>> announcer: from nbc news, this is "today" with matt lauer and savannah guthrie live from studio 1a in rockefeller plaza. and good morning. welcome to "today" on a wednesday morning. i'm matt lauer, and savannah just asked me if that 17-year-old is single. >> i'm just doing -- you don't think the teenage girls of america want to know? >> you were asking for others, okay. fine. >> well, yeah. i think so. good morning, everyone. we'll move on to weightier matters, and the question before the supreme court this morning. can the government deny benefits to same-sex couples who are married in states where it is legal? >> the historic arguments are sparking some intense debate and passion on both sides. at one point on tuesday, police had to separate demonstrators. nbc's justice correspondent, pete williams, is outside the court this morning. pete, good morning to you. >> reporter: matt, good morning on a blustery morning here. it's a lawyer for house republicans who will be here at the court today to carry on the

fight to keep the defense of marriage act because the obama administration no longer defends it. the question -- does it violate states' rights? emotions are running high with demonstrations on both sides of the issue outside the court. [ chants ] >> reporter: at the center of the storm, an 83-year-old former computer programmer from new york. edie windsor. >> this is one of my favorite pictures. >> reporter: doma, the defense of marriage act, barred the irs from recognizing her marriage to another woman, so it sent her a $300,000 inheritance tax bill when her spouse died. >> i couldn't believe that they were making a stranger of this person i lived with and loved for 43-something years. >> reporter: it's been 17 years since a strong majority in congress passed doma, defining marriage as "only a legal union between one man and one woman." nine states now permit same-sex marriage along with washington, d.c. 38 others ban it either by law or constitutional amendment.

on tuesday, the court took up proposition 8 which ended same-sex marriage in california. supporters say it makes sense to limit marriage because only opposite-sex couples can produce children. but justice elena kagan asked would couples over 55 not be allowed to marry either? >> i can just assure you if both the woman and the man are over the age of 55, there are not a lot of children coming out of that marriage. >> reporter: conservatives worry about going too fast. >> you want us to step in and render a decision based on an assessment of the effects of this institution which is newer than cell phones or the internet? >> reporter: so while the prop 8 case seems unlikely to produce a sweeping ruling on gay rights, the doma case may result in a clearer decision on who gets to define marriage, the federal government or the state. savannah? >> to hear the oral arguments yesterday, pete, it seemed at least some of the justices were questioning whether they should have take then case at all.

>> reporter: right. and i think especially it was justice anthony kennedy who said, "you're asking us to go into uncharted waters." he said, "i wonder if the supreme court should have even taken this case now." and if that's what the supreme court does, savannah, what it would probably do is find some way to make a decision that results only in a change that would allow a marriage to resume in california but would have no nationwide effect. >> all right. pete williams at the court again for us this morning. thank you. new this morning, an apology from former general david petraeus in his first speech since resigning as cia director or an extramarital affair. nbc's jim miklaszewski is at the pentagon with details. >> reporter: good morning, savannah. after a stellar 37-year military career and brief stint at the cia, his was one of the most stunning falls from grace in washington history. at the university of southern california in his first speech since the scandal, david petraeus has started his comeback.

for the first time in nearly five months, david petraeus walked back into the public spotlight. the most famous army general of our time stepped out to try to reclaim his career and reputation. >> i join you keenly aware that i am regarded in a different light now than i was a year ago. i'm also keenly aware that the reason for my recent journey was my own doing. >> reporter: this leader of men who once commanded authority was now asking for forgiveness. >> please allow me to reiterate how deeply i regret and apologize for the circumstances that led to my resignation from the cia and caused such pain for my family, friends, and supporters. >> reporter: it was a front page sex scandal that forced petraeus to give up his post as director of the cia. the other woman was paula broadwell. like petraeus, she was a west

point graduate, who made about a half dozen extended trips with petraeus when he was the commander of u.s. forces in afghanistan and wrote a book about the four-star general. petraeus has insisted, however, the affair did not begun until after he left the military. >> there's often a view that because an individual was a great soldier he or she will naturally do well in the civilian world. in reality, the transition from military service to civilian pursuits often is quite challenging. >> reporter: can petraeus ever recover? >> can he go on and have an incredibly productive career? yes. can he go on as if nothing ever happened and become president and get people to forget paula broadwell? no. >> reporter: now, sounding again like the commanding general, petraeus vowed to fight on. >> life doesn't stop with such a mistake. it can and must go on. >> reporter: it's not clear where general -- former general david petraeus goes from here. a book is probably in the works.

