music played loudly brewing in the north bay. the unhoused living in a nearby encampment say one business is targeting them. what lawyers are doing today to try to put a stop to it. this is today in the bay area. good morning to you on this tuesday morning. thanks for allowing us to be a part of your morning. i'm marcus washington and i'm laura garcia. we'll check in with mike in the morning, commute in just a little bit. first. want to enjoy the forecast for today? another nice one. a little warmer a little warmer for some spots. and mainly that's the usual spots that heat up a little bit more than the coastline. so we're going to have a temperatures peaking today in the low 80s. not too bad. but then tomorrow the winds will start to pick up and then it gets quite a bit cooler as we lead into our holiday weekend. take a look at our highs for today and what our normal high

temperature is for this date. in santa rosa, we're looking at a high of 84. now. usually we're seeing a high of 76. and in concord 86 degrees there. when we're used to seeing upper 70s. so once again it is a little bit above average but not setting any records here. san jose looking at a high today of 82 degrees. we'll talk about the rest of the week. coming up, mike, you're tracking the wait at the bay bridge yeah, things kicked in pretty quickly on this tuesday. i thought maybe a heavier volume was in store at the bay bridge, but we're sorted out to about what we'd expect now on your typical. so this is a smooth flow of traffic, a steady build there and things actually getting better for speeds heading into san francisco. i think they might have slowed those metering lights down a little bit more slowing on your typical builds. we're looking at no major problems as the first burst of traffic clears from san jose checking out a crash on highway 17, and i'll have more detail coming up. but i do want to make sure you know about this closure here on fremont boulevard between thornton and peralta. your access to and from 880 are central avenue and thornton. and for the details on this crash,

there's a lot going on. we'll hand it right back to you. yeah, that's that breaking news for us right now this morning. this is coming out of fremont as mike was just telling you, where police are investigating that fiery crash. this is leaving fremont boulevard close near thornton. now, it happened a little after midnight. this is when a car struck a tree before bursting into flames. as you see there. want to give you a live look right now? this is the scene. police. so far not confirming if anyone was trapped in that car, despite witness accounts suggesting otherwise. now we do know that someone was pulled from that car alive. it's not clear how that person is doing this morning. now, fremont boulevard remains closed at this hour. a bob redell is there at the scene. he'll have a live report for us coming up in our next half hour. wow. can't believe someone was pulled out alive. well, this morning some unhoused people in the north bay are turning to a judge for protection for what they call harassment. they're accusing a business of trying to drive them away by playing music. today in the bay kris sanchez joins us now from our newsroom with a

tactic that's really hitting a sour note here. chris. oh, so, laura, this is an encampment of unhoused people who are living behind an east bay tire shop that's been in san rafael for years now. things have been mostly harmonious until about four days ago when the music started. take a listen. now, one of the people who lives in the encampment near lincoln avenue and second street says the music started about five days ago. it is a loop of music that blares all night long. the folks at east bay tire don't want to talk to us at this point about the overnight music, but the president of the marin homeless union says this escalation is about forcing the unhoused people to pack up and move. i think right now, the property owner is trying to facilitate is being emboldened by the city of san rafael's antagonism towards camp integrity and trying to help facilitate the city's mission of forcing everybody

out. now, the city of san rafael did not respond to our requests for comments about the claim that it is trying to dissolve the preliminary injunction protecting that encampment. now as you might know, many local communities have been waiting for a supreme court decision on an oregon case that would clarify what communities can do, whether people can be fined or jailed for camping in public. if the communities don't have somewhere else to go, that case could have an impact here. now, this morning, attorneys for the people of that encampment will appear in a marin county superior courtroom seeking a restraining order, forcing that east bay tire shop to turn the music off. marcus all right. kerry, i mean, chris, thank you. well this just into our newsroom, a singapore airlines passenger is dead. another 18 passengers now in the hospital. this is after severe turbulence during an overseas flight. now, that plane taking off yesterday afternoon from london heading to

