12:00 am
truth of the horrors being experienced in ukraine. we thank you for your film, and for your bravery. and on that note, i wish you all a very good and safe night from all of our colleagues across the networks of nbc news, thanks for staying up with me. we will see you again tomorrow. well, there is a lot going on tonight. we have another immunity claim from donald trump. a key witness is now speaking out on camera and all the while the general election is full ll steam ahead. lucky for us congressman adam schiffes is standing by right here in studio and congressman dan goldman will join me later
12:01 am
on. i do want to start tonight with a bit of a riddle for you. what does a truth post about jimmy kimmel meeting with -- tell us about donald trump? all that might seem to examples of strange behavior, it is, they are also the actions of someone attempting to project strength in order to cover up p weakness. really, they are all the actions of a wannabe dictator. let's start with the news from earlier. he is now trying to delay the start of his criminal trial until after they roll. trump is basically sagging that just because he was once present
12:02 am
-- president, he is immune to everything. he tried this tactic before. including in the defamation suit he recently lost. he is again resorting to the same tactics that got him in cs trouble in the first place. he's attacking e. jean carol. over the weekend and once again, just this morning trump insulted carol ann coulter c accusations fault so trump is perpetuating propaganda about his perceived enemies, something you don't do from a position of strength or until things are on your side. remember on friday trump posted hungarian mind -- prime minister viktor orban at mar-a-lago.
12:03 am
>> we kept in touch, nobody that is better or smarter. he is fantastic. >> he can say this is how it will be and people do it? that is great. the guy trump is praising is the same person who dismantled democracy in hungary which by the well hasn't had a free and fair elections since 2010. a guy who created his own court system with crackdown on the freedom of the press openly admitting that reshaping the media helps him maintain his power who has left no space for challenge, that's how dictators keep control so it is pretty easy to appear dominant when you make the rules in your favor.
12:04 am
here is the thing. they are not tough, they are desperate and paranoid and insecure.no they are in fact weak and so is donald trump. we see that in his claims of immunity. we even see it in something as petty as a tack -- an attack on jimmy kimmel during the award show. at the end of the day the point of this is not to psychoanalyze donald trump, it is about understanding how his own weakness and desperation to hold onto power would impact how he would behave if he was sitting in the white house one year from now. joining me now is democratic congressman adam schiff. last week he advanced during november runoff in the race to u.s. senate.
12:05 am
congratulations on e your victo. i know you still have a generall election ahead there is so much to get to and i wanted to start here with the immunity claims because donald trump, we have seen this playbook before. this trial is supposed to start in two weeks. is it possibly could be delayed beyond that simply because of his immunity claim here? >> it is possible and this has been his modus operandi from the beginning. the whole argument that as a president you are immune somehow that even if you try to overturn the election the ultimate check on presidential power, the election that somehow you are immune wichman open invitation -- which would be an open invitation to others what he is hoping for is a delay. it was even more exurban
12:06 am
because one other requirement of even making this claim is the act have to be official in nature. what what kind of office was he holding if sending money to a star was on the list of things to do? >> the oversight committee litigated against him, he strung that out for years and he is hoping to string this out past the presidential campaign.a >> and there is a lot of money in judgments he owes. he continues to attack e. jean carol i want to play what he said and get your response. >> miss bergdorf goodman, a person i never, i never met. i have no idea who she is. except one thing, i got sued from that point on i said wow,
12:07 am
that's crazy i got charge i was given a false accusation and gi had to post a $91 million bond on a false accusation. >> do you hear that as meeting the bar of -- and do you think you're robbie kaplan you should act on that? >> it certainly could. majority could conclude he is at it again and what's more is the fact that he keeps having these judgment against him and it is further evidence that he knows what he is doing is wrong. is just human tivoli adding to the proof against him but it also shows that you have to be either stupid or crazy to keep doing the same thing that is -- but it also shows no matter what he just can't control himself. you certainly don't want someone in the oval office who has no impulse control not when
12:08 am
they have the finger on the button in addition to many other things. >> one of the things that has been concerning to me is where the money is coming from and how we should be watching that. he just made one bond payment in one of these cases, the e. jean carol case. he owes a lot more money in the new york civil fraud case. we don't know if anyone cosigned. there are not a lot of limitations, how concerned are you about that someone having leverage over someone who may be sitting in office. >> even more broadly what we have seen was effort to build trump tower and his lies to the american people about it this
12:09 am
