the bay bridge we have a bigger backup here. it's backed up all the way out to the mays 701. let's get back to the headlines. >> new this morning. one person is dead. another has been sent to the hospital following a fiery crash overnight in fremont. this happened after a car slammed into a tree. ktvu james torres is live in fremont at the scene of the crash, as police have shut down a busy intersection there. james garcia we are at the corner of thornton and fremont about a mile away from 880 and not too far away from american high school, where the intersection still shut down. >> we still have caution tape that is put up here, and that car at the center of it all, still in the exact same spot that it's been in for about the last seven hours. you can see just how much damage there is to it, how burned it is from the amount of fire that burned after that car crash, and some of that fire, of course, damaging the business right in front of it. those glass windows absolutely burned as well. now we are hearing from some folks who were on the scene here saying that

this was a relative of theirs, someone who was driving late in the evening last night might have been speeding just a little bit too much and then causing this crash here. police of course, asking you, any driver in the area to stay out of the area because this intersection is going to be closed for hours. here's what we're learning. that car drove straight into a tree on the street. it was around 1230 this morning. flames immediately engulfed the car. police and fire crews try to help someone outside of the car. they responded to the scene, got them out of the burning car, loaded them onto a stretcher and took them away in an ambulance. video caught those moments, though we're not sure the extent of that person's injuries. i did speak to some people on the scene. they say the driver was their family member. that is the person we've learned has been killed in this car crash and led to what we now know is a very long closure of this intersection at thorpe thornton and fremont, here in the city of fremont. now, we haven't heard

too much from the fremont police department. we know they've got the intersection closed down. they're asking you to stay away, but they haven't given up giving us too many updates on about how long it may take them to not only just remove the car from the scene, but try to get this all reopened. we expect that to take several hours. of course, once we have those updates, we will bring them to you. we're live this morning in fremont. i'm james torres, ktvu, fox two news. >> james, thank you. the federal traffic safety agency has just confirmed a ktvu. it has launched a formal investigation into a solo car crash in pleasanton that killed a family of four. tyrone george, his wife renee and their two young sons died when their electric car burst into flames after crashing into a tree last month. the car was made by a vietnamese company called vinfast. the agency look into claims that a problem with the car's steering system may have played a role in the deadly crash. vinfast has not yet commented on the federal investigation. >> time is now 704. we're still following developing news from thailand. that's where one person is dead after a plane

plummeted thousands of feet in just a couple of minutes. we're getting our first look at the emergency response. there on the tarmac in bangkok, thailand. look at these pictures. early this morning, a singapore airlines plane from london to singapore had to make an emergency landing after running into severe turbulence. the airline says one person died, a 73 year old british man. dozens more were hurt. at least 30 people have been taken to a hospital there in thailand, while others are getting treatment right there on the tarmac outside the airport. >> a week of funeral services begins today for the president of iran following his death in a weekend helicopter crash. his death prompted a strong reaction from iranian americans here in the bay area. may god. last night, dozens of people gathered for a rally in emeryville hosted by the iranian-american community of northern california. organizers say president raeisi was responsible

tangibly, in real terms for all victims, that the lives of all human beings, wherever they may be, have equal value. >> now, the international criminal court is deciding whether to issue arrest warrants to the leaders of both. both sides of the war, including israeli prime minister netanyahu . >> it's exactly what the new anti-semitism looks like. it is moved from the campuses in the west to the court in the hague. what a shame. >> now, dozens of countries do not accept the court's decisions about war crimes. so even if the arrest warrants are issued, the accused don't face an immediate risk of prosecution. >> some students at usf are frustrated after the university cleared out their pro-palestinian encampment. they say without warning. the encampment started on campus at the end of april when classes ended. many of the tents were abandoned. protesters however, say some of the tents were still being used. they say they were

already planning to leave and that the university's actions are upsetting. >> i literally woke up from that tent this morning. all of my belongings are in there. my computers in there, all my blankets are in there. my keys to my house are in there. >> any kind of bridge that they were building before they palmed it now? >> demonstrators say they're now transitioning into the next phase of their protest. the university says it will store the items found for pickup and says if they're not claimed, they will be donated. >> your time now just about 708. a tire company in san rafael facing a lawsuit now from people in a nearby homeless encampment over allegations the tire shop has been blasting loud music all night. the lawsuit was filed yesterday in marin county court. people living at the encampment outside of the east bay tire company says over the past few days, there's been a lot of loud music playing, beginning at sundown. they think it's aimed at trying to get people to leave the encampment, and it's so loud.

