"jesse watters primetime" right now with guest host sean duffy starts here. hey, sean. >> sean: hey, bret, thank you. appreciate it welcome to "jesse watters primetime," i am sean duffy. all right. let's is that right with a fox news alert. president trump says the fbi seized his passports during their raid on mar-a-lago saying, quote: they stole my three passports along with everything else. this is an assault on a political opponent at a level never seen before in our country. do they think former president trump is a flight risk? where is he going to flee to? his plane has his name written on the side in giant gold letters. sources are also telling fox news that the fbi seized records that are covered by

attorney-client privilege and executive privilege. if you want know how this could possibly happen to a former president, all you have to do is look at the language used in the warrant. it was specifically overly broad. it gave the feds the power to rifle through every inch of the mansion, trump's safe, the master bedroom. even melania's clothes. despite knowing exactly where the documents were located. this wasn't by the book. he said so himself. >> the department does not take such decision lightly. where possible, it is standard practice to seek less intriewfn means as alternative to a search and to narrowly scope any search that is undertaken. >> sean: so in the eyes of the doj trump is below the law. he says it's standard practice to be less intrusive. there is nothing more intrusive than having 30 agents in your home for nine hours. it obviously wasn't narrow in scope. they turned his mansion upside

down. raided his wife's closet this was calculated. they were looking for, quote: fruits of a crime? that gives the fbi access to anything and everything in trump's home. who have never had a drink of alcohol. he has never smoked a cigarette and he has never been convicted of a crime. but to the democrats and the doj, trump is chapo. so they threw out the rule book. this isn't the first time. it's a systemic takedown that's been going on since trump came down the golden escalator. if you paid attention you have lost faith in the fbi. people part of the machine why to think everybody is getting the same treatment. do you remember form peter strzok former fbi agent told co-workers they could stop trumpy becoming president. he was part of the investigation that let clinton off the hook for the emails. and also worked for mueller on the phony russia collusion probe. he says the fbi is playing fair and square. >> absolutely the measure public should trust what the fbi is doing.

it's not that the fbi is targeting any one side or the other. what you see is the fbi going out on a day in and day out basis objectively investigating allegations of law. >> sean: and the media is covering for the fbi, too. they say if you call this raid unjust, you are putting fbi lives in danger. >> republicans in congress reacted to the news of the fbi search by rallying to donald trump's defense and attacking the fbi. >> this behavior is treasonous. >> these republicans and others are creating an environment of political violence. they are putting americans at risk not only fbi agents but any american or anybody, really, who is seen as the target of the far right. >> the noisiest voices on the right were calling for everything from the abolishment of the fbi to civil war. >> sean: that's not coming from the same people who spent the last decade covering for violent rioters, who burned down our cities every time there is an officer-involved shooting. they have told us all about the criminal justice system and how

it was systemic and broken. now that the highest levels of american law enforcement are targeting trump, all of a sudden the feds are the good guys? it's funny how quickly things change. they never cared about equal justice. they just want to see their political enemies taken down by any means necessary. kamala bailed out a reporter who went on to murder someone. but republicans are dangerous because they don't think a president's home should be raided over paperwork? we're going into unchartered territory here. when obama was president republicans had the congress we didn't subpoena him over every time we had a disagreement or he didn't work with us. there were norms and standards. those have been completely shattered. this is how super powers devolve into third world state and banana republics. republicans take back the house and senate in november. will they use the justice system as their weapon against the democrats? or will they clean house and restore our country back to normal and pride?

mike davis is the president of the article iii project and he joins me now. mike, you know, good to see you. i want to go to this issue of the warrant with you because merrick garland in a statement a few days ago. he said that there is a standard practice and they narrowly tailor warrants in scope. but now that we have seen the warrant, we see that this was basically anything under the sun. look for fruits of a crime and get any location piece of (. what say you about how the doj crafted the warrant? >> this was clearly a fishing expedition. you see in that warrant they were looking for four years of president trump's records as president. that shows that this is a fishing expedition. that is -- they are looking for presidential records under the presidential records act. that is not a -- there is not a criminal component to the presidential records act. that is a former presidents have routine disputes, disagreements, with the bureaucrats and national archives. this is the fact that they

sought a home warrant from a biased judge u.s. knowledge straight judge bruce rinehart down in west palm beach, florida, this is the same magistrate judge who just recused from president trump's lawsuit with hillary clinton six weeks ago. same judge in 2017 facebook post where he personally characterized president trump's character. if he thought he was too biased to decide trump's case against hillary clinton six weeks ago how did that judicial bias go away in six weeks? the fact that they went to this home raid is so unprecedented. so unnecessary and so unlawful. >> sean: taking documents that are covered by executive privilege but more importantly attorney-client privilege is outrageous. i want to get your take on this. why on earth would they take his passport? do they really think he is a flight risk and leave the country on trump force 1. >> is he going to escape from his secret service entourage and

