underway in the busy intersection. still shut down hours after the moment of impact. plus the defense rests in the first criminal trial of former president donald trump. our scott mcgrew explains where the case goes from here. good morning. thanks for joining us for our midday newscast. i'm marcus washington and i'm laura garcia. first, it's been more than ten hours since that fiery crash we showed you in fremont. a busy intersection is still shut down. and within the past hour, we received an update from police surrounding the deadly investigation. we have team coverage for you this midday. mike is helping you navigate the traffic impact. just moments. but first we want to get to nbc bay area's bob redell. he's joining us live from fremont. so bob, what are police saying about all of this? good morning, jim marcus and laura fremont. police still do not know what caused that car right there to lose control, hit a tree and catch fire in front of a pet store here on fremont boulevard.

but i did just speak to the general manager of that store who says it's something like this was going to happen. it was only a matter of a time, in his opinion, because he says drivers tend to speed at this location where the road narrows, and you can see how it narrows. there where the car initially hit on the curb there where the dirt mark was. this crash happened around 1230 this morning. no other vehicles involved. there were two men in that car. and as you can see in the video, as i mentioned, that car caught fire. the passenger was rescued, but sadly the driver did not survive. now the pet store surveillance camera captured the accident. the general manager who watched it tells us it does show the car speeding, in his opinion not confirmed by police. he says it hit a lamp post and then crashed into that tree. he says that within about 10s, a fremont police officer happened upon the scene. the officer immediately grabbed his fire extinguisher from the back of his vehicle, and ran over to the vehicle, putting out the flames that were underneath the car at

the moment, trying to subside them, managed to get them low enough, so that way he and the 4 or 5 people who came out of the apartment complex were able to get the remaining survivor out of the car, and then. yeah, and then they, and then they all just backed away from the vehicle because i think it was probably a at risk of catching on fire again. and that car did unfortunately catch on fire again. a wrecker has removed the car from where it crashed. and this is while the father of the driver, who died has been looking on. earlier this morning , the father of this young man told me that this was his son and in spanish said they could have taken him out. they could have taken him out, but they let him burn. there is no indication that first responders didn't try their best to save the young man, the driver, the passenger was taken to the hospital, his condition unknown. again, police

do not know if the driver was speeding or what caused this crash. they are going to be releasing more information later today. they said, but they do not believe that they'll have a cause any time soon. and we're back here on fremont boulevard in the middle of fremont boulevard, which has been shut down between thornton and peralta for quite some time, reporting live here in fremont, bob redell nbc bay area news. no matter what the cause, a tragic way to die. thank you bob. well, as bob was just mentioning hours later, that intersection still closed on mike inouye. of course, now, with more of what you can know about getting around all of that. and mike, i mean, it certainly is going to cause some confusion for people who are used to using that area. it is, in fact, i was worried that it wasn't going to clear before school started, and it didn't reason is because there are two schools nearby now. this is where the incident is. the closure right here between peralta and thornton, you can get to and from 880 through the area, central avenue and thornton or state route 84. that's on this side of the

freeway. state route 84 over here. that's decoto road and continues on to the dumbarton bridge. and that's why this stretch of fremont boulevard is so popular. it can access the freeway. and basically for points. but now it's cut off by that continued closure. and investigation. now american high school over here, thornton middle school over here. so this morning's drop off and pick up really where probably a huge issue as far as local traffic flow. i saw very slow sensors. if this lasts much more and a couple more hours, there will be more traffic coming back into the area for pick up and drop off. so folks, it does look like they are loading that car onto the truck, but there is still fire department there and investigations. so watch that. and again, no duster berry and paseo padre are also your east west connectors. back to you. all right. thank you mike. our team has been sending out updates about this story. from the moment it broke. if you haven't already, make sure to download our free nbc bay area news app. well, just into our newsroom. disturbing video showing the moment a man smashes a window. this is an ice cream shop injuring a child. so it happens right here. the man

