>> legal expert michael cardoza says even though the judge has ordered the re-sentencing of do pap the defense can still use this as an appeal down the road in this case in the newsroom. terisa stasio kron. 4 news. >> by the way, the pap is facing separate state charges. jury selection in that trial is set to start on wednesday. meantime, an east bay man is dead tonight after a shooting in oakland. it happened just after 2 o'clock this morning on 14th street near frank ogawa plaza next to open city hall. police say the victim was pronounced dead at the hospital. no word conight on possible suspects to the south bay. now a man is critically injured after a shooting that involved police. >> it happened just after 4 yesterday afternoon at an apartment complex on kolmar drive in san jose. officers say they got a call about a man later identified as 41 year-old ricardo villareal shooting a gun in the back of the apartment complex. when officers got there, they say that villareal started shooting at them before

retreating into the complex. more officers responded and found villareal who kept shooting. they say at the other officers and that's when police say one of them fired a shot, hitting hillary out. what unfolded yesterday afternoon was another reminder of just how dangerous being a police officer, his. >> illegally present possessed guns continue to proliferate our streets and police are community and officers in danger. i couldn't be more proud of all the officers who responded to this call for help. he put others before themselves and that saves lives. >> santa clara county district attorney's office is investigating the shooting. >> home depot will be paying 1.3 million dollars after an investigation by santa clara county district attorney's office. the da's office started investigating home depot stores in the county after an arson fire at the blossom hill location in san jose. investigators say the store had several fire code violations that hurt firefighting efforts. that includes a broken sprinkler system that the da's office says home depot was aware of,

but did not try to fix the fire. happened back in april of 2022. dylan go. queen is accused of starting the fire while trying to steal from the store. the fire destroyed, destroyed the entire building. the da's office says the case against coakley is still pending. >> the fire broke out in cleaners in san francisco today happened about 3 o'clock this afternoon. martin's cleaners on polk and broadway in the city's russian hill neighborhood. crews say that one of the machines caught fire traffic was delayed while the fire crews cleaned up. but all lanes are back open now. nobody hurt. a massive search in alameda county is ending with good news hiker who went missing over the weekend in the regional wilderness is resting safely. crawford's lezla gooden is there to give us an update. >> that's right. a multi-agency search has ended for the search of the missing hiker here and all now, according to police, he was discover safely miles away off of his original path,

according to the east bay regional park police, alex stature and his dog apollo were found near the san antonio reservoir on monday around 12:15pm. >> the 2 appeared unharmed and in good health. alex was transported to nearby hospital for overall evaluation. now, alex, it off for his high on friday at an all regional wilderness. the 2 are scheduled to meet for a pickup on saturday afternoon at the devolved regional park. but when he did not show up, a search began and we were told that the 2 were discovered by 2 utility workers in the area near the reservoir. and once we get more information, we will keep you updated here and online. >> and son all was so good in kron. 4 news. >> dramatic rescue caught on camera. county authorities rescued a man who drove off a cliff and was thrown from his vehicle happened yesterday morning off highway one near jenner and sonoma county who

forward to the next 10 years. yeah. hey, what a nice day we had today, right? nice start to the workweek. lots of sunshine around the bay area. warm temperatures even clearing along the coastline to finally getting out of the fog. now we're seeing some see haze out there right now. general haze around the bay area's high pressure, sits over head looking toward the golden gate bridge. >> at this hour, temperatures, yes, nice and warm and spot. 75 and warm in santa rosa to 77 in concord, 70 degrees in palo alto, 70 for friends in redwood city. but you jump over the hill there only 55 right now in half moon bay, a much cooler right along the water's edge. overall, though, we've see more of a northerly wind kick in. that's a good old, offshore flow. and you see the fog dissipate and push further to the south. we're going to see that again. i think overnight tonight. so other than maybe up after 2 fog along the immediate coastline tonight, like we're going to keep things mostly clear out there. and then that fog likely make a return by tomorrow afternoon. but other than that, we've got a really nice evening stepping outside. stay mostly clear out there for you throughout the evening. if you want to head

out there, nice, warm 60's 70's inland and even inside the bay cool on the coastline numbers. they're running in the 50's. thank you, lawrence. businesses in berkeley will need to decide if they want to keep the outdoor dining spaces they created during the pandemic. >> the city will now charge rent for parking spaces have been turned into outdoor dining and parklets and it's not cheap. four's rob nesbitt talked with one business owner about the choice of paying rent. we're tearing them down. >> the city of berkeley has provided an example for how much it will cost to business to keep a parklet using the costs of how much it is to park in a parking space. for example, 2 parking spaces with an hourly rate of the $1.50. will cost around $8100 a year for a parklet businesses and restaurants in berkeley. we're left with tough decisions during the pandemic. many of them converted outdoor parking spaces into parklets, including solves restaurant and delicatessen during covid the park. that was a lifeline that enabled us to stay in business and continue operating. >> i now it's become just a

for your help in the unsolved homicide of a father and fiance. police say george cast off a key see was shot and killed on crosby avenue near foothill boulevard on november. 26 of last year. officers say he was standing outside with friends when it happened. witnesses say several suspects were seen leaving the area in a dark sedan. anyone who has any information about this asked to call oakland police, new pro gaza mural in san francisco's know leave allie neighborhood causing real stir in the community. now the jewish community relations council of the bay area speaking out about it. >> as kron four's tiffany justice reports tonight, they're calling it hateful. >> a mural in san francisco's knowing valley neighborhood is grabbing people's attention. it was painted in opposition to the war in gaza, but some are calling it antisemitic. others have no problem with the mural. i don't think this is anti-semitic at all. i think is just a message of was actually going on >> picture of the reality.

going to be a rough well week ahead for people affected by some of those pollen counts. we are going to see the winds kicking around around the bay area. and of course, that carries a lot of the pollens out there right now. yeah, look at the winds out there in the san francisco. we've had some 30 mile an hour gusts this afternoon, even inside the bay. it's been a pretty general breezy outside all the way to 21 in san breezy around the bay area. now, high pressure still overhead. that means where everything is grown out there right now. and boy, it's a beautiful, but warm and spots tomorrow again, then we'll see some changes coming our way. but between now and then, yeah, we're enjoying just some goegeous weather. how about 67 degrees? mostly sunny skies in san francisco tomorrow. a very warm 78 in oakland, not much of a breeze until the afternoon to help you cool off in the san jose will be breaking into the 80's by tomorrow afternoon. sunny, warm, probably some mid-eighties, i and some of the jury, also tomorrow likely going to be the warmest day of the week that we watch those temperatures coming down big time as we head in toward this next weekend. and the allergies in the pollen counts are going to come down by next
