tracked. new proposals in sacramento to combat organized retail theft are gaining support from lawmakers. and the effort tonight to free a whale spotted off the san mateo county coast, entangled in fishing gear. >> this is ktvu fox two news at 730. >> good tuesday evening, everyone. i'm heather holmes. a newly released audit found state agencies are not consistently tracking the billions of dollars being spent to end homelessness, and the state auditor who released this report says the homeless crisis is not improving. ktvu crystal bailey has been digging into this audit and joins us now live with more crystal. well heather, the audit assessed the cost effectiveness and impact of homelessness programs at the state and local level and found that between 2018 and 2023, the number of unhoused is going up and there's not enough data to prove outcomes. >> even though billions was poured into housing programs. the state auditor's report says they're not sure whether the

homeless programs in place are working, even though they cost the state $24 billion. it all started when senator dave cortez visited one of the largest homeless encampments in san jose, asking the city whether the money spent on housing programs was working. when he found insufficient data, he and other state leaders penned a letter asking the state auditor to look into it. >> up until last year, midway through 2023, there there was no centralization of data around the flow of dollars from the state, you know, to local jurisdictions. >> the audit collected information from 2018 to 2023, reviewing two cities. one of them is san jose. so i think the report's clear on is we need all of the above approach. >> we need low rungs on the ladder, basic, dignified shelter, as well as the long tum solution, which is building more affordable housing. we need a comprehensive framework for data

and performance measurement and the thorough report, auditors say the california interagency council on homelessness is responsible for coordinating and evaluating the efforts across the state. >> the audit says the council has not established a consistent method for gathering information on homelessness programs, cost and outcomes. a spokesperson from the council says in a statement, in part, that the audit's findings underscore a need to continue to hold local governments accountable who are primarily responsible for implementing these programs and collecting data on outcomes that the state can use to evaluate program effectiveness, and went on to say the council continues to improve its ability to ensure that taxpayer dollars are spent judiciously and effectively. >> this audit will establish some somewhat of a blueprint for legislative direction and guardrails going forward. you know, to improve upon, you know, some of these areas, these deficiencies and these systemic

issues that that the audit, calls out. >> and senator cortez says that auditors tell him there is no evidence of fraud. the state auditor is recommending legislature require the council to annually collect and report outcome information beginning in september 2025. crystal bailey, ktvu, fox two news. >> crystal. thank you. new at 730 tonight, the san mateo county sheriff's office is looking for the owner of a safe that was found during a traffic stop. deputies say they pulled over a driver and found the safe right inside the car. they're now looking for its owner. authorities say a loaded ghost gun and drug related items were also recovered from inside that vehicle. the two people in the car were arrested on drug charges, the other one on drug charges, the other for being a convicted felon in possession of that loaded ghost gun. lawmakers on both sides of the political aisle are getting behind a new package of bills to combat organized retail theft. ktvu s henry lee explains how, if passed, it would punish retail

thieves differently. >> as you guys know, our retailers have gone many years and have been asking for the help, and i think that's what we're here to do today. >> a bipartisan push in sacramento to crack down on organized retail theft. politicians from both sides of the aisle are working together to craft seven bills, to put an end, to snatch and grabs like these. >> this bill says to organize crime rings. we mean business, and we are going to give law enforcement the tools they need to shut you down. >> taken together, the bills would allow law enforcement to combine similar thefts from different victims into one grand theft case in certain cases, allow d.a.s to pool resources across jurisdictions, and result in stiffer penalties and restraining orders against thieves. the legislation, welcomed by retailers, our employees are asking for it. >> californians are demanding it , and retailers want to be able to just sell our products. we want to deter retail theft from even coming into our stores. >> people need to be safe. they

need to feel safe and making sure that we're responsive to california is critical here. and this package, i think, gets the job done. >> there's no turning back the clock on the criminal justice reforms that have been enacted. >> there's a separate effort underway to repeal parts of prop 47, which in 2014 increased the threshold for grand theft from $450 to $950. assembly speaker robert rivas says the new package of bills does not affect prop 47. >> for us, it's understanding the root causes of this problem, which is complex. and for us, each one of these bills gets after those layers of complexity. >> shoppers at broadway plaza in walnut creek say they welcome any crackdown on thieves. >> i think it's a great idea if they can work across the aisle to achieve anything, you know, it doesn't happen very often these days. >> we got to do everything possible. i mean, i used to be part owner and retail chain with my brother in law, and there was theft there. and what people don't realize is that it comes

