crash. what? his death means for the country in the middle east and relations with the united states. >> this is ktvu, fox two news at noon. >> good afternoon. i'm gasia mikaelian and i'm andre senior. >> we begin with developing news. we continue to follow for you san jose police still searching and working the scene of an officer involved shooting from sunday. the violence leaving one suspect hospitalized . an area residents and businesses impacted by all of this. ktvu south bay reporter jesse gary live at the scene in east san jose with the very latest jesse. >> andre. right now san jose police are removing the last of the equipment they had at this scene since around 4:00 yesterday afternoon. we're at the intersection of kolmar drive and story road here in east san jose. they removed the crime scene tape, and now they're getting ready to remove their mobile command unit here at the scene. additionally, san jose police say they're going to hold a media briefing at 3:00 to shed more light on what forced their officers to open fire here, a

gunshot. >> and we at first, we thought it was like a firecracker, but we didn't think much of it. and later we hear like two more gunshots. and then that's when i looked up to the kitchen window and i saw there was like a van with broken windows. >> neighbor jorge chavez says the sounds of gunshots rang out sunday afternoon at the k and k apartments on colmore drive here in east san jose. his cell phone video shows, in part, the police response to those gunshots. officers with guns drawn surrounded a van that had its windows shot out. no one inside, investigators say officers responded around 4:00 sunday afternoon to 911 calls of a man shooting a gun when officers arrived on scene, the suspect was still actively discharging a firearm. the suspect was seriously injured and rushed to a nearby hospital due to the officer involved shooting. we do not have an update on his condition. cell phone video from another bystander shows a man collapsed on the ground in the alleyway behind the apartment complex. now, as i said earlier,

san jose police are going to provide a media briefing 3:00 this afternoon to give more information on this incident. we'll have that on our website, ktvu.com, and then i'll have an update for you on our broadcast, the four at 4:00. right here they are removing the last of their equipment as this investigation moves to the next phase. we're live in east san jose. jesse gary, ktvu, fox two news. >> we'll talk again at 4:00, 20 hours after the initial incident began. it's still happening. jesse, thank you for that report. we're following more developing news right now. it concerns an arrest warrant for israel and hamas leaders, which president biden and others are condemning as, quote, outrageous . as the chief prosecutor for the international criminal court is looking into arrest warrants for israeli prime minister benjamin netanyahu, along with three senior hamas leaders. now, the prosecutor cites murder, rape and torture by hamas leaders as reasons for their arrests. he also says his office has evidence against netanyahu and his defense minister, suggesting they have committed

crimes against humanity during the seven month war in gaza. >> israel, like all states, has the right to defend its population. it has every right to ensure the return of hostages that have been criminally and callously taken those rights. however do not absolve israel of its obligations to comply with international humanitarian law, intentionally causing death, starvation, injury and suffering to the civilian population. >> in a statement today, netanyahu called the charges a, quote, disgrace and also vowed to move ahead with israel's war against hamas militants. >> iran's president and foreign minister are dead after a helicopter they were in crashed in a remote area yesterday, say the deaths are a shock, but the state department says they're unlikely to have any effect on iran's policies, such as their support for hamas and push to produce nuclear weapons. as fox's rebecca castro reports, iran's relationship with the biden administration is also

unlikely to change. >> after searching for hours in the mountains, iranian soldiers made it to the crash site on monday, where a helicopter carrying iranian president ebrahim raisi and the country's foreign minister went down. they found no survivors at this point , there is no evidence of foul play. >> it looks like an accident. >> iranian officials will investigate the crash and while the country mourns, president raises death, analysts say there are many who will not miss him. >> ibrahim raisi was considered the butcher of iran, the butcher of tehran by iranians for his personal role in one of the greatest mass executions of political prisoners. >> while raisis death is a significant loss, it's not likely to change current policy inside iran, but it does raise questions about the country's future after its supreme leader, ayatollah ali khamenei, who sets the policy for iran and certainly raisi was a protege and a potential successor to the

