>> i understand what texas went through with the migrant situation and some things have got to change. and the city of new york we are going to get clobbered financially and taxpayers are going to have to foot the bill. don't know if the government is going to step in. >> laura: thank you for alerting us to what you are dealing with personally and we appreciate it. that is it for us tonight. >> welcome to a special edition of "jesse watters primetime." i am pete we start with a fox news alert and it is a big one. here we go again it is looking like the fourth indictment is coming down the pipe for donald trump. get the orange cones and it appears that this can happen at any moment. according to the atlantic journal minutes ago they told

reporters to make maintain and ignore house for another hour. if you're reading the tea leaves it seems like we will have major news within the next couple of minutes, did not go anywhere. if you're keeping track at home that is for indictments and four months. this time it is coming out of georgia and it is over the 2020 election. democrats are the only ones allowed to contest elections. today, earlier, hours ago, mysteriously a list of charges against trump appeared on the fulton county, georgia, website, and then date vanished. according to lawyers. they were not supposed to be public and the grand jury did not even vote yet we are told so how did the whole world to get to see them. did a poor i.t. guy get trigger-happy? we will have to wait long to find out.

39 charges were listed. and one of them described as, "serious felony," it was a racketeering law one that is used against gang beggars and mob bosses. they were perfectly crafted to be state-level charges, and so they say federal pardons will not apply. we know what they are after. all they want is orange man wearing orange, that is it. the fulton county courthouse released a statement quickly saying, "the office of fulton county court and superior has learned of a fictitious document that has been circulated online and reported by various media outlets." there been no documents filed today regarding such all members of the media should be reminded that the documents that do not bear official case numbers, filing date, and name of the

court and concert are not considered official filings and should not be treated as such. trumps lawyers responded quickly saying that this district office has once again shunned it have no respect for the grand jury process. not a simple emaciated mistake. a post indictment should be only in the hands of district attorney office. it somehow made its way to the clerk's office and was assigned a case number and a judge before the grand jury even deliberated. this is emblematic of the violations that have played them at plate this case during it's very inception. we are waiting to see what the grand jury cooks up, but the case, and we're not going to have to wait long. just moments. what we are interested in tonight is a pattern that we have noticed, and maybe you have noticed it too. every time, and what we mean

every time there is a bombshell about hunter there is immediate news about another trump indictment. wiping out all coverage about the bidens. on friday we learned about a special counsel appointed to investigate hunter biden, and the next day we hear it that trump is going to be indicted in georgia. july 31st hunter's business partner testifies, and the next day trump is indicted over generated six. june 8, fbi document says that joe biden took a bribe from a ukrainian executive. next day trump is indicted. march 17th, on providing admits that the laptop is his. march 18th, the next day, we find out that trump's going to be indicted in new york by alvin bragg. you see how this works?

weekend biden retreats for some sun. march 18th, new york indictment is revealed and that same day but i goes for vacation. the beaches in delaware are beautiful and march. august 1st, trump gets indicted over january 6, biden is going for a week and just as we can after we found out about georgia biden is back at the beach. joe's handlers stay came behind on the sand to shuffle around so depressed cannot get to him, and went back in d.c. he takes the long way back to the oval so nobody can ask them questions. he is trying to commence a country that he has nothing to do with any of this. >> that is what the president believes, he believes that this white house is not going to politicize the department of justice. >> pete: totally independent. president has no idea that the guy he appointed his doing, never has. he found out about his son being

investigated and his biggest political opponents being arrested and the news, and just like us. a regular joe. no politics at play. i ignore that they were getting ready to drag him to testify about the biden ats not anymore. >> to go before congress and to state transparency? >> up to the department of justice. >> pete: you think the bidens doj is going to let him testify? not a chance. if he does he will be allowed to say nothing. it is an ongoing investigation, and repeat 400 times. weiss has been investigating the bidens for five years, and he only found a tax charge? "new york post" found a lot more after cracking up the laptop for 10 minutes. his lawyers said he will not be seeing anything new, no new

evidence. >> it there is no new evidence to be found, some of these transactions are years old. people in the grand jury, that at that been provided to them, they don't know the possibilities with this investigation. >> pete: same guy, no new information. special counsel is compromised. here is the irs whistle-blower who is largely responsible. >> he is not independent. we have provided multiple pieces of evidence to show that he has provided treatment, they have stopped investigation steps, and all under weiss, so he's not going to stymie the investigation steps back i don't think that is likely to occur. >> pete: the reason why there a special prosecutor is because of these whistle-blowers, and now they're saying that the whole thing is going to be a sham. democrats are never going to admit that this whole thing reeks because they're getting