back to the consumer here at broadway plaza, thieves have gone into the lululemon to steal things and then gone to other lululemon's across the bay area. >> the idea is to streamline any prosecution if these thieves are caught in walnut creek. henry lee ktvu, fox two news. >> we have some new information tonight about that tragic crash that happened in the east bay over the weekend that left a little nine year old girl dead. authorities today identifying that girl as dana hernandez tapia of oregon. she was killed early sunday morning when the suv she was in crashed at the junction of interstate 680 and highway 242, in concord. four women were inside the vehicle and they were hospitalized. the male driver, though, left the scene. there was no word yet from the highway patrol on what caused that crash, or whether the driver has been found. hayward firefighters spent most of the day today watching for flare ups at a warehouse where a fire burned for hours. it broke out last night at the building belonging to west coast insulation, near tripoli way and hall road. when firefighters

first arrived while the flames were shooting high into the air. part of the building's roof also collapsed. there are no reports of any injuries. that fire has been out for several hours, but some hot spots reignited throughout the day, and there was concern that insulation products compactly stacked in that warehouse could continue to catch fire. while the cause of the fire is under investigation. more e-bikes are coming to the streets of oakland, berkeley and emeryville. the mtc and lyft today announcing plans to add more than 500 next generation e-bikes and new docking stations to the bay area's bike share program. they will be placed in business and retail districts and near bart stations. city leaders say they hope this will help create a network to connect east bay cities. >> this is critical to not just getting people out of cars and advancing more sustainable trips, but also in providing good first and last mile options for people in berkeley in the

east bay, the mtc's bay wheels e-bike fleet began expanding its availability last november in san francisco and san jose. >> robert taxi company crews resumed testing five months after it paused operations due to that serious accident in san francisco. that testing reportedly resumed today in phoenix. for now, the self-driving cars will have safety drivers. the general motors subsidiary suspended operations last october after one of the company's cars dragged a pedestrian, who was initially hit by another driver in san francisco. california's dmv has also cracked down on crews for withholding information about that incident. the late california senator dianne feinstein could soon receive a new order. we'll have details on that coming up. also ahead tonight, what we know about a whale spotted along the san mateo county coast. it's entangled right now in fishing gear. >> and in barry weather.

and laphonza butler introduced a bill yesterday to rename the post office there, on stewart street near the embarcadero. it's in the rincon center, which served as the city's largest postal distribution center for several decades. as mayor of san francisco, feinstein oversaw its development. the name change is expected to be approved. san francisco public library workers held a big rally today to demand

better security to protect staff and patrons. this follows a recent increase in the number of dangerous incidents they want the city to provide security guards at all 28 branches. some locations have security officers, but at the other branches, librarians and fellow employees say they have been forced to intervene in dangerous situations that sometimes turned physical. san francisco library officials have not yet commented on the workers demands. a whale was spotted today off the san mateo county coastline, entangled in fishing gear. the whale was last seen off thornton state beach near daly city. this video that you're looking at comes to us from photographer tony corso. the national oceanic and atmospheric administration fisheries says the whale was first seen entangled in a net off laguna beach. this was last month. they attached the satellite tracking buoy to it at that time, but their team couldn't get the net off. the whale. they lost connection to the tracker last week. they're

hoping to disentangle the whale in the coming days. really unfortunate to see that situation there, but something that is fortunate to see is our beautiful weather today. i mean, it was just gorgeous today, mark. >> just a stunning just stepping outside for a few seconds. you can tell it's going to be a great day and good news. it's going to be nice again tomorrow. >> going to stick around you got to be nice. >> in fact tomorrow could actually be a little bit warmer okay. kind of in that comfortable range 70s and 80s. take a look at the highs from this afternoon. san francisco 67 san jose 78. lots of upper 70s out toward concord, antioch, santa rosa and napa. so we will continue to warm things up for tomorrow and into thursday. mostly sunny skies, temperatures, a good 5 to 10 degrees above the average, and we are expecting our next cooldown that's scheduled to arrive on friday. as we head toward the weekend as well. we're talking about more clouds and cooler conditions, but the satellite. as you can see, lots of clear skies up and down a good portion of the west coast. so not only here in the bay area, but down towards southern california, up on the north coast, and even up in the

