departments are carrying out investigations. good evening, i'm lucy noland. i'm iain page. let's get right out to dave schratwieser he's live at philadelphia police headquarters tonight with the story. dave? >> reporter: iain, lieutenant jamal johnson is 18 year veteran of the fire department. tonight, he's here at police headquarters awaiting rain many on some very serious charges. when firefighters from engine 45 ladder 14 responded to calls thursday, their lieutenant jamal janson was not on board. he was under arrest at the special victims unit. charged in an overnight sexual assault after allegedly impersonating a cop. >> at some point in time throughout this interaction identifies himself as a police officer which is not. >> reporter: johnson, 18 year old firefighter was pulled over in his nissan titan pickup truck wednesday night just moments after police say he stopped 48 year old woman on north third street asked her if she was getting high, then told her to get in his truck.

>> he then forces her into committing some type of sexual act while inside the vehicle with her. >> reporter: police say the lieutenant ordered the woman to perform oral sex on him, minutes later she jumped from the pickup truck and ran. >> she hides between vehicles at some point in time. once she exits the vehicle. then he maneuvers around several cars looking for her. >> reporter: the woman called 91 weren't and gave police the tag number to johnson's truck. he was stopped byplace and taken in for questioning. he now stands charged with kidnapping, sexual assault, unlawful restraint and impersonating a public servant. police say he was wearing uniform pants. >> he indicated that he was a police officer and that she would not be arrested if she performed these acts. >> reporter: now the fire department would not comment on this case except to say that they take this investigation very seriously and will conduct their own investigation before deciding on what disciplinary charges could be taken against the lieutenant. we'll have more on this investigation coming up at 6:00. iain? >> all right, dave, thank you.

another philadelphia firefighter and his girlfriend are facing charges. they're accused of assault. police say michael lawson and said today greenly assaulted his ex-wife and boyfriend twice in september. she's eight months pregnant. lawson and greenly are facing several charges including aggravated assault and making terroristic threats. bail is set at $75,000 for each of them. >> philadelphia police are searching for whoever killed a 34 year old man in olney on west lindley avenue late this morning. he had been shot. police say they also found several marijuana plants in the basement. and we have a developing story right now out of philadelphia's roxborough neighborhood. police are hoping that you could help track down a man wanted in an tack at a popular park, and this right here is a sketch of the man they're after. they say he grabbed a 51 year old woman as she was walking in wissahickon park. she says he approached her at gate house road near mack ma

confidential lump street late friday afternoon. he came from behind, grabbed her and demanded money. when she showed him she did not have any the man pushed her to the ground started choking her, shoved dirt into her mouth, then tried to rape per. police say they struggled for 10 long minutes until she finally broke free, escaped and called 911. >> happening now, the man who brought ebola to the united states faces charges back home. liberia says the man will be prosecuted for lying on his airport screening questionnaire. meanwhile in texas health officials are contacting nearly 100 people who may have had direct contact with the patient. fox's david lee miller reports. >> reporter: it's awaiting game for people had may have had contact with ebola patient thomas eric duncan while he receives treatment at the hospital. the apartment manager of the building he was transported from on sunday says members of the centers of disease control and prevention are on scene making sure everyone has the information they need to deal with the evolving situation. >> we are going to have

community meetings for one group of people today we have translators that are working. we are doing everything to get information to the residents about the situation. >> reporter: cdc director dr. thomas frieden says duncan did not have any symptoms until four or five days after arriving in the united states. team on the ground are interviewing people who may have that direct or inn direct contact, and he remains confident the cdc can control the spread of ebola in the united states. duncan's case emphasizing the importance of treating victims and finding a cure. survivor william, making an empassioned plea to help contain the spread of the disease. british foreign secretary philip hammond says the case in the us shows the disease can travel anywhere. >> this disease is a major threat but knows no borders, and indeed the recent case in the united states just goes to underline that fact. >> reporter: hawaiian health officials have now ruled out one

