i've never five an act of terrorism or mental health issues. that'll be the debate in a federal courtroom today. what we're expecting as the man who attacked paul pelosi awaits his sentencing just a few hours. >> protesters cleared out of a uc berkeley building. the tense moments as police make arrests overnight. >> plus, the contra costa county fair is here, but with new security measures. what guidelines? some parents will need to meet for their kids to attend. >> then a popular san francisco race is back this weekend. where to avoid if you're driving and not taking part in bay to

breakers, why am i this hot? >> why are you so tall? because i was trying to, like, pull the seat down and then it kept going up. >> i need an engineer. >> let's see. you need an engineer. >> it's nice to be taller than kumasi. reggie aqui. one time. >> let's just make it down. even more. you're going down a roll down. it's like when you're at a restaurant and there's a toddler and you're just, like, in a booster seat. good morning. let's look outside on this 17th of may. it is cloudy out there. we have a really deep marine layer meaning we are finding mist. if not some light rain currently along the coast. when i was driving through the city this morning, i did have to use my windshield wipers. our marine layer is about 3000ft deep this morning. what that means we have this cloudy start and the fog will be with us for much of the morning. temperatures right now we're running a few degrees cooler compared to yesterday, low and mid 50s. those current temperatures right now. so let's break it down along the coast. today it's very cloudy, very
5:02 am
similar to the past couple of days. temperatures in the mid and upper 50s. just be aware that we are dealing with some drizzle, some wet roadways close to the coast underneath this deep marine layer. now around the bay shoreline. you can see we're still dealing with that cloud cover through much of the morning. however, into the afternoon we get some bright sunshine. temperatures in the upper 60s around the bay shoreline and then inland. we even have a little bit of fog. that's how far our marine layer is pressing this morning. you do find sunny skies later on this afternoon, and those temperatures by 3 p.m. will get you into the upper 70s for daytime highs. hi, amanda, how's the commute going on this friday? >> good morning drew. yeah, for much of the bay area, the commute is calm here at 501, but we do want to zoom in to this problem area in oakland. it started after midnight last night, or i should say earlier this morning. this is at eastbound 580 at the grand avenue off ramp. we have video that we want to get to specifically of a multi-car crash. a deadly crash investigation. at least one
5:03 am
person was killed in a multi vehicle crash around 1220. as i mentioned, a car overturned near the center divide. this did block all lanes of the eastbound exit to grand avenue. we know that those lanes are still impacted at this hour. we're continuing to follow the development as crews work to clear that area. but as of right now that eastbound 580 on off ramp onto grand avenue very much impacted reggie. >> thanks, amanda. happening today. the man convicted of breaking into former house speaker nancy pelosi's san francisco home and attacking her husband, paul, with a hammer, will be sentenced in federal court. that attack happened nearly two years ago. abc seven news reporter lena howland was actually the first reporter on the scene that morning. lena. david depape is facing decades in prison. >> reggie. that's right. we've been following this case since the day it happened. and this morning, prosecutors are calling for a 40 year prison sentence. david depape was convicted by a federal jury last fall for the attack. his lawyers, however, are asking for a 14 year prison
5:04 am
sentence. there are two clearly different opinions with the federal government arguing this was an act of terrorism, while that while the defense could argue depape needs mental help, he's not someone that needs to be locked up if he's willing to go to treatment. >> so i think that's going to be the competing narrative in that courtroom. how much of mr. depapes mental health issues played a role in this case, and what the judge does with that, in terms of fashioning a sentence that sends the message that we need to protect america and democracy, but at the same time recognizes that perhaps mr. depape could be returned to society if he expresses remorse and he undergoes treatment. >> depape also faces a trial on state charges. legal analyst stephen clarke told us what happens in federal court this morning could very well trickle down to that case. >> well, certainly the jury is
5:05 am
being selected in the state case, and they're now going to know that mr. depape could be facing 40 years in federal prison. >> depape faces attempted murder charges in that state case. if convicted, he could be facing life in prison. the sentencing is expected to happen at 10:00 this morning. live in studio lena howland, abc seven news. >> thank you, lena, and we have been committed to this case since it broke right here on abc seven mornings in october of 2022. be sure to stay with us for updates throughout the day, and you can catch up on the entire timeline of the case. it's up on our website right now. abc seven news.com this morning. >> that second pro-palestinian encampment that popped up just blocks from uc berkeley's main campus is no more police moving in, facing off with protesters just 24 hours after they began occupying a historic university hall across from people's park. and amanda, some arrests were made. >> yeah, kumasi those police officers started moving in around 830 last night.