is someone who will use the oval office if he ever gets the chance as essentially a cash cow. if we think the emollients and enrichments enand all the that, were traveling in conflicts of f interest that is child's play considering what he may do if he is at risk of losing everything which he is right now. he is at risk chof losing everything because this is someone always motivated by greed and the fact of whether it's russia or the goal for other nations that he could be so desperate to recoup his money that he would be willing to do anything, sell out the country, it ought to be great gr concern. >> and many of those powers could pay in some way with the judgments have already been made. >> they could then we get records to find out who may be signing these and it could take
12:10 am
years. >> he spent a lot of time in the national security space and it is worth restating how bizarre it is that the week he secured the nomination he met with viktor orban. this is even going farther than trump had prior. what do you make of the fact that we are getting more from the leader of hungry then trump and is that concerning? >> both, it confirms the worst fears we have about trump, but v here is someone and viktor orban is kind of a proxy enabler stooge of vladimir on one hand. these are birds of a feather. exactly what he wants to do and you are precisely right. this doesn't show his strength that he emulates these peters,
12:11 am
it shows his weakness. he wants to be them because he lacks power. he is a weak figure and he emulates these men and wants to be like them. no wonder nato is terrified but here is the good news in all of this. nato is enlarging and growing and becoming stronger. notwithstanding what trump is threatening, nato is growing and thank god it is. thank god we have a president who represents the value of nato. it will be in many respects a very clear contrast between these two candidates for president but atin no area more than national security does joe biden shine in supporting this natural -- national rules-based order and in no other way does donald trump so endanger us that when it comes to nato and national security. >> there was a lot of reporting,
12:12 am
former trump chief of staff st said "my theory on why he likes dictator so much is that's who he is." >> he was chief of staff but what do you make of those comments from john kelly? >>ly this harkens back to trump is a saying that he can do what he wants. all he wants is power. the tragedy is that what has made him possible the first term and what makes him still viable
12:13 am
is some of the people i serve with on the republican side of the aisle also as it turns out only care about is power too. notwithstanding that they think he is a danger or ethical -- unethical or unmoral. mitch mcconnell who said sa basically said he wouldn't impeach because there are other remedies, all it is is about power and this is what has our democracy hanging by a thread. >> thank you. we are sneaking in a 62nd break and we will be right back. rig.
12:14 am
shingles. some describe it as an intense burning sensation, or an unbearable itch. this painful, blistering rash can disrupt your life for weeks and could make it hard to be there for your loved ones. shingles could also lead to serious complications that can last for years. if you're over 50, the virus that causes shingles is likely already inside you. and as you age, your risk of developing shingles increases. don't wait. ask your doctor or pharmacist about shingles today. we are back with democratic congressman adam schiff. there is also reporting from the new york times citing the newly released transcript for my secret service agent. the driver said trump never lunch
12:15 am
for the steering wheel. i read parts of your report you made it clear that there were people who testified and what you reported was on his intentions but some of your republican colleagues are suggesting this disputes cassidy hutchinson testimony. >> this is what i think, trump wanted to go to the capital why this insurrection is going on. he wanted to go and be there with them and he was irate about not being able to go. there is some debate about how irate he was, did he lunge for the will? kathy huston's testimony is what she was told by others. the question is if there is a conflict with what she was told by was the person who told her
12:16 am
this -- were they being truthful or untruthful ? it goes more to the credibility of this other witness than it does cassidy hutchinson. >> i wanted to ask you about intel briefings because you are the warmer chair and i know you said they should be dumbed down which i think they were but he didn't get them in 2021. there is a decision not to give them to him if i recall correctly in the same capacity. couldn't they do that now? >> we have never had a situation where the candidate for president is also under indictment for their negligent handling into classified information. if there was ever a case not to brief him, this would be the case but there is this tradition and my guess is what they will do is they will give him a briefing but they will
12:17 am
make sure that nothing in the briefing would be a problem in sources and methods. they know his track record, they will be very careful. the problem is our allies and other sources, if they think what they give us may be shared with him then they are not going to give us anything. >> of course but if you are allies wouldn't you want president biden to say i am sorry, you can't get it? >> i am sure they would like that and i think administrations can be very careful but they will have to continue reassuring our allies. and they are worried anyway because they realize there is a risk that he could be successful. so he may have access to these things.
