looking at live downtown san jose, this is where the mexican mariachi val is going to be held today. if you're familiar with the plaza you're familiar with the fountains. >> packed and lots of trees and people in the shade. i think that's going to be a spot where people go to cool off in the south end of the bay. more of that heat we had yesterday, more 09 and tomorrow is going to be hotter. right now we have lots of 50s. there is coastal right along the immediate coast but that's it. it's not going too far across the bay. we have a spare the air today, second one, we had one yesterday, another one today and notice the orange for the santa clara county valley there. what that is, it's unhealthful for sensitive groups is what the air quality is considered. upper respiratory problems such as asthma, you might want to avoid any outdoor activities. by noon, some 80s, mid 80s and by 5:00 p.m., more of the 90s.

garvin, tomorrow, is a bit hotter than today, the hottest day of the week. i will have the complete look at your seven-day forecast. >> it's going to be an important one to watch. thank you very much. as craig mentioned the heat has been turned on high and that's causing problems across the bay area. problems that will likely continue through tomorrow. this morning the lights are back on in crass castro valley after equipment overheated at the pg&e substation. more than 34,000 residents in hayward and castro valley were in the dark for about five hours last flight. eden hospital managed to stay open thanks to an emergency generator. people on their way to the hospital say driving without any street or signal lights was frustrating and potentially dangerous. >> i was picking up my cousin to bring her to the hospital and we were coming down castro valley boulevard it was hectic, bumper to bumper, cars not stopping and it was horrible. >> pg&e is still looking into exactly why the excessive heat

led to the malfunction. yet another byproduct of the hot temperatures, fires. right now, one firefighter is recovering from injuries after flames burned through grass lands in bodegay bay. crews worked through the night to corral the fire along highway 1 near the community of valley fort. the fire broke out around 1:00 yesterday afternoon, sending massive plumes of smoke. right now over 80 acres have been burned and one building is a total loss. the fire actually knocked out 191 service in the bodegay bay area overnight, forcing the fire department to handle all emergency calls. so far there's no word on when that service will be restored. a san quentin inmate sentenced to death has until noon today to choose how he wants to die. condemned murderer albert greenwood brown must decide between a lethal injection of one drug or three drug cocktail the state has used in the last 12 excuses. brown's attorney says they will ask a marin county superior court judge tomorrow to block the execution.

they're also considering an appeal to the ninth u.s. circuit court of appeals. brown is convicted of murdering and raping a 15-year-old riverside county girl in 1980. in a related development across the country, condemned inmates could get an unexpected reprieve from their death sentences to shortages of one of the three drugs used in the lethal injections. the governor of kentucky has been asked to sign death warrants for three inmates but the state can only set one execution date because the department of corrections has only one dose of sodium thiopental left. the only u.s. manufacturer of the drug says the active ingredient is back ordered. ohio and washington is are also facing delays. san francisco is the latest spot to consider banning fast food restaurants from handing out free toys with kids meals. tomorrow the board of supervisors considers a plan that would not ban toys in kids outright but make it illegal for

them to be included if meals exceed city set limits on calorie, salt and sugar. meals with a toy contain half a cup of fruit and three quarters of a cup of vegetables. the restaurant industry is exploring a legal challenge if it is approved. mayor newsom proposes the proposal saying it's the wrong way to achieve that. governor slrz schwarzenegger is saying yes but no to a ski helmet law. he signed a bill that would have fined parents of minors caught skiing or snow boarding without helmets but that was attached to a vetoed proposal that would have forced ski resorts to develop and publish safety plans. the governor says the safety bill would have placed a, quote, unnecessary burden on ski resorts. two oakland homicide detectives are honored this weekend for the work with families of murdered victims. a non-profit organization known as 1,000 mothers to prevent

violence offers to the healing of survivorses. benefits those families. >> i think it's important because far too many times doesn't get -- >> it's difficult working in the homicide unit. we always meet the families on the worst possible circumstance. they've just suffered a tremendous loss. they have a lot of questions, a lot of anger. >> lieutenant brian modero supervising the investigation of four oakland officers. last year sergeant george philip has worked on numerous cases including the shooting death of a 17-year-old girl who moved to oakland with her family to begin a new life after her louisiana home was devastated by hurricane katrina. still ahead on "today in the bay" a bay area convention where a lot more than politics is in the air.