but his broad base of supporters insist don't count him out, matt. >> all right, jim miklaszewski at the pentagon, thank you. we have new information on the legal drama facing amanda knox in the wake of italy's supreme court decision to order a new murder trial. will she have to return there? nbc's michelle kosinski's in rome. good morning to you. >> reporter: hi, matt. it has been confusing, but italy has no power to compel amanda knox back here for trial. in fact, if she arrived here today, she would not be arrested. if she were convicted, italy could ask the u.s. to extradite her. but legal experts don't think they've refused in other cases here. >> this is itv news -- >> american student -- >> amanda knox is again in global headlines. for a court ruling it seemed no one thought possible. >> it's a shocking decision. >> reporter: she and her ex-boyfriend will face trial

again for the 2007 murder of amanda's roommate, meredith kercher. now within three months the supreme court must explain why it accepted prosecutors' challenge that amanda's and raffaele's acquittal that blasted the prosecution case. prosecutors raised what they called 16 errors by the court saying evidence was basically brushed aside. dna, witness statements. once they explain the reasoning, that will shape the trial, whether there might be retesting of old evidence. >> i'm sure it will be more difficult now to defend amanda. >> reporter: for computer science student raffaele, conviction would likely mean back to prison. he said in a statement he is deeply saddened. but is conviction possible now. >> there is a realistic chance they could be convicted. now they have an uphill climb. much negative evidence that was explored overseas will be

reconsidered. >> reporter: even if convicted, amanda will likely stay in the u.s. though travel could be tricky to countries with strict extradition treaties with italy. she would not be able to return here, to the country she still wanted to see again one day. now this new trial isn't expected to start until next year at the earliest. the verdict possibly not until 2016. matt? >> all right, michelle kozinski in rome this morning. thank you very much. the nation's toughest anti-abortion measure is now law tamron hall is in for natalie this morning with that news. good morning. >> that's right. good morning, everyone. officials in north dakota are bracing for legal challenges after the nation's toughest new measure on abortion were signed into law there. one measure passed by state legislators bans abortions as early as six weeks into a pregnancy or as soon as a heartbeat can be detected. another bans abortions based on genetic defects. to wall street, cnbc's

jackie deangelis has the latest. good morning, jackie. >> good morning. the bulls are back on wall street, at least for the time being. the dow shrugging off troubles in europe, logging a triple-digit gain and hitting a record high. the s&p 500 less than two points away from its all-time closing high. the latest batch of u.s. economic data fueling the markets' move higher, also pushing oil prices up. fresh numbers on u.s. pending home sales are due today. housing, of course, has been key to the rally. we'll see if those signs continue to point to a recovery. back to you. >> all right. thank you very much. and some big money troubles for singer dion warwick. after selling more than 100 million records over the years, she filed for bankruptcy. she says she's more than $10 million in debt. much of it owed to the irs and the state of california. known for songs including "do you know the way to san jose" and "walk on by." her spokesperson said she was the victim of bad financial management. a couple of close calls and two amazing videos to show this morning.

veteran agent julia pierson as the agency's new director, marking the first time a woman will hold that position. nbc's white house correspondent, kristin welker, has more. good morning. >> reporter: savannah, good morning. julia pierson has worked with the secret service for 30 years. her colleagues say she's experienced just about every aspects of the job, which makes her the right person to lead the troubled agency into the future. julia pierson is set to become the 23rd director of the secret service and the first woman ever to lead the agency, an historic pick from an administration that has recently been criticized for a lack of diversity. >> this comes as welcome news, i think, to a lot of people who were looking for a cabinet and an inner circle and an administration that was much more diverse in this second term. >> reporter: an orlando native, pierson joined the secret service in 1983, right out of college, according to a 2007 interview with "smithsonian." telling the magazine, "i knew law enforcement was my area of

interest." now 53, pierson has risen through the ranks. most recently serving as chief of staff. former agent, dan bongino, worked with pierson for more than a decade. >> she's aggressive. she is tough. she's not going to put up with any nonsense. >> reporter: and it's that no-nonsense attitude that colleagues say makes her the right person to take over an agency recently mired in scandal. last april, investigators discovered that several agents brought prostitutes back it their hotel rooms in colombia just hours before the president arrived for an international summit. at least eight agents lost their jobs. devastating the secret service, an agency once known for its honor and prestige. >> the fact that she lived through that and felt that punch in the gut is going to be important going forward. she's going to do everything in her power that ensure that particular situation is never replicated again. >> reporter: now president obama called pierson to personally deliver the news on tuesday. former director, mark sullivan, said he believes she will do an