12:18 am
i think the only way our allies will have comfort is when he is finally defeated again and the republican party not willing to part company with him because he is a liar and unethical not even willing to part company and they may decide they keep losing with him. they need to move on only when the republican party does move on i think will our allies finally have confidence that america is really back. >> i could talk to you about national security for one hour. he did just when a primary against two formidable candidates. what you think people should learn about that race or what message resonated ? people think of california as a very blue state but also is a very diverse state. >> the state is also very pragmatic just like the country. they are looking for people
12:19 am
that can get things done. they do want a senator who will take on big fights when it's necessary to protect our democracy, they also want someone who's going to get things done and to deliver and i was fascinated by joe biden to add that he released one week ago because he really makes two points in that ad. he gets things done and he will protect our democracy, our rights and our freedom and that's exactly what i ran on and i think frankly it's a good message for democrats around the country. we will protect our rights and freedoms but we will also get things done. >> absolutely, people care about that. congressman schiff, thank you. >> thank you. >> coming up congressman dan goldman joins us. later i will talk to the journalists whose tick talks about senator katie britt went viral she uncovers the truth about a story she told in her response to the

when it comes to criticizing joe biden republicans in right wing media have created a favorite crutch. joe biden is old. as we stated many times he is 81 years old but here is the thing that all the right-wing attacks about his age. they are not consistent.
12:25 am
ever since joe biden took office people in waiting media have openly caused his abilities and asking tough questions like how sleepy sleepy joe? and yet at the same time they are trying to accuse him of corruption and he is all of a sudden a smooth operator. how exactly is sleepy joe overseeing a massive criminal scheme? well over the past month we watched another round of whiplash after special counseling investigating released his final report about joe biden's handling of classified documents. some comets were embarrassing for the president. the trump
12:26 am
appointed prosecutor did leave a big gift for republicans and fox news and in a move that is highly uncommon he chose to editorialize about biden's memory which of course sparked an all-out frenzy on the right. >> he does not have what it takes to be commander in chief. there is confusion and mental impairment. >> we do not need to settle for a cognitive mess as the leader of our country. >> more wild speculation from many who have probably never been in the room with joe biden.
12:27 am
joe biden deliver the state of the union address and suddenly he was not so sleepy. >> tonight america saw a very different joe biden. i might call it jacked up joe. i thought it was beyond bizarre at times and frankly frightening. >> it was amped up and jacked up. last night he spoke fiercely but he was a cantankerous kind of combat by. >> all of a sudden this guy is like on speed or something. to dismiss it like he's definitely clean, >> so, first he is too sleepy, then he is jacked up enough to need a drug test? tomorrow when robert hurst testifies i will bet we will be right back to the joe biden is
12:28 am
old sleeping joe part of this never ending loop that are such an expert in mental acuity i want people to know that they are well on their way to asking him all about this. >> rated my house in mar-a-lago. ukraine and russia wouldn't be fighting. >> by far the most disgraceful part of the disservice is the divisive crime-ridden nation we have become that's why there weapon rising law enforcement for high-level election interference against joe biden's camp and ultimately political appointment, a guy named me. >> the real story here is the current president was cleared
12:29 am
in classified documents and is still facing 32 criminal counts of national defense information. two councils made statements in two councils -- that is a mouthful. so they are not the same and no amount of testimony will make it so. i will guess that the congressman has a lot to say about all of this, and he joins me next. me next.

