defendant seeks is adjournment. personally responsible for generating much if not all of the surrounding publicity with his statements. with his unrelenting media post attacking those who he believes to be responsible for his plight. this is not new to him and is part of his own doing. without ruling, the judge slamming the door shut on his attempts to delay the inevitable. on monday morning, the case of the people will of the state of new york versus criminal defendant donald trump shall commence. commence. hourthe first time a former president will stand trial in a criminal case. the twice impeached and guided one term donald trump will

appear in a courtroom when jury selection begins in the first of his four criminal cases. charged with 34 felony counts of false applying business records to hide the payments he made to cover up extramarital affairs before the election. i need to make one thing abundantly clear, the hush money payments may be at the center of his alleged misdeeds, this is not a trivial trial about paying off an adult film star. hush money payments can be illegal if they are done to cover up a crime. the way that donald trump paid off stormy daniels through his lawyer right before the 2016 election, that makes this a campaign-finance crime. >> if it was you, in this case, the campaign-finance violation

manhattan d.a.s office. i want to start with a last- minute move that happened yesterday. a letter sent by trump's lawyers regarding the jury selection process excusing jurors that cannot be impartial or serve. and how the jury questionnaire benefits trump. people who affiliate with his political party. how quickly can we expect a ruling from judge marsh on when we have jurors coming up monday morning. >> he is already visiting this issue with the defense about excusing people who said, well, i cannot be fair and impartial. what happens in other trials, judges keep those people. as a way of saying, i don't want to be here. the judge said, we will not waste time. people who self identify that

they cannot be wired to spend time and having them poison the other jurors going on about their biases. i predict that the judge will take care of this immediately on monday. and jury selection will begin. i have to point this out, as donald trump was saying, he will testify and i don't believe that he would. in new york, before jury selection and before every criminal trial there is something called the sandoval hearing which is specific to new york. prosecutors have to tell the court and tell the judge all of the prior bad acts that they plan to cross-examine the defendant about. these are criminal acts that they want to cross-examine. that will happen on monday morning too. the judge will decide, yes, you can cross-examine the defendant.

no, you can't. that is too prejudicial. i predict because knowing the judge and his reputation, he will get this trial started on monday. not with witnesses, obviously tying up the last minute loose ends with this letter to the defense. >> does not impact the trial at all if it is determined by the court that he should have recused himself but that jury selection has been completed and the case has move forward? >> that would be in this trial. it is not going to happen. obviously, if it did happen, it would be in this trial. it is not going to happen. the judges daughter is an adult and does not live with him.

there has already been a ruling so to speak for the advisory committee of the court system on judicial ethics that said this is not on the basis for recusal. the judge will not accuse himself and the appellate court will not stay with the trial and say that he has to be recused. >> worked in the d.a.s office, alvin bragg, someone you know well, will you see him taking part in this trial? cross-examining witnesses do you think? >> no. he will be in the courtroom. most d.a.s in a large office are not the ones actually trying the case, that is what he has, about 500 district attorneys to do, this is a six member trial team. three members of the trial team, i know very well. they are excellent cross examiners, they have trial

experience. he will show how important this is to the office. he will not be doing any opening or cross. >> donald trump is looking at 34 felonies for business falsifications. i don't think he will get that. is it possible that for the jury to actually find that donald trump is guilty of one or two of the 34, is this an all or nothing proposition in your opinion? >> that happens often. a multiple count indictment and the jury picks and chooses. i have a voice and that means that the jury was doing their job. they are not saying guilty to everything. you have to look at each count individually. then there is no proof beyond a

and have found a new distraction to focus on. on friday, mike johnson headed down to matt mar-a-lago to bend the knee and kiss the ring. with a straight face, he announced plans to announce a series of public hearings to crack down on noncitizen voting in federal elections. here is something he forgot to mention. noncitizen voting is a crime and is extremely rare. according to a study by the brennan center for justice, among 23.5 million votes, they only found 30. that's right, 30 incidents of suspected noncitizen voting. that is .001% of the votes cast in 2016. the institute following the 2020 election said that noncitizens do not illegally vote in detectable numbers.

anyone who has had their mind changed by this is already a trump voter. >> this reminds me that this week he also is trying to tell his supporters at a rally, why do we not get people from nice countries. it is a dog whistle. black and brown people are bad people. and his comments of people coming to the united states. juanita, how clearly does this messaging work for donald trump when it comes to his base? >> it will appeal to the same people in 2018 when he originally made those comments. he stays true to himself with the policies he is trying to advance. that is what this is.