supreme leader. >> but he's not determining the policy. >> iran is known for backing militant proxy groups like hamas and hezbollah, and recently the regime has cracked down on women's rights, and there's been a massive surge in government backed executions. the us state department says those policies will likely continue. >> so we're going to just trade this terrorist for the next terrorist that the that the ayatollahs have are going to install. >> iran's vice president mohammad mokhber, will serve as interim president. iranian law requires new elections be held within 50 days in washington. rebecca kaster ktvu, fox two news. now to new information about a shooting near oakland city hall. >> oakland police confirmed a ktvu a man was shot to death early this morning. it happened around 2:15 a.m. video from the scene shows a car crashed into a construction site at the corner of 14th and jefferson. the front windshield of the car appears to have bullet holes in it. man was taken to the hospital where he later died. officers closed several blocks of downtown oakland to conduct the

investigation. a federal judge is sentenced. the man convicted of attacking the husband of congresswoman nancy pelosi, says she will reopen the sentencing portion of the case. the judge says she made an error by not giving david depape a chance to speak in court friday. depape was sentenced to 30 years in prison for the break in and attack two years ago at the pelosi's home in san francisco. the new sentencing date is now may 28th. his actual sentence is not expected to change. >> new at noon, billions of dollars in new federal funding is coming to a major transportation project in san francisco. the transbay joint power authority is getting $3.4 billion from the federal transit administration. representative nancy pelosi and mayor london breed were on hand for the announcement. the funding will be used to connect caltrain, and ultimately california high-speed rail to the salesforce transit center in the downtown section of the city. >> this is about saving the planet. it's about clean air. it's about people. it's about

quality of the air. it's about quality of the life, quality of people not having to be in their cars for long stints, adding to pollution, but nonetheless getting to and from work more quickly, adding time to their lives. >> once completed, the multimodal salesforce transit center will integrate 11 transit systems. >> we've just learned that home depot will pay $1.3 million for fire code violations found after an arson two years ago. the payment is to resolve a santa clara county da's investigation into how the company's fire code violations contributed to the san jose store fire in 2022. district attorney jeff rosen says dylan j. cruz go intentionally started the fire before trying to take off with a load of tools. the fire did $17 million in damage in inventory losses. the arson case against him is still pending. well the search continues in the east bay for missing hiker. >> now east bay regional park service says alex treacher and

their dog never came back from what was supposed to be a one day strike. the hiker and the dog left friday and reportedly hiking the ohlone wilderness trail at the time between sunol and the del valle regional park. now we're told he was wearing the same clothes you see in this photo here, a long sleeve green shirt, black pants and a khaki hat. >> former president donald trump's so-called hush money trial is heading into the final stretch on day 19. the defense appears to be nearing the end of its cross-examination of the former president's former lawyer, michael cohen. one thing that could delay closing arguments, though, is former president trump taking the stand. we're awaiting his decision on that. eric shawn outside the manhattan courthouse with more. >> former president donald trump's hush money trial continued monday with his former lawyer and fixer, attorney michael cohen, back on the stand. last week, defense attorney todd blanch questioned cohen for hours, portraying him as a serial liar who cannot be believed. this morning, the president arrived saying he's being missed on the campaign

trail. >> i'm not allowed to have anything to do with politics because i'm sitting in a very freezing cold courtroom for the last four weeks. it's very unfair. >> trump is accused of 34 felony counts of falsifying business records, stemming from the $130,000 payment to adult film star stormy daniels to keep quiet during the 2016 presidential election. he has pleaded not guilty. the prosecution is expected to rest its case once cohen is off the stand later today. then it will be up to the defense and for the defense, i think they're going to want what's called a default instruction, which says if you find that a witness has lied about one thing, you may conclude that the witnesses lying about everything, but the defense is not obligated to call any witnesses. >> it's better to sit down and shut up and not call any witnesses. >> the former president has said he wants to testify, but his lawyers have not said yet. if he will, if he does not take the

