technology when the crash happened on 101 in mountain view back in 2018. the drivers family says tesla oversold the autopilots ability. tesla says the driver was at fault for being distracted by a videogame while using the autopilot feature. nbc now reports the suit was settled just before it was set to go to trial. experts say if the family had won in court, today, it could have set a precedent for a dozen similar suits. the california highway patrol, meanwhile, is trying to determine what led to an early morning accident that left a nine-year-old girl dead. the girl was one of five passengers including her mom, her sister and her cousin. gentoo's jody reports, we are looking for the driver who ran from the scene. >> reporter: oscar nunez said he heard the sound of a driver hitting the brakes and then a car rolling off the road and into the dirt median. at i-680 and 242 split in

concorde early yesterday morning. >> the witness stated is on mazda cx-9 leave the roadway and rollover. officers responding to the scene observed a mazda on its roof with parties ejected. >> reporter: a nine-year-old girl was among three passengers ejected. the girl died at the scene, her 32-year-old mother, 13-year-old sister, and 217-year-old cousins were all taken to the hospital with major injuries. the driver of the car, a man in his 30s fled the scene. >> will be interviewing the family members still, they are trying to recover from their injuries and keeping all this together. >> reporter: nunez says there are no words to describe the magnitude of the tragedy for the family involved. he says that spot has been the scene of many accidents. >> this crossing is very dangerous. i don't know if it's a lack of signage or if they go too fast.

who knows? >> when we see these types of collisions, the seatbelt is often what makes a difference from being an injury collision and a deadly collision. >> the chp says acl could have saved a little girl's life. it appears at least three of the passengers were not wearing them. tonight, they are focused on finding the driver who faces felony hit and run and manslaughter charges. they are urging him to turn himself in. >> it's definitely a priority for us to talk to him, figure out what happened that night. >> reporter: jody hernandez, nbc bay area news. the chp looking for a gunman, it happened on the round on from ashby to berkeley. this is the 22nd freeway shooting in the bay area. if that case continues, we could see 80 by the end of the year. according to police that number would be 20% decrease from last

year. certainly frustrating and dangerous, a series of illegal sideshows playing in the bay area this weekend, including one that brought traffic to a halt on the bay bridge. when the smoke cleared, multiple people arrested and at least one person seriously injured. gentoo's velena jones exciting how this is causing a lot of stress for neighborhoods. >> reporter: this is not the sound you want to wake up to at 2:30 in the morning when at least 100 cars are outside your window. >> this is the last straw. this is the loudest and most of noxious out of all of them we have ever had. >> reporter: it's an issue that says he and his family deal with on a monthly basis at the intersection of alma and excelsior. >> we thought this was nice and quiet and safe neighborhood. sideshows are very scary. huge number of people showing up, very loud sounds. we have seen a car ignited right here at this intersection. >> reporter: the early sunday morning sideshow was one throughout the bay area

leaving trash and skid marks behind. frustrating. neighbors like didi stevenson bailey. >> we are in the west but we are not in the wild west. it definitely feels like the wild west. unfortunately. >> reporter: after police broke up the first oakland sideshow at 42nd and international and drivers left didi's neighborhood, the group headed towards the bay bridge. there, drivers.traffic on westbound 80 for around 20 minutes before the chp detained two minors and arrested two adults. officers say the shows are outright dangerous for everyone. >> our main concern is the safety of the public. and we would ask that those who are considering or actually engaging in these activities would think twice before they do so. >> reporter: officers broke up sideshows earlier in the evening in menlo park or stanford and in mountain view where a woman reportedly broke her ankle after being hit by a

car. neighbors back in oakland say they are fed up after watching them disperse the crowd without the citations. they paid for their own cameras collected over 100 license plate numbers and submit it a police report. they said i want the city to do more. we went that is not enough. catch whoever the last person is in front of your cop car, give them a ticket, and if you do that enough times, it will be too expensive for them to take the risk. >> reporter: in oakland, velena jones. a message triggered a lockdown at a north bay high school today. investigators say they locked down rancho cotati high. a threat came in by text. it mentioned a weapon and specific about the other students locations. police found the team who sent the text at home in santa rosa. school was reopened a short