outstanding job. by the way, in high school, pierson worked at disney world and said dealing with all of these large crowds helped her prepare for this line of work. matt? >> kristin, thank you very much. we appreciate it. pop star justin bieber is in the news this morning for all the wrong reasons. accused of battery by his california neighbor. nbc's kristen dahlgren is in los angeles with the overnight developments. good morning to you. >> reporter: good morning, matt. yeah. just when you think things can't get any tougher for justin bieber, the singer is now being questioned in relation to an incident under investigation by the l.a. county sheriff's department. according to the sheriff's department, justin bieber's neighbor tells them the singer made physical contact and threatened him during an altercation tuesday morning. >> battery means unwanted touching. it could be patting on the back. it could be throwing water on somebody. could be spitting. it could be any of those things. we don't know.

>> reporter: so far there are no arrests, no charges, and officials say no injuries. the accusation is just the latest in a string of bad days for bieber. earlier this month the singer struggled with his breathing and collapsed backstage during a concert in london. he was taken to the hospital, then accused of clashing with the paparazzi. days earlier, he was booed when he showed up late to a show. he apologized to fans. in february, pictures of bieber appearing to smoke pot surfaced online. the singer poked fun at the incident on "saturday night live." >> he got busted for smoking weed, and he's really sorry about it. and people make mistakes and he's never going to do it again. [ cheers ] >> reporter: then this week the singer unexpectedly canceled a concert tuesday in germany to return to l.a. but not before these pictures were snapped of him leaving poland in freezing temperatures shirtless. leaving many hollywood insiders to wonder if bieber's behavior is a classic hollywood meltdown or simply growing pains for a teenage boy.

>> it is a very difficult thing for anyone to be in the public eye like he is, but to be as young as he is and have been going through it so intensely for the last few years, you'd almost expect him to have some sort of episodes where he's going to crack a little bit. >> reporter: overnight, nbc news learned from sources close to bieber saying that the neighbor was on bieber's property. there was no physical altercation, and the security guards dealt with the neighbor. >> kristen, thank you very much. let's stay in los angeles for a moment. something getting buzz there. this has probably happened to all of us. you make a restaurant reservation, stuff happens, you end up not showing up. >> the owner of red medicine, a popular vietnamese restaurant in beverly hills, decided to do something about it. he took to twitter and posted the full names of people who failed to show up for their saturday night reservations. didn't just put their names in a list, he wrote things like, "hi," and then the name, "i hope you enjoyed your girlfriend's birthday and the flowers you didn't bring when you no-showed for your 8:15 reservation.

good wednesday morning to you. it is 7:26. i'm marla tellez. a few dozen people are without a home this morning after an overnight fire ripped through their apartment. it took crews a few hours to control these flames in san francisco's bay view district. two firefighters did get hurt. one fell off a ladder. the other suffered minor smoke inhalation. both are expected to be okay. a slight chance of rain in the forecast. meteorologist christina loren, i can see the clouds behind you. >> they are thickening up. marla, good morning to you. live look here. of course, the bay bridge. sliver of sunshine here. we will notice the clouds increasing, getting darker throughout the day. nonetheless, highs are really comfortable. 67 in livermore. 66 in san jose. 65 in gilroy, taking you through

check it out, weather channel on cable or weather.com online. savannah? there's a fight underway in california this morning over who should receive a million-dollar reward in the christopher dorner case. he's the former los angeles police officer who went on a killing spree last month before he died in a standoff with police. nbc's miguel almaguer is in big bear, california, with details. miguel, good morning. >> reporter: savannah, good morning. after eluding police for nearly a week, it's here in big bear where christopher dorner was holed up, spotted, and eventually lost his life. police offered that historic $1 million we ward. now as two parties have filed claim for the money, it's unclear if anybody will actually get it. during the six-day manhunt for murder suspect and fugitive christopher dorner, police announced the record reward. >> we raised over the million dollars. >> reporter: accused of killing four, the trail for dorner had gone cold until karen and jim reynolds surprised the ex-lapd cop who had been holed up inside one of their rental cabins. >> he said, "put your hands on

your head. turn around and face the wall." >> reporter: dorner left the reynolds bound and gagged before stealing their car. when they were finally able to dial 911, police quickly closed in on the fugitive. >> we're the ones that made the call to police that gave the 911 call that told them where he was, which direction he was heading. >> reporter: the reynolds aren't the only ones looking for a payout. >> he pointed a gun at me. assault-type rifle. >> reporter: rick heltebrecht was cornered after the reynolds called 911. he called the sheriff's deputy to report the incident and he, too, has filed a claim for the reward. our calls to him were not returned. the lapd now says some 25 agencies must agree on who if anyone should get the reward. and that process could take weeks. >> chief beck has been very clear and very vocal that he believes that a reward should be paid in this case. >> reporter: the city of