ship's been stuck since that crash back in march. this morning. tugboats are pushing it back to a dock. the process is taking more than 20 hours. crash led to the deaths of six construction workers and crippled operations at the port of baltimore. one of the busiest in the country. congress is still debating how much money to put toward rebuilding that bridge. >> former white house press secretary jen psaki delivered a keynote address at george washington university

graduation. and outside that ceremony, hundreds of protesters gathered to send a message. every germ. demonstrators held signs and chanted support for palestine. it was the latest example of dozens of protests that have happened at college campuses across the country, resulting in thousands of arrests. now, president biden's commencement speech at morehouse college in atlanta was peaceful, but some held a silent protest over his administration's stance on the war in israel. some of the graduates of the all male, historically black college turned their backs as the president spoke. a faculty member stood with her back facing the stage and her fist raised. president biden told the crowd he was committed to helping bring about a peaceful solution in the middle east. >> i support peaceful, nonviolent protest. your voices should be heard and i promise you, i hear them. i'm working to make sure we finally get a two state solution. the only solution for two people to live in peace. security and dignity.

>> yesterday's speech comes as president biden tries to win the votes of young black men for his reelection. some recent polls show his numbers with that demographic group slipping. a telecommunications billionaire is hoping his contribution to graduates is literally the gift that keeps on giving. robert hale jr. spoke at the university of massachusetts dartmouth commencement. while his speech included life and career advice, he also announced he and his wife would give each of the 1200 graduates $1,000 500 for themselves and the other 500 for them to give to someone else or a charity in these trying times have heightened the need for sharing, caring and giving. >> our community needs you and your generosity more than ever, hale told the crowd about his successes and failures, which included losing $1 billion in stock value overnight. >> he urged the graduates not to let failure define them, but use his own life as an example of resilience and perseverance.

there is still no electricity for many people in houston. >> after thunderstorms and hurricane force winds swept through the city, crews have been working around the clock to restore power to more than 240,000 homes and businesses. full service is expected to be back by wednesday. at least seven people died in those severe storms. meanwhile, here in the bay area, sunshine, blue skies. but wow, what a time they're having there in parts of texas. rosemary. >> you're right. they just can't seem to get a break. meanwhile, garcia andre here at home very spring like weather over the bay area and the warmer weather as expected. giving you a live look here over the golden gate bridge. plenty of blue sky here along the coastline. a little bit of fog, but we are pretty much with sunshine for most, if not all for today. and the warming trend continues. temperatures ranging from low 60s at the coastline to low 80s inland. temperatures near average to a few degrees above average. here's a view of a storm tracker two, where you can

now. >> combs apology comes after the l.a. district attorney's office determined combs cannot be prosecuted for the 2016 assault. the statute of limitations had passed. >> well, today, a win in a uk court for wikileaks founder julian assange, who is fighting extradition to the us. as greg palkot reports, the ruling is likely to extend a long legal battle, a years long effort by the us to prosecute julian assange, hitting another roadblock on monday, the uk's high court ruling the australian wikileaks founder can continue appealing his extradition. >> assange has spent the last five years in a british prison. seven before that in the ecuador embassy. here he faces a total of 175 years behind bars on 17 counts of espionage. that for posting online a slew of classified us government documents, especially those pertaining to the wars in iraq and afghanistan. the us says assange also took steps to encourage former army intelligence analyst chelsea

department issued a rare warning telling the lgbtq community to be very careful when traveling overseas. >> the state department warned about what it called the potential for terror attacks, demonstrations or other violent actions against us citizens in tourist locations and at pride celebrations. the warning comes just two weeks before the start of pride month, which starts in june, and it also comes less than a week after the fbi and department of homeland security warned of a potential threat from foreign terrorist organizations at lgbtq related pride events on us soil. the travel warning from the state department comes at the same time san francisco gets ready to recognize harvey milk day. the celebration is wednesday, may 22nd, which was harvey milk's birthday. but this weekend the community came together to kick off the celebration early. they say it's a reminder that more work needs to be done. >> a lot of heat right now. queer, trans and drag queens actually are under attack. the legislation that they're trying to pass in this country, of all places in america in 2024 is mind boggling.