walks up to the window, smashing it there. that glass falling onto that child. now, this happened last month at a born square just off of capital expressway in san jose. that child was injured by the glass, but it's not clear how that child is doing now. police later arrested the suspect, pam fafsa. he is facing assault with a deadly weapon and child abuse charges. police are seeking the public's assistance in identifying the victim and the victim's guardian. anyone with information is asked to call san jose police. the national highway traffic safety administration will investigate the deadly crash, which took the lives of parents and their two children in the east bay in april. it's all according to reuters, the owner of the car. the family was in filed a complaint with the agency last month. they claim the 2023 vinfast v8 electric vehicle previously experienced steering problems. torrance george, his wife and their two children, ages 13 and nine, were killed when the car slammed into a tree

and burst into flames. developing internationally, a singapore airlines passenger is dead. another 30 were injured. this is after severe turbulence during an overseas flight. now we're learning the victim is a 73 year old british national who likely suffered a heart attack. the plane took off yesterday afternoon from london heading to singapore. the pilots later made an emergency landing in bangkok. now tracking data captured by website flight radar 24 showed the singapore airlines flight cruising at an altitude of 37,000ft. well, it then shows the plane suddenly dropped down to 31,000ft over the span of some three minutes, about 211 passengers were on board that plane with four form the united states. the airline is now working with authorities in thailand to provide necessary medical assistance for those impacted. also, just into our newsroom, a man is recovering. this is after a stabbing at san jose airport. police say it happened around 830 last night.

this is inside the airport at terminal b. that man was taken to the hospital and is expected to survive. one person was taken into custody. police say the motive is still under investigation. well, the first ever criminal trial of the former president is now nearing the end. the defense has rested after presenting just one witness. and that witness was not donald trump. scott mcgrew has the latest in what happens now. good morning. trump had said earlier he wanted to testify and he has every right to testify in his own trial. but defense attorneys often remind their clients of their right to remain silent. and trump took that advice this week, wrapped up with more cross-examination of trump's former attorney, michael cohen, on monday. the defense trying to paint cohen as dishonest, which is not hard to do. cohen has been found guilty of, among other things, lying. he admitted on the stand he stole money from the trump organization, also monday and

again today, we heard from one witness for the defense, robert costello, who's the defense seemed to hope would call cohen's honesty into further question. but costello may not have helped much. the reporters in the courtroom say he rolled his eyes, made sounds that the judge said showed contempt. there were more members of congress at the trial this week, including this similarly dressed group on monday, straining to speak over the shouts of others. needs to happen. is this particular judicial type system needs to be defunded? and i think one of the best ways to do it is to prevent the funding, the federal funding, any federal funding, all federal funding from going to a to this new york system that is prosecuting a federal candidate for president. now, fact check the new york state court system. the congressman clyde is talking about defunding is run by the state. it does rely to some degree on federal grants for certain programs, including child welfare, substance abuse

treatment and domestic violence programs. the judge in the case gave jurors a break, closing arguments won't come until next week. the lawyers, though, are going to stick around to discuss jury instructions at a hearing today. back to you. thank you scott. well, now to a live look in oakland this midday, alameda county district attorney pam price announcing a lawsuit against several insurance companies. not yet clear which companies are being named in the suit, but it does come after several large companies, including state farm and allstate, have stopped writing new homeowner policies because of wildfire risks and the cost of rebuilding homes. we are listening in to the news conference. we'll have an update coming up in our evening newscast. well, communities are sounding the alarm over a shortage of first responders from nurses to dispatchers and emts. most recently, contra costa county in san francisco, where some supervisors are calling on voters to approve a charter amendment to try to boost staffing. nbc bay area's

kris sanchez joins us with what this could mean for staffing and for taxpayers. both sides critically important, right. so supporters say amending san francisco's charter would allow hospitals to hire their own nurses to work extra shifts rather than paying traveling nurses. in just the last hour, san francisco supervisor asha saffy joined nurses, 911 operators and union leaders outside zuckerberg san francisco general hospital to push for two changes to san francisco's charter to address critical worker shortages. i reviewed a draft of the proposal that will be filed with the clerk later today, ahead of the supervisors meeting. one proposed charter amendment would allow san francisco department of public health to offer nurses retirement credits as an incentive for filling vacancies, which supervisors say would be a cost saving over hiring traveling nurses. the other proposed amendment would also roll 911 workers from their current pension into a better