patient. they placed in isolation from having the ebola virus. in new york, david lee miller, fox news. >> to your fox 29 weather authority now. here's a live look from philadelphia international airport it was a cool dry day but some rain on the horizon. chief meteorologist scott williams who with those details. >> that's right, iain. we are tracking a potent front that will head our way for part of the up coming weekend bringing with it the rainfall as well as some cooler temperatur temperatures. right now stepping outdoors we have the mostly cloudy, 70 degrees winds out of the east at 9 miles per hour. here's the bottom line for your thursday evening plans. grab that light jacket or sweater. but it is going to stay dry. by 11:00 o'clock we're looking at temperatures right around 62 degrees. so we have the clouds, but no rainfall but take look at the system right now taking shape through sections of the midwest. showers even thunderstorms right now in illinois, iowa and missouri. coming up we'll talk about how that system affects your weekend, how much rainfall to expect and also some of the

registers. east market street was a beehive of commercial activity with all manner of major retailers setting up shovel. developers of east market a pl planned multi use commercial development promise a return to those good old days. >> east market is going to be a unique place with boutique shopping, national retail shopping, great restaurants, new reasonable rental apartments and really cool offices. >> reporter: the four plus acre project will sit on land bounded by 11th and 12th streets market and chestnut. artist renderings show pedestrian walkway splitting the sight in half from market to chestnut. with shops and restaurants lining the walk. >> mayor nutter joked that none the dignitaries on hand for the launch ceremony will actually be building the project. that work will be done by 1200 construction employees and all union work force. >> they're going to get decent wage, they're going to get good benefits.

they're going to get a decent pension. and they're going to work in a safe environment. >> reporter: east market is just part of a retail boom underway in center city. the japan based clothing retailer opens friday on the 1600 block of chestnut street. just up the block at 17th and chestnut, nordstrom rack is slated for a late october opening. also, this month, eighth and market will be home to century 21. not the realtor, the clothing store. promises designer duds at discount prices. >> this is a hitter rock section of the city of philadelphia. one of the nation's earliest retail hubs and it will in fact return to its former prominence one of america's great urban centers. >> reporter: when complete the east market project is expected to create nearly 300 permanent jobs. demolition of existing buildings is expected to get underway this month. the project will be built in faces with final completion date around august or september of 2016.

>> a delaware county family is terrorized by armed robbers inside their collingdale home much these bold bandits terrified the neighborhood and the search is on for the home invasion robbers. fox 29's dawn timmeney live in collingdale tonight. dawn? >> good evening, iain. a lot of people here are really rattled by what happened here last night. police say they believe that this house here was targeted but residents living here along the 100 block of lafayette avenue are still very fearful. >> right now i'm very scared. i'm very very scared. >> reporter: so frightened and upset a home invasion a if you doors down from her home she doesn't want her face shown. other neighbors on the 100 block of lafayette avenue also shaken to the core. >> it's terrifying, because this is the worst feeling anyone can have in their life. >> reporter: about 10:20 last night when police say four mas masked men all in black and all armed with guns busted in the

back of this home at 104 laugh fave yet of a confronting the homeowner. >> they took him down to the ground. asked him where the money was. said he didn't know what they were talking about. >> reporter: police say three of the gunmen stormed upstairs where the wife and two adult sons were. threatening to shoot them and ransacking two bedrooms. but apparently, not finding what they were after. cash. investigators suspect they were targeted. >> it doesn't make any sense. something is not right. they were looking for something or they had some -- some prior dealings with this the family or the sons. we don know. >> reporter: no one was hurt. no shots were fired. the police chief says the masked men made their escape into the darkness down the train tracks fulcroft and sharon hill. despite police reassuring neighbors that they don't node to be afraid for their safety, that this was not a random crime, many residents we talked to are still on edge. >> it's still scares me because you don't feel safe on your own neighborhood. they den care who's in the

house. we shouldn't have to live in fear. >> reporter: now, police say the four got away with about $300 in cash, some high-end watches and some pricey sneake sneakers. coming up to it in at 6:00 o'clock, the one clue these guys may have left behind that could lead police to the gunmen. that's coming up at 6:00. lucy. >> talk to you then, dawn. thank you. two state troopers injured while searching for fugitive eric frein are okay with only minor injuries. they are checking out a tree stan in the woods when it collapsed. they tumbled to the ground. a hospital treated and released the troopers. meanwhile the manhunt for frein is now three weeks old. state police say forty nine killed one trooper and wounded another outside their barracks last month. >> the push is on to make attacks based on sexual orientation hate crimes in pennsylvania. public hearing is just wrapping up at the kimmel center. state representatives brian sims and mike sterile la are sponsoring legislation that would restore lgbt protects to state hay crime law. the state supreme court removed it on the tech in h technicalit.

