tonight. the bogus bloodbath story. that's the focus of tonight's angle. all right, aside from the democrat machine raking in big money for the campaign, joe biden has had a rather lousy month. as much as the press tried to sell biden's state of the yell speech, it flopped. didn't give him any bump in the polls but it did remind everyone of their old uncle's reaction whenever someone tried to turn down the volume when he was watching jeopardy. and this is the "new york times." democrat voter registration is plummeting as well. virtually every group of voters under 70 has become less likely to register as democrats compared to republicans since 2019. and even biden's new choice in foot wear tells a sad tale. >> are those sneakers? yep. they are so-called lifestyle sneakers made by hoka. >> these are called the hoka transport and as you can see

they have tried to destroy donald trump through lawfare and indictments are not working. they tried to get him off the ballot. they tried to bankrupt him and ruin him physically and financially. that hasn't worked. they look at the issues that are important to all of us, laura, the border, crime, inflation, what happened in afghanistan. two wars that broke out on the biden watch. energy, and they can't run on any of them because they have been ungodly disaster. then they look at the candidate themselves, and he is not able to function as a normal 21st century candidate. they look at the vice president. so this frustration builds up. and they just lash out and they -- they make it worse. they are like an addict that don't understand that they don't understand that the fixation is destroying them and destroying their popularity and their team and message. they can't stop. they are so obsessed. i have never seen anything like this before. >> laura: victor, someone who was pretty well respected for many, many years, michael belch

>> laura: supreme court heard arguments today challenging the government's work with social media companies to prevent so-called disinformation during the covid pandemic. plaintiffs from missouri and louisiana allege that dozens of federal agencies coerced social media platforms to censor post on covid restrictions. the government argued that this wasn't coercion. these were necessary public health directives. >> in the context of an effort to get americans vaccinated during a once in a lifetime pandemic. i really think that piece of conduct doesn't change the first amendment principles but relevant to how they apply here. i think it's important to understand that at this time this was a time when thousands of americans will still dying

every week and there was a hope that getting everyone vaccinated could stop the pandemic and there was s a concern that americans were getting their news about the vaccine from these platforms and the platforms were promoting not just bad information. >> laura: justices alito and thomas didn't seem to buy the government's reasoning but they were in the distinct minority. joining me now is missouri senator eric schmitt who filed the original lawsuit while serving as missouri's a.g. also with me from the original medicine cabinet dr. jay bet char i can't, one of the original plaintiffs on the case the line into coercion was not crossed because they never threatened anyone. what's your response to that? >> well, the power that they we would and i think what's important here the context, laura, these big tech companies have section 230 protection. that was clearly at play as they were telling them what to take down. they created special censorship portals, they had weekly

meetings. so the government was very interested. and you heard in that clip. there is no pandemic exception in the constitution. people have a right to speak their minds. and the government can't outsource censorship like they did here to big tech giants, which is exactly what happened. whether it was the lab leak, mask efficacy issues, origins of covid. all those things the government was very interested in wielding a lot of power, threats of investigation, section 230 elections, all that stuff on the line with the full force of government if they didn't do their bidding and censor speech. >> laura: dr. bhattacharya, you and i, a few others stop this madness and masks on children. obvious from the italian data that children were not going to be the main -- you know, not even close to being really really affected by. this yeah, there was data from all over europe. it was very, very clear. that's the main point, laura that i want to emphasize.

it was the government that was the primary source of misinformation during the pandemic. the first amendment would have protected us against the government misinformation had it been operative during the pandemic. the argument of the supreme court today was so frustrating to hear because that -- it was if the supreme court justices lived through a different pandemic where the government didn't say that mask stopped the spread of the virus. the government didn't say the beings masks stop from you government and no such thing as immunity. >> laura: mitigation measures over medical history did not work i mean, sadly. i mean there is another piece, i think you might have sent me on email. those mitigation measures as well as intentioned as some of them may have been, they traditionally don't work with this type of virus. that it sadly has to go through a population and sadly people were vulnerable are going to be worse hit and that's exactly what happened. >> yeah. and that's the problem when you put the quote, unquote, the

experts or the science. we took anthony fauci's deposition. and they were very head-strong about what their point of view is. it doesn't give them the right to censor other americans, which is what was happening here. you combat speech you don't agree with more speech not censoring speech. this played out, look, even those arguments they talked about this being a once in a lifetime kind of thing. that's what every dictator or tyrant does, right? you have an emergency, you consolidate power, y exercise that power in ways people never thought they would, and so here we are now with this very important case, sitting before the supreme court. what is protected in the virtual town square? certainly people have a right to express dissent. the government doesn't get to crush dissent because they think we are in some sort of an emergency. they just don't get to do that and they don't get to use these big tech giants to do their bidding for them. >> laura: we are afraid this going to keep going in this election. i would say dr. bhattacharya, that was exactly the time you needed robust exchange of ideas and not one person -- all people worried about dictatorial moves

and we talked about in the first block. what was more dictatorial than what they were doing to our children? >> i mean, i think that is really the key point, laura, which i entirely agree with. the first amendment is essential to the health of our country. it's not just a civil right. it's a basic tool of public health. you have to allow dissent or else the government -- who are much more dangerous than somebody random person posting on twitter can go unchecked. they can close schools. they can close your churches they can close businesses. they can tell you things. >> laura: they took our churches away. how many of our constitutional rights were abridged for long periods of time? i mean, i still can't believe we actually went through all of this. i can't believe what has happened to our children. senator schmitd dr. bhattacharya, thank you both so much. all right. the relationship between obama and biden. what is it, really, behind closed doors? what was it over time?

president biden doesn't even speak frequently with barack obama but behind closed doors, he does talk about him a lot. and while obama may have moved out of the white house, he is apparently living rent-free in joe biden's head. obama would be jealous, biden sometimes says, when speaking about a perceived accomplishment and at times biden's competitiveness with obama has affected how he governs. biden was adamant about withdrawing troops from afghanistan in 2021 in part because he felt vindicated that obama should have followed his own advice in 2009 to largely withdraw them then. of course chaos ensued. 13 american marines dead and service personnel because of joe biden's decision to craft policy based old grudges and the open wounds of a scorned exbff. the white house denies this reporting. if biden apparently stews over his old pal's obama's content to keep his distance and let his old staff run the white house while he stays busy with more

and be very undetected by border patrol or law enforcement and again gain access into the city or get to the highway and get a car be transferred into the interior from there. >> is there any effort to put some type of an obstruction in front of these tunnels so when water needs to go through it can but people can't go through? >> there's some of that at the very end of the tunnel system, kind of where the rio meets but most of it as you can see are walking through it. i'm almost 6 feet tall and stand easily. it's very wide in some areas as well. we saw border patrol sort of navigating outside they are patrolling the area for them to completely block did maybe there is a city ordinance of some variety. they don't. we saw tons of traffic people sleeping there. going back and forth and walking over the place including very small footprints indicate children. >> tell us about the caves that