singapore. pilots later made an emergency landing in bangkok. i want to show you some video. this is new video from the tarmac there showing those passengers being treated now, tracking data captured by the website flightradar 24. it showed the singapore airlines flight cruising at an altitude of 37,000ft. it then shows that plane suddenly dropping down to 31,000ft. this is over a span of just three minutes. about 230 people were on board that flight . we're told 30 of them in all were injured. the airline, now working with authorities in thailand to provide necessary medical assistance to those impacted. new overnight france and belgium announcing their support for a controversial ruling by the international criminal court tied to the war in gaza, the court yesterday called for arrest warrants for israeli prime minister benjamin netanyahu and the leader of hamas, along with israel's defense minister and two other top hamas leaders. the court is accusing both sides of war

crimes and crimes against humanity. the u.s. and israel are among those harshly condemning the decision, calling it a farce and saying there's no comparison between each side's motives. many in iran are mourning after the country's president and foreign minister were killed in a helicopter crash. this is new video of the funeral procession for ebrahim raisi and members of his entourage. a white truck carried the coffins for raisi and his foreign minister, along with the seven other people who died in the crash. tomorrow marks a public holiday as a funeral for the former iranian president will be held in the country's capital of tehran. 606 this morning, former president donald trump back in court today, the criminal hush money trial proceedings monday ended abruptly. this is after the jury heard more testimony from his former lawyer, michael cohen. now the prosecution rested its case. the defense calling its first witness, who drew anger from the judge overseeing those proceedings today in the bay's

brie jackson live for us in washington this morning and brie, i guess we're expecting another dramatic day in the courtroom. that's right. good morning. marcus. so judge juan mullholland cleared the courtroom yesterday to scold one of former president trump's witnesses, robert costello. costello was an attorney for rudy giuliani. now mershon, among other things, saying, if you don't like my ruling, you don't give me side eye or roll your eyes. chaos breaking out in the courtroom during the criminal hush money trial, a former president trump. nobody's ever seen anything like this. this is a witch hunt. this is a witch hunt. judge juan merchan clashing with defense witness robert costello, a former federal prosecutor. he advised former trump fixer michael cohen before the two had a falling out. costello testified, saying that cohen said numerous times that president trump knew nothing about the $130,000 hush money payments, stating cohen

did this on his own. cohen's attorney coming to his defense, i think michael has been nothing but, forthright with this prosecution team. while on the stand, cohen admitted that he stole money from the trump organization because he did not receive a large enough bonus. trump allies speaking out. there's a lot of crime in this city, and the manhattan d.a. should be focused on real crime, not on a president of the united states. protest outside the courtroom. continue. those against trump chanting no one is above the law is above the law. his supporters echoing claims that this case is a witch hunt. we did nothing wrong and i want to get back to campaigning. i'm representing millions and millions, hundreds of millions of people. judge mershon says both sides should expect to deliver closing arguments after memorial day in manhattan.

district attorney alvin brags office presented its case with testimony from 20 witnesses over 15 days. marcus and the trial goes on brie jackson and this morning helping us sort all of this out. thanks, brie. well, new at 6:00, san jose is getting a huge financial boost to help crack down on speeding drivers. city leaders just announced an $8.5 million federal grant. the money will cover most of the cost to install 33 new speed cameras in some of the highest risk locations. the data will not be shared with police to support criminal investigations, only for speed limit enforcement. the program is expected to roll out late next year. all right, let's take a live look out in san francisco this morning. are beautiful shot. i mean, just that san francisco for you, right? breakfast in the city. that sounds nice. let's do it. and now it's going to be warm in a lot of places across the bay area today. carrie, what about san francisco is going to be

