i'm julie julie haener and i'm greg lee. >> a marin county man filing that lawsuit today accusing police of stunning him with a taser and arresting him as he was having a grand mal seizure in his own home. >> that encounter was captured on an officer's body camera, ktvu christien kafton tells us. the man also alleges once police realized what was happening, they tried to cover it up. >> what are you doing? cpr >> police body camera footage captured the moments that central marin police responded to a 911 call in san anselmo. that call, placed by elise frankel, who woke up late one night in august 2022, she says her then fiance, now husband bruce frankel, was gasping for air and she says he was clearly having a medical crisis. elise says she was expecting emts to respond when she called 911, but central marin police officers arrived first. and she says instead of treating bruce like a victim, treated him like a criminal. >> he jumped on him and tackled

him on the ground, yeah. and, it was very scary. just watching the whole, scene. the whole situation happen. >> bruce frankel says he doesn't remember the encounter and can't bring himself to watch the video. no i, i can't do that to traumatic. >> yeah, i can't keep reliving this over and over and over again. it's so. no, i have not watched the videos. >> doctors later determined that bruce frankel was suffering a grand mal seizure, unaware of his surroundings and unable to comprehend what was going on. in the video, bruce can be seen mumbling and pushing the officer as the officer tried to grab him. he said he was treated like a criminal instead of a patient in need of medical care. >> if the police arrived and it just asked elise, you know, two questions, what's going on? and has this happened before, none

of this. we wouldn't be here today, but they didn't. that officer did not do that at all. >> documents reviewed by ktvu say that police officer kevin cinit said that frankel actively resisted him for more than two minutes. the officer ultimately pulled his taser and shocked frankel twice. an internal review found the officer's use of force was justified, the responding officers attorney releasing a statement reading in part, quote, while we now know this was the consequence of a seizure at the time, the officers had no such information and acted in accordance with training, law and policy. all the officers wanted to do was help make sure everyone was safe . >> i've always respected the police. until now, the frankel say. >> eventually, emts arrived on scene and bruce frankel was taken to the hospital where he was treated and arrested for resisting arrest and faced domestic abuse allegations. frankel say that's when they began digging into the events of that night, eventually spending more than $10,000 to clear bruce frankel's name. the marin county

district attorney ultimately did not file charges, but now the frankel's have filed their own lawsuit alleging abuse at the hands of central marin police department, their attorney saying the responding officers rushed to judgment using force when medical care was called for , and then started collaborating on their stories to build a cover up. >> we're trying to hold people accountable for some really bad decision making that taints an entire department, which is not good. >> the chief for central marin police department released a statement about the incident and lawsuit, reading in part, quote, the authority will vigorously defend itself against this meritless and factually inaccurate litigation, which has not even been served upon the authority as of yet. unfortunately this individual has decided to first litigate his case in the media rather than in court, where we are confident the action of our officers will be vindicated. christien kafton ktvu fox two news. >> new at five tonight san jose

police say a juvenile is in custody in connection with a deadly hit and run. it happened around 4:00 this morning. police say the juvenile driver heading nortound on neiman boulevard blew through a stop sign and struck a pickup truck that was headed west on daniel maloney drive. the driver that truck died at the scene. police were ab to locate that juvenile driver a short time later, and that driver was taken into custody. the accident marks san jose's third traffic fatality of the week. >> it's been nearly 24 hours since a thunderous 7.4 magnitude earthquake rocked taiwan. the strongest quake to strike the region in 25 years was followed by several powerful aftershocks, killing at least nine people and injuring nearly a thousand. >> as dawn breaks in taiwan, the recovery efforts continue. the quake struck in the same area, where a 6.4 quake hit back in

2018. that disaster killed 17 people and collapsed many buildings, ktvu tom vacar joins us now with a report of what we know so far about this most recent quake. >> tom. >> well, we do have some late numbers. the latest data show nine killed, 963 injured 143 trapped under rubble, as well as some 50 people on minibuses headed to a national park. they're missing. taiwan is twice the size of the nine bay area counties and home to 23 million people in 101 cities and towns. fortunately, the brunt of the force was experienced on its mountainous, sparsely populated east coast 90 miles away, but was felt everywhere, for nonetheless, it has consumed local television there and at sfo. we met people just in from the battered island and it lasted pretty long. >> it was longer than i expected. yeah, people definitely are starting to say earthquake. earthquake, you could see some of the ticket

