"the beat" with katie phang and ari starts now. >> if i haven't said it before, it's really good to have you back. thanks for being here. >> thank you, my friend. have a great show. >> thanks. and to all of you welcome to "the beat." i'm katie phang in for ari melber. we begin with donald trump doing what he does best, trying to delay justice by claiming, wait for it, presidential immunity yet again. today trump's legal team filing a motion to delay his new york criminal hush money trial, which is currently set to begin march 25th, just two weeks away. trump argues the trial should wait for the united states supreme court to weigh in on his

presidential immunity claim. those arguments are scheduled for april 25th. trump's legal team writing, "the court must preclude the people from offering evidence at trial of president trump's official acts as the commander in chief." trump claiming that even though stormy daniels was paid off in the fall of 2016 trump didn't reimburse his then personal fixer and attorney michael cohen until 2017, when he was president. and thus, all of those actions are going to fall under the category of, quote, official acts. trump's attorneys also arguing that trump made statements about it as president and on official premises, referencing this infamous moment aboard air force one in 2018.

>> his team adding, "president trump respectfully submits that an adjournment of the trial is appropriate to await further guidance from the supreme court." trump has other legal problems of his own making waves today as well. trump posting a $91 million bond in the civil defamation case of e. jean carroll as he tries to appeal that ruling. and despite that legal trouble and hefty payments trump is continuing to make statements that could land him back in court. >> 91 million on a fake story. totally made up story. false accusations made about me by a woman that i knew nothing about, didn't know, never heard of. >> miss bergdorf goodman, a person i'd never -- i'd never met. i have no idea who she is. i i never met i have no idea who she is.

i was given a false accusation and had to post a $91 million bond for a false accusation. >> aging carol's lawyer saying they could possibly sue again. stating continue to monitor every statement that donald trump makes about our client. in the interest of full disclosure i am friends with eugene carol. joining me is -- former fellow prosecutor for the northern district of illinois kristi greenberg for myrna -- southern district of new york. i would like to start with you. i want your reactions to the filing specifically let's look at the one in the new york case. trump's attempts to delay to adjourn this trial from beginning before the show started i looked at really carefully the arguments he is raising and put aside whether or not those that conduct as alleged kristi actually falls within the official kind of parameters or the parameters of his official conduct.

i had a concern about the fact trump is fighting to the anderson case which is the recent decision from colorado. and also citing to the fact scotus decided to take up the presidential unity defense in the first place. do you think that gives the judge some cause for pause mount? >> those cases are interesting. what is even more interesting is the case -- mentioned which was the case that was before judge hellerstein in this very matter. where they sought trump's lawyers sought to remove the case to federal court. in this very issue was put before judge hellerstein and he said trump is not immune from the people of new york's prosecution in new york supreme court. this argument of immunity is not a colorable defense. he specifically went to the same duties they are trying to put forth now and said these are not presidential duties. hiring and making payments to your personal attorney to handle personal affairs not a presidential duty. reimbursing: for advancing the

hush money presidential duty. they had the opportunity to appeal that to the second circuit. they did not do so. they have the opportunity even to bring it up in a motion to dismiss. they didn't do so. did not bring it up in the timeframe they were supposed to for a motion which is just trying to exclude certain evidence from trial. this is not only been there done that they've been ruled on. in the federal court in the same case. but it is also untimely. i understand there are matters going on before scotus but they have already been adjudicated in this case. just as they were by the way with eugene carol. in that trial they also did not make the argument and therefore the district court in that case said you did not make it in a timely wait in the first three years of the case. you don't get to make it now. just as it was waived there i assume it will be waived here and the trial will proceed. >> to kristi's point trump did

appeal that decision from hellerstein but he voluntarily dismissed that appeal. thereby actually not having the second circuit make a decision. does it make a difference though that that decision was done by a judge to basically say you have argued for immunity and you don't get it trump. but the fact the supreme court is actually going to be deciding it does that end up overruling in any way a prior judge has decided? >> i don't think so. with the supreme court is deciding is to the what extent there is presidential immunity. that is a standalone question. the issue and i agree 100% with what kristi said is whether or not the collateral stop because there was a finding by a judge that he had waived the absolute immunity argument and that he did not appeal that ultimately. he withdrew his appeal. i think that issue in this particular case is decided.