like get on don jr.'s plane and go somewhere? this is ridiculous. what we have seen with this raid it, is a pretext. it is a political charade. they are just trying to get trump here. >> sean: i think a lot of americans want to know how do we deal with the fbi and doj? we want law enforcement to keep us safe. but when you see law enforcement becoming this political, you have to rein n somehow. do you separate, break up the doj and the fbi? do you just do massive oversight? do you fire people bring people in? get rid of their union? what do we have to do to clean this massive mess up and make sure that the justice in those departments are blind? >> i think it's very important that republicans show up this november and vote. we need a check in the house and the senate. and my former boss, senator chuck grassley will become the senate judiciary chairman again if republicans win back the senate. and he will do -- he is the king of oversight. he has been for 40 years. and he has long been suspicious

of the fbi going back decades to ruby ridge. i think he is ready to clean house inside the fbi. >> sean: you know, mike, president trump earlier today said i want to help bring the temperature down. he wants to do it. he was very presidential of him to say that from my vantage point, the only way you bring the temperature down is to get transparency from the department of justice and they have now are fighting to stop the affidavit from being released. that could bring the temperature down. whether they just admit they are an arm of the democratic party. at least be honest with us, that could bring the temperature down. or joe biden came out and said you know what? this is wrong to go after a former president. i'm going stand with you donald trump and all of us are going to investigate the department of justice and the fbi. those three things, i think, would bring the temperature down, what say you? >> yeah. i mean, just with this affidavit, they have been illegally selectively, leaking grand jury material. there was a "newsweek" piece earlier, several days ago where they said that the grand jury

social media giants they have a direct pipeline to the white house. ron klain or season rice tell twitter to jump and twitter asks how high. how do we know? look no further than what happened to former "new york times" reporter alex baron stone. his accounts were pulled multiple times for sharing covid misinformation and now we know that the white house had a hand in his online ouster. last week baron stone released information between white house aides and twitter staffers outkick. they wanted to know employee one wrote to another describe a recent meeting with senior adviser to president biden's covid response team. andy suggested they had seen data visualization that had shown he was the epicenter of disinformation that radiated outward to the persuadable public. twitter deplatformed him. twitter claims it doesn't take orders from the biden administration.

now that is disinformation. and now with political midterm elections less than three months away, how can we be so sure that joe biden won't force twitter to do his bidding all over again. dana loesch is a nationally syndicated radio host and she joins knee now. dana, good to see you. >> good to see you, sean. >> conservatives that these little woke snowflakes in san francisco working at the twitter headquarters can determine what is truthful and what isn't truthful? >> no, sean, i don't think anybody can do. truth isn't truth anymore. truth is whatever your ideology dictates it whatever your ideology is that's what truth is. if you say something that might be based in science or biology and that rubs the popular ideology or whatever ideology runs that platform, you could very well banned or suppressed or censored or shadow banned as

i am on social media and some millions of other people. i was one of the whom was suspended because i shared the "new york post" story on the hunter biden laptop story there was nothing in there that was not factual there was nothing in there that was a lie or violated twitter's terms of service yet, it didn't matter because i was wrong think. i was wrong ideology. it's so incredibly orwellian but, yet, that's what this is all about. truth isn't truth anymore. these people who control these platforms, when they work with the federal government, and we know they do because, sean, as you just said, jen psaki has talked about this from the podium when she was having a white house press briefing. they have discussed this. they have talked with these social media companies and there have been also according to project veritas and others whistleblower information where you see these private conversations of these insiders and they talk about who they are going to target next and based on what ideology. that doesn't even violate twitter's stated termination of service. it's also ridiculous and incows sis tently applied.

social media companies, sean, put themselves in this position when they stop acting as facilitators of conversation and they decided to appoint themselves as these digital bouncers of national dialogue. and now we are in this particular position where they are acting as agents of state. >> sean: they are public companies. the argument goes they can do whatever they want. the problem dana is that the white house is bound by the first amendment. they have to support free speech. in order to get around that they go to twit tore say we can't censor speech twitter but if we go to you we can have you censor speech for us and you can shut down the speech and the reach of conservatives who are saying things that we disagree with. exactly. that's the big issue. when you are asking as agent of state carrying out the edict of the federal government that brings into question censorship. i know these are privately owned companies. i also understand that these privately owned companies who act as really editors and