hi, i'm kevin, and i've lost 152 pounds on golo. (uplifting music) my biggest concern when i started golo was food. i'm a big guy and, shockingly, i like to eat.
12:33 am
i was worried it was gonna be like other diets that were bland and restrictive. but with golo, my meals are great, and i'm no longer hungry like i was before. i'm so pleased i gave golo a shot. don't wait, go to golo.com.
12:34 am
five years after issuing -- five days after issuing a report that pointed biden as a man with a poor memory special counsel hurst will testify. in addition to fanning the flames of george biden being seen at -- joe biden being senile, -- a worker has come forward. he tells cnn that he is cooperating with investigators and that he doesn't believe this case is a witchhunt of donald trump would have us believe. brian butler is referenced as a trump employee spy in the indictment today he described how he unknowingly helped information. >> what happened is what left
12:35 am
before me, i ended up load -- loading a lot more than normal. >> oh yeah, the white banker boxes. that is what i remember loading. >> did you have any idea at the time that there is potentially security secrets in this box? >> i have no idea. they are huge. >> in their indictment the feds say those workers were alerting boxes of documents onto trumps new jersey -- on the same day -- congressman dan goldman is a former federal prosecutor and he joins us now. let me get your reaction to what we hear from this witness.
12:36 am
how valuable is what he is saying to prosecutors on this case in your view? >> oh, brian butler i think is going to be important because he is going to provide really a lot of cooperation to so much of the other evidence. he is going to be able to narrate in the debate of all of the above. there are a lot of little nooks and crannies that he will fill in and he clearly is quite open and honest about what he saw, what his role was and he did it unwittingly but i think will be an powerful and credible witness for the prosecution. >> i'm guessing you would recommend key witnesses doing television interviews but given
12:37 am
this is delayed, he worked out for 20 years and he seems willing to talk about what he has seen. how important do you think this is in terms of the telling of the story of what happened in this case? >> yeah, look. i certainly spent years as a prosecutor i did not want a witness to say anything to anyone else. you just don't want to create more of a record where small different details could trip you up. in this case we are his only difference is in the court of public opinion. i think it is very important for brian butler and other witnesses to come forward publicly to explain what they know and what their role is. we are going to need to have ryan butlers and former truck cabinet secretaries and former trump intelligence officials and former trump national security officials. everybody will need to come out and publicly explain why donald
12:38 am
trump is such a risk to our democracy, to our national security and to our global security and by him doing this it takes a tremendous amount of courage because he will get a serious amount of vitriol threats most likely, otherwise he is a private citizen and has not signed up for this so this is a very old and admirable courageous move by mr. butler. >> this is quite a newsweek as we all know. i was curious your take on what the democratic strategy should be there? it's clear from reporting that republicans want to bring up the age issue again. what do you think the democrats should do here? >> well, look i am concerned that he resigned the day before
12:39 am
and that he has been prepping apparently was trump orbit people. he was appointed by donald trump and the reason i am concerned about that is if he were still an employee, he would be obligated to adhere to the rules placed on him by the department of justice. now as a private citizen he does not have the same obligations and is strange that he would desperate. is being prepped by trump officials or trump associates then this feels much more political than special counsel should otherwise be and frankly that's what i saw in his entire report. not just about the gratuitous age references, and adjusts about his editorial.
12:40 am
>> that report does not contain the factual basis to make the conclusions that he makes. even though you decided not to charge joe biden because he would never be able to prove that case who ensured him, he impugned him by using the same language in the statute by willfully obtaining classified information is what he said which is what the law prohibits food to charging city to the conduct and the evidence that he recounts does not support that so i think there will be a couple things for the democrats heading forward and i think some will hit upon this, the could to resist and editorializing also he violated a number of dod rules -- doj rules and regulations.