to that impact the generally six case or a different case? perhaps. it doesn't impact this case because ultimately he has the opportunity to make that argument he did not make that argument. he waved it. ultimately he could have appeal. he withdrew the appeal and did not go forward. that disposes of that issue here. that is obviously why he recognizes the issue and he is trying to save it at the last member i agree too little too late. >> kristi within this motion there's also inconsistent positions that are taken by trump that somebody like judge is going to pick up on. he is trying to say certain conduct like his tweets he did that are at issue in this case. suites that dealt with michael cohen and others that those actually were in his official capacity. that is what trump is asserting in this motion to adjourn the trial. on previous occasions to get inconsistent position where he said actually those are

personal capacity tweets being made you cannot actually use them against him. does that require then some type of hearing by the judge to decide this in terms of whether he wants to adjourn the trial or is that just something that can be dealt with as the trial commences? >> i think the judge will look to deal with it before the trial starts. i think yes they take positions whenever they think it is useful to them and they don't always have to be consistent. it certainly the case that these tweets he was making those are statements of the defendant in the criminal case. and again they are dealing with personal matters about his personal lawyer. so i expect the judge will have a ruling on this because really what they are trying to do is they are trying to take their immunity defense which again they have already waived. it is too late and has been dealt with. they are trying to shoehorn it

into a different issue what kind of evidence can be admissible in the trial? once you set as a matter of law they can't make the unity defense i don't then see how the judge is going to keep out certain evidence that on that same basis. so again i think there is this tortured argument from the trump team to try and get at a minimum some evidence thrown out. but these are the defendant's own statements. these are donald trump's statements. i don't think his immunity defense at this late hour is going to save him. another hail mary that donald trump is trying to do is he is trying to buy some more time in the mar-a-lago classified documents case. he wants 10 more days which is more time than the federal rules of criminal procedure allow. but to the gamesmanship that comes from trump legal in terms of his defense, they as in the trump legal team is saying you know judge trump needs more time because he is going to go to trial in new york on march 25th but in the same breath and out of the same mouth they are

now saying we want to adjourn that case. how much coordination or paying attention is going on between the judge in new york and the judge in florida. ? counsel has filed opposition to that motion for more time in the classified documents case. great question. the judges are not monitoring each other's dockets. but you can be sure that the prosecutors in both cases are watching all of those other cases. pretty extensive team working with the district attorney brag opposite of special counsel is a substantial team. they will put that in front of the judge. you can bet your bottom dollar that these positions are going to get thrown in front of the other judge. it makes them look bad. one of the issues they are trying to delay every case is that ultimately it just makes you look bad in front of all the judges. it is easier to push them in a certain order. candidly they did not try to delay this one early enough or

new details on trump's $90 million bond are raising alarms. that big bond being posted at the 11th hour last week in the e. jean carroll case. giving trump time to appeal that defamation verdict before he has to pay up. trump's bond was underwritten by a branch of the company chop one of the largest insurance firms in the world. and one that has a history with trump. in 2018 trump appointed chubb's ceo evan greenberg to a white house advisory council on trade policy. in 2020 greenberg served when a counsel of business leaders advising trump on how to reopen the economy after the covid pandemic. >> my next guest is on the president's task force to reopen the economy and he was on that call yesterday. chubb chairman and ceo evan greenberg. >> the more we can have the ability to test identify isolate

while we practice social distancing, we weren't telling the president anything that he doesn't already know.>> all of this raising speculation that trump may have called in a favor to secure that bond. chubb has provided trump with insurance policies in the past which came under scrutiny in his new york civil fraud case. new york attorney general letitia james alleging intermittent chubb sent an insurance appraiser determined their worth of his penthouse apartment trump tower. trump rushed the expert out before the assessor to take any measurements. also of note the terms of the bond agreement between trump and chubb have not been disclosed to the public. we don't know what assets trump may have had to put up to secure the bond. or more importantly if the bond was cosigned by someone else. former fbi counsel andrew wiseman making this very point on the beat on friday. >> the issue is is he going to

be beholden to somebody? we know somehow he got a bond from chubb. i'm interested in knowing did somebody for instance have to cosign was there somebody there some individual there who he is beholden to? >> joining me is neil peterson the owner of the new york-based surety bond agency peterson and sons kristi greenberg is back with us. i want to start with you because from a legal standpoint in criminal cases for example there is something called a never your requirement. if it is a case that involves drugs or money laundering etc. sometimes there is a requirement for a criminal defendant to have to show that the bond proceeds came from clean money. but we don't have that in this instance and the civil case. we don't have that for purposes of in a surety bond. how concerned should anyone be

including the court perhaps as to whether or not the terms of this bond need to be transparent for everyone to know about? >> well i think one thing i thought was interesting was today was the day when e. jean carroll's lawyer could have ejected to the bond. they did not do so. and the court has to still approve the bond. but usually there is not a lot of looking behind and trying to get transparency from the court. if you can get a bond from a reputable insurance company. and usually that is the end of the inquiry. at least for e. jean carroll knowing there is security there that she is going to get paid if as i suspect she would be successful in her appeal is really the end of the inquiry. but for us obviously the public with this individual being a candidate for president raises all kinds of questions. so, yes you would love to know there's going to be transparency. i don't know we will get it from the courts.