publishing houses in a way, they don't have to abide by the same rules the state of "washington post" even though they make and generate headlines. they don't have to abide by the same rules as fox news even though they share information that's widely cited and trusted as news one way or the other and trustworthy. so it brings up a lot of questions. no, to your point, i don't trust these entities at all. we have seen -- i mean, sean, you have been shadowed banned i'm sure so many people watching this program have been. it's really unfortunate. i think it shows they are absolutely terrified of ideas. when you drive out opposition from the marketplace of ideas. that you will says is that -- that just is a testament to your weakness, not your strength. >> sean: they can't compete in the arena of ideas. i'm going to make one point here which is that if these social media companies actually help democrats, and these races, that's campaign contribution from a corporation to the democrat party or to the democrat candidate, which is illegal and if we had a department of justice and an fbi, that would actually look at that time it, probably file

have seen, and i think what have you right now is the biden administration finally -- people realizing that it should be held to account for dropping the china initiative, for example, which was meant to deal with chinese espionage on campuses. this is all across the board. and, look, any think tank in d.c. i have worked at think tanks. people make the case to you. we need modern figures from the chinese communist party to be engaging with us. we need to talk to them. it's not as simple as just we are going to block them all out, right? what is their influence? are you aware of it? did you even know you were talking to a member as it seems here was the case? they didn't know they were talking to members of the chinese communist party. that's where you see the tentacles of communist china stretching further and deeper into our institutions that people understand. i think the biden administration is asleep at the wheel on this and also, perhaps, doesn't want to be awake because of some of the issues that you raised. >> sean: you mentioned members of congress using think tanks. i was a member of congress for

nine years. you are right. we have small staffs. our budgets are small and we are dealing with a massive government and important legislation. so oftentimes we look to think tanks to say hey, could you help me out? could you help research, give me some ideas? every single member does it if you are partnering and looking to a think tank that's actually taking money from the ccp the chinese communist party and you don't know it, the chinese government, the communists have a pathway through the at this tank right into congress. how do members know where the idea comes from the think tank, from my perspective, liberals and not from the commerce party. >> elites in this country for decades have been fund 'mentally wrong what would happen with china. also wrong in a way that benefited them. they believed if we made china belty. if we turned a blind eye to all the trade practices and cheating they were engaged in until president trump came along, then everything would get better. more liberalization and things

would improve. what we have seen burrowed further and deeper into our institutions than before. think tanks is the beginning of it they bend the nikon distantly to china and the democrat party, i think, is unwilling to view china as the threat that it truly is. and it's much more concerned about holding january 6th hearings and lecturing us about the threat to national security from donald trump as we have seen this is something until we meet the challenge there will be continued effort by the chinese and successful one to steal our most sensitive information in technology but push our policy in ways that benefit them and not just by writing million dollars checks to hunter biden for being an adviser. what is he advising people on, sean? that's what i want to know. >> sean: cocaine usage, beer bong. >> videos. a whole bunch of talents. >> sean: where to get seedy characters in l.a. i have got to go in a second. when you have this elite capture and businesses and universities and think tanks, you know, the

elites that are selling americans out. selling out the average american, so they get rich off of china, it's outrageous. we use to have had have leaders in this country that wore american lapel pins. they would never sell their country out. they would never allow themselves to be taken for money for a foreign entity. too great an american. you see it happening every single day. let everybody in on a little secret. a lot of democrats in this country see the way that china is run and say if only we could be in charge, that way here. whether it's the way they handle covid, the state command and control economy effectively authoritarian capitalism which is what china does. don't look at this and say to themselves, wow, if we could call all the shots, we could build trains, roadways, railways, everything just as fast. we could do all the sorts of solar energy and green knee deal projects we want buck sexton

down. this morning 200 crossing illegally in the elements. it didn't stop anything. this was predominantly single adults from venezuela, cuba, nicaragua turning themselves into border patrol. take a look at what we saw yesterday. look at this drone video. we saw more than 500 people cross in a single one hour span. that includes this group you are looking at of 300 people. again, predominantly single adults. they are coming in from all around the world. central and south america. some from asia. some from africa. you will see many of them dressed very well waiting with their smart phones for border patrol to process them. then you will see some of them even walked out to a nearby highway, almost getting on the road before texas dps troopers stopped them. then take a look at this third piece of video. two more groups we saw yesterday, totaling more than 200 migrants again, almost all of them single adults. we are no longer seeing those mass family units like we saw last summer. just to put it in perspective. there have now been more than

400,000 illegal crossings here in the del rio sector just since october. that's up double from the same time last year. texas congressman tony gonzales represents this area. i spoke to him yesterday. he just got back from a trip to the northern triangle countries. here's what he had to say. >> i recently visited guatemala and i sat down with the president there. and i asked him hey, what would it take in order for you to take back more guatemalans that do not qualify for asylum due repatriatation. his answer is this all it would take is a phone call from the president of the united states. biden has failed to even call these leaders from northern triangle. i set with the foreign minister el salvador she told me they have never spoken with the biden administration. >> sean, what the congressman said there is quite remarkable. remember, the biden administration halls claimed they are working with these northern triangle countries to solve the route the root causes. the leadership of two of those