pretty comfortable. yeah, really nice day. i mean, upper 60s, low 70s throughout the afternoon. and we're going to be even warmer for the inland valleys as we're starting out in the upper 40s and low 50s. it is a sunny start all across the bay area. and then as we get the kids off to school, drop off time in san jose, it will be at about 52 degrees. but look at the difference between drop off time and pickup time. it will be 80. with all of that sunshine and a nice summer like day 82 for that high temperature in the south bay. we'll see that in much of the east bay with upper 80s for the inland east bay in concord, 86 degrees 80 for napa, and 71 in san francisco. but we'll bring those temperatures down just a few degrees for tomorrow afternoon. and, mike, you've been watching the morning commute. any issues popping up out there? you know, no major issues. we're talking about smooth flow of traffic, mostly green sensors and no real surprises. i told you we'd check on the crash down here on highway 17. it's actually the campbell on ramp to southbound

loss of about $300 million. hims is a company that sells viagra and hair loss drugs. it's now selling its semaglutide weight loss management like wegovy or ozempic. same ingredients and for a lot less than drug companies about 200 bucks a month. the head of the fdic is stepping down after a scathing report found the workplace he leads is rife with harassment and discrimination. martin gruenberg says he'll stay on until a replacement is named the white house says that's going to happen soon. the latest data shows inflation easing. things are getting better, but a number of big chains say they're seeing pullback from american consumers tired of high prices and shrinking products mcdonald's, home depot, starbucks all saying the same thing. target says it will lower some prices to get people back into stores. what's behind this decision by target? consumers have been showing since the inflation surge of a few years ago, very strong price

presley's famed graceland estate in memphis is set to be sold during a foreclosure sale this week. now, the sale date has been set for thursday. this is according to a legal notice. however, presley's family is fighting back to stop that foreclosure sale. presley purchased graceland mansion back in 1957 and lisa marie, his daughter, inherited the property after her father's death. however, lisa marie died in january of 2023 and her daughter is now the heir of the estate and trustee of the promenade trust. presley's granddaughter has countered that lawsuit, saying that the claims to the estate are fraudulent. according to the document, the music stars heir says lisa marie presley never borrowed money or even gave a deed of trust to the investment company, which is now behind that upcoming sale. an injunction hearing is now set for wednesday. trending for you this morning. you heard of luxury planes, yachts, luxury cars. but what if it was on the

look at this. look at the sun behind us here already. make your way for a nice day. it's going to be warmer, too. with the lack of that marine layer in the fog that we see, that kind of protects us from those hotter temperatures. as you're heading to work this morning in the north bay, it's a cool start with low 50s, but it will be warming up quickly upper 70s by 1:00 in the afternoon, and our high temperatures up to the low 80s. and we're going to see this one day of a lot of widespread 80s from the south bay to the east bay. we're still in the upper 70s for oakland this afternoon, 78 degrees 78 in redwood city and in san francisco, 70 degrees in the mission district for the north bay. we're going to see novato reach a high of 82 and 84 in santa rosa. so then as we go through the forecast, several storm systems moving through the pacific northwest, we'll push some cooler air our way. we're not going to see much in the way of rain, with the exception of more clouds and fog near the coast and maybe even some drizzle. but we're also going to see a significant cool down here, with santa rosa going from

84 today to 78 on thursday. and then look at saturday. when do we get memorial day weekends with a high of 67 degrees and 71 degrees on sunday, and then going through next week, just a little bit warmer, but still very seasonable for this time of year. so we're going to see a big dip in temperatures after today. each day stepping down into the coolest day on saturday where san francisco will only see a high of 58 degrees. yes, cooler temperatures ahead. and mike, you're looking at a couple of major crash scenes. the first one is a new one. palo alto police tell us to avoid the intersection of oregon expressway and middlefield road. these are two major roadways through palo alto. you see the congestion already forming. there's an injury accident that they're investigating. embarcadero is probably your easiest access. instead of oregon expressway through the area other side of the bay. we continue to follow that fiery crash in fremont. that's fremont boulevard between thornton and peralta. we got

to help our kids struggling in middle and high school. the schultz family foundation, along with pinterest and americorps, they have teamed up with 11 states, including california, to create a new youth mental health corps. it will actually help