there is one person who may have some insight into it and that may be the independent monitor judge jones. any time now under this new decision from judge -- in the civil fraud case any financial disclosures that need to be made to a third party including lenders like chubb need to be need prior approval from the independent monitor reviewed and approved before they can go out. so she may have some insight as to what kind of who it is who the lenders are if there are any. and what that looks like. so she may have some insight but i don't know that will ever trickle down to the public. >> neil put your bon hat on and walk us through whether or not there is much to do about nothing when it comes to this bond. and how much would somebody like donald trump have to put up to be able to get the bond in the first place what kind of collateral would you be looking for for the balance of that judgment? >> so in my professional

opinion, i believe he had to put up liquid collateral. a lot of different newspapers and other organizations are talking about using real estate as collateral. it is not traditionally done with a matter of this size. it is generally the surety has 10 days to pay the judgment i believe in the bond that was filed -- clause 30 days is not sufficient time to liquidate real estate. satisfy a judgment. if he had to liquidate real estate 30 days it will be at a fire sale. the price would be impossible to determine other issues if former president donald trump is reelected can you perfect the indemnity agreement which is the contract surety companies you to secure the bond. against the sitting u.s. president. that is one of concerns surety companies not very forward thinking. they are very risk adverse. it is not like someone is going to come in here and extend a lot of credit.

any asset base you would want for the client with a matter decides to extend them credit would be several times what it is reported that owner president donald trump's work. it would be looking for someone worth 17 to 20 billion to give them a lot of credit. >> i want to stick with you for a second then. assuming when you say liquid assets you are talking cash. because that cash is king. if donald trump does not have the ability to be able to give the reassurance to a bond surety that he has that value, to be able to satisfy making sure that that surety company gets what it is putting its money up for at this point. you then require somebody to cosign on that bond? >> it is always an option. i have a lot of clients that have an additional guarantor what we call intimate sores. there are various matters where maybe you have one party that needs to obtain a bond and that the company is going to acquire

that company. they may have a vested interest in getting them a bond or there could be other reasons such as someone has a vested interest in a person getting a bond they can guarantee it. that is a possibility. >> kristi neil brings up an important issue which is you get somebody like trump he ends up back in the oval for whatever reason. can't get him to honor his obligations contractually he has to do to federal insurance which is the surety prayer e. jean carroll. what you have to do if you can't sue a sitting president or even really pursue anything simply because he is a sitting president does chubb have to wait until he gets out of the oval to collect on any of this? >> that to me is the real conundrum for any insurance company for any potential bond company that would be looking to secure a bond here. if he does become president and he steps them the records is

not going to may not come for a while. so it is a real risk to do. i'm really especially with someone again who is who has been found liable for committing financial fraud. in particular insurance fraud. so, this seems like a real risk to me. again it seems as though he had a personal relationship with the ceo of chubb and maybe that came into it. it raises a lot of questions about who would feel comfortable providing a bond posting a bond for him in this kind of circumstance. >> we have not talked about the fact kristi that trump has to by march 25th that is a special day in his life as well, come up with the half $1 billion to be able to deal with the new york civil fraud aji case. neil peterson i appreciate your insight. thank you for staying with us. thank you. coming up s&l rose the

new claims about his private embrace of strongman figures and dictators including his praise of hitler. it comes as trump publicly embraces hungary's authoritarian prime minister. hosting him mr lago. some context the european union formally condemning his assault on democracy. he drew international scorn for his racist comments about mixed race societies. he's led crackdowns on lgbtq rights. he's assailed immigrants and threatened political journalists. with jail. this is how trump described him over the weekend. >> there is nobody -- a better leader than victor erb on. he is fantastic. prime minister of hungary. he does a great job. not controversial figure. this is the way it is going to be and that is the end of it. he is the boss.

