can still be enforced. the ruling is on hold for two weeks. and arizona's attorney general is vowing not to enforce the law. nbc's laura jarret kicks off our coverage. >> reporter: a legal fight over abortion in a critical battleground state. fanning the flames of a political fire gaining ground towards november. arizona's highest court backing a law that bans nearly all abortions and carries up to five years in prison for doctors who perform one. the conservative majority on the court reviving a 1864 law that lay dormant for decades under roe versus wade. >> are you kidding me? 1864 was before women even had the right to vote. we are totally going backwards. >> reporter: 66-year-old arizona residen resident beth baumann fighting back tears. yet the state's democratic attorney general says she won't enforce the law. >> it is one of the worst

decisions in the history of the arizona supreme court. no woman or doctor will be prosecuted under this draconian law. i will fight like hell. >> it does give me comfort. >> reporter: some reassurance in a time of uncertainty, says dr. gabriele goodrin, who's practiced in the state for over two decades. >> i don't know what the law will be. it is so early to know how that's going to play out. >> reporter: is today's decision a win for your side? >> it is. >> reporter: alliance defending freedom says the existing 15-week law doesn't go far enough. and even if the state a.g. won't enforce a stricter ban, other prosecutors still can. >> it's our position that county attorneys have the authority to enforce this law. >> reporter: this latest court fight over abortion only raising the political stakes in a h election year. arizona, long a republican stronghold, now the latest state

on track to get a constitutional amendment on the november ballot, creating a fundamental right to abortion, if it passes. the vice president also planning to travel to the state for events friday. >> you look at state after state where they're passing these abortion bans, and the majority of the legislators doing it are men. telling women what to do with their body. and i've kind of had it with that. >> reporter: while the former president and many gop lawmakers continue to avoid talk of a national abortion ban. instead, backing state-level restrictions. >> some states are taking conservative views, and some are less than conservative. but it's back with the states. it's back with the people. >> the supreme court has turned it back over to voters. we've got to let voters sort through this. >> our thanks to laura for that report. articles of impeachment were expected to be delivered to the senate today. but house speaker mike johnson says he is postponing the effort to impeachment alejandro mayorkas until next week.

snalt senate majority leader chuck schumer is expected to quickly table the articles. some have threatened to hold up all senate business if the democrats do not allow a full trial. president biden says israeli prime minister benjamin netanyahu is making a mistake with his handling of the war in gaza. in an interview with univision that aired last night, mr. biden showed he is increasingly willing to criticize netanyahu but without making any significant changes in u.s. policy towards israel. let's go live to chapman bell who's following the story for us. what more candidatedid the pres? >> reporter: as you said, president biden has been increasingly critical of netanyahu when it comes to israel's handling of the war with hamas. particularly when it comes down to humanitarian aid and the lack of protection for aid workers and civilians in gaza. the president saying this in a statement earlier this month after the death of those world

central kitchen employees. and the president once again critical in an interview with univision that was recorded last week but airing last night. here's what he had to say. >> what i'm calling for is for the israelis to just call for cease-fire, allow for the next six, eight weeks, total access to all food and medicine going into the country. this should be done now. >> reporter: once again, the president emphasizing the need for more humanitarian aid to flow into gaza, as negotiations for a cease-fire continue but appear to continue to stall. and allthis while the biden administration has been critical of israel's handling of the war. defense secretary lloyd austin saying yesterday at a senate armed service committee hearing that the u.s. has seen no evidence that israel has committed genocide in gaza. this comment following

accusations earlier this year that israel had done so. the international court of justice saying that there is a case to be heard following a case brought by south africa on this topic as pressure continues to mount up on netanyahu. >> okay, chapman bell for us, thank you. the fbi says a teenager has been arrested for planning isis-inspired attacks. the suspect is 18-year-old alexander mercurio. the teen allegedly wrote text messages, saying he planned to carry out deadly attacks on churches in idaho. some of those were sent to an fbi informant. during the arrest, agents seized knives, a mashetchete and propa. the parents of michigan school shooter ethan crumbley were both sentenced tuesday. jennifer and james crumbley got

10-15 years each for involuntary manslaughter. while both expressed remorse in court, here's what the father of one victim had to say. >> i'm sure they were sad people lost this lives. i'm sure they're sad their son is in jail, i'm sure they're sad that they're in jail. that's not what's important. what was important was for them to recognize that they made mistakes. >> the crumbleys' son ethan is serving a life sentence without the possibility of parole. the company responsible for a freight train that derailed last year in ohio has now reached a settlement. norfolk southern agreed to pay $600 million to resolve class action suits filed after the accident. the company says individuals and businesses can use the money as they need, including for health concerns or property restoration. last year's derailment in east palestine was considered the most hazardous train crash in

ohio history. 38 cars carrying toxic chemicals came off the tracks, spilling contaminates into the country. a powerful microburst in arkansas damaged several homes this week. this happens when a relatively small column of air rapidly sinks during a thunderstorm creating a powerful gust of wind. a microburst with 80-90 mile-per-hour winds caused the damage you see here. people said it was all over in 60 seconds. let's bring in angie lassman. good morning, angie. >> hi there to you. we're dealing with severe storms this morning. we've got those thunderstorm watches up for parts of texas and a long line of storms stretching up into portions of the south. flood watches up to 13 million included in that across parts of the south. alexandria, birmingham, as this heavy rain works in.

today we have another day where we're concerned about these strong to severe storms developing. 13 million people at risk. notice monroeville, up towards lake charles and tupelo. we could see a couple of strong tornados and those wind gusts over 75 miles per hour. here's the spots where we're looking for the best chance of those tornados developing. new orleans up to tupelo. but where you see those crossed lines, that's where we have the better chance even through the evening hours tonight. as we get into tomorrow, the storm system heads to the north and east. we'll see heavy rain and another day of severd charlotte. upper 80s in orlando and miami hits 83 degrees with partly-cloudy skies. and that's a look at your forecast, frances. back to you.

investigating new whistle-blower claims made by a quality engineer who warns the 787 dreamliner's fuselage was improperly fastened together. in a letter to the faa his attorney writes it is likely to cause premature fatigue failure and it could cause the plane to break apart after many thousands of flights. >> he is alleging that boeing, knowingly, took a series of manufacturing shortcuts in the construction of the 787. >> reporter: but boeing strongly objects, insisting the 787 is very safe and has undergone intense stress testing, saying these claims about the structural integrity of the 787 are inaccurate and do not represent the comprehensive work boeing has done to ensure the quality and long-term safety of the aircraft. still, the new claims come after two fatal max 8 crashes

overseas, and the max 9 door plug blowout in january. all to be the subject of congressional hearings next week. >> boeing is putting profits and production speed ahead of quality and safety. >> reporter: the 787 fuselage is made of a lightweight composite material to make it stronger than aluminum, with better fuel economy. boeing and three different providers make the components that join together in the final assembly. the faa has already approved boeing's plan to tighten paper-thin sections which they claim are vulnerable. boeing says they are tested and safe. the plane should fly for decades. the whistle-blower worked at the same plant where another whistle-blower worked, john barnett, who took his own life last month. before these new allegations, the faa chief told lester last month, boeing's quality control remains under intense faa oversight and inspection.