12:41 am
the core task was to determine whether or not joe biden violated any criminal laws and should be indicted and there is a good reason why you speak in indictment and not in reports like this because there is no way for joe biden to cross- examine him, to cross from him in witnesses or to defend himself against these accusations. i am looking forward to my colleagues, they know their stuff and they will challenge him on a number of different things in that report. >> one to watch, lots of questions you alluded to. congressman dan goldman, and q as always. independent journalist took it upon himself to fact check senator katie britt we will be back after a quick break.

12:46 am
by now unless you are living under a rock you may know that katie britt -- this is her testimony in 2015 about her experiences in mexico and they took place between 2004 and 2008 and at that time george w. bush was present -- present these events
12:47 am
did not happen in the united states. not even near the border. they took place in mexico. >> so to recap he found that this horrific crime did not happen on joe biden's watch but many years before, did not happen in the u.s. things went viral and now senate -- senator britt is trying to do damage control. >> no shannon. >> reporter: the story related is not something a habit under the biden administration? >> a very clearly sped -- said i spoke to a woman who said she was trafficked when she was 12. i didn't say a teenager or young woman, a woman who was trafficked when she was 12. >> so yes, when confronted with
12:48 am
the facts is not admitting that she distorted the story. clearly in an effort to score clinical points. she is saying that the audience should have inferred that the story had nothing to do with joe biden. what about the woman? how does she feel about all of this? last night we found out. >> i hardly ever cooperate with politicians and i think she should take into account what really happened before telling a story of that magnitude. >> so remember, she went through something horrific. the details of how it was described are not accurate and to recap senator britt chose to exploit the survivor story to score political points and she was held to her comments about
12:49 am
president biden and the border. now i am joined the former bureau of press in haiti and the author of two books. when i was watching your tick- tock video i thought to myself, how did he figure this out.? >> i think part of it was that she was giving very specific, very lurid details about stories
12:50 am
. i was also wondering what what happened to the woman after this? >> i started googling. >> you said this in your video but you did contact her or her team was that back and forth like? they didn't respond at all? >> no, just me and google and press releases and other senator had put out. the information was out there but someone had to look for it. >> i will admit is disappointing as it is it's a bit painful to watch her unravel from it. watching that fox news
12:51 am
interview she seems to be implying she wasn't commenting on the border policy. >> no, she makes a sandwich with a feeling i'm not supposed to say on tv. she starts off talking about the border policy. i am very familiar with the dynamic of coming from the united states or richer countries from elite classes and taking someone story and then using it to career.
12:52 am
>> i am shocked they didn't contact the woman. i have been involved in a lot of speeches and we only have one minute left and i should talk to you about this for 20 minutes. we have covered immigration, what is the one thing people say what people speculate about this issue that he just drives you crazy because it is so wrong ? >> the biggest thing is a terms of the dissection the backlog closing ports of entry and forcing those to go through smuggling routes are migrants. those are the people who are
12:53 am
suffering. and the way that talked about in washington and the way the republicans talk about it is at the ultimate victories are the american people and that is your business. it is just a perversion. people who are suffering are trying to make better lives for themselves here. >> such an important point. i really appreciate you. thank you for your time. coming up a few thoughts from me about a manipulative scene

>> i am stunned by how they manage this there are no steps to ensure there is no disaster. don't lie and trying to get all the information out at the same time. now we are getting a master class on what not to do. for those of you not following back in january the palace announced that princess kate underwent abdominal surgery. that was about all day long and willing to share you don't need a medical degree to know that a month-long coverage is there.
12:59 am
as kate remained out of sight the speculation only intensified in the palace still refused to operate with any new details to tempered the situation until yesterday when a photo featuring kate and her three children was posted to social media. celebrating honesty in the uk. global photo agencies took the rare step of pulling the photo. this is a very rare step and this morning the palace attempted to do damage control by admitting the photo was manipulated but not sharing any additional information at all. now i have no idea now and they have made it worse.