here in d.c. >> pete: let's turn to lindsey graham who is a member of the judiciary committee, and thank you for being here. i want to get the overall reaction about the news -- >> [laughs] >> pete: in just minutes the grand jury is going to vote to indict. >> i know it is georgia, but usually do not assign a judge and get a number until the grand jury actually votes. you have the trial after the fact, this is crazy stuff. the statements that you heard from these liberal analysts make me sick to my stomach. no american and the country would get a bill like hunter biden. and here on national television, i don't believe for one moment that there was an ongoing investigation, the version once completed after all of the financial crimes that are out

there and said there is nothing left to investigate if the diversion agreement on the gun charge was implemented. defense attorney said that i will never take my client and to court and plead guilty if i thought they were more charges pending. nobody would do that. when they told the judge that there is an ongoing investigation, that was to cover their ass because the judge figure out that this was a sweetheart deal. it was a abusive power and the weiss team needs to be replaced, and i have zero confidence that they are actually going to impartially investigate this case. >> pete: help me to connect the dots. you have been in washington and you have seen investigations and how common is it that evidence comes out the next day, next day, time and time again? >> your monologue you should have just print and send it out. it is obvious that the system when it comes to trump, there

are no rules. they misled the court, the russian hoax stuff, it got rebuked by the fisa court, and the attorney for the fbi was charged and convicted of altering to get trump and every time something comes up about hunter biden they sweep it under the rug. we looked at this for five years and all of the felony charges were allowed to lapse because the statute of limitation and a charge the guy with misdemeanor, tax invasion, and still there is a gun charge, and here's what passes me off. that way that they wrote this is that if he completes the program on the gun charge then all of the things that did "new york post" and the house has found about the shady deals with foreign governments will all go away. it was head and ended agreement and the judge stumbled on it. the fix was in. there were going to give hunter biden the deal of a lifetime and

the man in jail. they are trying to take donald trump down and setting a bad presidents and what i fear is that you are changing the way the game is played in america and there is no going back. we are in for a very hard time if this becomes the norm. >> pete: thank you for your time tonight. let's go outside the courthouse as we await news from the fulton county grand jury. national correspondent is in atlanta with more. matt? >> if an indictment does come down tonight we are told that the process is that the judge is going to ultimately handed to a bailiff, bailiff will take it to a clerk's office where it will be manually entered into the public system here and georgia. at that point we will get much more information about any pending indictments. it was a steady stream of activity outside of this courthouse indicating that a grand jury was staying busy throughout the day. four different witnesses who

spotted, we spotted going into or leaving this courthouse today. jeff duncan the former republican for georgia saying that this is a chance to form any republican party, he called it glp 2.0. we asked him how his testimony might impact donald trump's campaign, but he did not answer that question. a former democratic that -- testified today at writing in part, "nobody is above the law." and previously confirmed that they were subpoenaed also testified today. grand jury is staying busy, and right now it is 8:18 local time and we have been getting updates from the judge saying guys asking everybody to please stay as late as possible and that we are getting this late in the evening anticipation is growing for any potential indictment against a former president of the united states. fourth indictment and we will be here through the evening and we

will keep you updated pete. >> pete: you mention a flurry of activity and you have any sense about why they sped it up? if they had a timeline why they felt the need to move more quickly? >> pete, we have no idea what is going on inside of the courthouse. grand juries are are very private and secretive matters. we are outside and seeing some of these witnesses, and an out. there are some reporting earlier today and there were images circulating online adapter to show that donald trump may be indicted for the charges against him, but this evening the fulton county court clerk is addressing those images and saying that they are fictitious. if you look at them there is a lot of information to say that there might be something, something that we are trying to report or lead into throughout the day, perhaps that might have played a something and to the timeline today what does document surfacing online. we do not know, pete at the mercy of the judge and his grand jury tonight.