agents, like, get underneath the counter already. >> the clerk was just about ready to issue me. my, my boarding pass and the place started to shake. and shake. it shook about 15 seconds, but somehow it seemed a lot longer, and i looked up. it's a vast building, very large chandeliers, and they were swinging. and i looked around and most of the people were running out. >> one family was on a hotel's 13th floor. >> we were just in our room getting ready to leave, and just the whole building started swaying back and forth. you kind of hear the shuddering like in the building, but yeah, it lasted about two. how many minutes? 2 or 3 minutes. 2 or 3 minutes. >> the chen's were able to drive to the airport. >> highway is still working, but the railway, the rapid transit is closed. transit temporarily. >> those most affected in taiwan must now find new places to

live. he says. we are all residents who live in this neighborhood. the wall of our apartment is cracked. we live on the upper floors so we don't dare to go home. now. any large disruption to taiwan's microchip manufacturing industry will slow the production of vehicles, cell phones, communications devices and the burgeoning and important to the bay area artificial intelligence industry. and this is a worldwide phenomenon. these are the chips that fuel and keep the disputed nation's powerhouse high technology economy at $800 billion. however, good to note, workers are already returning to the massive semiconductor facilities. and that is very good news. >> okay so were they ready to go these these factories. >> well after the big earthquake that they had a few years back, they worked much more heartily on the idea of better zoning codes and better earthquake codes. and on top of that, more of what they call base

isolation. you put these things on almost like floating surfaces, so that when the earth starts shaking radically, it takes this a lot longer to get them the building to move that protects the equipment. very good. eventually, what you're going to have to do when you really think about this would be to have maglev, levitated buildings and then when an earthquake strikes, you would have almost no motion at all. >> all right, tom, thank you. yep. >> last hour at four, we spoke with ucla professor john wallace. he told us a lot of the damage in taiwan was in older buildings. >> you see buildings with retail at the base level or commercial that have open floor plans at the front. they collapse at the first level, if corner buildings , corner buildings might be open on two sides and they have a problem of some twisting or some torsion that leads to partial collapse, and you're basically seeing that most of the photos i've seen have been buildings

highway partially collapsed during a storm last weekend. people who have medical issues or are unprepared to be isolated for several days were urged to leave before the convoys ended at 4:00 this afternoon. >> we've had eyes on it continuously. it it it looks as if it has not advanced anymore from its original state, which is a good sign, but because, because it's such a new event and because it's such a new location, and because it was likely caused from saturated ground in recent rain events, we're going to suspend any travel across the closure area, for thursday and friday. >> caltrans says they expect to restart the convoys saturday morning. crews will continue to monitor the collapse section during the two day closure. >> a scare in the north bay today. police say a report of an junior high school in petaluma to go on lockdown. petaluma

say they have never seen anything like it. after a month of counting votes, there is now a tie for second place in the race for the 16th congressional district. >> we are talking about the race to replace congresswoman anna eshoo. silicon valley assembly member evan lowe and santa clara county supervisor joe simitian have both earned exactly 30,249 votes. the candidates have been back and forth battling for razor thin margins over the other, all to see who will face sam liccardo this november. >> ktvu is an reuben live now at the santa clara county registrar s office in an. this means that both candidates could now be moving on to the general election. >> that's right. and there had been actually only one vote separating the two candidates until the final tally brought in

one more to tie it up. thank you. the race for the 16th congressional district had already been filled with drama, neck and neck all along. now a single vote in the final minutes may have made all the difference. >> our count indicates that we have one more vote that came in yesterday for joe simitian, giving joe simitian and evan lowe both exactly 30,249 votes. but the information we have right now is that it is a tie, a tie for the second spot in the general election, which means both advance former san jose mayor sam liccardo was already in. if it is a dead heat, then both candidates move forward to the november general election and there will be a three way race for the congressional seat. >> while the tie is not yet official, the period for counting ballots has ended. both san mateo and santa clara counties spent the last weeks curing any ballots with signatures that were missing or did not match, and that's where this last vote came from. a