kids connect with mental health support, which is lacking in many parts of the country. now, we know that locally, there's a shortage in mental health providers who actually can afford the bay area and insurance coverage usually doesn't support enough sessions to truly help people deal with issues. now, last year, a mental health america study found that almost 60% of young americans with major depression do not receive any mental health treatment and it's certainly badly needed, the cdc study found that the suicide rate among young americans increased over 60% between 2007 and 2021. the youth mental health corps would actually deploy specifically trained 18 to 24 year old men and women to help their peers navigate and actually find help and mental health system. it launches in some states this september. the rest of the states, including here in california, will happen in fall of 2025. you must have a high school diploma and be between the ages of 18 to 24 to

in fremont. we're live at the scene with new details on the investigation and the impact to the commute. they said it was to allow us to be independent. they said it was. it was to help drivers and it hasn't helped drivers. it's made it worse for drivers. the fate of gig economy lies in the hands of the state's highest court. the recently passed ballot measure, rideshare drivers call unconstitutional, and the measure and the message they're sending today to judges. a fast food fight is heating up in contra costa county as a planned new chick fil a ruffle some feathers, the area many fear could soon turn into a huge traffic headache. this is today in the bay good tuesday morning to you. thanks for starting your morning with us. i'm laura garcia and i'm marcus washington. let's get right to that. breaking news for you this morning coming out of fremont. this is where that fiery crash is under investigation today in the bay's bob redell is live on the scene. we know roads are

still shut down in that area. bob it is laura and marcus. we're talking about fremont boulevard, where i'm standing between thornton, which is behind the camera position. all the way down to peralta. traffic is light right now, so we're not seeing too much impact. but as the morning commute goes on, this could become an issue. and you can see what we're talking about as solo vehicle crash into that tree right there. this happened a little bit after midnight around 1240, the driver of that vehicle crashed, and they ended up in front of a discount pet food supply. and as you can see in the video, that car caught fire. we are not getting any information from fremont police, but we did hear from a witness at least one earlier overnight that maybe somebody had been trapped inside the vehicle. maybe somebody is dead inside the vehicle, but we have not been able to confirm that within the past ten minutes, a man came over and started yelling in spanish, talking to police. we do not know if he is possibly the father of somebody who might be

in the car. there's also some other younger men who have been on the scene, i asked one of them if they were, you know, friends with anyone who might have been involved in this crash and there was no response to them. and so, again, we are trying to get information from fremont police. we have not seen a coroner's vehicle show up yet, but they are treating us obviously as a major crash investigation, given the fact that here we are several hours after the accident, the road is still closed. the vehicle has not been moved and they are taking lots of photos of the scene and such. so again, a major vehicle crash here, just past the intersection with thornton on fremont boulevard in front of bogeys discount pet foods and supplies, not clear how long this road is going to be shut down for, just trying to get some more information from fremont police reporting live here in fremont, bob redell today in the bay. all right, bob, thank you. now, our team has been sending out updates about this story from the moment it broke. if you haven't already , make sure you download our

free nbc bay area app. that way you can get those updates. well, happening today, the state supreme court weighs the future of california's gig economy. it comes in the form of a voter approved measure some workers now call unconstitutional. today in the bay's ginger conejero saab joins us live in san francisco this morning. and, ginger, this really all boils down to whether people and delivery rideshare workers should be considered independent contractors. that's right. laura. good morning to you. and both sides really have quite a bit at stake here. and that's why we can also expect a turnout of gig workers who are opposing proposition 22. they're set to rally later today outside the courthouse, where proposition 22 and its constitutionality will be argued here in san francisco. but let's take it back a bit at the heart of this, at the center of this all is proposition 22, which is a ballot approved measure. it was set on the ballot in 2020. it was sponsored by big gig firms like uber and