compared to other indictments. >> you can have an arraignment where president trump possibly goes down to atlanta to have the charges read to him. this is the third indictment, and this is unprecedented. we never had a former president indicted in our nation's history. we never had a leading presidential candidate and i did and nation's history, but democrats are doing this, and they are driven by joe biden, merrick garland, and the biden justice department are waging warfare against president trump. he can go down to atlanta to face the charges. i will say this, if you look at the polling all of this is going to do is guarantee that president trump is back in the white house after november 7th 2024 because the american people are not going to let democrat prosecutors, democrat judges, and democrat juries, and democrat hellholes pick our next president. american people get to pick the

counsel of the investigator on this nominated by merrick garland, the guy who made the dash it is ridiculous. look at what is happening and atlanta, and what happened with jack smith, trying to cover whatever you think you can because you don't have anything, it is one of the things they claimed. people are losing faith in institution, and particularly our justice system, especially due process which is what our country is founded upon when they see stuff like this cared for instance, you mentioned the documents earlier that came out, and i was on air at doing my radio show when i saw these documents and we were trying to run them down, and it seemed pretty legit. judge was assigned, case number, all of that stuff, they had to resend it, everybody else was speculating that it was real. it is weird that you come out with this indictment before the grand jury can actually vote on, voting on charges. i'm not an attorney, but i am informed american citizen's i know how court proceedings work, and noted order of things, and

it seems pretty backward how that will happen this afternoon it. maybe you ask your previous guess, what is the rush? the rushes to cover their backside. maybe they are trying to make up for their mistakes and get out there and get ahead of this. i will tell you this, it is not turning people against trump, where it is doing is debt, people who may not even support trump and the primary or election out all our stopping and they're taking inventory of all this and are digging, we wait we remember happened with the fbi doj with people who spoke up at school board meetings, we remember what happened with the federal firearms licenses, and obvious individuals, to go over it is catalog of situations in their mind, pete, where it seems like you weaponize government goal over and after individuals over ideology. this does not look any different. government has not made their case. >> pete: no doubt. the overarching premise of this case and atlanta is disputing

the outcome of the 2020 ele election. i'm not that old, but i'm old enough to remember plenty of democrats disputing the outcomes of elections and then that tape seems to disappear. ultimately, another example of if it is donald trump that we have got to throw the book at him. >> i want to have a little notation if i can because what democrats did and previous elections that we are all odd enough to remember the whole hanging chad thing, old halloween costume if i remember it correctly. if you remember the difference and the democrats are saying that the entire election was a fraud, et cetera. a lot of republicans are saying that because we had a lock down, and this pandemic, this locked down, a lot of states immediately changed voting procedures, and some in contradiction of their state constitutions. you have for incident, signature verification that is dropped for

the convenience of voting. mail and, and georgette was one of the key states that did this. they voted to submit some of this. there are a lot of protections to uphold the integrity of a balance, and a lot of republicans are saying that we understand that states have a right to hold their own election, do all of that, constitution, we get it. also asking our assays to accept those results. can we make sure that everything was done by the book, and above board, a lot of the stuff was changed to accommodate voting during a lockdown, and a lot of were changed out procedure. that is what a lot of people are objecting to. the media also want to draft a narrative, pete, everything was stolen, public. this is what they were objecting to, they are saying, can we talk about the integrity of the vote. any democrat who says that none of that was brought into question by the changes that took place during lockdown is a liar, and they should not be so stupid that think that we all are the same, stupid enough to buy into that.

>> pete: there some some tension with the locals that want to give in and deliver aid and their friends, and the police that they are trying to keep people out of the disaster area. cops are going to require a placard to even enter the part of west maui. dogs are going through the rubble and sniffing through that five square-mile area. because of the fire's intensity rescue teams may not be able to account for all of those who are missing an f requested that anyone who thinks that they lost a relative to provide a dna swab for those who may have been lost in the fire. >> when we pick up the remains and they fall apart, and so when you have 200 people running from the sea yesterday, and some of you, that is what you're stepping on.

>> pete: a lot of second-guessing. why did utilities cut off the power windows wins and the power pole started coming down, why did the states not activate that emergency alert system to let people know and give them time to actually get out. we will probably get those answers from them. >> pete: so many questions, and so many prayers are needed. william, thank you so much. let's now turn it over to someone who knows firsthand what the islands are going through. a former hawaiian congressmen and fox news contributor tulsi gabbard joints is now. thank you for being here under such tough terms, and i can see behind you. it described the scene as hawaii wakes up to the next day and what to do it about it. >> there have been a lot of coverage about what has been happening to the community. the community surrounding on

west maui. the suffering that they have gone through and continuing to struggle for after a few days after this disaster occurred. where i am now is a different part of the island of maui, it is a community and this also, community has experienced the devastation of the brushfires. there are a couple of homes on a small rural street that have been completely destroyed, brushfires ripping through many of these neighborhoods just as they did through lahaina. important to convey the sense of urgency needed for direct services and response coming from the county, state, federal government, and only for the crisis right now, but also recognizing the steps that are necessary to be taken for this community has a start to look on what is rebuilding looking like.