>> i mean, so loud. blaringly it it it it makes your ears bleed. you can't. you can't hear yourself think. you can't have a conversation. and i mean, this person especially. right under it. oh, my god, i was here last night and i was crying. i was just like, i got to go. i can't, i can't do this anymore. >> now surveillance camera is also been installed in the parking lot of the tire store. and it's pointed at the encampment. a court hearing is set for this morning over a possible injunction to stop the loud music. as the case is working its way through the court system. we're trying to get in touch with the owner of the tire shop to get his side of the story. >> restaurants in berkeley are forced to choose between paying thousands of dollars or losing their public outdoor dining spaces. the city's implementing a new rule that will allow businesses to keep their parklets by charging them an annual fee. business owners are being given three options pay an annual fee to keep that parklet for private use only, pay nothing, and turn the parklet

into a public space, or take down the outdoor seating altogether. >> time is 709, and right now we do have a look at this morning's commute. it is going to be a little bit busy, as you might imagine. let's go right to the bay bridge toll plaza and you can see it is backed up to the maze. that's nothing unusual. we're beginning to get some other fill in in the east bay, though. interstate 880 is okay here, but it does slow down as you get closer to downtown oakland and the san mateo bridge. traffic is busy. we haven't seen anything unusual in the south bay this morning along northbound 101 and 280, but we do have traffic in fremont in the centerville district. we just heard james report from a scene of a devastating accident last night. thornton at fremont boulevard. it's actually on fremont boulevard just south of thornton, and that area is closed. it's putting a lot of pressure on side streets, and it's near a high school, so don't be late to school today. 710 let's go back to the desk.

we love lake merritt. spent so much time there. i mean, lake merritt and a historical landmark has been special for families and friends for generations. but recently, crime has been a problem. >> it's a real concern for many andre seniors here in studio, with plans to make lake merritt take it back to that visitor friendly destination for people all across the bay. >> not just oakland, not just oakland, but come into oakland and gather around that area. beautiful lake there. visit oakland's love for or lake initiative officially kicks off this saturday with a free afternoon concert and community picnic aimed at getting more people to lake merritt. now, over the past few years, fewer visitors than normal have been coming out to the lake, the popular destination that's served as a beautiful outdoor

gathering place has also been the scene of homicides, car break-ins and vandalism as we reported on them in an effort to change negative perceptions, the oakland museum, public library and other institutions have teamed up with visit oakland to make the place. many consider the jewel of oakland shine bright again. they're planning to host pop up activities, free concerts, health and wellness classes at the lake over the next few months. >> i want children and families to feel really comfortable and excited to enjoy outdoor recreation, art and culture at our heart center at the lake. >> last year, a man's body was found stuffed in a suitcase at the lake at. one longtime oakland resident says he was at the lake during the juneteenth shooting in 2021. that left one person dead and several others wounded. >> i was on the other side of the lake, and if y'all youtube it, it's a shooting that happened between two rival enemies and half of us ran up, down, up. mcarthur. i used to be a person that would come down to

the lake all the time, you know, the vibe started changing. i quit coming down, but i think this is a good way to boost reverence of the old lake merritt before the pandemic. >> other people say the lake is still a safe place for families to walk around and enjoy the outdoors during the day. there are plenty of people out in the park and walking around the three mile trail. >> i think it has a bad rap. i do think it's a lovely lake. it could definitely use some more lighting and i do not like going out after night. not unless i'm accompanied by someone. >> oakland police data shows that violent crimes citywide have been trending down this year. dave. >> all right. andre. thank you. time 716 will the federal government showing support for one of san francisco's biggest transit projects ever? it's giving $3.4 billion to the work already underway at the trans bay terminal. that money will help connect caltrans 77 mile system and california's high speed rail trains to downtown san francisco. san francisco