time later. there was never a risk to students or staff. a police standoff triggered a tense start to the week for a san francisco neighborhood today. darden at 6:30 this morning at an apartment complex. officers responding to reports of a man working in and making threats. that man, police say barricaded himself in one of the apartments. the man was having a mental health emergency and they called in a crisis negotiation team to help. ultimately he was taken into custody around 2:00 this afternoon and no one was hurt. a live look at segmental, lawmakers are trying to figure out how to revitalize the downtown of california cities. california assembly held its first meeting of the select meeting on downtown recovery. the mayors of sacramento, long beach, riverside and san francisco all weighed in, discussing specific challenges that china is facing recovery from the pandemic, including lack of tourism, light, empty office buildings, storefronts. the mayor suggests possible solutions part of which includes changing the narrative around what is happening in

tickets. there was a news conference held today at the state capital to explain why the bill is needed. >> instead of having one twice consumers will have multiple options of where they can purchase their ticket. companies will have to compete for consumer business, which will lead to lower fees and better service. >> if passed the bill would change ticketmaster's control over ticket sales in california. more opposition tonight for the proposed name change for oakland airport. the time is coming from san francisco city attorney. port of oakland proposed changing to san francisco bay oakland international airport. they would choose this but they say renamed airport could confuse travelers and violates the ethical trademark. the plan is to take legal action if oakland international airport doesn't change course. leaders say the goal of the name change is to attract more

travelers and highlight the geographic significance of flying into oakland. oakland airport says it will fight for the right to use the new name if it is approved. crab season getting cut short again. the season started late and today it is ending early. commercial crab season usually begins in november but this year it was delayed until january. it lasted less than three months. the shortened window is an effort to protect humpback whales during crab season and migrating whales sometimes get tangled in that crab gear. so if you are a crab lover it's a little bit of a problem. so many meteorological things happening today with the partial eclipse we got to see and then the sun was so bright, beautiful sunshine outside. >> it was such a fantastic day and it was so nice to see all the families enjoying such a monumental moment. >> a lot of people on spring break. you perfect time for that. been tested and that something

winter storm we saw just recently, and also any high clouds have kind of cleared through. tonight we are going to see a decent overnight low in the 50s so it will be a warm night compared to the 30s. no frost advisories for tonight and let's talk about those wind gusts. we have some breezy winds, 11 to 20+ miles per hour. the wind speeds calm down as the high pressure begins to settle in. so what can we expect you tuesday? we got upper 70s, for san jose 77 degrees, concord 78, hayward 75. san francisco, 68, and oakland, 73 degrees. however, right now, looking ahead into wednesday, it does look like it could potentially be the warmest day of the week. we are talking 80s. these are going to be the warmest temperatures we have seen since fall. definitely above average for this time of year, 81 martinez,

dublin 80 degrees, san jose, 83 degrees, morgan hill, 82. and here's the thing, depending on if we do see some cloud cover early on, or clearing, it could get even warmer than that. let's talk about how long this work will last because things are expected to change. you see the orange glow over california? that is a signal of high pressure making it exit starting on friday. here's the reason why, look at the rotation. we got a system churning just off the coast. timing for this, we are still going to see a bit of a change as fries friday into saturday. but we will know more as we inch closer. we are a couple days out. however, this does look like it's going to bring a chance for rain, but also a drop in temperatures. the possibility is going to come just in time for saturday, leading us into the weekend not only for the bay area but down through southern california yet again. and yes, this could even signal more sierra snow. your seven-day forecast looks great for the next couple of days. even san francisco coast and vacancy temperatures rising into the low 70s starting

the idea of unregulated, open and accessible internet to everyone has been a political battle for more than a decade. most recently the trump administration halted what is called net neutrality. today the as head of the sec came to the santa clara neighborhood to discuss how it will impact net neutrality. especially wildfire situations. hosting the roundtable discussion, jessica rosen were self, had its internet access cut off in the 2018 fire when fire agencies hit their cap on the internet use. >> federal medications commission oversees interstate communications. and internet networks are interstate. so when we go online and we try to use our broadband connections, it is important that there is someone who can oversee that to make sure it's