lyft, rideshare companies, as well as doordash and instacart. it allows those big companies to treat their drivers and delivery workers as independent contractors and it was a response to a california law that codified a supreme court decision requiring companies to classify gig workers as employees. proposition 20, i should say proposition 22 passed with 59% approval from voters, but drivers and delivery workers have continued to challenge its constitutionality. today, the state supreme court will hear arguments on both sides and where that decision eventually falls can impact the gig economy tremendously later today. as i mentioned, hundreds of gig workers are expected to rally outside the courthouse to show their opposition to how prop 22 works in practice. one rideshare driver that we spoke with has been driving for eight years now, he says he's seen things change quite a bit. he says, what is offered in proposition 22 is not enough to protect

contract workers like drivers, and he believes it's simply unconstitutional. and if there was a $10 fair uber and lyft before they started with, you know, $2 for what they do, which is the background stuff, the, you know, the leadership and the software and $8 to go to a driver. now, if that's a $10 fair for uber and lyft. now, take 7 to $8 and driver gets two. well, uber specifically has responded to today's hearing saying in part, quote, forced employment would be devastating for the thousands of drivers and couriers who turned to uber for flexible work and the millions of californians who would see major service reductions and cost increases, or lose ridesharing and food delivery entirely. that rally is set to start outside the courthouse at 1230. there's also a caravan that has is expected to arrive

in san francisco from other parts of the state. laura. so this is really something that we see impacting not just the people involved, but also the consumers as well. we'll continue to monitor how this all develops and bring you updates on air and online. laura. all right. perfect. thank you very much, ginger. well new at six. the half moon bay mushroom farm at the center of last year's deadly shooting rampage, now being ordered to pay nearly half $1 million in back pay and damages. seven people died at the farm owned by california terra gardens and concord farms. the department of labor now says that agents uncovered multiple workplace violations with the discovery of poor living conditions for those workers. now, the owners are also accused of illegally deducting housing costs from farm workers wages. and accused gunman, meanwhile, recently pled not guilty to new charges. tonight, people in walnut creek can let the city know what they think of a proposed chick fil a today in the bay's kris sanchez. joining

us now with more on the concerns already being raised about this very popular restaurant. i mean, i think you can probably guess what those concerns are. chick fil a is super popular. chances are you've waited in a drive through line, or you've seen a line of cars snaking through the parking lot waiting to place an order, but even the restaurants that don't have drive thrus are plenty busy. and that's why a lot of folks in walnut creek want their city to say no to a new chick fil a restaurant. let me show you where we're talking about. chick fil a has a conditional use permit for this location at citrus marketplace on oak grove road near ignacio valley road. that permit is for restaurant without a drive thru, but people who live in the nearby neighborhood filed an appeal, saying the restaurant, still without a drive thru, will create too much congestion because cars with no drive thru, more customers might turn to food delivery services. while a traffic study did not show a substantial impact on traffic, not everybody is sold. i think

it would be fine. probably there's not a lot in that plaza, so as long as there's parking, then i think the traffic wouldn't be too bad. it's going to create a traffic nightmare. you got northgate high school right up the street. you got ignacia valley down the street and certain times during the day it's going to be pretty chaotic. it is a wonderful restaurant. a lot of people love it, but definitely it could be an issue how chick fil a representatives and opponents will get to have their say at tonight's city council meeting. that's at 6:00. this would be the second chick fil a restaurant in walnut creek. the other one is about four miles away. okay, so we see this in a lot of communities. sure. you know, you understand. but i do think that some of these restaurants we were talking about, they do try to make, you know, put more attendants out there to try to keep it moves along pretty quickly, you know, in. yeah i mean, i guess it depends on even car washes have to deal with this too. they got to keep it. yeah. oh yeah. for sure. yeah. well we'll see what happens. all right. that we will. thanks,

