113 degrees. looking at the temperatures now, plenty of 90s. 103 in gilroy. no signs of a sea breeze, which is impacting the air qualifity. let's show you what you can expect in terms of the winds. we're waiting for sea breeze to pick up. it's just not there this evening. the wind slightly onshore. as you can see, the headlines we have tomorrow morning, we're going to get off to a warm start. mostly 60s. high temperatures soaring into the 100s. george joins us and it's not just the heat, but the air quality that would lead to public health issues. >> on spare the air day, what we're hearing is this. give me some air because it's hard for people to breathe out here. combine the high temperatures and unhealthy air and that makes

the heat wave obviously putting pressure on the graph. today's peak usage hit around 3:00 this afternoon. earlier today, we were asked to quit using as much energy like your dishwasher and drier. a short reprieve for a death row inmate scheduled for execution wednesday morning. the governor delayed the lethal injection two full days. trace is live to explain more about the hearings. tracy? >> reporter: well, lisa, albert brown has been sitting on death row for nearly three decades and now he's found out he has an additional 45 hours to live. he was supposed to die by lethal

injection at 12:01 wednesday, but the governor gave the courts a little more time. >> for these reasons, the application for temporary restar restrainer order is denied. >> reporter: they ran into a serious obstacle today. he was convicted for raping and killing a 15-year-old girl in riverside in 1980. 30 years later, the focus is how to keep him out of this death chamber. but attorneys for brown and another inmate argue it shouldn't happen at all because the process remains just as flawed as it was in 2006. marinne sue peer your court

sunlg said -- or that the california department of corrections and rehabilitation was likely to botch the execution. >> mr. brown cannot prove that he will suffer pain if he's executed under the current regulations. >> the issues here today is whether california will be a law-abiding state or lawless state in execution of citizens. we will appeal immediately. the stakes are too high and there are too many uncertainties. >> reporter: brown is now waiting on decisions from the u.s. court of appeals they say that no matter what the courts decide, the prison is ready. >> given the leeway to move forward, we will. if there are stays in place that brings this to a halt, then we will stand down. >> reporter: the attorney general's office announced execution would continue and that after brown is executed,

they'll stop the executions one more time and that has because they say there is a shortage of one of the drugs they use in the p lethal injection. the drug is known as sodium panthenol. it is also known as truth serum. >> thank you. if congresswoman jackie spear gets her way, natural gas lines across the country will be equipped with automatic shut-off valves. she will introduce a bill to let homeowners know if they live within -- feet of the lines. >> we have an ageing natural gas transmission pipeline running through our communities. are the lines too old? are they safe? people want to know if they're living anywhere near one of these transmission lines and i

believe they have a right to know. >> after the san bruno explosion, you may remember pg&e workers had to shut off the gas flow manually and it took nearly two hours. stopping the flow earlier would have cut down on the damage. the force has just 90 offers. a 43% drop. the crime is not slowing down. jodi hernandez is live at one of the latest shootings this weekend where a photographer nearly lost his life. >> reporter: the photographer had to be air lifted out of here when the party he was hired to take pictures out spiralled out of control. you can see some of the damage that happened when shots rang out inside the building. he says he never saw the gunman, but when the gunfire stopped, he lay in a pool of blood with his

camera still around his neck. >> i shoot a lot of models. a shoot a lot of club events. i shoot a lot of family portraits. >> reporter: he never thought his job would have cost him his life. he was shooting pictures friday night when someone armed with a gun started pointing and shooting. >> i heard the shots and dove to the ground like everybody else. at first, i was hysterical and thought i was going to die and just kept saying, i'm dying, somebody call my mom. i'm dying, somebody call my mom. the bullet went into the arm and stayed there and then i got shot in the hand and it went through my hand and came out the other side and hit my chest. >> reporter: police responded to three shootings, a stabbing and robbery last weekend as police staffing hit a five-year low.

>> i thought they followed up pretty quickly and violence and gun shots and things of that nature, but they never even simply asked me, never came and asked me, was it meant for you, were you the target, do you feel safe. like the stuff you see on tv. i got none of that. >> reporter: spencer is still waiting for police follow up, meanwhile, when he recovers, he plans to focus on safer jobs like weddings and model shoots rk but he'll stay away from the club scene. >> they're playing with lives out there. >> reporter: now, it will likely take a year to recover enough to take pictures again. meanwhile, police union representatives tells nbc bay area the understaffed department is having a tougher and tougher time keeping up with all the calls. so far, no one has been arrested that took place out here.

our state has a huge deficit. meg whitman's plan will make it billions worse by eliminating the capital gains tax for wealthy investors, including herself. economists say her plan will "rip a hole in the budget" and is "deeply flawed". analysts for the l.a. times say whitman's plan is a "pure handout" to the rich creating a "huge risk" to schools and public safety. jerry brown's against this unfair giveaway because it will take billions from our children when we can least afford it. get california working again-for all of us.

an east bay family fears the formula recall may have hit home. nbc bay area's david trujillo has more. >> our expert says if your child ate some of the recalled formula, chances are, they'll be okay, but for one family, it's gotten a little scary for a while. >> reporter: this is how the family prefer to see baby jay. smiling, playful, healthy.