pension in order to make that job more appealing to applicants for them. nurses are paid almost time and a half, but they're not afforded the benefits that full time nurses are. so when you really cost it out, when you think about the amount of money that the city is spending, paying for a contract temporary and not full time nurses and keeping all of these positions empty, it's going to end up saving the system money. now, this is happening. one day after the contra costa fire chief sounded the alarm about a shortage of ambulances and paramedics in that county, limited capacity at local emergency rooms also cited as a problem. a chief, louis brochard , said that some patients are waiting as long as an hour to be taken into the hospital at john muir health, john muir health leaders told us in a statement that though they are experiencing higher demand, they're attending to patients with the most urgent needs first. now back to san francisco. that proposed amendment will be filed this

afternoon. it would appear on the november ballot for voters to decide it does take six votes in favor to get it on that ballot. and then in order to pass, voters have to say yes, 50% of them, plus one vote. marcus and laura. all right. thanks for breaking it all down, chris. well, the fate of gig economy lies in the hands of the state's highest court. next, on our midday newscast, the recently passed ballot measure rideshare drivers call unconstitutional. and the message they're sending today. plus millennials and mortgages. a redfin expert has advised for first time home buyers trying to make it in the bay, and the mistakes you'll want to avoid if you're one of them. and temperatures are heating up a lot more quickly in the north bay already 11 degrees above yesterday. at this time, we'll talk about the peak of these temperatures and the rest of the microclimate forecast. after this

the future of california's gig economy. it comes in the form of a voter approved measure. some workers now call unconstitutional. as nbc bay area's ginger conejero saab explains, it all boils down to whether delivery people and rideshare workers should be considered independent contractors. and both sides have quite a bit at stake here, which is why we are also expecting a turnout for gig workers who are opposing proposition 22, set to be argued here in san francisco later today. in just a short while. actually, let's take it back a bit. at the center of this all is proposition 22, which was a voter approved ballot measure in the 2020 elections. it was sponsored by big gig companies like uber, lyft, doordash and instacart, and it allows those big companies to treat their drivers and delivery workers as independent contractors. it was a response to a california law that codified a supreme court decision that required companies

to classify gig workers as employees. proposition 22 passed with 59% approval from voters, but drivers and delivery workers have continued to challenge its constitutionality. today, the state supreme court will hear arguments on both sides and where that decision eventually falls can impact the gig economy tremendously. later today, hundreds of gig workers also expected to rally outside the courthouse to show their opposition to how prop 22 works. in practice, a rideshare driver that has been driving for eight years now, who we spoke with, says he has seen seen things change. he says what's offered in prop 22 is not enough to protect contract workers like drivers, and he believes it is simply unconstitutional. if there was a $10 fair, uber and lyft before they started with, you know, $2 for what they do, which is the background stuff, the, you know, the leadership and the software and $8 to go to

a driver. now, if that's a $10 fare. uber and lyft now take 7 to $8 and driver gets two. uber has responded to today's hearing saying in part, quote, force employment would be devastating for the thousands of drivers and couriers who turned to uber for flexible work and the millions of californians who would see major service reductions and cost increases, or lose ride sharing and food delivery entirely. now that rally here in san francisco will start at 1230, with arguments at the state supreme court to begin an hour later. we will give you updates on air and online at nbcbayarea.com in san francisco, ginger conejero saab nbc, bay area news. thank you. ginger. well, new data shows making it in the bay is still a real struggle for many millennials. redfin reports. gen zeus and young millennials took out 40% of u.s. mortgages last year, but in the bay area older

millennials between the age of 35 and 44 are taking out the most mortgages. that's because the expensive housing market makes it difficult for younger homebuyers. it then leads them to keep searching for a house because their offers are oftentimes rejected, experts say the biggest mistake young homebuyers do is not knowing the housing market and not having a realistic budget. i think the first thing is just be realistic and come up with a budget for what you can actually afford. given your earnings and your debt to income. and if there are homes that meet that budget that are in the area that you want, great, go for it. if not, you're going to have to start making some compromises. those compromises might mean renting for longer. it might mean buying a smaller home, or it might be buying a home in a more affordable area. for redfin, experts also recommend that you plan out your finances and stick to a budget so you don't get stuck with a mortgage you can't afford. good advice there. and don't forget the property taxes. oh boy, do not forget insurance. you know, maintenance kearny

