actual shears. salinas police say the man in this surveillance video used them to threaten two cops as they moved in on him tuesday afternoon. 44-year-old carlos mejia accused of breaking into a woman's home and threatening here walks away from officers as they open fire. >> the officer concerned with the damage that that individual can do with this weapon not only to himself, but to the many innocent people around who are absolutely defenseless. >> reporter: this cell phone video of that same shooting shows officers shouting and pointing guns at the suspect. that sound was a taser. police said two attempts to hit him failed. you can see carlos spinning and waving the shears in front of the officers as he walks towards a busy street and a bitchery. the east salinas community -- and a bakery. the east salinas community is angry and anxious. this is the third time the police department has shot a man this year. >> our police department has shown they do not care bus like human beings and are willing to

shoot us down like dogs. >> do i believe if these gentlemen had been white guys or african americans would they have been treated any different? those officers are not dealing with anything with respect to the race of the individuals. they're dealing with the individual's conduct and aggression. >> reporter: that aggression from the community peaked last night when someone threw a bottle at a police officer who he was giving cpr to a -- at a police officer who was giving cpr to a man who had just been shot. live in salinas betty yu, kpix5. shut down about tw you can't get on interstate 280 southbound at fourth and king streets tonight. the freeway shut down about two hours ago for the long holiday weekend. crews are replacing what's called a hinge on the roadway. the 280 is closed all the way

past march mariposa street to the pennsylvania on ramp. to get out of san francisco you need to take 101 south. this is the first of three planned closures for the interstate. the next one is set for july 4th. a woman gave birth to a healthy baby boy today against the odds. she's been in a coma since march. our joe vazquez is at ucsf medical center and talked to her family tonight. >> there's nothing like having a baby. brian is ecstatic over the moon in love with both his son and my daughter. >> reporter: the baby is a healthy boy born today at ucsf. mom melissa carleton of fresno is recovering from delivery but is also in a coma. a few months ago melissa found out she had a brain tumor. just before the operation to remove it she had a seizure that damaged part of her brain and left her in a coma. 10 weeks ago her family wasn't sure if melissa or her baby would make it to today, but they did and there were many

smiles and tears and the baby's grandfather said there have even been some developments surrounding her delivery after the c section this morning. >> her eyes were wide open. that's fairly new. she grabbed brian's cheek with her hand and she pulled his face down to her face and she gave him the first hug that she's had since this trauma. >> reporter: melissa's husband brian lande is tending to baby wes tonight and also to his wife who is able to nurse her baby but has to have assistance. >> he has taken care of our daughter in a way that parents can only, you know, hope for and that's a credit to me lisa because melissa chose him. >> reporter: joe vazquez, kpix5. >> melissa's long term prognosis is still unclear, but with every positive development doctors tell the family to keep their hopes up. right now in the south bay they are getting ready to fog

for the potentially deadly west time in virus. this is the area they'll fog tonight. it covers parts of san jose and campbell. the spraying should take a couple hours. vector control says this is the earliest start ever to its mosquito season. a uc berkeley grad is suing in-n-out tonight claiming she spilled hot coffee on herself at this drive-thru in oakland last april and employees refused to help her. an employee claimed she didn't call 911 because it was against company policy. the suit asked for money to cover the woman's injuries which include first and second degree burns. in-n-out is not commenting. tonight we're hearing two very different sides of the story involving a bay area woman and an alleged bully. delia bradster is accused of choking an 11-year-old boy at an elementary school last week. her lawyer claimed she was

being framed and that she simply asked the boy to leave her daughter alone. >> my client was standing up for her daughter. it's that simple. >> you make her sound like the mother of the year. >> she is mother of the year. she did nothing wrong. her daughter was being bullied and she confronted the bully. what is wrong with that? >> the district attorney's office hasn't filed any charges as the investigation continues. the mom is due back in court next month. tonight the man accused of holding a woman captive for 10 years is held on $10 million bail. his lawyer says the alleged victim made the whole thing up. tonight she's speaking out. >> reporter: fear and deception, police in southern california say their suspect, sidro garcia used both to hold a young woman captive for nearly 10 years. the young woman didn't want to be seen on camera but is speaking out for the first time. >> i'm so happy and privileged