5:06 am
>> there were some tense moments as they confronted protesters. as you see here. a school spokesperson says people were arrested for trespassing, breaking and entering and vandalism. the group began occupying the building on wednesday and the property was quickly declared a crime scene. protesters made the same demands. we've heard from so many others, but this group was different from one that disbanded from in front of sproul hall earlier this week, and they also escalated the situation with graffiti spray painted on the side of the building, according to the chronicle, some graffiti equated zionism with, and others showed jewish stars equaling swastikas. now, protesters didn't want to speak on camera, but we did speak with a berkeley resident. >> it's going to keep happening until, there's a cease fire or the war ends. berkeley is a traditionally a protest city. so i think it's going to be a lot of berkeley incidents, just throughout the summer, the building where this happened is owned by uc berkeley, but it is
5:07 am
several blocks from the main campus, and it's unlikely this is over. >> protesters last night insisted they will be back. back to you, reggie. >> amanda. thank you. in the east bay, organizers of the contra costa county fair are promising more security and stricter rules to try to make this year's event more safe and fun. today is day two of the fair. last year, things got a little wild. this is just one incident involving a group of people in a fight. so if you're going to the fair this year, expect to see a lot more staff both inside at the entrance and in the parking lots. and parents, anybody 18 years or under needs a chaperon of somebody 25 years or older to be here with the fair. >> we want to make sure that people are not just dropping off their teenagers and thinking, we're a babysitting site. >> the fair runs through sunday at the contra costa county events park in antioch. >> if you are heading to wine country this weekend, you may need to budget in some extra time. the last scheduled closure along highway 37 is set to start at 10:00 tonight. you can see
5:08 am
the closure in red on the map there. it is, the westbound portion of the highway from highway 29 in vallejo to sears point, and that detour line that you see there is green. caltrans is repaving the road, and then highway 37 will reopen at 50 monday morning. and that's not the only paving project happeninthis weekend. >> caltrans crews will also be working on two other freeways starting tonight. the three left lanes of southbound 680 will be closed between acosta boulevard d san ramon, and the five 8680 connector in pleasaon. the partial closures begin at 9 p.m. tonight. they go through 4 a.m. monday every day here at abc seven news, we are focused on the issues that can lead to a better bay area. the complex issue of homelessness is something we are we are all hoping to crack. >> the city of san francisco is celebrating its new numbers on homelessness, but it doesn't really paint the whole picture. >> so we're going to walk you through these numbers. the results of the most recent homelessness count were put out yesterday. the city says the
5:09 am
number of people living out on the street has reached the lowest level in nearly a decade. however when you look at the total number of homeless across the city, that number is actually at a record high and more than 8300 people. the number of people sleeping in vehicles spiked 37. this is all despite a massive amount of money being spent on this issue, according to a recent city audit , funding for the crisis reached $676 million in 2022 2023. >> we are also keeping a close eye on oakland this week with the city's new era in law enforcement, of course. police chief floyd mitchell is in his first week on the job, and we wanted to find out more about where things will go from there. so we had oakland mayor shengtao join us in abc seven news midday live to discuss his new role. >> the first line of work for chief mitchell is really a meeting. you know, his rank and file. he's going to meet his

5:12 am
lot further inland this morning than in the past couple of mornings. so most of us waking up these cloudy skies along the coast, we are seeing some light rain, even some drizzle underneath the marine layer. temperature right now in san jose is at 58 degrees. the humidity is up and the winds are light. so taking a look at future weather, watch what happens even by 915. look at all that fog we are still dealing with. even in the valleys of the east bay. danville still foggy. we're still seeing fog thick along the coast now as we head towards noon. that fog really breaks down very fast. as we head towards the afternoon, the marine layer actually gets compressed along the coast, so areas that were quite cloudy yesterday across the city get more sunshine today compared to yesterday. so highs we'll have that wide range again. that pollen count still remains high 64 in the city, 68 in oakland, 77 in san jose. the fog breaks in the city around lunchtime much sooner in the east bay, probably closer to 9:10 a.m. we'll find those temperatures close to average for this time