the presidential election may have the biden campaign on alert . it shows former president donald trump leading in six battleground states as fox news rebecca castro reports. now, president biden is looking to rally supporters by focusing on some very specific hot button issues. >> new polling suggests former president donald trump is winning the battle for swing states. he's up in nevada, arizona, georgia and several other states that went to joe biden in 2020. voters in these swing states are more sensitive to the issue of the economy. >> that is something that president trump wins on and something that joe biden is so deep in terms of being behind in approval ratings that he has a big hole to dig himself out of. >> but some of those closest to the president are brushing off the poor polling. >> once people start to focus in and they see their two choices, it's obvious that joe will win this election. >> the president is looking to rally supporters on issues that get voters to the polls like abortion access. >> donald trump ran to overturn

to postpone the new york trial indefinitely until the immunity claim in trump's election interference case is resolved, and the judge denied that request and also criticized trump's legal team for waiting until two weeks before jury selection to raise the immunity issue. the trial over trump's alleged payments to adult film star stormy daniels is set to begin april 15th. >> up to ten degrees cooler today than what we experienced this time just yesterday. but wait, it'll be colder tomorrow. let's get to it. right now it's our live weather camera looking out towards. oh, isn't that gorgeous? this is what rainfall does to the bay area. we're looking out towards rio vista. it's our live weather camera and you can also see on the horizon there we have several layers of cloudiness. we did start off with a gray slate in the form of some low clouds from the marine layer, but that all dissipated. it was wiped out with the approaching trough. i'll share that with you after this. numbers across the board in the

50s and 60s, it is now 63 degrees apiece, and napa and in concord, how about 64 in fairfield and also 63 degrees in cupertino and in campbell. but it's the winds, boy. that's what's making it feel raw outside right now. we have a wind gusts in throughout that san bruno gap at 29mph. how about 20? in mountain view we do have a wind gust now at 28, in the fairfield area, backing through travis and at oakland international airport. a wind gusts at 33. this is the approaching trough. it's already producing some thunderstorm activity in throughout the redding area. and all this continues to dig into a southerly direction. so we're going to track it together here. this is our future cast. and i got to tell you, these computer models, they have been spot on. so let's watch the clock tick on by. it does illustrate once that trough passes the winds will continue to blow. they will subside just somewhat after midnight 10 to 20. but anticipate those 20 to 30 mile

per hour winds throughout the evening hours. and they're going to say, what rain? look at this clearing here. well, this is the apparent cold front. and this will begin to descend on the bay area as early as tomorrow morning, sunup, which is a 648. not going to see it. lots of rain showers, unsettled air mass because this is a cold front. so we do have that potential of an isolated thunderstorm containing small hail. the breezy conditions, the cold air that filters in. and did i mention snow tomorrow? it's true. down to 2000ft. so that means mount tam. you'll see a couple of snowflakes. mount hamilton, mount diablo. you could see as much as two inches of snow. here's your friday afternoon. yep, i would count on a stray shower for the giants home. opener and also some blustery conditions. when all said is done. up to about a half an inch of rain in most locations, perhaps a full inch and others. and we'll talk more about that in just how cold it's going to

alleging workplace sexual harassment and discrimination. the lawsuit was filed today in federal court in san francisco by a blackberry senior executive referenced in the suit as jane doe. she claims gia matteo attempted to woo her during what she thought was a business dinner. the suit says the woman was subjected to sexual harassment and inappropriate comments. she also says as soon as she reported the harassment, gia matteo retaliated by interfering with her ability to do her work effectively. blackberry says it has conducted an extensive investigation into the allegations and found no evidence of wrongdoing or violations of the company's code of conduct. >> portola valley is hoping state regulators will change their mind. the san mateo county town is the jurisdiction in california to have its housing plan revoked. the state is now requiring all local governments to draft and update a plan and

add to add more affordable housing. the town had until january to approve new zoning laws. they call for more multifamily homes and dense neighborhoods. this town is now ineligible for state housing and transportation grants. music app spotify could be raising its prices, bloomberg reports. the music streaming service will up the cost of its plans anywhere from $1 to $2 in certain markets by the end of the year. right now, spotify's premium rate costs $10.99 a month. bloomberg says customers will be able to opt for a basic plan at that same price, but with no audio books. >> a battle within disney's top brass appears to be over, as shareholders voted to reelect the entire board of directors. the vote rejects nominees put forward by activist investor nelson peltz. his hedge fund ran a campaign criticizing disney's growth strategy and hoping for a successor to ceo bob iger. disney's new bundled streaming service has yet to turn a profit, and peltz's hedge fund started a website calling for