>> that will be a massive driver. it will be compounded by the fact that constitutional amendments will be appearing on the ballot in multiple states across the country. i appreciate vice president harris being on top of this. because what she said is something that really lays out for you what is at stake here. talking about the fact that a second administration will mean more bands and fewer freedoms, that hits the nail on the head. hours before she spoke former president trump said that these day bands are working out exactly how he anticipated. that goes to reference the fact that he did appointed three anti-choice judges. they reference the dobbs decision in their decision and opinion to allow these bands to

move forward. laying this at trumps feet is appropriate. the biden campaign is continuing to amplify this message around freedom as it relates to the second administration because that is something that will resonate with voters. seeing the contrast before a former president saying that these bands that predate the civil war are exactly what i want compared to the administration that is fighting for women's basic freedoms is critical. something the vice president does explicitly well is emphasize that they need a congress that can send a bill that codifies roe v wade to president biden. >> getting a national protection in place to make sure that we have reproductive rights. rick wilson, wishing you a speedy recovery, thank you for being here. ahead on the katie phang show, trump is on file --

6000 new yorkers will be subpoenaed but not all will be appearing for the first criminal trial. 500 will be the starting number for the d.a.s office and trumps legal team. the goal is to bring that down to 12 jurors and six alternates. it is particularly high and will be examined under a microscope. you cannot win the case in jury selection, you can lose the case in jury selection. join me as one of the best criminal defense attorneys, david marcus. when the issue of jury selection came up, i had have

you on, you're the best triers and you go to court and try cases. that is an important distinction between people who say, i can tell you about a case which is you have to look in the whites of the eyes of the jurors, to pick them. walk us through why jury selection is so important. >> like you say, so many cases play out, 97%. this is the case that is going to trial. it is an important part in our country. everyone says they will be fair. it's trying to figure out who can actually be fair. that is the trick of the lawyers. it is tricky and hard to do to find people who do not come in with an agenda. >> we will talk about that in a second. explained for our viewers, in order to whittle that number down, there is a challenge

called a pause challenge. this is when jurors cannot be fair. if he shot someone on fifth avenue, i would still find him not guilty, that person would not be sitting as a juror. you can raise that as often as you can. the judge will say that only jurors that can be fair are safe. if not, they are struck for cause. >> in new york, there will be 10 for each side. >> a strike can be for any reason other than race or gender. things like that. a strike if someone comes on and says that i am not a heat fan. you can strike them and get rid of them. >> the next thing i want to ask

about, i invited our viewers to put in some questions. fine. if you get 10 strikes and you know it is for a reason that is all teary or and not good, that is the batson inquiry. >> you are using the challenge in an unconstitutional way. for any reason you can except for the unconstitutional reasons. >> we talked about the role juror. you defended successfully to the acquittal, a good candidate and mayor of tallahassee. in his federal criminal case. my understanding is you already had a concern to filter out the stiff or rogue jurors. >> there can be rolled jurors on each side. those who want to vote for the defense and want to get on the jury. when you are a prosecutor, you

have to know that you are a fierce prosecutor, the fear is people not wanting to be on the jury. trying to find an excuse not to be on the jury. the fear is people who want to be on the jury and people who are trying to get on the jury to write a book or get on a show. it's hard to read those people out. what we'll do is look at social media. we were not allowed to look at social media until after the case. if they are saying things that don't make sense or if they have an agenda online, people will see that. all of these jury consultants, high school and college kids. the kids will be looking to see what they are saying online. >> how does this work, david? if we are sitting at the counsel table together, i'm not putting us on team trump.

if we have the luxury of doing this, is it in real time? we have their name and we are trying to figure out if they are telling the truth, can we look at their social media in real time? >> and real-time people will be looking at their social media, sending messages to the lawyers, if they are on x, true social, what they have said. we found out one of the jurors found on their social media pages, trump is still my president. we could not find that out until after which was while we had this crazy juror, if we had been able to look at social media, we would've found out. there is no written western air. they are much more likely to tell the truth in a written questionnaire. saying things like all politicians are liars and

scumbags. we got rid of those jurors very quickly, they do not have that luxury in the trump case. only going through this questionnaire which is very time-consuming. >> knowing what you know about this trial on monday, this question comes up all the time, how long will the jury selection process take? >> days if not weeks. we will get a fair jury in this case. i believe it. most juries are fair. many want to come in and tell the truth doing the right thing. people are saying that jurors lie. many people are good people doing the right thing. we want to get a fair jury in this case. >> we will have you come back as the trial continues. i want to emphasize the importance of someone who actually does this and goes in and picks the juries and gets the acquittals.

should execute a warrant before we start going through this americans life. we know that there were abuses of fysa before. with the rhetoric that we get out of trump, he will clean house and misuse fysa. when we are passing legislation, we should pass legislation that will survive anybody being in office. it was a big concern. the amendment failed because of a tied vote. the difference between the fysa that could not pass and the fysa that didn't pass the rule was that it was a reauthorization initially for five years. now it is a reauthorization for two years. i am okay with that. we don't have to go half a decade before we find out that there is something wrong with this iteration of fysa. we can hopefully go in and