chris. the secret's in the sauce. hey, let's take a live look outside. we are anticipating a beautiful day in the bay area. live look. the sun rise over san jose. carrie's got a look at our forecast that sun going to warm things up? yes. and if you like the warmer temperatures, today is your day. if you like the cooler weather, just wait a couple of days. things are going to be changing here as we take a live look outside in san francisco. all clear and sunny and the sunshine continues, which means it's going to be a warmer day here as well. upper 60s and low 70s for the afternoon. and when we take a look at our highs and what we're expecting today versus what's our average high temperature for this date, in some spots like oakland, it's going to be ten degrees above normal, with san jose hitting a high of 82. we're used to seeing temperatures in the mid 70s. so we'll talk about a cool down in our forecast. mike, you were calling out the unexpected. yeah we expect to see where the arrows are showing the slower drive. that's the continued build south 242 really jammed up south. 680 also building there were earlier crashes. there was

the bay accusation from the international criminal court? yeah, from their chief prosecutor. good morning. who wants the court to issue arrest warrants for israeli prime minister benjamin netanyahu as well as israel's defense minister and three leaders from hamas? here's a brief clip of the accusations the prosecutor made speaking from the hague. i'm filing applications for warrants of arrest before pretrial chamber one of the international criminal court. in the situation in the state of palestine. now, among the accusations against israel using hunger as a weapon and deliberately targeting civilians, both of which are war crimes. president biden spoke shortly thereafter at a ceremony to recognize jewish american heritage at the white house. here's his first reaction to the accusations against israel. let me be clear we reject the icc's application for arrest warrants against israeli leaders. whatever these warrants may imply, there is no equivalence

between israel and hamas. and it's clear is must do all it can to ensure civilian protection. but let me be clear. contrary to allegations against israel made by the international court of justice, what's happening is not genocide. we reject that and will always stand with israel and the threats against its security. neither the united states nor israel are members of the international criminal court. so the arrest warrants, if they're issued, will not affect the accused directly, though it could limit their travel. the icc has a warrant for vladimir putin's arrest as well. netanyahu says the charges against him will bring shame to the court, and he says the court is one of the enemies of israel. two weeks ago, on holocaust memorial day, i pledged this no amount of pressure and no decision in any international forum will prevent israel from defending itself against those who seek our destruction to all

the enemies of israel, including their collaborators in the hague. i renew that pledge today. israel will wage our war against hamas until that war is won. in other news, the top democrat in the senate says he'll bring back that tough new immigration bill, written in part by republicans that would allow the president to, among other things, cut off applications for asylum and bring more funding to the border patrol. it was rejected by republicans at the behest of donald trump, who publicly said he wanted to keep the border an issue. we, the american people, do not have the luxury of playing games with border security. the issue is too important to ignore, and the bill we negotiated earlier this year is too good to pass up. so we're going to give republicans another chance this week. that vote will come thursday. donald trump's first criminal trial continues today. we expect the defense to rest. and the judge, laura, says the closing arguments will come next week. all right. one, we'll continue

to follow. thank you scott. well, now to our climate in crisis, california has some of the best weather to generate solar power, but it can get a little hazy when deciding if it's the right move for you or your home or your business. yeah, and it really can get expensive when you already have solar but aren't seeing the returns you thought you'd get. meteorologist kari hall has shined some light on this topic. california leads the nation in solar generation in 2023. what's known as small scale solar or homes or community centers was enough to power around 6 million homes. solar power is also coming to light in states like texas, florida and north carolina as the world looks to turn off the switch on fossil fuels, solar panels can lower greenhouse gas emissions, create green and healthy neighborhoods, and possibly increase your property value by up to $15,000, according to the department of energy. as attractive as rooftop solar panels may be, it can get

complicated and frustrating, with frequent and confusing changes in how property owners get reimbursed and what's known as the net metering program. last april, we changed the policy for new systems, but not for old systems. old systems still get that. net metering deal. the new systems now have, have you still get to save the retail price if you use the power right in your house? but if you inject it into the grid, you get a much lower compensation. we're now in the third version of this program, with recent reductions in buyback rates, due in part because california has expensive electricity rates, some residents have started to question whether solar panels are right for them, and that makes solar companies nervous. now, initially, it can be really overwhelming trying to figure out the tax credits, the installation, estimating your net energy metering, all of that stuff. but just keep in mind that the end goal is to try to move toward a greener solution. we're trying to meet these climate goals here, so, you know

