4:03 am
soul of the nation. the campaign has also cut a new digital ad leveraging former president trump's comment about the auto industry. if he is not elected it would be a bloodbath for the country. biden campaign says trump has spent years threatening political violence and praising dictators. trump's campaign responded no amount of gaslighting from the biden campaign can mask biden's bloodbath he has brought all across america from the disastrous afghanistan withdrawal, costing american lives, record number of illegals crossing 9 border. so this week we will see president biden out west engaging voters but also asking the white house when the president will field questions from reporters. >> when will the president hold another news conference so we can ask a question of him without having helicopter noise or jet noise in the background? >> i don't have anything to bring to you share. obviously the president, as you just -- as you just saying, the president takes questions pretty regularly, enjoys having engagement in all of you. i don't have a press conference to lay out for you at this time. >> is there talk of one?
4:04 am
>> i don't have anything for you. but, as i said, the president enjoys engaging with all of you on a regular basis answered will continue to do it. i think i have to go. >> we will see if we get helicopter noise questions next hour. in the meantime president biden held 33 news conferences, former president trump and obama held 57 and 68 at this point respectively. the president did speak yesterday to prime minister benjamin netanyahu of israel. according to the white house the president pushed for more aid into gaza and also warned about a major ground offensive, a potential major ground offensive by israeli forces in to rafah. the first time the two leaders have spoken in a month. back to you. >> steve: hey, rich, is the president going out west to essentially, you know, encourage the troops, stir up some interest in his campaign, or is this all about making money, fundraising? >> i think it's going to be a little bit of both. if you look at some of the stops here, of course, you have got the swing states in arizona and nevada. texas, democrats have been
4:05 am
talking about texas going blue for some time it hasn't quite happened. so the campaign does note he will be hitting a lot of the swing counties farther out west, but, as those texas stops are concerned, probably a little money. brian. >> lawrence: not going to win texas. >> lawrence: ticked off texas about the border. >> brian: trump at 48%. bush 41, 39%. jimmy carter 43%. is he at 38%. >> steve: not good. >> brian: behind the scenes he has blown up since january. how can my ratings be so low. how come, you know, people don't understand the things i have done? he also told him to punch up the speech and talk more about his glishments in the state of the union address. so, we keep hearing about his temper behind the scenes lawmps lawrence a lot of people lying about the president about the reality of america. paul krugman released a piece in the "new york times" yesterday.
4:06 am
>> brian: always so blend paul krugman. >> lawrence: why are americans still down on the economy? and essentially he says that things were so bad under donald trump, the economy wasn't really that good. that covid was so bad and everything. answered he just doesn't understand it and it just doesn't go with the numbers. and i'm sure this is what the commander-in-chief is reading every day. >> ainsley: also talking at the top of that about democrats twisting the words the bloodbath comment when he was talking about the auto industry. last night on show's show he did a montage. remember he was on yesterday teasing he was going to do this. he found 11 clips from msnbc and cnn of democrats and hosts using the word "bloodbath" when they were talking about a donald trump win in the past elections. they used the same word answered did the montage. i think you are going to use it during a segment. >> brian: common term in economics. in the stock market. it's a bloodbath down there on wall street. it's a common term it's a bloodbath here in the auto industry it's a bloodbath. then you have other people screaming into the television
4:07 am
you are an idiot if you didn't think there would be blood in the streets a war if i lose. >> ainsley: what was jake sullivan talking about with your son? >> steve: glad you asked. brian, you mentioned you alluded to this nbc report we quoted yesterday where apparently there was unreported meeting in the -- i think in the west wing, where the president was there with his aides and he was frustrated that he was lagging behind in the swing states. and he was yelling. and he was -- he was cussing. and a lot of it had to do with he is under water in those swing states because of the support for israel in the war with hamas. and so that is where peter doocy picked up a question with jake sullivan. >> ainsley: listen to peter's response. >> steve: at one point peter said excuse me? jake sullivan gave him kind of a crazy answer. just saying. >> peter: there is a report that when president biden was told his handling of the war between israel and hamas was starting to affect his poll numbers. the quote is he began to shout
4:08 am
and swear. so, when he does that, is he shouting and swearing about netanyahu or about hamas or about his poll numbers? >> this is the "when did you stop beating your spouse" question because i don't think he ever did that. >> peter: excuse me? >> you used that as the pressroom mills of your question when he does that. i have never seen him do that shout or swear in response to that so, from my perspective, that particular report is not correct. >> lawrence: so full of it. never looks peter into the eyes. to the point of the president losing his temper. we have seen him do it publicly. starting with peter doocy calling him an s.o.b. targeting people on the campaign trail saying that he would like to challenge them to a pushup contest. so he does it all the time. so to act like he doesn't do it in private, i just think is just being dishonest. >> ainsley: i love peter's response. >> lawrence: excuse me? >> ainsley: what? excuse me?