>> pete: i want to get that to a moment the idea of rebuilding, but first, to rescue operation, and what is going on going and what we know that will be downs now. give us a sense of the human toll of who we are looking for and how big the scope is. >> there has been a very small percentage of the area that has been devastated where the recovery of remains, those who have perished has occurred, that recovery effort is continuing, and it will continue on for days. near 100 identified deaths, and that number is expected to continue to rise, fortunately. a lot of community that are surrounding the lahaina town that are struggling with lack of communication, neighbors are helping neighbors with food and water, unfortunately a lot of communities including the one here and it kula right now are

having security problems. looters who are taking advantage of the situation to go and break into homes, and we don't know where these people are coming from, but things like it, and you know it is very well that the deterrent effect of something like a presence control with the national guard work of the police department is something that these can skin you need them communities need and are importantly not seeing. basic communication and they don't have a cell signal, don't have wi-fi available, and a county state and federal officials need to be going out to these communities and finding them where they are to tell them what is going on and to let them know that resources are available. a huge amount of resources that are available from the department of defense, military facilities that exist within the state of hawaii and are chomping at the bit to provide the disaster relief here like they do in other countries all of the time, and that can only happen when the state and fema says, okay, green light, go. >> pete: rail quake, tulsi,

and there is no need at this time to play the blame game, but what you need leadership? where do they need leadership to take hold of this and say, we are going to address the need of the people? >> starts with the county working with the state and the federal government. outpouring of support from this community has been incredible. people have lost their homes and they are stepping up to help their neighbors and give whatever they have. a small island that is just a short boat ride away, and they don't have much, but they are filing buds of supplies and bringing them over to west maui. the area of focus right now you need to be at the response coming from the county, state, and federal government, and only today immediate recovery of remains and lahaina town, but related to communities like this one that are suffering. if there is a disconnect, the resources are available, the leadership is necessary from the

happening, what should we expect? >> a looks to me like the process of this grand jury is going much faster than most of us have fought. and georgia grand jury indictments can take place and literally had three or 4 minutes in a routine case. this one has been taking a little bit longer. she has been bringing in the fulton county district attorney fani willis. she's bringing actual witnesses alive to the grand jury to tell what they have to say, and if the documents was released earlier today gives us any thing to expect, ricoh, and racketeering is going to be the centerpiece of this indictment. look like they went out of d.c. because it is focused on the efforts of donald trump and probably others who are overturning the results of the 2020 election. i expect that it will be donald trump, but i also expect some other big names that will probably be indicted by this grand jury. may be it on a separate

indictment, maybe tomorrow, but this particular indictment is eminent. the judge will be receiving the document in open court is staying open late. the courthouse is not this busy usually, and i do believed it is because a grand jury is voting and we shall hear something very soon. >> pete: i want to get to those charges that were mistakenly put on the website says fulton county and reporters were reporting on. i don't know if you can see this bond the upper right-hand corner of the screen there is a live shot inside of the courthouse and what will we be looking at? press waiting to get an announcement from the judge based on devoting of the grand jury, what are viewers looking at? >> what happens is that after the grand jury returns a true bill of indictment than the grand jury bailiff takes custody of the documents and has to present it to the presiding judge, and this case it is judge robert mcburney.

he does not usually do that unless it is a reason to, that is telling. if the grand jury does not reach a conclusion tonight, presumably, they will return tomorrow. if they return a bill of indictment and the courthouse is closed then the bailiff is going to have to take custody of that document into the courthouse reopens. there are media and every branch of the courthouse, courtroom, the halls, the document itself when it is return in open court we are told that judge mcburney is going to allow that to be televised. we will see video, and have pictures of it, then there is going to be pressed or 40 district attorney, hold the press and what we don't know whether the judge is going to arrest in the indictment. he has the option, or has the option to set a court date for the former president to appear and probably something similar to what we saw happen in manhattan with d.a. bragg.