street. but we pay, pay for some great weather in the bay area. yes. and it's going to be really nice over these next few days. and when we take a look at what we're expecting heading into our memorial day weekend, we're going to check that out as well. here is a look at this beautiful view from the sutro tower camera, looking down at the golden gate bridge, where we're seeing a very thin layer of fog. but overall we are seeing some warmer temperatures in the inland valleys away from that cooling fog. this will be the warmest day of the week. tomorrow the winds will start to pick up and our temperatures will be slightly milder. going into the weekend. it will be a cool one compared to what we typically see for this time of year. right now we're at 65, in san francisco, 71 in palo alto. we're talking about the warm up that we're seeing in the north bay, and it's mainly santa rosa that's 11 degrees warmer than it was yesterday. now, at 79 degrees, we're in the low 70s in livermore. and when we compare our high temperatures today

versus what we typically see for this date, we are in some spots about ten degrees above average, like in oakland and in san jose. we're looking at a high today of 82 and our average high temperature is 75. so we're going to see those highs in the low 80s. for the south bay. the warmest spot will be los gatos and east san jose up to 83 degrees. moving over toward the east bay. we're up to 87 in antioch, while martinez will see a high of 8480 in fremont and will be in the low 70s in san mateo, palo alto, 80 degrees today and upper 60s and low 70s in san francisco, 78 mill valley, but then sonoma, as well as santa rosa, up to about 84 degrees going into the weekend, we will see several storm systems up around portland and seattle farther north, but none of that rain makes it to the bay area. but it does shift our wind direction. it brings in a stronger ocean breeze and cools down our temperatures. take a look at a spotlight concre where

we're typically warmer. we're going from mid 80s today to low 80s on thursday, and only upper 60s for the weekend. that's a big cool down for us, and then we'll see it gradually starting to warm up again for early next week. but as we're taking a look at our 7-day forecast for the inland areas once again mid 80s today, upper 70s with sunshine on thursday. the weekend is looking so nice, but it will be cool at times. only 67 degrees for the highest temperatures. we'll see for the inland areas. low 70s on sunday and then memorial day. it does warm up a few degrees and then as we check out san francisco, expect a sunny sky and a breezy wind. but it's going to become more windy, more clouds. it will be in the low 60s by friday and the weekend the high temperature will only reach 58 degrees on saturday, so we're keeping those jackets and hoodies ready for the cool and windy weather. there and along the coastline. marcus. all right, thanks so much, carrie. well happening

he's cut off right now from antioch all the way through the area of pleasant hill, walnut creek, and lafayette. those stations are currently out of the mix right now because of a major medical emergency at the walnut creek bart station, so there will be no service until further notice through the area. bart has not given a bus bridge information again between pleasant hill, walnut creek and lafayette. there is no yellow line service because of a major medical emergency, so that affects basically everyone out of antioch and heading in toward lafayette and orinda. back to you. all right. good to know. thanks, mike. well, today, san jose leaders will hold a final vote today. this is clearing the way for a 150 foot buffer

between schools and rv parking. or homeless encampments. that ordinance will ban rvs, tents and other dwellings anywhere within 150ft of preschools, elementary and secondary schools , as well as daycare centers. that rule will start as a pilot program near three schools in east san jose. if it works, the council may extend it citywide. tonight, a public hearing is scheduled to take place at the walnut creek city council meeting. it surrounds a proposal to build a chick fil a inside the citrus marketplace shopping center on oak grove road. the city's planning commission approved a conditional use permit for that project. an appeal was filed by people that are living nearby while the shopping center is relatively empty, some residents are expressing concerns the restaurant could create traffic issues near the intersection, but a study by the city disputes those concerns. a city spokesperson says no final decisions have been made and both sides will be heard at tonight's meeting. all right, well, today shaping up to be a beautiful another beautiful one. yeah, a little bit warmer, though in some spots. we are