bay area, san francisco's richmond district is seeing a spike in crimes, particularly burglaries. >> but according to community members and even the san francisco police department, everyone is focused on public safety. family owned restaurants and small businesses help this community thrive, but many are also hurting. just this week, another window in another restaurant smashed out tablets stolen. neighbor jim reilly says it's infuriating. >> it's really frustrating and to see it on a regular basis. and just yesterday when we came here, we walked through a bunch of glass right behind me at the chinese restaurant that's been broken into four times. >> marjan philhower is running for district one supervisor. in november, a small business owner, parent and a native. having grown up in this neighborhood, she wants more support for the police, the residents and the merchants. >> so many business owners and families who live here have really had enough. they're looking for a change in what

they see on the streets every day in the richmond, there's an appreciation for the police. >> according to philhower, they know so many of our neighbors, but we only have 48 police officers here in the richmond. >> at any given time, there will be six police officers on the street. >> we spoke with sfpd captain chris canning at the richmond district station. he served the city for over 20 years. >> one of the most frustrating things that i'm hearing, and we are feeling secondhand. nothing more frustrated than the victims, the neighbors or the residents themselves suffering from crimes such as burglaries or vandalism. >> captain canning says voters demonstrated more support for the force with technology. >> we have seen is a number of encouraging ballot measures that have passed that allow the police department to leverage technology advancements to really help facilitate where we can send officers and accelerate crime reports, current district supervisor connie chan's office told us by phone. >> they, too, are looking forward to automatic license

plate readers and other technologies being implemented to address crime throughout the neighborhood and the city to improve public safety for all. in san francisco, alice wurtz, ktvu, fox two news. >> drivers in san francisco are going to see some big changes soon. the san francisco municipal transit authority has banned right turns on red lights at 200 intersections. this will be mostly in the downtown and the soma neighborhood. the agency says this is an effort to keep pedestrians safe and something advocates support when turns on red are allowed. >> what ends up happening is, is that drivers end up creeping into or completely through the crosswalk while they look in the opposite direction of where they're turning to see if there are cars coming and so what happens is, is they not only block a crosswalk or potentially hit someone in a crosswalk when they're trying to pull up, but then if they look, you know, in the opposite direction that they're turning, see no cars coming and then accelerate to turn, there might be someone in that crosswalk as well.

>> so pedestrians say they already feel safe enough, and the change could bring unintended consequences. >> where? the street that i walk, there's not many cars passing at the times that i'm walking. so like it's really safe. >> yeah, i think it's going to slow down traffic and i think that's what they want. more traffic management downtown. >> the sfmta said changes will not start immediately, and they probably won't go into effect until about late summer 2025 to give them enough time to install signs at each intersection. >> three cities in san mateo county have joined others across the bay area in investing in automated license plate readers. daly city, san bruno, and san mateo have all recently purchased computer controlled cameras to install at busy intersections. city leaders feel the license plate readers are a valuable tool in cracking down on organized retail theft and other crimes. however critics in those cities have and elsewhere have raised privacy concerns. the walnut creek city council is vowing to crack down on noisy protests by anti-abortion groups

outside a planned parenthood office when the council holds its next meeting, it will officially pass an ordinance banning the use of bullhorns and other noisemakers within 100ft of the entrance to the planned parenthood on oakland boulevard. those who live and work in the area say the noise from anti-abortion protesters is getting louder and bolder, protesters are using voice augmenting devices and saying horrible things. i went into the clinic because i wanted to see how loud it was. you could hear everything that was being said loud and clear. >> last night's vote comes two years after the walnut creek city council approved a similar ordinance. the council created a protest buffer zone around that same planned parenthood building and banned protesters from gathering within eight feet of entrances. >> secretary of state anthony blinken is marking the 75th anniversary of the nato alliance this week. he helped unveil a

statue of president harry truman that will soon be installed at the home of the u.s. ambassador to nato in brussels. under truman, the u.s. became a founding member of nato in 1949. the alliance was formed to confront the growing threat of soviet aggression and has ballooned from 12 members to 32 today as nato commemorates 75 years. threats are rising around the world. some leaders are sounding the alarm about the potential for widening wars. fox's connor hansen has more from new york. >> in nato, members gather in brussels discussing the urgent need for more aid for ukraine as it deals with troop and supply shortages. but that's just one conflict. the alliance is watching carefully. >> i think the war in ukraine demonstrates how intertwined the security of europe is with the security of asia and the pacific, security is truly global. >> just after president biden spoke on the phone with chinese president xi jinping, china moved warplanes and naval ships towards taiwan. the move comes