of 82 and 83. in east san jose, 82, in gilroy. the 7-day forecast is coming up at the bottom of the screen, and you notice that it's going to be cooling off every day after today. so if you like the warmer weather, today is your day. antioch, 87 degrees 84. in danville and fremont. up to 80 for this afternoon. we'll also see a high of 80 in palo alto in san mateo at 73 and 65, in daly city, 70 in the mission district, the marina district, 63 and 82, in novato, with clear lake hitting a high of 85. we are going to see some changes. storm systems moving across the pacific northwest, moving east now, it's going to miss us with the rain, but we are going to get the cooler weather much more of a marine layer at the coastline. and that fog and drizzle for the beaches. but we're also going to see a cool down inland. take a look at concord and what to expect. we're going for mid 80s today to upper 70s on thursday and saturday's high temperature only

65 degrees, and it does get a little bit milder going into next week. but wow that's a cool weekend. especially with it being memorial day weekend. and a lot of people want to head to the beach, but it's going to be chilly and our valley temperatures in the upper 60s, only 58 in san francisco. and mike, you have an important detail about that drive through fremont. yeah, carrie, the closure continues here. fremont boulevard between peralta, between peralta and thornton, now in about the next hour, we should see folks starting to arrive over at american high school, which is over here. and so that could be a major factor for local traffic. thornton middle school is right about here as well. so central will take you to and from the freeway. so will thornton. and to get past the scene, you can go down here to blake howe and also go up to paseo padre. but again, that local traffic, having had kids that went to those schools, things get very congested in that area. so keep that in mind for local traffic. meanwhile, the rest of the freeways are moving pretty smoothly. the build is on for the south bay. back to you. all

right. thank you very much, mike. well, happening now. thousands of health care workers in california may have to wait for a minimum wage increase. that's because the state is facing a severe budget shortfall. governor gavin newsom says negotiations are centering around possible delays or changes to a bill that he signed last year. the law would raise the health care minimum wage to $25 an hour next month. however the state says it would cost about $4 billion a year. governor newsom says he's working on a resolution. and up next this morning, the top stories making headlines that breaking news out of fremont. that's where that deadly fiery crash overnight closing nearby roads. we're live there at the scene this morning on that investigation, plus heading to the state's highest court, the recently passed ballot measure, gig workers call unconstitutional. and the message they're nding tose

welcome back. we are moving you forward with a look at our top stories here on today in the bay, starting with our breaking news out of fremont. that is where there's still a lot of cleanup after a deadly, fiery late night crash. our bob redell is at the scene. and bob, are you learning anything more about who was in that car or what happened here? we are getting a better sense. first of all, fremont boulevard is shut down between thornton and peralta. this is a major intersection because of that right there. that is the car accident. this happened just after 1230 last night. you can see in the video that the car crashed into a tree. this is in front of bogie's discount pet food and supply and it caught fire. now the fremont police has confirmed to us that 1 or 2 people in the car, one person, was pulled out alive and taken to hospital while the other person person sadly died. and we believe they are still in the car. there's a man out here who is very upset.

he told me in english. that's my son, referring to the person still in the car, and then in spanish, he chastised first responders, saying they could have taken them out, they could have taken them out, but they let him burn. we should let you know. we have no reason to believe that firefighters didn't do everything in their power to try to save this young man. reporting live here in fremont, bob redell today in the bay. so sad. all right, bob, thank you. well, the state supreme court justices will hear arguments on proposition 22 today. that's the measure approved four years ago. defining gig economy workers as independent contractors, rideshare and delivery companies supported that measure, which was a response to a supreme court decision requiring companies to classify gig workers as regular employees. opponents call prop 22 unconstitutional, saying it does not offer enough worker protections. looking forward to the forecast today should be a nice one. it's going to be nice and warm for some spots up to 85 degrees in parts of the east