>> san francisco city leaders say they're increasing efforts to support and celebrate this community. right now, they're working on building the country's first lgbtq museum and research center. >> the american academy of pediatrics just released new guidelines on breastfeeding for people with hiv. according to the guidelines, people with hiv can now breastfeed their babies as long as they're taking medications that suppress the virus that causes aids. the new report reverses recommendations it had since the start of the hiv epidemic in the 1980s. it also recognizes that routinely prescribed drugs can reduce the risk of transmitting hiv through breast milk to less than 1. the seafood restaurant chain red lobster has officially filed for bankruptcy. move is meant to bring down its outstanding debt. the chain has already closed dozens of its restaurants plans to continue closing restaurants and eventually sell the business to lenders. company says it hopes to stay afloat by making a financing agreement honoring the history and legacy of san francisco firefighters. the new mural unveiled today and who's

the community police is now searching for his killer. ktvu joey horta sat down with those who knew him. >> there's now a growing memorial outside the antioch gas station where 48 year-old raheem co, who was homeless, would often hang out. >> he was around here. he was up here every day and he had a good spirit on us. and he always good, good advice to everybody. >> police say a report of a man down on the sidewalk led first responders to the antioch health center along country hills drive just after 7 a.m. on wednesday, where raheem was found to be lifeless. >> it appears to be blunt force trauma at this point. >> crime scene investigators could be seen collecting a stone about the size of a grapefruit as evidence. >> he didn't deserve to die like that. although he was homeless, he was like. he was like family, you know? he's a good dude. >> close friend harold moore,

who at one point experienced homelessness himself, was shocked by the loss. >> i couldn't believe it. i never cried so much in my life. >> moore says raheem struggled with mental illness, but the two of them had many heart to heart conversations to help raheem get his life back together. >> this is what it is, man. some people have compassion, some don't. >> the organization facing homelessness does street outreach in antioch, connecting the unhoused with shelter, rehabilitation and counseling. but director nicole gardner says antioch doesn't have the resources to meet the need. >> we don't have enough in the city, and we are definitely lacking it in the county as well. these are real people. they have families that love them and care about them. they're good people. >> a mural on the nonprofit's bus lists the names of dozens of homeless people who've died in just the last year and a half. >> we just need to stop the violence now. >> this marks antioch's fifth homicide of the year. police do not have a suspect in this case. they are asking anyone who may have dash cam video from country

hills drive from midnight to 7 a.m. on may 15th to give them a call in antioch. joey jordan ktvu, fox two news. >> police in fremont are investigating a motorcycle crash. officers getting a call of a crash around 9:00 last night along niles canyon road near palomares road. police stayed on scene for hours, working to learn what caused the crash. >> the investigation continues into an overnight fire in san jose, started shortly after midnight at a vacant building near fifth and jackson in the japantown neighborhood. firefighters say the flames caused major damage, but no one was hurt. investigators are now working to determine if the fire could be linked to people who were living in that vacant building. >> i'm getting reports from communicating with some of the people who are the property owners of the building, that they've had some issues with homeless people staying in the building or in camping in the area of the building. >> firefighters say the building that went up in flames this morning was previously home to a japanese restaurant called kubota, but it appears to have been closed now for several years up to sonoma county. now,