generals of the group were not loyal to him and in fact tried to assassinate him a few times. and trump did not know that. all of this emerging as trump promises to be a dictator on day one if he wins reelection. joining me is samantha a veteran of the department of homeland security. she has worked in the biden obama and george w. bush administrations. michelle goldberg new york times columnist and msnbc political analyst. thanks to both of you for being with me this evening. sam i would like to start with you. if you could joke about the romances that trump had. with north korean dictators chinese leaders and obviously victor -- but it is not funny because trump is trying to channel what they all stand for especially victor --. trump typical pygmy guy is trying to take multiple pages from that playbook. how seriously should people especially americans be taking what we are hearing about his reported admiration of people like hitler as well is victor --? i hope many americans

find trump's comments about hitler a . but more specifically katie trumps track record in office is campaign rhetoric and his actions speak to the fact that he has an absolute allergy to democracy. and the low over preparations of that are being felt today will be for the 2024 election. trumps rhetoric and actions checked a lot of boxes for the kremlin. we know from the intelligence community's report from february that russia seeks to undermine the west. undermine our alliances and that it views u.s. elections is a opportunity to advance its own interest. trumps embrace of dictators certainly is driving a wedge between the united states and our allies. not to mention his comments about nato. and the u.s. led liberal democratic order is diminished. when the president of the

united states or the former president of the united states is the clearing he will backslide democratically the loser list of trump's election from a democracy standpoint is almost impossible to think about. united states currently gives tens of billions of dollars in foreign assistance to countries. to engage in democracy promotion and protect human rights. if the united states is not leading by example is not giving funds to individuals that need them to protect them from autocratic onslaughts that we are in big trouble. finally his rhetoric and his actions might have an open door to autocratic leaders around the world to think it is just a waiting game until they can launch their own invasions. until they can roll back democratic norms in their own countries. that is a huge problem for people globally not just in the united states. michelle when i was reeling off the greatest hits of victor targeting lgbtq rights assailing immigrants wanting to jail political opponents and

journalists, you could actually enter change victor's with donald trump. that is exactly what donald trump promised to do when he gets back into the oval office. how do supporters of donald trump and or republicans more specifically how do they reconcile what america is supposed to and should be standing for the sam talked about the influence we have internationally, the democracy we are supposed to be defending. how do they reconcile those concepts and integrity of those concepts still support donald trump? >> they don't know very many of them recognize anymore the nobility and integrity of those concepts. that was kind of ronald reagan's republican party not the ronald reagan always lived up to democracy promotion. that rhetoric that soaring optimism about the spread of democracy was a hallmark of the republican party that has now been rejected by a new generation. why donald trump trounced haley in almost every single primary caucus. and actually the early sign of

that was throughout donald trump's presidency. the real fetishization of victor -- in particular. and his model of what he called a liberal democracy. the way he has rigged the voting system to make it basically impossible to vote his party out of office. the way that he has really taken over the media. the way he has used the power of the state to drive critics and enemies and even people who don't fully submit out of corporations. out of universities. out of public life. so, republicans for a long time have seen victor as a model of what they would like to do here. i think we just haven't had somebody articulate that at such -- at the highest level of politics. >> sam this is not a flirtation. this is not just kind of like one off expressions of admiration of how maybe another

international leader is operating their country. we have cpac hosting annual meetings in hungary. having victor be a keynote speaker among others. you now have victor not meeting with president joe biden. and instead meeting with former president donald trump and donald trump's mara lago. i feel like we become numb sometimes to the alarming things that are going on. because there are so many of them. and yet how is it that these things happen and yet we don't actually hear about it more at a level of concern that should actually impact us in terms of our domestic front? >> there is a lot of noise out there. what is important for people to remember is from a geopolitical standpoint, the u.s. led liberal democratic order has provided for our security and analyze security for decades. we cannot allow the rollback of

democracy to become normalized. we should assume that our adversaries and our allies and it is unfortunate i have to say that but our allies and adversaries are engaging in very real scenario contingency planning right now to prepare for the fact that there might no longer be a u.s. led liberal democratic order. they are likely thinking through ways to rebalance if united states is no longer a democratic leader around the world. if they can no longer depend on u.s. security assurances and u.s. foreign assistance spending and more. the most important thing that those of us that believe in democracy and the u.s. liberal led democratic order can do is to vote and to exercise our democratic freedoms. but we cannot allow individuals who don't practice democracy to try to redefine what democracy should mean for the american people today. samantha and michelle thank you both for being here.

guise of humor. encouraging violence whether it is attacking the capital or beating joe biden an effigy this is standard. it is not new. we had 15 years ago and you have sarah palin with pictures of democrats during the midterms with gun sights around their heads. none of these things are new. i have to point this out. when i was looking at the newsweek article pointing this out the talked about republican leader mike brown complaining they had a picture of mike brown the basketball coach. this is mike brown. the guy is the head of the republican party is another mike brown. i'm glad local republicans are complaining about what happened in kansas. that does not speak for the party as a whole. there are too many republicans in congress and the national party who embrace this violence. there is no condemnation of the political violence as high up as it should go. we won't count on trump to condemn what his supporters are doing especially when they're kicking effigies of joe biden.
