they have earned in service to the nation. i don't know what the president is up to, but he needs, if seems to me, a double espresso. >> you have had such a measured approach to this entire scandal and to your credit, i think what you just said right there may be the most impactfulis still time. i want to take your temp on what mark cuban said. he had this to say about race. >> we're all prejudiced in one way or the other. if i see a black kid in a hoody and it's late at night, i'm walking to the other side of the

street. and if on that side of the street there is a guy that has tattoos all over his face, white guy, bald head, tattoos everywhere, i'm walking back to the other side of the street. and the list goes on of stereotypes that we all live up to and are fearful of. >> he was talking about donald sterling and whether or not as an nba owner, they should get together and vote him out. he said we want to be slow to judge in those situations because we all have inherent biases. a lot in the media jumped on him and called him a racist and should apologize. what do you make of the statements? >> i think mark cuban stole his line from me during the trayvon martin murder case. if you'll recall, i got in a lot of hot water when i suggested that the hoody that the youngster was wearing that night killed him as much as george zimmerman because it fit the stereo time of every surveillance video, of every stickup of every 7-1 # we've

seen timend time again in the local news programs. there are definite stereo types. we did he have israeli a -- definitely have a race reaction. it doesn't make us racist. it's not that mark cuban invented it or george zimmerman or geraldo rivera invented it. it is the reality. i'm doing on saturday night, we start the weekend. i'm going to do my o. j. simpson murders at 20 years special all this weekend on the fox news channel. the simpson case and the way people responded to it laid bare the race divisions in this country and the racial stereotypes in this country. it is a reality. we should grasp it and deal with it and i think cuban should be applauded for being frank about it. i think, however, this will start a discussion that where it ends, nobody knows because look at the nba. if i'm not mistaken, every owner in the nba is jewish. i mean, i may be wrong about that, but i think that is real.