mayor london breed says this project will help meet the city's future needs for both transit and housing. >> downtown cannot be a 9 to 5. it has to be offices, housing and places for people to enjoy because it is a real neighborhood with a park right above our heads that we can enjoy on any given day, and the goal is to finish the entire project within the next ten years. >> new technology allows customers to leave their wallets at home and pay for purchases with facial recognition. some experts say the technology, initially used as a security tool may soon replace our credit and debit cards. several companies have been testing the use of facial recognition for making payments. while some consumers may be wary of the technology, experts say that biometric authentication is safe and efficient. >> so these are 3d scans, which makes them secure and pretty much impossible for a bad actor to try to bypass anything that can kind of make these day to

day transitions and transactions faster will ultimately prove successful with customers. >> privacy experts, though, caution people who agree to use facial recognition for payments should still use the strongest passwords possible. >> good idea, good idea. all right. 717 right back to sound. i know you're busy. did you fix everything on highway four and every place else? >> well, we're looking at it, dave, and highway four is slow as it normally is. in fact, we can start there just to show you that highway four is going to be pretty slow coming through the area there, heading west. now it's not unusually slow, though. you know, we usually have very slow traffic this time of the morning, down to about 15 miles an hour, getting west. but it gets a little better at 242 slows again through pleasant hill down to about 25. those are pretty slow speeds, obviously, but if you do the morning commute, you're used to it here at the toll plaza, 15 to 20 minute delay 880 near the coliseum looks all right. but as you get closer to downtown, you

will start seeing some congestion there. 718 let's talk about today's weather. here's steve. >> thank you, kind sir. yes, sir. all right. we'll get to it here. inland areas will bump up today. this will be the warmest day of the week. and we've been out here any length of time this isn't that warm, but we'll get above average on the temps for san rafael, walnut creek, palo alto and los gatos all going low to mid 80s coast and bay. really, i don't think we'll jump all that much. there's still some fog san mateo coast down to santa cruz and monterey bay, so warmer inland and bay side. but i think we level off today. started dropping a big drop as the fog comes back in thursday. friday. for all right now it's just confined to a few to the south. there not much of a breeze. i mean, it's a little westerly southerly northerly has turned northerly in the oakland berkeley hills that was west southwest earlier. now it's northerly there you can see some of that fog, half moon bay down to santa cruz. so i don't think they're going to jump out of the 50s and 60s today, 40s, 50s on the temps almost vacaville with a northerly breeze is almost 70, brentwood 63. after that, it's

40s and 50s. we had a cool morning though, a lot of low to mid 40s. 30 in truckee, 33 south lake tahoe, 41 arcadia. they were down to 38 again. and then 51 monterey, santa barbara's in there and san diego at 60. the low kicks out, but another one right up there is on its way. and as that one follows the same highway, we'll start to see lower pressure develop to the west southwest. that'll be over us. that will open the door to a cooler breeze starting tomorrow, and significantly cooler by the time we get to friday and saturday. but today it's more about sunshine for most, and warmer temps could be a little bit of activity popping up over the mountains on the weekend as that low drops in mainly towards the lee side of the sierra. but if you're going up there, just keep an eye on things. two for tuesday is sunny and warmer for many, not for all, but for many today. some fog though to the south and that that's, you know, going to impact them with keeping them on the cooler side. but most locations 60 to 70 inland temps will take the biggest jump with 80s start to downshift a little bit wednesday, then much cooler thursday into the weekend. >> thank you steve. time now is

720 health care workers making minimum wage in california could have to wait a bit longer for a pay increase by state. lawmakers are delaying a move that would push their wages to at least $25 an hour. >> and a big surprise for some growers in southern california, researchers say a sea lion jumped right into their boat right in the middle of their exercise

defense in his criminal trial just rested its case just minutes ago. now the prosecution can call rebuttal witnesses. the judge expects closing arguments to begin a week from today. donald trump never took the witness stand on his own behalf. and as the defense rests its case, trump's legal team is now asking the judge to throw out the case entirely. >> we i think the case is going very well. we've asked for a termination of the case. this case should be terminated now. >> it's not likely the judge will grant that request by trump. the case is expected to go to a jury as early as next week. >> a japanese town long known as the best place to take photos of mount fuji, is certain to have far fewer tourists this summer. leaders of the city, about 80 miles outside of tokyo, have now put up a 65 foot tall barrier. it's designed to prevent tourists from taking photos of mount fuji. locals have long complained that a growing number