with concerns china could invade the island, something they've previously threatened to do. and in the middle east, iran has vowed to retaliate against israel after an airstrike killed several iranian military leaders in syria. u.s. officials say they have told iran they were not involved in the airstrike. >> the comments by the iranian foreign minister that somehow were to be held to account, or that we're to blame, is just nonsense and we warn them not to use this attack as a pretext to attack u.s. facilities or personnel. >> the increasing threats across the globe come as the presidential election heats up at a campaign rally tuesday, former president trump claimed the u.s. is heading for world war three as you were safe because they respected your president and they respected the united states of america, and now you're not safe. president biden is reportedly scheduled to speak with israeli prime minister benjamin netanyahu thursday for the first time in weeks in new york. connor hansen, ktvu, fox two news.

city officials recently approved plans to build a location at the citrus marketplace shopping center near ignacio valley road. the company insists this will lead to new jobs and other economic benefits, but those who live and work in the area say a new chick fil a will only make the neighborhood's traffic problems worse. >> it's also worth noting that our restaurants often help neighboring businesses attract customers, and can very much act as an anchor tenant for a shopping center like citrus center. this type of a commercial space is just not appropriate for the neighborhood

sites of interest rate hikes that have hurt commercial real estate as tenants continue to downsize due to the hybrid work model, industry analysts say the evolution of offices will be determined by their proximity to mixed use neighborhoods and public parks. >> federal reserve chair jerome powell was in the bay area today and gave some insight as to when interest rates could go down, powell delivered the keynote address at a stanford university forum as concerns grow on wall street, that progress on inflation has stalled. powell says the fed is trying to balance the risk of cutting interest rates too early or waiting too long, both of which will have consequences. he says more evidence is needed before policymakers can move in either direction.

>> we do not expect that it will be appropriate to lower our policy rate until we have greater confidence that inflation is moving sustainably down toward 2. given the strength of the economy and progress on inflation so far, we have time to let the incoming data guide our decisions on policy. >> the next indicator will be when march jobs report is released this friday, along with new inflation data next week. the white house is now reaffirming its commitment to covering the costs of rebuilding after the francis scott key bridge collapsed in baltimore last week. that disaster upended operations at the busy port of baltimore, a crucial link in supply chains along the east coast. a temporary channel has been cleared now for ships to pass through a section of the river, but the port is still far from operating at full capacity. >> our focus right now, outside of the rebuilding that bridge, is making sure that the ports are open, making sure that we continue to, do that recovery, clean out, clean out that area.

recovery process in prospect, kentucky. i'm nicole valdez, fox weather. >> and remember all that inclement weather we experienced last week into the weekend. that was our storm that just affected them. and now this system that's working its way into our forecast is going to affect dallas, louisiana and oklahoma as far as the visibility is concerned for the totality of the eclipse on monday. so what happens here shifts east and south. and right now we're talking about pretty close to average temperatures for this time of the year somewhere below normal. some were at average. for example santa rosa was pretty close to normal. but yesterday we were at 77 degrees there. look at san jose now. that was pretty spot on for this time of the year. but all of this is going down. this is a look at our average high temperatures for the time of the year. now meanwhile, this is what we can anticipate for our thursday. we're not going to make it to 60 degrees anywhere.

and right now we're seeing the leading edge of the trough. the front push into the bay area, several decks of cloudiness anywhere from 1100 feet to about 20,000ft. we currently have temperatures in the 50s and 60s, but boy does it feel colder outside because of this, the winds are gusting right now in throughout that san bruno gap, up to 29mph around the peninsula . 16 mile per hour winds at san jose mineta international airport. we have a wind gusts now at oakland international at 33mph. it is blustery. novato as well as in fairfield. all because of this incoming system. check this out. we now have lightning strikes and heavy rain in throughout mount shasta along i-5 into redding, all traversing in an easterly direction and behind that front is a lot of cold air. this is the apparent low. this is the cold front, so it's a12 shot. first of all, this with the windy conditions. then behind it here a lot of instability. so let's watch our future cast. i got to tell you this has been spot on. we have