4:09 am
>> brian: r.f.k. i did not know over the weekend r.f.k. all the kennedys were invited except r.f.k. >> ainsley: they took pictures. >> brian: i guess he is not irish? >> ainsley: does that mean the family is voting for biden and not their own relative? >> brian: they are very upset is he running. >> steve: they are. >> ainsley: i'm going to quote taylor swift one time. bad blood. it works with the segue. >> brian: are you calling for blood in the streets? >> ainsley: is that a bloodbath? >> brian: what is going on, lawrence? >> lawrence: are you all trying to create a scandal? >> ainsley: sean should have put taylor swift singing that in montage. >> lawrence: donald trump has a week to pay $454 billion in a bond civil fraud case. >> ainsley: lawyers are firing back saying the judgment's full amount is a practical impossibility. a bond requirement of this enormous magnitude effectively
4:10 am
requiring cash reserves approaching or cash reserves approaching $1 billion is unprecedented for a private company in as new york state attorney general letitia james is threatening to seize trump's assets and sell them off to get the money. >> some facets to this story let's bring in fox news contributor g.w. university law professor jonathan turley. jonathan, i did not know anyone in my life to try to get $450 million bond. one thing i found out very few companies offer it. they end up to about 30. all 30 secretary of defense we can't do that unless you have a billion dollars to put up. we don't want collateral. we don't want things to put up. we don't want properties to put up. they're we are at impals. what are the options for the former president. >> this is obviously a situation where you don't have any good options, including getting the bond itself. remember, if you get the bond, you still lose considerable amount of money on the cost of
4:11 am
the bond. and this creates a sort of perverse incentive for judges like this one who comes up with this astronomical, in my view ridiculous level of. >> brian: in anybody's view. nobody thinks that number is good. >> right. but in order -- basically his position is in order to get any other judge to look at what i have done to you, you have got to come up with basically a half a billion dollars just to appeal. it's like a judge saying i'm going to take your house away but you can appeal my decision, you just have to sell your house in order to do it. it doesn't -- many people look at this as a type of almost mob justice. as, you know, the attorney general ran on bagging trump. she is now pledging to seize his property just because he can't come up with this bond. at some point the courts have got to step in and say, look. this is enough. you are requiring this astronomical bond just for this
4:12 am
guy to be able to get any other judge to look at this decision. >> steve: sure. jonathan, get in the way back machine because you just perfectly set it up. she ran on getting trump and here she is back when she was running before she tried to get trump. watch. >> no one is above the law! including the illegitimate president! [applause] >> and so i look forward -- i look forward to going into the office of attorney general every day suing him, defending your rights, and then going home. >> i say one name, trump. that should motivate you. [laughter] >> will you sue him for us? >> oh, we're definitely going to sue him we're going to be a real pain in the [bleep] he going to know my name personally. >> president trump cannot avoid justice in the great state of new york. >> steve: okay. so there she is. then you look at today's "wall street journal" and they are echoing something you have said and that is whatever is transgressions, jonathan, defendants are entitled to due
4:13 am
process, which includes the right to appeal. the appeal has not run its course. and it goes on. but, you have been talking about how he is not getting due process for months. >> right. look, you don't have to like donald trump to be appalled by what we're seeing. i can't imagine why any business in new york would want to continue to do business in new york, including these banks. could you imagine being the bank that gives this bond to trump whether you have got an attorney general who is just laying waste to the land. these banks don't want to get in the crosshairs as the next target of letitia james. keep in mind what you just played by james walls a campaign based on selective prosecution. selective prosecution anathema to the rule of law. she actually ran on that. she pledged that she would get trump without saying what she would get him on.