of visitors was creating traffic problems. they came up with the idea of blocking the view to mount fuji. >> i found out that it was the last day, so we didn't really plan to come here, but we say, yeah, we have to go there. we will be the last one to see it. >> this comes at a time that foreign tourism is booming across japan, due mostly to the yen's recent decline, to a 34 year low. >> all right. our time is 724 rowing team in southern california had a real surprise when a sea lion pup hopped into one of the rowers boats. logan hibbard told us she and her teammates were practicing in marina del rey when the sea lion jumped out of the water and right into the boat and into her lap. her teammates on the ucla rowing team took these photos. while she did her best to stay calm. >> it's a baby sea lion. so, he was really, really friendly. and. yeah i figured if i stayed calm, then it would make him more calm. and so we just sort of had an understanding with

each other. i did try to pet it and it didn't really like that. so. so i stopped it. >> good idea. they did call the marine mammal center in los angeles. they sent out a crew to take the sea lion pup and study it. experts say the sea lion was malnourished. likely that's the reason it was so willing to get so close to humans. >> the north bay's music and food festival, bottlerock napa valley, kicks off this friday. celebrities scheduled to appear at the culinary stage include warriors star stephen curry, actors bradley cooper, neil patrick harris and cameron diaz, celebrity chefs jose andres and alton brown, as well as motley crue drummer tommy lee and rapper nelly will be there as well. this year's performers include. this is a really good lineup, yeah, stevie nicks, megan thee stallion, pearl jam and ed sheeran. >> like it? all right. time is 726. students at uc santa cruz won't be heading to classes today. we'll tell you what the university decided to do instead. plus it would stop the water from flowing.

most of it's about half moon bay south and it's sold out down towards santa cruz and monterey bay, no doubt. 40s 50s now on the temps here and there. it is, most of it's pulled off away from san francisco, still a little bit southwest part of marin coast, but then san mateo coast down to santa cruz, gilroy , hollister. forget about it. i mean, that's i don't think you're warming up. i don't buy into the some of the warming a lot of the forecast highs have been way too warm. but we'll jump in on the inland temps. they won't have any problem jumping up today. so 60s, 70s low to mid 80s on the highs. salah's here 730. and we will begin with the east bay steve we have a lot of slow traffic there. >> it's not surprising to you to me or anyone really who has been driving for a while. let's go to highway four and 680. you see it very slow coming from antioch, heading over toward concord. most of it is pittsburg bay point, and then 680 is slow getting to walnut creek again, all very ordinary. the bay bridge backed up to the maze. so if you're just checking in to see if things are normal, i

would say yes, they are. we don't have any unusual slowdowns on the bay area bridges right now. this is the san mateo bridge. it's crowded. one of the things we do mention is that the south bay is getting very busy this morning, especially getting onto 85 and 280. and in fremont in the centerville district, thornton at fremont avenue, that interchange is closed. that intersection, it's super busy as you know well today you can't use it. and a lot of the other streets are crowded in centerville, district of fremont. just word to the wise, it's going to take you longer to get around there. 732 let's go back to the desk. >> okay, sal, thank you. happening today, rideshare workers and delivery drivers will be rallying in san francisco outside of the california supreme court, ahead of a big case that could affect the future of the state's gig economy. ktvu is ali rasmus is here to explain what this case is all about. good morning. ali >> good morning dave. yeah. at the center of this case is the

question do california voters have the right to set laws about employment, specifically, how certain types of workers, in this case gig workers, are compensated? now, the group that brought the complaint that's led to this case argue that no voters don't. whether it's through a ballot initiative process or otherwise, a77 justices on the california supreme court will decide they will hear arguments today on the legality of prop 22. now, prop 22 is passed in november of 2020 by nearly 60% of california voters. what it did was classify rideshare and delivery drivers for companies like uber, lyft, doordash and instacart as independent contractors, not employees as contractors, drivers are supposed to have more flexibility with their work schedules, but it also means they're not legally entitled to state mandated things like minimum wage, overtime or sick leave. now, some rideshare drivers and state union representatives are challenging the legality of prop 22 and arguing that some worker rights