pacific northwest. just a few scattered clouds out there as far as the closer inspection of the satellite, you can see just a few clouds approaching cape mendocino up toward eureka, and we'll pick up a few high clouds for tomorrow, but it will still be a nice forecast for your wednesday. current numbers out there for the 7:00 hour, we have san francisco 57, santa rosa 62. some lower 70s out toward walnut creek and concord and san jose. right now a pleasant 71 degrees. a beautiful sunset to this evening, some scattered high clouds out there looking out toward the bay. but as you can see, we're heading into a nice forecast for tonight. and then still clear skies first thing tomorrow morning. overnight temperatures will be in the upper 40s to the lower 50s, and then as we put this forecast model into motion you can see those brighter colors starting to resurface. eventually it will be adding to the scale to show 90s and triple digits, but not just yet. here's your eventual temperature range for your wednesday upper 60s to the 70s, all the way to the lower 80s by tomorrow afternoon. this is essentially the same forecast for thursday as well. you can

see the big picture. once again, this big area of high pressure is offshore. building into northern california. so for wednesday and thursday it's a warm pattern with the 70s and 80s. and then into friday that will be the transition day. that will ultimately cool things off here in the bay area. and then by the weekend, we'll be talking about some scattered showers approaching the region as well. there's a chance we could have some thunderstorms that could lead to some heavy downpours. so you might think, okay, the rainy season is over. not just yet. it's warm for now, but it looks like we're talking about some more rain as we head towards saturday, with still a chance of some showers by sunday. here's his forecast model it is bringing into some scattered high clouds tomorrow for your wednesday. thursday looks like a great day and then into friday. see that the cloud cover approaching the region? there is a slight chance of a sprinkle on friday, but the main rain is up to the north of the bay area, and they're going to bump up those shower chances by friday night and into saturday. take a look at the numbers for tomorrow. lots of 70s out there. we have sprinkled in a few 80s for san jose, morgan hill,

doc? was arrested today on campus on suspicion of inappropri. contact with the student. deputies arrested 41 year old brad matthew rolle, a p.e. teacher and track coach at the school. he is suspected of three felonies, including suspicion of contacting a minor for sexual purposes, sexual exploitation of a child, and having child sexual abuse material. now, the district says that rolle has been placed on administrative leave. he is being held in napa county jail on $100,000 bail. two requests have now been made for recounts in that hotly contested race for the 16th congressional district in the south bay, where evan low and joe simitian are tied for second place. earlier today on the

four, we spoke to david mcewen. he's a political science professor at sonoma state about what we could be looking at as this race moves forward. >> this race is going to garner a lot of attention because of the unusual set of circumstances. liccardo, still in the driver's seat, but one of those other two is going to try to cut through that means negativity and lots of money. that will be the element of this race. >> there is no word yet on whether election officials will be conducting a recount. new at 730 tonight, marin county supervisors have given the green light to prepare for the possibility of new funds for affordable housing. the board approved spending nearly half a million dollars to plan for the potential passage of a regional tax for affordable housing. a new bond measure may be added to the november 5th ballot that would generate money for more affordable housing in the county. if it is passed, marin county could receive between 300 and $50 million and $700 million and would be required to have a plan in place on how to spend

it. affordable housing is replacing the idea of a full fledged entertainment district in san jose. the mercury news reports a los angeles based developer plans to construct eight buildings, each of which are seven stories high, and they would be located near the top golf center at highway 247 and north first street. this project calls for about 780 homes with a few retail shops. original plans, though, featured hotels and restaurants. the plans never materialized and the site eventually ended up in foreclosure. a north bay police department has announced a change in leadership. coming up, what we're learning about petaluma's new chief of police. and then later tonight on the 10:00 news, strong reaction tonight to an arizona supreme court ruling today that effectively bans abortions in that state. the effects this could have on california. plus family members of american hostages being held by hamas met with vice president kamala