burglar caught on video going to a lot of work to break into the drive through window of a cvs. police say he used a large pipe to eventually smash the window at the cvs on the 6600 block of north broad street in philadelphia's east oak lane neighborhood. but once he got inside, police say he got scared running away without taking a thing. >> hokessin police and demonstrates turning violent in chili. the protesters were calling attention to the death of a man

her an tempt robbery. he opened fire and she was shot in the arm. the girl says she ran away towards another house but the suspect followed and continued to fire shots at her. police say the girl was taken to saint christopher's hospital. she's in good condition tonight. >> as we showed you earlier president obama has turned to delaware county native to head the troubled secret service. for now. >> joseph clancy of havertown is a villanova grad and he's leaving his post as director of security for comcast to serve as the agency's interim director. and now some lawmakers are calling for an independent review of the entire agency. fox's mike emmanuel has it all. >> reporter: just 18 months after president obama appointed julia pearson to clean up the secret service's tarnished images she's forced out after a string of embarrassing security failures. in her place joseph clancy a 30 year veteran of the agency who also protected presidents bill clinton and george w. bush. >> i know clancy very well. he's a goodman, and i trust his judgment a lot.

>> reporter: president obama isn't speaking out on the breaches or pearson's resignation. white house defended pearson up until wednesday morning. but with bipartisan list of lawmakers calling for her to go by late wednesday afternoon, she had resigned and the white house reversed course. >> director pearson offered her regular zig nation today she blessed it was in the best interests of the agency to what she had dedicated her career. >> reporter: her resignation comes after blistering criticism at a congressional hearing earlier this week when she was unable to explain how a man with a knife scaled the white house fence and ran all the way into the east room. after the hearing, another black mark. it was revealed that an armed security contractor road an elevator during mr. obama's visit to the centers for disease control. >> like any organization, dynamic as the secret service, there are going to be i. there are going to be situations that, you know, that will occur. >> reporter: new acting director's tenure is not without controversy.

announced that president and ceo david montgomery was taking a leave of absence while he went through treatment for cancer in his jawbone. but sources told me that montgomery was push out as the head guy. it was a convenient store because of the illness but dave montgomery was there every day during his illness while recovering. i'm also hearing that there is a move to have a new owner of the phillies. john middleton is one of the limited parceners of the phillies but has been buying more of a percentage of the team from the other partners over the last few years. i'm told he now owns 48% of the phillies. the way the limited partnership was set up with the phillies, no partner can own a majority without unanimous approval of the other partners. now, with the death of many original partners the phillies are willing to sell more of their shares. we montgomery now out, it has become easier for the vote that middleton needs to become the majority owner. montgomery had made the final decisions on every part of the

organization and the problem was his involvement and final say with on field personnel. montgomery's decisions have helped make the phillies the second oldest team in major league baseball. it was montgomery who made the decisions to sign jimmy rollins, ryan howard, chase utley and carlos ruiz. it's been david that had kept the scouting minor league system in place. a system that has become one of the worst in baseball. david montgomery is a very loyal guy but that is what has put the phillies in this spot. loyalty is a great trait but not in sports. montgomery was pushed out. so the bud did he system now goes and that includes the players. john middleton who sold cigar company for $2.9 billion in 2007 has been the most aggressive of the limited partners and will continue to be when he finally gains majority control. and with that, pat gillick serving as the acting president i'm told and he'll be a lot that will change. i'm told almost a certain ryan howard will not be back next

season. phillies are now willing to pay almost all of the 61 million howard is owed to make that trade. don't be surprised if chase utley moves to first. codey asche could end up in left field. sources tell me pat gillick and ruben amaro will also look at trading cole hamels to get much needed young players. the chicago cubs and boston red sox want hamels very much. it is going to be a rough ride with the rebuilding of this te team. but this should have been done two years ago. but when john middleton become the majority owner, he will let baseball people like pat gillick make whatever baseball decisions that need to be made eventually getting the phillies back to being a winning team. this is an interesting thing that has now transpiring. david now i'm told has been pushed out. john middleton is a very, very passionate aggressive guy, and he's going to do what it takes but there's some steps that have to go before that to get that all done. >> where do you see the phillies