but a few days ago, it got a little scary. >> the fever went up to about 105 at one point and he just wasn't himself. he wasn't playing. really clingy. >> reporter: jay was diagnosed with a stomach virus. days later, the family heard about the sim lack recall, looked at the lot number and realized they were giving jay the formula. during an inspection, authorities found the presence of a small common beetle. >> it was crazy seeing stuff on the news -- it was tripped me out. >> reporter: jay's doctors didn't blame his sickness on the formula and the pediatrician says a 105 degree temperature isn't one of the common

symptoms. >> you don't find much of a problem with that. >> reporter: dr. dell says most children have no issues even if they ingest the formula. >> the amount is probably minuscule and if they did injesuit, probably would have no problems. jays parents are just relieved. you can return the formula to the store for a refund. right now, the voluntary recall only pertains to certain powdered formula products. no apple. no toy. the fight over what goes in a happy meal prompted some anger. the hearing would block restaurants from giving away

>> reporter: but in these days of shrinking academic budgets, everyone could use a little help. san francisco education leaders announced a grant from the bill and melinda gates foundation. it will go towards strengthening the transition for public students heading to san francisco city college. >> it's going to help because you're going to have the institutions working together as a team to get rid of this high dropout rate. >> reporter: the money comes at a time when schools are reaching out to foundations and donors to make up the cuts in state funding. last year, the city college even held a garage sale to save some 300 classes from the chopping block. >> we want to double the number of graduates and double the number that graduate. >> it's been some struggles, but i think i overcomed them now. that's why i'm here now. >> reporter: but austin only

sees good things ahead, says he's learned that sometimes schools and students just need a helping hand. san francisco is just one of four u.s. cities receiving the grant. other cities include new york city, me sa, arizona and riverside. people are trying to change education all across the country. in new york city, nbc's education nation kicked off a two-day summit, where teachers and educators are focused on improved the system. >> get the best education and now i know by the time some got to college, remedial courses. they had to take remedial courses. >> also, today, the white house announced the goal of creating 10,000 science, technology, engineering and math teachers over the next two years. let's take politics. today, governor schwarzenegger blasted oil companies for

supporting prop 23. the plan to suspend california's restrictions on greenhouse gases which has nothing to do with that teacher right there. the governor visited the santa clara commonwealth and said companies are manipulating the public to protect jobs. the governor claims that in reality, they're pumping millions into the proposition because of quote, self-serving greed. >> does anyone really believe this company is out of the goodness out of their black oil hearts spending millions of dollars to protect jobs? this is like ever brown riding a kosher cook book. >> it would freeze california's global warming act until the rate drops to 5.5%.

well, the governor talking about the black hearts, a lot of talk about prop 23, but he's not talking about who he supports for governor. interesting because he is a republican, but has not said a word about meg whitman or jerry brown. >> jessica, in all the years i've been watching this, i have never seen an incumbent governor fail to endorse the would be successor. >> does he not like either one? >> there are a couple of theorys. one is that schwarzenegger, the liability and the whitman camp has said, stay away. you're radio active. we don't want anything to do with you. the other theory and schwarzenegger gave an interview this effect, he doesn't like either one and frankly has little to gain by putting his -- in either candidate. so, one way or the other, this is a first. we know we always have firsts. here's another in california where the outgoing governor where at least five weeks out has failed to say who he would

like to see succeed him. >> meg whitman has some big guns campaigning for her, but now, we're hearing that jerry brown is going to have bill clinton come h and campaign for him, which is surprising. the whitman campaign had that commercial out. >> the president, president clinton, said this is child stuff. if you think about it, here we have former president bill clinton and president obama both coming out. how important is this? very important. these are very, very popular democrats and it's all about mobilizing the base. the polls show that democrats are just less enthusiastic about voting this time, so if these characters come out, watch out, these are heroes to the base and could give the democrats a much needed boost.

>> so tomorrow, we talked a about the first debate between whitman and brown. who was the most to lose? she can't just say, this is the way i'm going to do it because i'm the boss. a hard line to walk for both. >> the gender thing makes it difficult. they both have things to worry about but what you want to do is look for efforts on behalf of the panelists to get the candidates off message. y?wh because then you see who's got the most to lose by what they say. watch for follow-up questions. getting off of the stump speech, all that stuff. finally, you want to think about gaps. the statement that each has made recently. whitman last week comparing fresno to detroit and brown going back to the clinton mess. if they commit a gaffe with that kipd of audience, it will resognate in the news for days and days. >> thank you very much.

flood waters continue to rise in the midwest where heavy rain is causing widespread flooding, threatening some communities. high water causing power outages, flooding roads from minnesota to the da kkotadakota. a small community many wisconsin keeping a nervous watch on a levy that could give way. heat is the problem in the bay area. there are some delays in the pleasanton areas. it's heat related. >> when temperatures get close to 100 degrees, it causes expansion and tracks can warp for a beef period of time.

you have to take precautions. here's the reason why we're having heat related issues. pretty amazing. 103 in santa cruz. 93 today. 104 in santa rosa. livermore and pleasanton, 96 in san jose. slow cooling in oakland and notice the skies. it looks like southern california around the bay area. you got the smog set up in oakland. all the air pollution kind of settles into the area. 89 degrees. san jose now, 93 degrees. you'd hope to see low clouds and fog, but nothing like that now. the wind is picking up out of the west. we're going to have to wait for the sea breeze to get stronger

before we see temperatures drop. right now, still warm at 84 degrees. inland, 90s, 87 in hayward. not enough of a sea breeze tomorrow to prevent another spare is air day. this is toward the tri valley. probably don't want to do any outside exercising tomorrow. inland temperatures easily in the 90s. out toward livermore, that warmer air banks up in the hills. may get close to 105 tomorrow. to south san jose, upper 90s for tuesday. towards wednesday and thursday, the sea breeze will pick up. 80s to low 90s inland. that will feel cooler than today. by thursday and friday, is sea breeze takes hold and we should