up. >> this next one -- a lot of people -- people come over unexpectedly. you have wine that's warm, you need to chill it. most people pop it in the freezer. >> takes an hour in the freezer. this takes a half-hour. water and ice gets to 32 degrees, obviously -- why don't you hold this? >> thermometer? >> yeah. >> and angle maybe a little bit. if you add salt to this, what's going to happen is the water temperatures going to go down to 32 to 25, 26, fairly quickly. >> why does that happen? i failed junior high school chemistry. >> it's complicated, but the basic concept is the ice melts, it's drawing energy out of the water, energy means heat. the temperature goes down as the temperature of the ice goes up. >> then to follow your logic, you popped that bottle of wine in that water with the salt in it, it's going to chill faster than in the freezer? >> like 25 degrees, a half-hour instead of an hour in the freezer. salt takes it from 32 to 24. >> a great idea. really good. and bunt pan, most people make a take with a bundt pan.

good morning to you. it's 8:26. i'm laura garcia-cannon. investigators need your help finding a man who molested and tried to kidnap a young girl. take a look at this surveillance video. oakland police released. it's close to the intersection of 94th avenue and b street on monday. officers say a 9-year-old girl was playing when a man grabbed her, sexually assaulted her and threatened to kidnap her. they think the man also tried to abduct a child last year. pretty close video but we wanted to show it to you. >> things starting to recover nicely after a big jam formed at the oakland coliseum northbound 880 starting to move at high street and heading into downtown. we had a two or three car crash at 23rd that caused the back-up.

"it went together. >> being a volunteer emt was harder than he thought. >> i didn't quite even know what i was getting into to tell you the truth. i quit a couple of times.

this. sleeping disorders among kids can lead to obesity, misdemeaem problems, anxiety, and depression later in life. we've got young children. how do we know when it's just a 3-year-old's regular exhaustion or something we should be worried about long term? >> for the most part, it's 35i-year-old's regular problem. i -- 3-year-old's regular problem. it's difficult to get young kids to sleep alone, go to sleep. if your child has night terrors or sleepwalking or excessive snoring, those can be signs of a real problem, a sleep disorder that needs to be managed. >> the article says that -- a 5-year-old snoring, parents think it's cute. they said if you can hear the snoring outside the room, if it's that loud, that could be a telltale sign. >> absolutely. this could be a sign of what's called sleep apnea where you stop breathing for seconds to minutes during the night. and this lack of oxygen leads to problems with sleeping. you wake up to try to breathe again, and you never get into that nice deep rem sleep that you're supposed to get into.

this leads to daytime sleepiness even though the child's in bed all night they wake up exhausted. >> and to back track, define a child. if you have an infant that wakes up every three hours -- >> i have this. six months. >> this is different from an 8-year-old waking up constantly. >> children sleep a lot. especially babies. babies sleep 14 to 16 hours a day including naps. >> right. so does my father, by the way. put that out there. he's 80. >> right. they seem to be awake a lot, but they sleep a lot. they just awaken frequently. that's normal. in preschoolers, you want 12 to 14 hours of total sleep a day. once in school, 10 to 12 hours a day is what kids need to be fresh and aware and awake and not cranky. >> we've got a list of ideal sleeping scenarios. you begin with a cold, dark room. >> really cool. not too cold but a cool room is better than a hot room. >> like a wine cellar? >> a wine -- talk about surrounded by wine.

>> cold, dark, quiet. >> so usually a little cooler is better than warmer. quiet in the house. if you can, have a regular sleep time. leave the child alone, give them ample time to fall asleep. some people think you're supposed to get in bed and fall asleep in five minutes. it takes about 20 minutes of just relaxation to fall asleep. also get rid of screens close to bedtime. the blue light from a screen alerting to the body. get rid of those. let the child have time to rest. >> how do you know when there's a problem? at what point do you say, okay, this is beyond normal. i need to see a physician about this? >> sure. those issues we talked about, the snoring, sleepwalk, night tro terrors are three to see your doctor about. if you try to be disciplined in the household to have a sleep time, good bedtime, and your child seems to have daytime sleepiness, crankiness, trouble paying attention, bad behavior problems, those are things to discuss with your physician and see if they might be linked to sleep. a good thing is to keep a sleep
