diller now posthumously promoted to detective first grade. diller was fatally shot on monday during what should have been a routine traffic stop the alleged gunman has a lengthy rap sheet for this show of solidarity followed a two date wake with a similar turn out to include a visit from former president donald trump. new york governor kathy hochul also went to the wake we are told diller's family member spoke with her about policy changes they would like to see. but there was an incident as she left. our colleague brian kilmeade report that is when a family member approached hochul said she was not one of their msnbc the governor said this. >> there is a lot of anger, understandably there is anger about how these individuals who commit crimes over and over our areback out on the streets agai. that is one of the reasons we've worked hard with the legislature last year to change the bail laws. so that the judges have more discretion and there's a lot of

jonathan diller's widow, stephanie, demanding change within a new york city's or new york's criminal justice system. what can change in the immediate to ease crime in new york? >> well, i have to focus on kathy hochul's remarks were to be generous she is being disingenuous at best. as a bully pulpit being the governor of new york. she knows the problems we have the bail reform laws that is a euphemism for legislative initiatives that really hamstrung the police and prosecutors here in n your stat. as the covenant she can simply say the legislature if you want my operation if you expect me too search anything going you and i are going to have to get in a room and hammer out some real reforms. i am sorry but she really has not done that. i know she's name checking some incremental changes that have been put in place relative to

primarily discovery laws which have not helped at all. can do those sorts of things in the real truth of the matter is the problem is in albany. the new york city council is certainly not friendly to the police. but if albany is where we need that changes kathy. arthel: in the meantime what could nypd do to curtail crime from a tactical perspective? and while we are at it, what can and should be done before this depletes officer morale and retention and recruitment? >> that is a very good question for you put your finger on something they're dealing with now. nypd, depending upon what week t is is down someplace and two and 3000 officers. they are surging at least 800 extra bodies into the subways. they're about to initiate congestion pricing costing $15

extra a day for people who drive into the city. until everyone is going to push into the subways for they want people on the subways as part of the green ended shift, et cetera. nypd is tactically trying to do with the can. the problem is, this is a very good case example. 800 officers, aside from not being enough to cover the nation's largest transit system, the prosecutors will not prosecute the crime they are primarily there to interdict. steady losses between $570 million in the services to charge. alvin bragg said were not going to prosecute that charge. so while the police can stop these folks and tried to keep guns and recidivists, eric adams talked about the fact a lot of the hochul crime is been driven by recidivists. the police can stop these people people. but the prosecutors will not prosecute. the message is no harm no foul they're going to continue. that is the real challenge for the police department. that is really where the action

is, right there. arthel: paul, let me take a look right now some crime stats according to the nypd this is 2023 versus 2024. this is just threw it last sunday. murdered down almost 18% dataset shootings down 18%. robbery up 4% hochul crime up for an half percent. retail theft up almost 7%. some could look at this and say that's not bad considering it is new york city. how would you respond to that? >> i would say comparing 2024 to 2023 is comparing bad to worse. we really should be looking at 2019 for but let's be fair covid it definitely had an effect. but also the criminal justice reform really began to take wing and that year end have progressed since. there have been at least 10 new measures coming out of city council just designed to throw bureaucratic sand into gears of the nypd. if we can purge it 2019 or up a
