for the bond. this morning he boasted about money he says on handwriting in part through hard work, talent and luck i currently have almost $5 hundred million in cash, a substantial amount of which i intended to use in my campaign for president. this is the judge who handed down a clr 454 million in the civil fraud case. ordered the trump organization on thursday to closely inform the court of its efforts to secure the bond. trump's lawyers have called securing the bond a practical impossibility because insurance companies won't underwrite it for the massive amount, or won't accept trump's real estate as collateral. real estate, which appears to be on the radar of new york attorney general leticia james. she registered the judgment in westchester county, new york, earlier this month. the area is home to two of trump's properties. it would allow her to secure a

lien against properties in the future. real estate development and former obama fundraiser told fox this case will turn businesses away from new york. >> this case amplifies that it is very difficult to do business in new york. if you happen to be a successful, wealthy entrepreneur, watch out. the government can be used to weaponize you especially if you get out of line and do something that the far left doesn't like. >> trump's monday deadline comes as the former president could reportedly receive a sizeable pay-out of his media company that owns truth social goes public. >> dana: thank you for following that for us. thank you so much. >> jacque: let's bring in shannon bream to break this down for us. shannon, obviously there are various efforts the former president is making. but the court could step in before then and try to change this in some way. are they allowed to consider the

court, the ripple effect across business in the state or former president's business or only allowed to look at the narrowness of this appeal? >> well, they can take in any number of factors in looking at this. what the trump team is arguing, a couple of things. they say listen, when you make a fine or penalty so excessive than even trying to appeal it is nearly impossible, you are completely violating the issue of due process which is the bedrock of the american legal foundations and society. so they have a number of arguments on that front. if that appeals court doesn't step in right away signals from the trump team they'll file lawsuits as well if james goes after physical properties there in new york. and as cb noted wrapping up her report there is the issue of truth social. if it goes public next week billions of dollars in the mix there. he shouldn't be able to sell stock for six months unless he gets a waiver from the shell company that would take it public.

if that happens, his financial picture turns around significantly potentially as soon as next week. >> jacque: will he be able to get a waiver? the shell company, i think, is connected with him, right? they wouldn't deny him that likely. >> that's the question. but yes, in media, outlets and reporting about that shell company it is described as friendly to the former president. if that's the case, you would assume they would give him the waiver well ahead of the six months he would otherwise have to wait. so you already see people out there online buzzing and talking about this. i don't care about this company but buy shares if i am a supporter of president trump. funnel more help for them. a great fundraiser. they are fundraising off the threat coming on monday. they are lagging when it comes to what the president has built up in his war chest. this is just another call for them to their base to step up and help. >> jacque: let's look at the numbers on that. trump has now in fundraising

$74.4 million. biden campaign has $155 million. the trump campaign is asking to designate some of the fundraising to these legal costs. what will that do to the former president's ability to build out campaign infrastructure? we're eight months out from the election. is it getting to be a dicey time to do that? >> are you tired of it yet? you and dana and every one of us covering it. it can be a long general election campaign. a lot of money these two camps have to spend. there is this new deal of joint fundraising venture that involves the rnc and path friendly to the former president and how to divide money. some goes to the legal costs before it goes to the rnc getting a cut. big fundraisers coming for both camps. obama and clinton will have a big fundraiser for president biden and vice president harris next week. after that in palm beach former

overwhelming texas national guard. one migrant has been charged with assault. governor abbott says they were able to regain control and redouble that wire barrier that sits between mexico and the u.s. border wall in the area. migrants were turned over to cbp and processed under title eight. brandon judd reacted. >> i have conducted numerous interviews with people that have crossed our borders illegally. when i've detained them. they have flat out told me they know that nothing is going to happen to me. these individuals do not fear our laws. >> cbp issues this statement. consequences to crossing the border illegally. cbp continues to enforce united states immigration laws, no one should believe the lies of smugglers, individuals and families without a legal basis to remain in the united states will be removed. our colleague aishah hosni got reaction from democratic

called for a cease-fire as soon as practicable. this continues a pattern as the biden administration starts to distance from netanyahu. >> jacque: we're watching the floor of the house of representatives where this morning they are set to take a vote on a $1.2 trillion spending package to avoid the government shutdown that would take effect at midnight tonight if it doesn't happen. the republicans have to pass this on suspension and need to get 2/three of the house to vote for it to go through. 290 votes. republicans have to put up at least 100. unclear if that can happen although it does have support of leadership. house waived the 72 hour rule they have to give members a period of time to look over this. we're on a deadline. still needs to go to the senate to fund the government and midnight is fast approaching. >> if you ban tiktok i will find you -- [laughter] >> dana: threats to lawmakers by