it's a debate that blazes on. among the big issues of this election season, whether to legalize marijuana for recreational use here in california. a new poll out from survey usa shows more voters favoring proposition 19. 47% say yes, legalize pot. 42% are against it. it's a complex issue. we sent nbc scott budman to the bay area's cannibis festival to help clear the air. >> reporter: along with the haze of pot, the international cannibis and hemp expo, which is expected to bring close to 50,000 people to the cal palace this weekend, is also bringing with it the unmistakable arroma of politics. >> definitely goes to show that

it's a thriving industry. >> reporter: it's also the focus of proposition 19, which would, if passed, legalize marijuana for personal use. >> people are tired of the old propaganda and the reefer madness stigmatism and, you know, we're just ready to move this industry forward. there's no jobs out there. this industry is able to bring, like i say, tax revenues and jobs. >> reporter: not everyone, even at the cannibis festival, is lining up to support prop 19. turns out the legalization of pot brings with it new economic concerns. for example, the fear that a more open market will lead to much lower prices for those who sell weed. they worry about their income taking a big hit. >> you were originally, you know, selling an ounce of, you know, medical marijuana for upwards of 200, $220 and now that same ounce is going to be decreased to $40, you know, it's

just absolutely going to kill the market. >> i'm on the fence really, i'll be honest about it. i take care of real patients so the real patients i need, they need a lot more medicine than what prop 19 is going to allow us to grow right now. >> reporter: wherever they stand on the issue, just about everyone here told us, they're glad to clear the air. in daily city, scott budman, nbc bay area news. speaking of politics san francisco mayor gavin newsom is slipping in the latest field poll in the race for lieutenant governor. newsom and mall da maddo are running neck and neck. in the senate race barbara boxer's lead over carly fiorina has increased. two months ago the race was deadlocked. boxer leads fee rene na 47 to 41%. the gubernatorial race gets tighter. jerry brown and meg whitman are tied at 41%. their first debate is tuesday from uc davis. today in the bay's political analyst larry gur ston will join us later in the show to talk about the numbers and what they

mean. reducing california's carbon footprint has been one of governor arnold schwarzenegger's priorities as he prepares to leave office, though, the governor ponders whether the state will remain focused on clean energy or adopt a new approach. tomorrow governor schwarzenegger will be in santa clara to discuss the future of the state's climate change law approved in 2006. that law could be affected if prop 23 passes in november. prop 23 would suspend the provisions of the 2006 law until the state's unemployment rate drops to 5.5% or below for a full fiscal year. the governor will talk about his china's trip and the country's progress with clean technology. coming up next on "today in the bay" photo bombed by the boss. the unexpected jersey sho shore serenade just ahead. and a good saturday morning live over san francisco. a little fog, not much. it is sticking to the coast. the rest of us, another hot day. i'll have your forecast coming up.

helicopter and fly over that, then we'd see angel island. it's really right over the water. it's a little bit, it will be clear -- what's that? >> let's take that helicopter ride, shall we? it's sunday, let's do it. next shot takes us to oakland back towards san francisco. gorgeous, look at that start to the morning. as are playing today. it is going to be a hot one for the game. 105 taking on texas. as we look out over the east side of the bay, inland valley, plenty of sunshine to livermore, concord, perfect time to get out on the bike and get your ride in or your walk or run this morning. because it's going to be another hot one. there's live san jose, as we look out toward city hall the rotunda and off in the distance the fremont hills. we have been dealing with 50s. we have 57 in san francisco, a couple 40s into the north end of the bay, close to santa rosa, over to petaluma and novato. once you head down the peninsula, east side of the bay and south bay, we've got some 50s, close to 60 degrees.

this is what we saw yesterday. we saw a lot of the cloud cover just about right here. it's all headed to the pacific northwest. this cloud cover here. the rest of the state under sunshine. again a little bit of fog hugging the immediate coast and just really not going to influence our temperatures inland. as we go through the end of the week, the cooler air starts to move on in, but that's not until about wednesday or thursday. meantime today the beach has 60s, 70s and 80s. 90s for the rest of the bay area. very weak sea breeze along the immediate coast. those 90s that we have inland today turn into 100 plus in some cases tomorrow. again a spare the air day for the entire bay area today and across the santa clara valley. air quality expected to be unhealthful for sensitive groups. near 90 at 1:05. by the time we get to 2:00 and 3:00 as the game moves on, closer to the mid 90s. we got 91 jed in san francisco. 90s for sonoma, napa, over to