video of rescuers rappelling down a rope from a helicopter to rescue a man whose vehicle veered off a cliff along highway one. the driver thrown nearly 350ft from the vehicle. this happening around 8:00 sunday morning, the sonoma county sheriff's office says the car's automatic crash notification system alerted 911 and gave dispatchers the location of the crash. helicopter crews found the injured man about 300ft beneath the car. helicopter flew the critically injured victim to a local trauma hospital to receive treatment as well. >> investigators are searching for the cause of a weekend fire on yerba buena island that caused a big traffic jam on the bay bridge. the brushfire broke out saturday afternoon, sending thick plumes of smoke into the air and shutting down the eastbound lanes of the bridge. dozens of firefighters battled the flames for more than two hours before all lanes could reopen. investigators say the fire did not damage any buildings. contra costa county continues to deal with a shortage of ambulances. ambulance services have been reduced to level zero at times lately, which means there were no units available for transport, the county fire chief

told the board of supervisors. part of the problem is getting patients transferred to hospitals. it's an issue he's been working to resolve. >> we have also started to institute, some offload policies at hospitals, where after a certain point in time, we become much more engaged with their staff to, essentially, we work very aggressively with their staff to get that patient transferred to the hospital, the fire chief said the wait time to get patients to the hospital is typically an hour. the state and county standard is 20 minutes. new at noon. there's a new mural inside sfpd headquarters to honor the history and legacy of san francisco firefighters. the mural was unveiled this morning in the rotunda lobby of the fire headquarters by chief denny nicholson. it was hand-painted by san francisco academy of art university students. chief nicholson says the mural offers visitors a window into the fire department's historic past.

>> this is where we do a lot of the work to keep the department moving forward and to have a piece of our history on the wall, not just these beautiful old pieces that we have here, but to have a piece of history like this on the wall is incredible. >> the artwork and other items on display at the fire department headquarters are available for the public to come and see during regular business hours when the lobby is open. >> 2000 graduate student workers at uc santa cruz are on strike. the walkout involves teaching assistants, researchers and other academic workers. the union leaders say the strike is to protest the uc system's recent crackdown on pro-palestinian demonstrators on college campuses across the state. it's still not clear how long the strike will last. uc administrators say the walkout violates the no strike clause in the student workers contract. several school districts and charter schools in our state have been fined for violating rules on transitional kindergarten class sizes. schools are required to have an

average class size of no more than 24 students. they're also required to have a 1 to 12 adult to student ratio. the state education department says tc classes have smaller class size requirements to make sure the young students get the attention they need. more than ten districts and 22 charters were found to be out of compliance. most of them in southern california. several districts blamed the nationwide teacher shortage. at least one says the state didn't make the requirements clear. >> well, anchor brewing is expected to announce a new owner by the end of this month. the 127 year old brewery shut down last july. many buyers have stepped up with their own visions for reviving the company. the new owner will get anchors remaining assets, including buildings and intellectual property, a cafe in oakland is closing after serving the community for more than 20 years, lakeshore cafe announced it's shutting down next monday, may 27th. since 2002, neighbors have come to lakeshore cafe, just north of lake merritt, for breakfast and lunch. the owners

of the cafe say a new restaurant will open in its place. happening today, the fairfield police department is launching its annual highway safety campaign ahead of the busy memorial day weekend. it's called click it or ticket. fairfield police officers will look for drivers who are not wearing seatbelts, or those who have not secured young passengers in a child safety seat. the crackdown continues until june 2nd. >> a new shuttle service is starting in santa cruz county at california's oldest state park this week. that continues to recover from a devastating wildfire. back in 2020, the icu fire burned 97% of the big basin redwoods state park in santa cruz county. this free shuttle marks the biggest increase in service since the park's reopening in july of 2022. the shuttles will run from 9 a.m. to 6 p.m. starting memorial day weekend through labor day. it's a chance for visitors to see all the regrowth and signs of wildlife returning to the forest. they're thousands of people gathered in los angeles county this weekend for one of california's largest pride celebrations. they lined the streets of ocean boulevard in