clay travis joins me now. this is from the lawyers for ohtani. in the course of responding to recent inquiries ohtani has been the victim of a massive theft and turning the matter over the authorities. how do you think they figured this out? >> well, this is a huge mess, first of all. if this is true and 4 1/2 million dollars were stolen from ohtani to allow gambling wagers to be placed in california, that's a massive, massive crime, right? not very often that a theft of this magnitude would occur. and so this individual, the translator, would be facing potentially years and years in prison for this activity. but remember there is also several other complicating factors here. i'm a little skeptical on this, dana, because the only way that shohei ohtani could be cleared

is if they say he had absolutely nothing to do with this and had no knowledge of these wagers being placed. there are obvious evidence aspects here that suggest that's probably not true or maybe unlikely. and also remember here is the big challenge, sports gambleling in california is still illegal. so that is a violation of california law. and if there was any suggestion at all, 4 1/2 million is a lot of wagers placed, if there was any suggestion at all that ohtani had been involved in these wagers and that baseball games were involved in any way, this would be a modern day pete rose scandal for major league baseball except far larger because ohtani just signed a $7 hundred million contract, ten years, with the l.a. dodgers. the biggest global star for baseball anywhere. there are a lot more details to come out here. what i'm skeptical about, there

is no way that this bookie in california would be giving 4 1/2 million dollars of credit to a translator who only made a few hundred thousand dollars a year. that guy would have never been able to pay back a gambling debt of this magnitude. the bookie must have believed that ohtani was involved in placing these wagers, otherwise allowing a debt of this magnitude to be wracked up doesn't make financial sense at the most baseline level. >> dana: i remember when he got the contract he was is subject of dana reads sports. one more story. the biden president, president biden has made the cover of "time" magazine on a bike and he is looking vigorous except the article is not great asking if the president is stuck in the mud and there is a headline is biden's campaign in trouble? will the turnaround plan work.

are trying to catch up? >> "new york times" discovers the obvious. they need to catch up and we need to help them catch up. summer school and other efforts. these kids are behind going into covid. covid accelerated that decline. and they are in decline after covid. so we need to do a lot of work to fix this. the one thing that did happen as a result of closing the schools was not that covid was stopped, it wasn't. but that learning and connection to the school, and emotional stability were all upset and went in the opposite direction. >> dana: we have seen chronic absenteeism. a school has students to miss 10% of school or more has continued. look at the math scores. the results from also "the new york times" analysis, how far

down those math scores have gone. in your experience, what kind of effort is needed or how quickly could a student catch up on something like math? >> math is harder, but you can catch up. it needs to be intense. that's why i mentioned extra hours in the school day and summer school and we need to get these kids up to par. remember, dropping in math, if you think about what the chinese are doing, this is a serious national security issue for the future. people worry about a lot of things in regard to the future and security but the readiness of our students to think and to analyze and to compute is a very important aspect of it. >> dana: want to ask you about this. news this week about a new fully digital s.a.t. test to get into college. apparently it adapts to what you

are able to do. this is a q and a. will i be disadvantaged if i get easier questions in the second module? the answer is you won't be disadvantaged but presented with questions taylored to your abilities or questions that are much too hard or too easy. what do you think? >> what the heck is going on? first the s.a.t. was banned. now it's brought back but brought back digitally but it's brought back in a way if you have trouble with the first half they will go easy in the second half. what does it mean? i will tell you one things it means. parents are confused and don't like what is going on in higher education, not sure what the expectations are. they do know what the cost is. the big picture here, dana, is that more and more parent and their children are thinking twice about going to college. what is the return on investment? for most students, the return on investment is not very good.

or like to distance himself from this idea? >> the white house has said look, they support any ideas that would help try to address the housing crisis. it's a problem they acknowledge exist but they aren't endorsing this specific policy, dana. it is unlikely that this policy would ultimately pass congress and become law. >> jacque: they tried the green new deal with other things before. how did they settle on this branding? >> that's a good question. the other green new deal, the og green new deal didn't work out or get too far. they are trying to tie part of the housing crisis to also the climate crisis saying that existing affordable housing right now also is bad for the climate and a lot of the energy efficiency is out of date and where the green new deal came into play for this. but again it is really unlikely if this is a realistic proposal that has any legs outside of this press conference.