like making sure people are paid a minimum wage, should be determined by state law, regardless of what voters decide. now, opening statements in the case will start today, this afternoon, and while they're going on, a group of about 200 workers with a group called the gig workers union will hold a rally outside the courthouse. some will be listening and watching to a live stream of the arguments, in this case happening outside the california supreme court. and there's a group of about 100 or so gig workers, rideshare drivers, delivery drivers coming up from southern california on their way here to take part in that rally and listen to the court case as it goes on this afternoon, live in san francisco . ali rasmus, ktvu, fox two news. >> ali. thank you. california health care workers will have to wait an extra month before seeing an increase in their minimum wage. health care workers were supposed to have their minimum wage raised to $25 an hour starting in june. new documents show. lawmakers submitted paperwork to delay the increase to july 1st. backers say the move will align the pay increase with the state budget

year. the increase has also been at the center of budget negotiations. the state has said the move could cost about $4 billion a year. >> well, new this morning, police in fremont telling drivers stay away from part of a very busy road as police investigate a fiery and deadly crash. you heard so just moments ago. investigators say one person was killed in this, another was hurt when their car slammed into a tree and then burst into flames. it happened just after midnight on fremont boulevard between thornton avenue and peralta boulevard. is-i'll told you. police say that roads are going to be closed for several hours. authorities have to clear the scene and collect evidence. meantime, san jose plans to install speed cameras all over the city. the plan is to place 33 cameras in high collision areas and then mail tickets out to the speeding drivers. city officials say the annual number of traffic deaths in san jose more than doubled, from 29 back

in 2012 to 60 5 in 2022, and most of the funding for these cameras is coming from an $8 million federal grant. >> police in the east bay say they arrested a 13 year old student for homicide at his middle school earlier this month. the arrest follows a deadly stabbing on april 2nd inside the safeway store on bancroft avenue in san leandro. broadmoor district investigators say the teen stabbed and killed 18 year old zion goodin after goodin got into a heated argument with the alleged attackers friend. police say the arrest comes after investigators talked with witnesses and reviewed surveillance video, was able to piece together what transpired during the altercation that led to the stabbing and homicide, and we were able to, from surveillance footage, eventually able to piece together the identity of the suspect. san leandro police say they arrested the 13 year old last week at his middle school in a neighboring city. he's now being held at alameda county's juvenile hall, facing

one count of murder. >> our time is 736. new details from fremont about a fire at the tesla plant factory there. the fire department says it started inside of an oven around 5 p.m. skyfox was out there flying over it, showing fire crews on the roof and around the building. the fire crews say all of the employees have been accounted for and no one was hurt. the environmental protection agency has issued a new warning involving the safety of the nation's water supply. >> the epa says cyber attacks against public water facilities across the country are becoming more frequent and more severe. it's issued a nationwide alert urging companies to take immediate action to protect the nation's drinking water. however, tight budgets could prevent the water facilities from adding more layers of security. >> a lot of these systems are are stretched fiscally. they don't. they just have enough budget to keep the water system running. cyber security is not something that they've been focused on as much as, say,

large power grids. and so this is sort of new to them. and it's again a wake up call. >> the epa says roughly 70% of the public water facilities it inspected last year failed to meet current cybersecurity standards. >> our time now, 737 classes are remote today at uc santa cruz because not only today but tomorrow as well, because of a continuing strike by graduate workers. now, the students protesting the uc system's recent crackdown on pro-palestinian demonstrations on the campuses around the state is the reason for this. some students reported having problems getting to classes yesterday, so the university today went remote because strikers were blocking the entrances to the campus. the walkout involves teaching assistants, researchers and other academic workers. we don't know how long that strike will last. >> 738 we'll swing back to the traffic center here. sal's watching a couple of issues on

bit of fog still hanging on on parts of the marin coast. muir. muir beach to bolinas. not much, but there's a little bit there. but there's a lot there. if you go from about half moon bay south. look at that. i mean, santa cruz was 66 yesterday. how in the wide, wide world of weather are they going to warm up today? i don't get it. so look at that fall. even gilroy up to morgan hill. so i think those locations will actually be a little cooler today are the same as yesterday. if you're north and east though, should be no problem warming up into the low to mid 80s. i had a chilly tuesday morning, i'll say for may 21st hollister, morgan hill, pinole, woodside, san anselmo, rohnert park, orinda, pacifica and palo alto all between 41 and 46. cool degrees. i'm going 68 in the city today. after a low of 52. what's average? 6452. the record 92,045. the record low again way back in 1899. warmer today for many. not for all, but for many. we'll go 86 in concord. although again, i think this is the warmest day of the