phone, he actually picked up the phone? >> he did. he was so a media train back in those days he told me all the details of the venture capital ground he closed. >> he's gotten media trained and harder to talk to. what do you suppose his reaction to all of this about the movie? >> i know because when i was worken on my book, movie is based on, was being written and at first i think he was hurt by it. even though he's a billionaire, leading this company, he's not a two dimensional character. he's a human being. i don't think any of us would want a book or much less a movie made about our lives and the source material was, you know, angry ex-friends, angry ex-girlfriends, people you knew in college. i think he was shocked and hurt that someone would do this and that he had no recourse. but since then, you know, i think it's been very widely pub sized this is mostly fictional.

it's a day of mexican music culture and cuisine in the south bay. the final day of the annual san jose mariachi and mexican

heritage festival gets under way in a few hours. this year's event holds special meaning celebrating two independence day, 100 years since the mexican revolution and 200 years since mexico gained freedom from spain. the spokesman, fernando rivera joins us from our newsroom this morning. thanks very much for getting up early and joining us and this year, obviously, is a big year culturally as we just mentioned. how is that going to be reflected in this year's festival. >> this year's festival focuses on the mexican revolution which is 100 years -- the centennial of the independence and we have a great set of musicians coming today to play at the plaza. we have called the concert for the american dream and this concert really celebrates the blend of all the cultures in the san francisco bay area. we have three grammy award winners that are coming to play. the first one will be tex man c

results. this month the field poll shows 41% of likely voters support jerry brown compared to 44% in july. meg whitman is tied with brown at 44, 41% compared to her 43% in july. 18% of californians are undecided, that is up from 13% in july. but there's more to these numbers than what meets the eye. let's bring in today in the bay's political analyst larry gurston. interesting the closer we get to the election the undecideds go up. that sounds unusual. >> yeah. that's probably the first statistic one we'll look at closely, garvin. we're talking about a meaningless figure to some, but meaningful to the rest of us. that vote has gone up to 18%. the undecided vote has gone up to 18% from 13%. this is the time in the season when people begin to make up their minds. instead now, they are less sure than ever. this may be a reflection of jerry brown beginning the active stage of his campaign, defining

himself instead of leaving that to meg whitman. that could make a big difference down the stretch. >> he's had all the money. she's had all the money and ads and he's kind of cracked in to that. >> saved his money until the end and now he's spending it. >> there must be a lot of political scientist strategists looking at this campaign, saying can you do this, can you sit back and be pummeled for an entire year before fighting back and jerry brown is going to see if that works. you've been looking deep in these numbers and you said the latino community and poll numbers there are very telling as well. >> this is another cohort or group we want to watch here. it's a good statistic that tells you something about what's going on for whitman. with 38% of the state's population, look, latinos may account for as much as 20% of the november vote. that's a record as far as latino voting goes. republicans have done their calculations and believe that 37%, 37% of the latino vote, will be enough to win the

election. currently, latinos favor brown, but only by a margin of 43% to 40%. that's kind of tight. now, if you look at the polls, there you see it, 43, 47. it means over the next six weeks brown has to hold the 43%, capture all the undecideds and convert some of the whitman latinos to his side. jerry brown has a long history with latinos, okay. it may well bode for him well down the end. it's the stretch run we're looking at. >> another interesting thing with this late start as it were by jerry brown. he's starting later and every year it seems the election starts earlier. more people go mail-in and absentee balloting. november is not the election day. it starts weeks earlier. how does this factor in this race? >> the week after next, in fact, garvin. >> that soon? >> the week after next. this time around, another record will be set in california. we expect half of the electorate

to vote in advance of the election. half will be voting long before election day, which says a whole lot about the commercials and everything else going on right now. the september field poll that we've been talking about, finds some very interesting differences between the mail-in voters and those who intend to vote on election day. this becomes important for all the strategy going on. the mail-in voters favor whitman by a margin of 41% to 40%. run your campaign commercials early. election day voters favor brown by a margin of 42 to 39%. so why do we care? these seem to be insignificant. the mail-in voters are more motivated, more committed, know they're going to do it. too many things can happen on election day to keep somebody voting and who knows what happens and look, the more votes a candidate can get in advance, scoop them up, get them mailed in, know it's done, the better his or her chances. so it's something. >> okay. bottom line, how do you see this, the two-month mark, how do you see, where do you see us at
