because it's not the decision as kathy said to fire the police officer. >> i think it's positive, ali, because eric garner died as a result of the police using an illegal chokehold. and as we have talked several times before, ali, i absolutely believe that eric garner case is one of the most vivid examples of the fact that the police can get away with murder when they kill a black or brown person in america. >> benjamin, what do you think of the police union and the suggestion that kathy park and i were just talking about in that if you go down this road of holding individual police officers responsible for what the union says is the police officers doing their job, they will hold back from doing that, they will call a sergeant and the implication is that will result in mayhem. that's the argument coming from the police union. >> so, they would like to advance the argument that you can kill poor black and brown people and not be held

accountable. and if you hold them accountable, then we won't do our jobs. well, it's very simple. if you don't do your job, then you need to lose your job. and it's very clear that there are people who are good police officers, we're not saying all police officers are bad people, but when you do something illegal, unethical, unjustifiable, then you should be held accountable just like you or i would be. nobody is above the law. and so the question for the police commissioner, is he going to send that message clearly to the citizens of new york and to people all around the world who watched eric garner say "i can't breathe"? >> you've represented a lot of cases in which there's been violence by the police against african-americans. what's your sense of the degree to which there might be implicit bias or unconscious bias that causes police to do these things as opposed to obvious bias?

>> you know, it's interesting. i want to believe at best that it's implicit bias, ali. but you see some examples that make you wonder if it was just obvious bias. you know, we deal with situations, the fifth anniversary of ferguson, michael brown's death, is coming up on next friday. and many people question whether these officers just target young, especially black men, in baton rouge, louisiana, where he says i'm going to kill you black m-f. and then a couple minutes later he actually kills him. is that implicit bias or is it obvious bias? it's in i guess the judgment of the jury. with but what we know without a shadow of a doubt the law seems to protect police officers who do unjustifiable acts that cause

the death of minorities. and so we have to send a message that it's equal justice under the law for all americans. >> so let's say that message gets sent, whether it's implicit bias or explicit biis. what does the fix look like? >> i think the fix looks like systematic and constant implicit bias training. we have to have from the top down. i know it's hard with who we have in the white house right now. but it has to be sent from the top down that we respect all our citizens and every american citizen deserves their right to equal protection of the law and that a police officer in many instances is the first connection that citizens have with their government. and so it looks like treating people fairly for all of our children. >> benjamin crump is a civil rights attorney who represents the families of trayvon martin exactly what red

the manhattan district attorney's office has subpoenaed the trump organization as part of an investigation into hush money payments made to stormy daniels, stephanie clifford is her real name by michaelti elec. this is according to "the new york times". prosecutors are looking into whether the trump organization falsely listed its reimbursement

of cohen for the $130,000 payment to daniels as a legal expense which could be a state crime. but that's not all. prosecutors have also reportedly subpoenaed american media incorporated. the parent company of the national enquirer which made a payment to cohen to suppress former playboy model karen mcdougal's story about her alleged affair with trump. joining me now is elizabeth holzen and a former member of congress, former member of the house judiciary committee when nixon was the president and importantly for this discussion a former district attorney. you were the kings county district attorney in brooklyn. tell me what this means that the manhattan district attorney, this is not the southern district new york, has issued these subpoenas. >> well, it's pretty important because the manhattan district attorney's office is probably one of the most respected district attorney's offices in the country and has generally been that for decades. they deal with financial crimes. that's one of their areas of

real expertise. wall street is in manhattan. so that's something they handle a lot. the d.a. does not report to anybody. it's not like the justice department who can tell the southern district of new york to lay off or re-write a report. no, the district attorney is elected and reports to nobody. of course the district attorney's conduct is reviewed in every case that's brought, defense counsel can attack it, judges can respond in appropriate ways. and soar, yes, the d.a. is very independent. and. >> an attorney for the trump organization has called the inquiry a political hit job and that it's just harassment of the president. this is the terminology we've heard a lot. his family and his business using subpoenas and leaks as weapons. we will respond as appropriate. talk to me about what happens with this. they subpoena information. what can the district attorney do when they get this information? >> well, the district attorney

can prosecute, assuming that there is a crime. i mean, one of the crimes that could possibly be involved here would be falsified business records. i mean, if the business records were entered improperly in terms of how they recorded in other words the hush money payment, could be a crime, a medicine. it could be elevated into a felony if it was done for the purpose of helping the commission of another crime. so we could have felonies, and it could well be, too, that of course if donald trump ordered the concealment or the distortion or the falsification of the business records, heju f but for the president of the united states. >> this information about the payments to stephanie clifford, to american media, the payments america media made, the payments to michael cohen, they've all