week. after today, temps will start to drop off a little bit here. 60 mount veeder, north wind. the oakland hills had a west southwest wind. now it's turned northerly, so they went from about 49. now they're 56. and even boulder creek has a northerly breeze. so we're starting to see warmer air aloft which will translate into a warmer day today, especially away from the coast by the coast. probably not too much change here, but fog looks like it. i mean, it's been this way since early april. we get about 2 or 3 days of warm up and then right back into the fog. and that's exactly what's going to happen again. vacaville is already 71, brentwood 66, but 40s mainly 50s on the temps 30s in the mountains. arcata 41 to 60 in san diego and the high pressure is really not that strong. another system up in seattle and portland is dropping in to take the place of the one that's already there. that will then kind of backtrack a little bit with lower pressure over us starting tomorrow. today, though, it's about warmer, especially bayside and inland. they'll jump up in the 70s and 80s, but cooler weather is on the way. maybe a little bit of thunderstorm activity up in the

reports tomorrow morning. the most anticipated earnings report this week comes from nvidia, another bay area company they report tomorrow. taking you live to the new york stock exchange for the latest numbers this morning up across the board. as you can see the dow jones started the day ended the day yesterday below that 40,000 mark. but it's up a little bit today the s&p 500 up slightly as well. the nasdaq posting a slight loss this morning. a local health and wellness company claims to have a cheaper version of the popular weight loss drug ozempic. now san francisco based hims and hers health is launching injections with the same main ingredient as ozempic. but the company says it will cost about $200 instead of the more than $950 that ozempic or wegovy can cost without insurance. there have been shortages reported of both of those drugs due to a recent surge in demand. you do still need a prescription for the compound from hers and hims as you do for wegovy and ozempic. the company has sold close to

andre, we're seeing the aftermath of that accident. >> it's very visible behind me. we're at the corner here of fremont boulevard and thornton avenue area. that's about a mile off of 880, not too far from american high school here in fremont, either. this intersection still remains closed this morning, and it's been closed for nearly eight hours at this point. that car at the center of it all, still in that same place. you can see just how destroyed it is. that fire that was involved in there as well, damaging the building next door. that's just right in front of. we're still waiting to hear from police about how much longer they may still have this scene looking like this. we know the coroner's office of the county medical examiner's office still has yet to come out to the scene, and certainly no word of how soon a tow truck may be coming out to remove that car from this area. the police, of course, asking all drivers to stay out of this intersection because this will likely stay closed for hours. that car we know drove straight into a tree on the street that happened

around 1230 this morning. the flames engulfing the car immediately, police and fire crews responded to the scene and they were able to help. one man out of the burning car. video did show one person loaded onto a stretcher and being taken away from the scene. at this point, we are not sure of the extent of their injuries. i did speak to some people who have been here since very early this morning. they say they are family members of the driver. that's the person who was killed in this crash. we are still waiting to hear from the police department on just how soon, maybe how much longer it will take until they get this intersection reopened. but again, we are still waiting for medical examiner's office and a tow truck to big pieces of information. two big parts of the plan to make sure that they can get this intersection reopened, cleaned up and back open for drivers to come through. still expect that to take another couple of hours before we get to that point. we're live this morning in fremont. i'm james torres, ktvu,

back of the toll plaza, there's not there's not a lot going on there now. and that's good because that means we're getting improvement here, which will eventually improve all the way through. 832 let's go back to the desk. >> happening today, the california supreme court will hear arguments on a case that could determine the future of the state's gig economy. workers ktvu rasmus explains. here, a group of rideshare drivers is on its way from southern california, from the bay down to southern california to listen to the case in court, ali. >> yes, the seven justices on the california supreme court here in san francisco will decide the future of california's so-called gig economy and the legality of proposition 22. proposition 22 was passed in november of 2020 by 60% of california voters. it classifies rideshare and delivery drivers for companies like uber, lyft, doordash, and instacart as independent contractors, not employees. now, as contractors, drivers are supposed to have more flexibility with their work schedules, but it also means