4:14 am
she just pledged i'll bag him for you. >> lawrence: jonathan, i hate to interrupt you. but you go to the crutch of the argument. what is the legal recourse for that? we just played the montage. said on the campaign trail made it very clear is there anything legally that can be done just on that? >> >> it's very hard to make out a case of selective prosecution. i filed a couple of motions like that against prosecutors. judges don't like it. they don't like getting into the motivations. but the threshold issue here is just a basic due process of requiring confiscatory bonds in order to just secure an appeal. and this could end up going beyond the new york system. they could appeal this all the way to the supreme court. on occasion the supreme court has intervened in state actions. for example, on punitive damages. and said at points damages could become so high they deny someone due process of law this is
4:15 am
falling into that extreme category in my view. i find it appalling. it shocks the conscience that you have to pony up this type of money just to get someone to look at what you believe and i believe is an excessive ruling by this judge. >> ainsley: um-huh. it's a lot of money. he has to come up with it by monday. that's in new york. let's go down to georgia where the lawyers for trump and 8 co-defendants. they filed an emergency appeal in the fani willis case. they are trying to disqualify her, again. and this is from trump's lead defense counsel. the notion notes that the court found that willis' actions created appearance of impropriety and odor of audacity that lingers in the case nonetheless refused to dismiss the case or disqualify her will they be able to disqualify her through this appeal or will this happen? >> >> well, usually the courts will prevail on this. but the question is whether the trial judge will give leave to
4:16 am
appeal to do an interlocutory appeal which is relatively rare that will further delay the case. you know, basically, willis has been playing game of chicken with these courts. she has refused to remove herself, as she should. and she succeeded. you know were the judge knew if he disqualified willis, he would likely have had to disqualify the entire office. and that's quite a cliff to go over. and so he blinked. and they are going to ask courts to look at this and say how is this coherent or consistent? you know, you indicated that wade, his answers were less than forthcoming. some people believe he committed perjury. but she adopted his answers. they testified largely in tandem. so, if he was saying something untrue. she was saying something untrue. but, more importantly. thattance of impropriety does not end with nathan wade. these two are joined on this appearance problem. so, we will see if he gives leave. if he gives leave, then this
4:17 am
thing is not going to see a courtroom for a trial before the election. >> brian: yeah, we will see. if i was going against somebody, i would like to maybe go against her already so damaged her credibility so destroyed and she does not seem as though she is great legal mind. >> that's the best situation for trump is that she is, indeed, carrying more luggage than amtrak and maybe that's what you want. >> steve: great line. >> brian: jimmy failla is going to use that a little bit later. thank you very much, jonathan turley. appreciate it. >> lawrence: also comedian. >> brian: when trump and the bond he is trying to get down to 100 million. filed a 5,000 page. they got five days to get back back to him. you don't think it's a huge hail merry to look at this and say is the goal to get him to appeal? we know he is not going anywhere. his things aren't depreach united states.
4:18 am
so, i think he has a got a shot. i think that somebody could be somewhat rational. >> ainsley: if she goes after his properties in new york do you think she will try for trump tower first? >> steve: that would be iconic. >> brian: go for it. but not in the best interest of the city. this is not the time to be buying commercial real estate. >> lawrence: other business people. that's why the governor, kathy hochul tried to clear things up and say this was just about donald trump. >> brian: sorry. don't think so. >> lawrence: not buying it. >> steve: unless suddenly out of nowhere the new york state supreme court or court of appeals rules, he's going to be on the hook for it on monday. >> brian: five days. >> steve: we keep you posted. carley joins us at 7:18 with some news. >> carley: i certainly do. we have brand new body camera footage that came in last time seen missing riley strain seen alive. he vanished 11 days ago after leaving luke bryan's nashville bar.