to be with my family. all the time i cry for them, more for my mom and my sisters. >> reporter: she reunites with family she hasn't seen in years. she told police she was drugged and taken by garcia who was her mother's boyfriend at the time. police believe the victim is from mexico and was in the country illegally. they think garcia used that to convince his victim to keep quiet all this time. >> he tells her that her mother doesn't care, that she can't go to the police because they're going to deport her. >> reporter: the victim tells police she was forced to marry garcia when she turned 18. investigators say she even gave birth to his child. the mother and victim's identities are being protected due to claims of repeated sexual abuse. the suspect's neighbors were shocked. >> she always seemed happy and he always makes good with her and everything. >> they'd be happy, kissing, holding hands. she comes up with this now.

ft them to safety. three people attempting to climb a dem near morgan hill this afternoon -- a dam near morgan hill this afternoon needed rescued. they got stuck and couldn't get down. the people may be in trouble. you're not supposed to climb the dam at anderson reservoir. tonight we learned an ex- oakland cop has been collecting thousands of dollars in disability benefits while working as an fbi agent. how is that possible? christin ayers says that's what oakland wants to know. >> reporter: when fbi agent and ex-oakland cop aaron mcfarlane shot a defendant, he was collecting disability. for the past 10 years he's collected more than half a million dollars in tax free disability pension payments, most of it public money. kpix5 has learned exclusively from a source inside the department that when mcfarlane left opd, he was facing the

possibility of being fired. instead he opted for medical retirement, but even on disability mcfarlane was able to pass an fbi physical that requires agents be in excellent physical condition with no disabilities which would interfere in firearm use or defensive tactics. the city of oakland confirmed it's investigating and will take further actions as appropriate. cures are part of the g fraud case in it's called operation nail polish and tonight kpix5's andria borba tells us manicures and pedicures are part of the largest billing fraud case in santa clara county history. spinal r 7.29 ingenius i >> reporter: the sign outside says san jose chiho spa, but what was happening inside was more beauty treatment than spinal realignment. enter operation nail polish. the premise was simple according to investigators. walk into the spa, ask for a

manicure and pedicure and never pay a bill. >> her insurance company was billed for his chiropractic treatments. >> reporter: an undercover agent got her fingers and toes painted on nine separate occasions while her health insurer was billed two grand. >> we do believe it is not an isolated incident and we believe 90% of the treatment at this particular location is fraudulent. >> reporter: a deputy insurance fraud de says his agent wasn't the only one getting pretty and pampered on the insurance dime. >> mostly they are getting nontherapeutic messages, manipedis and facials as well. >> reporter: to the tune of 7 million bucks. four employees were arrested in the year long investigation including dr. tracy lee, head chiropractor and owner believed to be the brains of the operation. andria borba, kpix5. >> the four people arrested could face 24 years in prison and be forced to pay back the

how is this for an unlikely tourist attraction? >> a dead humpback whale is drawing people to the san mateo county coast. the carcass wound up on the rocks this afternoon. it first showed up yesterday near pillow point. researchers are waiting for it to wash up on the beach so they can examine it. in the meantime people have been coming out in droves to see the massive mammal. >> the wonder of marine life in general is sort of beyond our human experience. when you think about marine mammals and the size of these creatures that are so like us and the fact that their world and life is so different, i can't help but thinking the mother isn't out there circling out there wondering how long its baby is and how long it stayed with it after it died. >> the whale is about 30 feet long which isn't big. that means it's likely a juvenile. .. and becomes big holiday weekend up ahead. give me something i want to hear. >> sunshine. >> heat, 90s. >> give me some more. burgers on the grill?