they're not legally entitled to things like a minimum wage, overtime or sick pay. now, some rideshare drivers and state union representatives are challenging the legality of prop 22. their argument some worker rights, like making sure people get minimum wage, should be determined by state law regardless of what voters decide . >> who gets to decide? does the legislature get to decide? or do the people of california through the ballot process, get to ultimately decide? it could be something in between. perhaps the california supreme court will take out the most controversial parts of the legislation and let the rest of it stand. >> now, one of the most controversial parts of prop 22 was cutting gig workers out of the state's workers compensation program, limiting their protections if they got injured on the job. arguments in the case will be heard today at the california supreme court in san francisco. and while it's going on a group of rideshare and delivery drivers is going to have a caravan coming up from

southern california to the bay area so that they can watch and listen to the court case. it's expected to start 130 this afternoon. that's when the supreme court will start hearing some of the opening statements on this case. and outside the courthouse, they will have the gig workers and their supporters will have a screen where they'll be able to watch the live stream of what's going on in the courtroom, live in san francisco. ali rasmus, ktvu, fox two news. >> ali thank you. california health care workers will have to wait an extra month before seeing an increase in their minimum wage. health care workers were supposed to have their minimum wage raised to $25 an hour starting in june. new documents show lawmakers submitted paperwork to delay the increase to july 1st. backers say the move will help align the pay increase with the state budget year. the increase also has been at the center of budget negotiations, as the state has said the move could cost about $4 billion a year. >> 835 now new this morning, police in fremont are telling drivers to stay away from a part of a busy roadway as officers

investigate a fiery and deadly crash. this is in the area of fremont boulevard between thornton avenue and peralta boulevard. police say roads in the area will be closed for several hours as authorities clear the scene and gather evidence. investigators say one person was killed, another injured, when their car slammed into a tree and burst into flames shortly after midnight. san jose is planning to install speed cameras throughout the city. 33 of them are set to be placed in high collision areas. drivers captured violating traffic laws will be mailed a citation. city officials say annual traffic deaths in san jose have more than doubled, from 29 in 2012 to a peak of 65 in 2022. a majority of the funding from the camera is coming from an $8 million federal grant. >> police in the east bay say they have arrested a 13 year old student for homicide at his middle school earlier this month . the arrest follows a deadly stabbing on april 2nd inside the safeway store on bancroft avenue in san leandro, broadmoor district. investigators say the teens stabbed and killed 18 year old zion gooden after gooden got into a heated argument with the

alleged attackers friend. police say the arrest comes after investigators talked with witnesses and reviewed surveillance video. >> were able to piece together what transpired during the altercation that led to the stabbing and homicide, and we were able to from surveillance footage, eventually able to piece together the identity of the suspect. >> san leandro police say they arrested the 13 year old last week at his middle school in a neighboring city. he's now being held at alameda county juvenile hall, facing one count of murder. the environmental protection agency has issued a new warning involving the safety of the nation's water supply. the epa says cyber attacks against public water facilities across the country have become more frequent and more severe. it's issued a nationwide alert urging the companies to take immediate action to protect the nation's drinking water supply. but tight budgets could prevent the water facilities from adding more layers of security. >> a lot of these systems are are stretched fiscally. they don't. they just have enough

cents. >> yes, a lot of talk about a bay area company, nvidia. the most anticipated earnings report this week comes from nvidia, the ai chip maker based here in santa clara, reports tomorrow. target also releases its quarterly report tomorrow. consumer spending accounts for two thirds of economic activity, so those retailers those are important reports. as the opening bell rang this morning, lowe's quarterly report beat analyst expectations. and that's also some good news. taking you live to the new york stock exchange and the big board, the dow jones up a little bit 40 points still hovering below that 40,000 mark. the s&p 500 up slightly. the nasdaq has been fluctuating up and down. slight change for the nasdaq so far ahead of those earnings reports macy's released its first quarter earnings report this morning though, and beat wall street's expectations. macy's raised its full year outlook for sales and profits in. the ceo says the turnaround strategy is working. the company is in the process of closing 150 macy's stores, but opening some new
